Hussie, Councilman Joseph L. Townsend, Jr. , Councilwoman Ruth D. Oliva, Justice Louisa P. Evans, Town Clerk Judith T. Terry, Town Attorney Laury L. Dowd. 9 : 10 A.M. - Ruben S., Brown, President of The E ,'GUbed Company made a presentation to the Town Board on potential municipal electric opportunities for Southold Town (copy on file in the Town Clerk's Office) . 9:45 A.M. - Police Chief Stanley Droskoski and Detective Beth Wilson, DARE Officer, met with the Town Board to . bring them up to date on the DARE Program. Chief Droskoski wanted the Town Board to know that Officer Henry Santacroce has asked to be relieved of his DARE responsibilities and return to full-time police officer duties. Detective Wilson cannot do the DARE program alone, and without two DARE officers they cannot reach out to all the schools. Supervisor Wickham said he will be looking for a way to continue the program without an increase in the budget, and to do it as well, perhaps better. He asked Chief Droskoski to prepare a projected budget to continue the program as it currently is. 10:25 A.M. - Solid Waste Coordinator James Bunchuck met with the Board to discuss the acquisition of certain equipment for the Disposal Area, Mr. Bunchuck first discussed his proposal to rent a portable Trommel screen from the Town of Huntington to screen leaf mulch. The cost .would be approximately $1 ,500. The Board asked Mr. Bunchuck to come back on July 12th with his request, along with a proposal to sell the screened leaf mulch.---Mr. Bunchuck also presented to the Board a proposal to advertise for bids for a payloader and tractor truck. The two large payloaders at the Disposal Site have had engine rebuilds, are not efficient, and are experiencing mechanical problems. The tractor truck he proposes to use to truck recycables. Councilman Townsend asked him to make inquiries of private firms for contracting out the trucking services. He will do that and report back on July 12th. 11 :05 A.M. - Discussed Fishers Island Metal Dump, bond and soliciting bids. Fagan Engineers is in the process of preparing bid specifications for complete excavation of the metal dump. Specifications and bonding will be discussed again on July 12th------- Supervisor Wickham asked the Town Board to consider submitting the permit application to the DEC for the Yard Waste Composting Operation at the Disposal Area. Resolution no. 21 was placed on the agenda authorizing the Supervisor to execute and submit same.------A proposal was received for the construction of a Gravel Removal System at the Scavenger Waste Plant, and resolution 'no. 22 was placed on the agenda to accept this proposal of Mobile Welding Service, Inc. 11 :35 A.M. - Planning and Zoning Issues: Councilman Lizewski discussed his proposed Local Law to remove Commercial Recreation Facilities from the General Business District, and allow them only in Hamlet Business Districts. He said he feels they should be allowed in Hamlet Business zones. The question was raised as to why they couldn't be in both zones. This proposal was referred to the Planning and Zoning Committee for review-------Supervisor Wickham presented his proposal for the creation of a Site Evaluation Committee to assist the YMCA in finding a suitable location in Southold Town. He will prepare a presentation to the July 12th meeting outlining his views on. the creation of the committee and the manner of identifying the people to serve on it.------Lengthy discussion on the proposed "Local Law in Relation to Bed E Breakfast 374 JUNE 28, 1994 Facilities". There is still concern among the Board members with regard to "major" and minor�� facilities, and the permit procedure. The Town Attorney will review further and tighten the proposed regulations.----- The proposed "Local law in Relation to Wineries" .was placed on the agenda for environmental review and referral to the Town and County Planning Boards (resolutions 23 and 24) . Proposed "Local Law in Relation to Public Entertainment and Special Events" was considered, but due to the fact it relates to wineries, only the environmental review went forward (resolution no. 25) . 12:15 P:M. - Recess for lunch. 1 :45 P.M. - Work Session reconvened (Police Chief Droskoski present) and the Board discussed proposed "Local Law in Relation to Burning", which deletes that:Chapter in its entirety, therefore prohibiting outdoor burning in . .Southold Town. * Councilman Lizewski asked that this matter be held in abeyance until he has an opportunity to speak to the Board .of Commissioners of the local fire districts; and has received a copy of the DEC law with.' regard to burning.