Dear Mr. Sulahian:
The following action was taken by the Southold Town Planning Board,
Monday, September 20, 1982 .
RESOLVED that whereas, a formal application for the approval of. a
subdivision plat entitled New York Telephone/ Kavanaugh, located at.
Greenport was submitted to the Planning Board on March 24 , 1982
and, a filing fee in the amount of $50 was paid July 12, 1982, *and
WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, Southold, New York, on August 30, 1982 at
7 :30 p.m. , and
WHEREAS, the requirements of the Subdivision Regulations of the Town
of Southold have been met by said subdivision plat. and application,
NOW, therefore, be it RESOLVED that the application of New York Telephone/ .
Kavanaugh for approval of said subdivision plat prepared by
Roderick Van Tuyl, P.C. dated June 15 , 1982 , be approved and the
chairman be authorized to endorse approval on said subdivision plat
subject to the following conditions:
1. No lot shall be subdivided or its lot lines changed in
any manner at any future date unless authorized by the
Town of Southold Planning Board.

2 . All stormwater runoff resulting from the development and
improvement of this subdivision or any of its lots shall
be retained on the site be adequate drainage structures
so that it will not flow out into the right-of-way of Main
Road.

4 . No driveway or entrance road on Moore ' s Lane shall be lo-
� cated within fifty feet of the northerly side of the right-
of-way of Main Road.
5 . The above conditions shall be filed as covenants and restric-
tions in the office of the County Clerk on or prior to the
granting of approval to this subdivision.
Upon receipt of a copy of the filed covenants and restrictions and
four (4) copies of the final subdivision map, within six (6) months
from date of resolution, the Chairman will endorse his approval; two
copies will be returned to your office for your files .

as "owner")
W I T N E S S E T H
WHEREAS, said NEW YORK TELEPHONE COMPANY is the owner of certain
tracts of land, which tracts are within the boundaries of and have been
subdivided into plots and a reserved area, hereinafter designated and set
forth on the map filed on the Office of the Clerk of the County of Suffolk
and more particularly bounded and described as follows :
BEGINNING at the intersection of the northerly line of the Main
Road (Route 25) with the westerly line of Moore ' s Lane; from
said point of beginning running along said northerly line of the
Main Road, two courses, as follows :
1. Westerly on a curve to the left having a radius of 1507.18
feet, a distance of 172.30 feet; thence
2. South 74046 '40" west, 87.30 feet to land now or formerly of
Karas, thence along said land of Karas, two courses as follows :

ments, subject to which the said tracts of land as subdivided into said

map are now held and shall be sold and conveyed, to the end that the re-
strictions, easements, covenants, reservations, conditions and agreement

declared and imposed by this declaration shall inure to the benefit of
each and all of the purchasers of said lots and their respective heirs,
distributees and assigns.
NOW, THEREFORE, owner declares that said lots and reserved area,
shown on the map above referred to, are now held and shall be sold and
conveyed by it, subject to the restrictions, easements, covenants, re-
servations, conditions and agreements hereinafter set forth in the vari-
ous articles of this declaration, to wit :

Attention: Mr. Henry Raynor Jr .
Dear Sir:
I am requesting your consideration and help with
respect to the following matter. The development or improvement
of private property sometimes requires the relocation of utility
poles adjacent to the property but in the public right of way.
This generally occurs when the municipality requires that as a
condition of site plan or subdivision approval, curbs and or
sidewalks be constructed along the public right of way at the
developers expense. As a result of this construction utility
poles may be left in the travelled portion of the road with
attendant hazard to the driving public.
Since the development of the property is clearly a
matter of private enterprise, costs associated with the
relocation of the utility poles should be borne by the
entrepeneur not the public or the rate payer. With this in mind
we respectfully request and point out the following:
1 . New York Telephone is in no way denying its
responsibility to relocate facilities on the public
right of way at no charge if directed to by the
municipality. This should not, however, be
construed to include relocation required solely
because of the development of privately owned
parcels of land.
2 . Construction of offset or isolated sections of
curb with associated pole relocations does place an
additional cost burden on the developer. In
addition, more poles and guy wires may be required
to hold a skewed pole line and road safety may
actually may be decreased. Alternate methods of
providing for construction of curb lines and
sidewalks (eg. payment to a fund held by the
municipality) may be benificial to all concerned.

3 . If the construction of curb/sidewalk etc. is
made a condition of permit, the developer, should be
informed of his obligation to contact the
appropriate utility as soon as possible after plan
approval. This is a most necessary step if required
utility work is to be completed on a timely basis
and the driving public protected.

Dear Mr. Raynor:
The Suffolk County Planning Commission at its regular meeting on August 4,
1982, reviewed the proposed subdivision plat entitled, "Minor Subdivision -
New York Telephone Company"; referred to it pursuant to Section 1333 of the
Suffolk County Charter. After due study and .deliberation it resolved to approve
said map subject to the following five conditions deemed necessary to help pre-
serve the traffic safety and carrying capacity of Main Road, a state road:
1. No lot shall be subdivided or its lot lines changed in any manner
at any future date unless authorized by the Town of Southold Plan-
ning Board.
2. All stormwater runoff resulting from the development and improvement
of this subdivision or any of its lots shall be retained on the site
by adequate drainage structures so that it will not flow out into
the right-of-way of Main Road.
3. There shall not be any vehicular ingress and egress on Main Road for
Lot 2.
4. No driveway or entrance road on Moore's Lane shall be located within
fifty feet of the northerly side of the right-of-way of Main Road.
5. The above conditions shall be filed as covenants and restrictions in
the office of the County Clerk on or prior to the granting of ap-
proval to this subdivision.

The following actions were taken by the Southold Town Planning Board,
Monday, June 28, 1982 .
RESOLVED that the Southold Town Planning Board declare itself lead
agency in regard to the State Environmental .Quality Review Act in the
matter of the minor subdivision of New York Telephone Company, located
at Greenport. An initial determination of nonsignificance. has been
made.
RESOLVED that the Southold Town Planning Board approve. the sketch ma
of New York Telephone Company, located at Greenport, dated June 15 ,
1982 .
In order that we might expedite state and county referrals, please
submit six (6) copies of the final subdivision map to our office;
please see enclosed list of requirements for an acceptable final map.
I am returning. your check in the sum of $25 as the filing fee for this
subdivision is $50. Upon receipt of the filing fee and the signed
statement regarding no grading, no new roads , no new drainage (see
enclosed) we will take those actions necessary to schedule this proposal
for a public hearing.