------The next item was enforcement of the recycling laws. In attendance at this time was Roy and Todd Schelin, owners of North Fork Sanitation, and Chief Droskoski. The fact that out of town garbage carters are trying to sign up businesses in ,Town at cut-rate prices was discussed. These carters do not require recycling, an8l .take the garbage out of town. The. Town Code requires ss everyone to recycle, therefore, there is a serious violation of .the law. Supervisor Wickham said it is in the Town's interest to draw attention to,.this development and to provide all reasonable support to our local businesses. A more serious approach must be taken to enforcing the Code. Chief Droskoski will cooperate in any way possible, and Supervisor Wickham will write letters to the local chambers of commerce.---- Councilman Lizewski presented a proposed "Local Law in Relation to Taking of Fish in Town Water", which would institute a catch and release program for sportfishing and prohibit the killing of sportfish. ' Due to the fact the Trustees need time to review this proposal, this matter was set aside until receipt of input from the Trustees-------Town Board agreed to reaffirm their Procurement Policy (see resolution no. 28) .------ Discussed need . for funding for the upcoming Transportation Symposium to be held on refurbished railroad cars which will run from Greenport to Ronkonkoma -ande back. ack. visor Board agreed to funding not to exceed $750.00 (see resolution no. 30) .----- p Wickham submitted a report from the June 23rd Finance Committee meeting. 3 : 15 P.M. - Personnel Issues: Agreed to appoint Gail F. Horton and Merlon E. Wiggin to the Transportation Committee (see resolution no. 30) .------Placed a resolution on reed the agenda to appoint Ryan Springer as a .Traffic Control Officer (no. 31) . Ag to readvertise for School Crossing Guards in early August.--- --Authorized an appraisal for the Land Preservation Committee (see resolution no. 32) .------ ed resolution to create the Southold Town Youth Support Committee and advertise for members (see resolution no. 33) .------Report from Daniel Karpen on his evaluation of the Recreation building and Highway Garage complex with regard to the feasibility of obtaining funding- from the NYS Energy Office for energy. efficient improvements. It appears, upon an initial review of Mr. Karpen's report, that the pay back will be less than the cost. Supervisor Wickham will discuss the report further with Mr. Karpen.------Supervisor Wickham submitted a report on a preliminary meeting with regard to the Local Tax Committee. Regular Meeting. EXECUTIVE SESSION 4:30 P.M. - On motion of Councilwoman Oliva, seconded by Councilwoman Hussie, it was Resolved that the Town Board enter into Executive Session. Also present: Town Clerk Terry, Towr Attorney Dowd.---The Boa rd discussed the appointment of four summer interns (se resolution no. 36), and negotiations for the possible purchase of property. 5 :15 P.M. - Work Session adjourned. 375 REGULAR MEETING A Regular Meetiing of the Southold Town Board was held on June 28, 1994, at the Southold Town Hall, Main Road, Southold, New York. SUPERVISOR WICKHAM: I think most of you have copies of the agenda tonight. You'll notice.on the back page the order of business for the issues that we took up during the Work Session during the morning and afternoon. Most of those of those issues were discussed in a Work Session environment, and some of them have some resolution attached to them, which we will be taking up tonight as part of the resolutions. We have a public hearing at 7:55 tonight dealing with parking at Indian Neck Lane, and we have a series of public hearing later on, on proposed changes of zone. What I propose we do is go through our resolutions tonight, take up the one on the parking at Indian Neck Lane, and when we complete all of our resolutions, we will go into the public hearings, later on, on the changes of zone. Consequently we may not begin the pubic hearings on the changes of zone exactly at 8:00 o'clock. It may be five, ten, fifteen minutes after eight by the time we get to that. This is the opportunity for anyone to speak, who wishes to address the Board for up to five minutes on any one of the resolutions on our agenda tonight. There will be another opportunity at the end of the resolutions for any member of the audience to address the Board on any matter of their interest, and then for each of the hearings there will be additional opportunities for the audience to address the Board related to that hearing. Seeing nobody with an interest at this time, I think we're ready to launch into resolution number one. I .- Moved by Councilwoman Hussie, seconded by Justice Evans, it was RESOLVED that the Town Board of the Town of Southold hereby rescinds the appointment of Gertrude Bauer as an EISEP Aide (part. of resolution no. 35, adopted on June 14, 1994) whereas Mrs. Bauer declined the position; and be it FURTHER RESOLVED that the Town Board hereby appoints Ruth E. Kerr as an EISEP Aide (Expanded In-Home Services for th Elderly Program), effective immediately, '17-1/2 hours per week, at a salary of $5.50 per hour. JUNE 28, 1994 377 2.- Moved by Justice Evans, seconded by Councilman Townsend, it was RESOLVED that the Town Board hereby extends the response date for receipt of resumes for the Committee on Local Taxes to June 30, 1994, and authorizes and directs the Town Clerk to place an advertisement for resumes in the June 23rd edition of The Suffolk Times and The Traveler-Watchman to reflect the above mentioned extension. 2.- Vote of the Town 'Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was duly ADOPTED. 3.- Moved by Councilwoman Oliva, seconded by Justice Evans, it was RESOLVED that the Town Board of the Town of - Southold hereby, grants permission toSenior Accountant John Cushman, and Data Control Supervisor Jeanne Ruland to attend a meeting and ' luncheon sponsored by New York CLASS (Cooperative Liquid Assets Securities System) at 11 :00 A.M., June 29, 1994, at Southampton, New York, and the use of a Town vehicle for travel shall be a legal expenses to the Accounting & Finances Department's 1994 Budget. 3.- Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was duly ADOPTED. 4.- Moved by Councilman Townsend,...seconded by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes the closure of Cases Lane, Cutchogue, from 7:00 A.M. to 5:00 P.M. , Saturday, July 2, 1994, in the interest of public safety, during the Cutchogue-New Suffolk Historical 'CounciPs 30th Annual Antique Show and Flea Market, provided they file with the Town Clerk a One Million Dollar Certificate of Liability Insurance naming the Town of Southold as an additional insured. 4.- Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, . Gold as Chairman of the Southold Town Land Preservation Committee, effective immediately through July 3, 1995, he to serve in said position without compensation. 5.- Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was duly ADOPTED. 6.- Moved by Justice Evans, seconded by Supervisor Wickham, it was RESOLVED that the Town Board of the Town of Southold hereby accepts the resignation of Mark A. Hawkins, part-time Custodian at the Human Resource Center, effective May 25, 1994. 6.- Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was duly ADOPTED. 7.- Moved by Councilwoman Oliva, seconded by Councilman Lizewski, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes a refund of 15,00 to Frank Malek, which amount represents the fee for a Resident Disposal Permit; Mr. Malek purchased his permit on January 6, 1994, and inadvertently purchased another on May 26, 1994. 7.- Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was duly ADOPTED. 8.- Moved by Councilman Lizewski, seconded by Councilwoman Hussie, it was RESOLVED that the Town -Board of the Town of Southold hereby grants permission to the North Fork Youth Community, St. Patrick's Church, to hold a Mass for youth, followed by a picnic supper until dark, at McCabe's Beach, Southold, on Saturday, July 9, 1994, beginning at 5:00 P.M., provided they file with the Town Clerk a One M'iflion Dollar Certificate of Liability Insurance naming the Town of Southold as an additional insured. 8.-Vote of the Town Board:. Mullen, Jr. as the Town's Insurance Consultant, effective July 1, 1994 through June 30, 1995, at an annual . fee of $21 ,000.00, payable in twelve ( 12) monthly payments of $1,750.',00; Mr. Mullen to provide complete insurance consulting services for the Town of Southold. 9.- Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham.. This resolution was :.duly ADOPTED. 10.- Moved by Supervisor .Wickham, seconded by Councilman Townsend, WHEREAS, the Town Board had adopted a bond resolution April 20, 1993 authorizing the.`: preparation of preliminary plans, specifications and estimates necessary for the improvement of the Town's yard waste composting operation in connection with an intermun,icipal agreement to be executed with the' Town's of Huntington and Smithtown, and WHEREAS a capital fund known as the Yard Waste Composting "Twigs for Trash" Capital Fund has been established for this purpose, and WHEREAS the Town Board has determined that no further work on this project is required, now. therefore be RESOLVED that the Town Board of the Town of Southold hereby closes the Yard Waste Composting "Twigs for Trash" Capital Fund and be it further RESOLVED that all remaining capital monies be used for debt service in accordance with §165(a) of the Local Finance Law. 10.- Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was duly ADOPTED. 26.- Moved by Councilwoman Oliva, seconded by Supervisor Wickham, BOND RESOLUTION OF THE TOWN OF SOUTHOLD, NEW YORK, ADOPTED- JUNE 28, 1994, AUTHORIZING THE ACQUISITION OF CERTAIN DEVELOPMENTAL RIGHTS IN PRIME AGRICULTURAL LANDS WITHIN SAID TOWN FOR THE PRESERVATION OF OPEN SPACES AND AREAS, STATING THE ESTIMATED MAXIMUM COST THEREOF IS $1,750,000, APPROPRIATING SAID AMOUNT THEREFOR, AND AUTHORIZING THE ISSUANCE OF $1,750,000 SERIAL BONDS OF SAID TOWN TO FINANCE SAID APPROPRIATION. Recitals WHEREAS, Section 247 of. the General Municipal Law, constituting Chapter 24 of the Consolidated Laws of the State of New York (herein called "Section 247" ) , authorizes the Town of Southold, Suffolk County, New York, to acquire developmental rights in agricultural lands actually used in bona fide agricultural production, which developmental rights represent permanent legal interests or rights in land for the preservation of open spaces and areas; and WHEREAS, the acquisition of developmental rights in prime agricultural lands located throughout the Town for the preservation of open spaces and areas and conserving the character of local communities is found, determined and deemed to be necessary, in the public interest and a proper public purpose of the Town in accordance with the findings and determinations of the State Legislature as set forth in Section 247 ; and WHEREAS] in pursuance thereof, the Town desires to implement the land acquisition and financing program set forth below. X 384 JUNE 28, 1994 Now, therefor be it resolved by THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF SUFFOLK, NEW YORK, (by the favorable vote of not less than two-thirds of all the members of said Town Board) AS FOLLOWS: Section ' l. The ' Town of Southold, in; the County of Suffolk, New York (herein called "Town" ) , is hereby authorized to acquire such developmental rights in various parcels of prime agricultural lands within the Town for the preservation of open spaces and areas as may be authorized from time to time, by the Town Board of the Town, after due notice and a public hearing, pursuant to the provisions of Section 247 , including incidental costs in relation thereto, such acquisition being hereby found, determined and deemed to be necessary and' in the public interest and a proper public purpose of the Town in accordance with the findings and determinations set forth in Section 247 . The estimated maximum .cost of said class of objects or purposes, including preliminary . costs and costs incidental thereto and to the financing thereof, is $1, 750 , 000 , and said amount is hereby appropriated therefor. The plan of financing includes the issuance of $1, 750, 000 serial bonds of the Town to finance said appropriation, and the levy and collection of !taxes on all the taxable real property in the Town to pay the principal of said bonds and the interest thereon as the same shall become due and payable. Section 2 . Serial bonds of the Town' in the principal amount of $1,750, 000 are hereby authorized to be issued pursuant to the provisions of the Local Finance Law, constituting Chapter 33-a of the Consolidated Laws of the State of New York (herein called "Law") , -to finance said appropriation. Section 3 . The following additional matters are hereby determined and declared: (a) The period of probable usefulness of said class of objects or purposes, as described herein, for which said serial bonds authorized pursuant to this resolution are to be issued, within the limitations of Section 11 . 00 (a) 21 . (a) of the Law, is thirty (30) years. 8 .CURIE 28, 1994 385 (b) The proceeds of the bonds herein authorized and any bond anticipation notes issued in anticipation of said bonds may be applied to :reimburse the Town for expenditures made after the effective date of this resolution for the purpose or purposes for which said bonds are authorized. The 'foregoing statement of intent with respect to reimbursement is made in conformity With Treasury Regulation Section 1. 150-2 of the United States Treasury Department. (c) The proposed maturity of said $1 , 750 , 000 serial bonds will exceed five (5) years. Section 4 . Each of the bonds authorized by this resolution and any bond anticipation notes issued in anticipation of the sale of said bonds shall contain the recital of validity as prescribed by Section 52 . 00 of .the Law and said bonds and any notes issued in anticipation of said bonds, shall be general obligations of the Town, payable as to both principal and interest by general tax upon all the taxable real property within the Town without limitation of rate or amount. The faith and credit of the Town are hereby Irrevocably, pledged to the punctual payment of the principal of and interest on said bonds and any notes issued in anticipation of the sale of said bonds and provision shall be made annually in the budget of the Town by appropriation for (a) the amortization and redemption of the bonds and any notes in anticipation thereof to mature in such year and (b) the payment of interest to be due and payable in such year. Section 5. Subject to the provisions of this resolution and of the Law and pursuant to the provisions of Section 30 . 00 relative to the authorization of the issuance of bond anticipation notes and of Section 50-. 00 and Sections 56 . 00 to 60. 00 of the Law, the powers and- duties of the Town Board relative to authorizing bond anticipation notes and prescribing the terms, form and contents and as to the sale and issuance of the bonds herein authorized and of any bond anticipation notes issued in anticipation of said bonds, and the renewals of said 386 JUNE 28, 1994 bond anticipation notes, are hereby delegated to the Supervisor, the chief fiscal officer of the Town. Section° 6. The validity of the bonds authorized by this resolution and .of any notes issued in anticipation of the sale of said bonds, may be contested only if: (a) such obligations are authorized for an object or purpose for. which the Town is not authorized :to expend money, or (b) ' the provisions of law which should be complied with at the date of the publication of such resolution are not substantially complied with, and an action, suit or proceeding contesting such validity, is commenced within twenty days after the date of such publication, or (c) such obligations are authorized in violation of the provisions of the constitution. Every :prospective purchase of goods or services shall be evaluated to determine the applicability of General Municipal Law, Section 103. Every town officer, board, department head or other personnel with the requisite purchasing authority (hereinafter Purchaser) shall estimate the cumulative amount . of the items of supply. or equipment needed in a given fiscal year. That estimate shall include the canvass of other town departments and past history to determine the likely yearly value of the commodity to be acquired. ' The information gathered and conclusions reached shall be documented and kept with the file or other documentation supporting the purchase activity. GUIDELINE 2. All purchases of a) supplies or equipment which will exceed $10,000.00 in the fiscal year or b) public works contracts over $20,000.00 shall be formally bid pursuant to General Municipal Law Section 103. GUIDELINE 3. All estimated purchases of: * Less than $10,000. but greater than $3,000. require a written request for a proposal ( RFP) and written/fax quotes from 3 vendors. * Less than $3,000. but greater than $1 ,000. require an oral request for the goods and oral/fax quotes from 2 vendors. * Less than $1,000. but greater than $250. are left to discretion of the Purchaser. All estimated public works contracts of: * Less than $20,000. but greater than $10,000. require a written RFP and fax/proposals from 3 contractors. * Less than $10,000. but greater than $3,000. require a written RFP and fax/proposals from 2 contractors. * Less than $3,000. but greater than $500. are left to the discretion of the Purchaser. Any written- RFP shall describe the desired goods, quantity and the particulars of delivery. The Purchaser shall compile a list of all vendors from whom written/fax/oral quotes have been requested and the written/fax/oral quotes offered. All information gathered in complying with the procedures of this Guideline shall be preserved and filed with the documentation supporting the subsequent purchase or public works contract. JUNE 28, 1994 389 GUIDELINE 4. The lowest responsible proposal or quote shall be awarded the purchase or public works contract unless the Purchaser prepares a written justification providing reasons why it is in the best interest of the town and its taxpayers to make an award to other than the low bidder. If a bidder is not deemed responsible, facts supporting that judgment shall also be documented and filed with the record supporting the procurement.. GUIDELINE 5. A good faith effort shall be made to obtain the required number of proposals or quotations. If the Purchaser is unable to obtain the required number of proposals or quotations, the Purchaser ' shall document the attempt made at obtaining the proposals. In no event shall the inability to obtain the proposals or quotes be a bar to the procurement. GUIDELINE 6. Except when directed by the Town Board, no solicitation of written proposals or quotations shall be required under the following circumstances: , a. Acquisition-:,of professional services; b. Emergencies; C. Sole source situations; d. Goods purchased from agencies for the blind or severely handicapped; e. Goods purchased from correctional facilities; f.. Goods purchased- from another governmental agency; g. Goods purchased at auction; h. Goods purchased for less than $250.00; i. Public works contracts fo.r. ,les,s than $5,00. 00. GUIDELINE 7. A properly executed purchase order is required for all purchases. . Neither goods nor services are to be ordered without first obtaining a purchase order signed by the Department Head and the Supervisor. GUIDELINE 8. This resolution was duly ADOPTED. 35.-Moved by Councilwoman Hussie, seconded by Justice Evans, WHEREAS, the health, safety and welfare of Town residents is directly dependent upon immediate dispatch of emergency services; and WHEREAS, an up to date communications system is essential to the dispatch of those emergency services; and WHEREAS, there is provision for the NYNEX Telephone Company to collect a 35 cents surcharge to be used to provide these services provided they are undertaken on a multi-town basis; and WHEREAS, the Town believes that it is already providing Enhanced 911 service and intends to continue such service; now, therefore, be it RESOLVED, that the Town Board of the Town of Southold hereby adopts a 35 cents surcharge pursuant to County Law §303 and authorizes the East End Supervisors and Mayors Association to make an application NYNEX to collect the E-911 surcharge. 35.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. CYNTHIA HALSEY: I'm Cynthia Halsey, and I came earlier today because I'm concerned about this business of burning trash. I thought something was said in your office this morning, that there might be a discussion about it this evening. I don't know when you're going to discuss it. You had letter from me on the subject, and I imagine other people passing through Southold today between four o'clock, and the time I got here, which was 7:30, I've been interested to find . out that Southold is aromatic, not 3 9 2 JUNE 28, 1994 pleasantly so, but aromatic. I don't think that's a great idea for people who live here, obviously, however, I think it's a very bad idea for the town as a whole to let this go on, because the people are going to come here to visit, and people are going to come here to the store, and people are going to come here to enjoy the country life, which sometimes in strawberry smelling, and spruce trees. There are not going to' want to think Southold is one large municipal incinerator, and nobody is going to buy houses, or sell houses. I myself have changed since last night, my plans for inviting my friends and relations. They've always enjoyed coming. What happened; in my letter, happens again, they won't enjoy coming, they'll murder me, and the way that effects our economy, if we get known as a town you wish to avoid, because you can smell it twenty miles away. I do hope you stop it. Thank you. SUPERVISOR WICKHAM: Any other comments from people in the audience, that would like to address the Board? INGABORG FLYNN: I'm Ingaborg Flynn. I'm a resident of the Town of Southold. I have a question in regard to your resolution 25, Local Law in Relation to Pubtic Entertainment and Special Events. I would like to know if this only on outdoor events, outdoor: music, outdoor entertainment? Is that only in special districts, and is there any control of noise for the property on these events? If there's no noise control, and I think if these are outside. 'music entertainment there should be a time limit that it could only go on for a certain length of time. I believe it's not in the resolution, and have you thought about that? SUPERVISOR WICKHAM:. I think you are correct. It is not in our resolution. The resolution itself was aimed specifically at wineries, and permitting certain special events under certain condition for wineries, but I don't think noise control is written into that. That might be something that the Board would want to take up at some future stage. INGABORG FLYNN: I would suggest that the Board would take noise control up for the town. I do think that the time has come to do that. Thank you. JUSTICE EVANS: I just like to say, that when they get their permits for the special event, that they might, within the permit can be included a time limit. INGABORG FLYNN: I do think that it is necessary, but I also would suggest that the Town would think about a noise control, which covers the whole town. SUPERVISOR WICKHAM: Are there any other comments from anyone in the audience on any business before us? HAZEL JEFFCOAT: My name is Hazel Jeffcoat. There's a few things. I wanted to thank you, number one, for. when United Southold was running, and in your ads you told us about open government, and decisions, that were effecting the public that should be made in public, by the public, and it's very hard to see that as an example in government anymore. I want to thank you for doing that, because as a taxpaying person, who is a new property owner with a child in school, two children, I don't think that the government getting so much of my money is fair. I don't think that they're representing me properly, and I hope that when you have to make decisions that effect our scenic route, the proposed lane down Main through Orient, I hope it's not another step for legislature to take property rights away 'from people. I do hope that you can. help keep the growth of the town so that we can enjoy an open spot, because I know that I moved to that kind of neighborhood in my older age, as my choice. I don't know what will happen. It's too far based on what the government is doing. I'm hoping that everybody in town knows about the support that your Board has offered the school, Southold School District, in trying to help raise funds. There was a PTA proposal for a fund raiser, and many of you donated an hour of your time, and I hope the rest of the community takes into consideration what we're teaching our children, because it trickles down from we the people to the top of the government, not down from the town government to we the people, at least in my view. 1, don't want my child to think that it's okay to spend more that what we make. I want my children to know about investing money. That's what mortgage is-"about, and math. I know that social programs are necessary, and I think that's where a neighborhood pulls together. Instead of thinking only about the now, and 17 JUNE 28, 1994 393 making this a picturesque tourist place. I know it's a hard job for you, but the balance is not to just make money off of our land, tourism, quietness, but to keep a balance on what's happening with the people who live here, because we can chop down our own trees without a permit, and do it the right way, if we teach each other and our children from the beginning how to do it the right way. So, again, I hope you know there's many of us out there that are voting no for the school budget, because we don't like underhanded table deals, that give away our money to the year 2000. We want supportive teachers, and we want to keep legislature, like . yourself, keep agreements, contracts, and job positions placed because of merit, not because of handouts. Thank you. SUPERVISOR WICKHAM: Was there another comment?. HARVEY ARNOFF: Good evening, Mr. Wickham. Harvey Arnoff. I just have a quick question on the for discussion item 22. Could you tell me what the status is of the proposed Local Law in regard to Bed and Breakfast? COUNCILWOMAN .OLIVA: We had a discussion about the bed and breakfast, especially about the mihor bed and breakfast. There is a concern on the Board that just giving letters of notification.. to the . Building Inspector is not quite enough, that there are some special circumstances; perhaps in zoning law, that the Building Inspector should be looking at, or .an example was brought up of someone having a bed and breakfast, --and using a right-of-way that connects other people's houses. Would that be fair? So, we're trying to work out some sort of mechanism in that law, that allows for that (tape change) HARVEY ARNOFF: Have you set a date;.when the Board might have that? I have had many inquires about that. COUNCILWOMAN OLIVA: Hopefully within another two weeks we'll have the wording worked out.
