Dear Mr. Bayley:
The following resolutions were adopted by the Southold Town
Planning Board at a meeting held on Monday, April 27, 1992.
BE IT RESOLVED that the Southold Town Planning Board,
acting under the State Environmental Quality Review Act, do an
uncoordinated review of this unlisted action. The Planning
Board establishes itself as Lead Agency, and as Lead Agency
makes a determination of non-signifance and grants a Negative
Declaration.
WHEREAS, Warren and Helen Hufe are the owners of the
property known and designated as Future Screw Machine Products
SCTM#1000-59-7-33 , located at 4155 CR 48, Southold; and
WHEREAS, a formal application for the approval of this site
plan was submitted on April 21, 1992; and
WHEREAS, the Southold Town Planning Board, pursuant to the
State Environmental Quality Review Act, (Article 8) , Part 617,
declared itself Lead Agency and issued a Negative Declaration on
April 27, 1992; and

WHEREAS, this site plan was certified by Victor Lessard,
Principal Building Inspector on April 24, 1992; and
WHEREAS, all the requirements of the Site Plan Regulations
of the Town of Southold have been met; and
Be It Therefore
RESOLVED, that the Southold Town Planning Board grant
conditional final approval and authorize the Chairman to endorse
the final survey dated April 15, 1992, for a 37 ' x 1418"
storage addition subject to a one year reivew from the date of
the Certificate of Occupancy.
The following conditions are to be affixed to the final map.
1. Handicapped parking space be relocated to parking
space number one on the plan dated April 11, 1992.
Existing handicapped space to remain as a regular
parking space.
2. An amended site plan be filed for the 342 square foot
addition designated Phase Two on the plan dated April
11, 1992, when and if the Zoning Board of Appeals
grants an area variance.
Enclosed please find a copy of the map that was endorsed by
the Chairman and a copy of the Negative Declaration.

Reasons Supporting This Determination:
The project involves a 37 ' x 14' 8" addition to enclose a
loading area attached to the existing machine products
building on 13,718 square foot site. A Special Exception
was granted by the Zoning Board of Appeals on March 5, 1992
which found the proposed action is consistent with zoning.
The proposed site plan was reviewed by the Principal
Building Inspector and found to meet all zoning
requirements.
An Environmental' Assessment has been submitted and
reviewed. It was determined that no significant effects to
the environment were likely to occur should the project be
implemented as planned.

Application of FUTURE SCREW MACHINE PRODUCTS (MR. AND MRS.
WARREN E. HUFE, JR. ) Variance to the Zoning Ordinance, Article
VIII , Section 100-82, for approval of an addition, for storage
purposes only, having an insufficient setback from the westerly
side property line. Subject premises is a nonconforming lot
located in the Light Business (LB) Zone District. Location of
Property: North Side of County Road 48 and the Westerly Side of
Kenney' s Road, Southold, NY; County Tax Map Parcel No.
1000-59-7-33 .
WHEREAS, a public, hearing was held on March 5, 1992, and all
those who desired to be heard were heard and their testimony
recorded; and
WHEREAS, -the Board has carefully considered all testimony and
documentation submitted concerning this application; and

WHEREAS, Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1 . By this application, appellant is requesting approval of
storage, addition at the westerly side of the existing building.
The addition is 14' 8" and 4" overhang, all to be set back 11.5 (or
12 feet) from the westerly (side) property line. Although the
setback requested in the application is 12 feet, the setback
according to the survey prepared February 5, 1992 indicates that
the building is presently set back 26. 0 feet from the westerly
side property line at its closest point, thus a reduction in this
setback by 1418 feet and a 4" overhang will leave a setback at
approximately 11. 2 feet.
2. The premises in question is nonconforming as exists with
a total lot area and width containing a total area of 13 ,718. 85
feet ( . 3149 ac. ) . The building as exists is nonconforming in the
northerly rear yard (on this corner lot) and the front yard
setback from County Road 48 is shown to be 18. 4 feet at its
closest point.

3 . The premises is located in the Limited Business (LB) Zone
District and the existing principal building with addition has
received a Certificate of Occupancy under No. Z6919 dated March 4,
1976. (It is noted, however, that the metal truck trailer shown
on the February 5, 1992 survey prepared by Joseph A. Ingegno is
pending reviews by the Building Inspector at this time and is. not
part of the variance request at this time -- requiring a separate
application. )
4. This addition is to be used for garage and storage
purposes which are accessory and incidental only to the principal
use of the premises.
5. It is the position of the Board in consideration this•
application that:
(a) the circumstances are uniquely related to the land
and buildings and are not personal in nature;
(b) the relief is substantial in relation to the
requirement, being a variance' of: approximately 40 0 {from a 20 ft.
setback to 11. 2+- feet} ;
(c) the relief as granted will not be an increase in use
density since it will be used for accessory storage purposes;
(d) the relief requested is not unreasonable due to the
uniqueness of the property - being a corner lot and of a
substandard size;
(e) there is no alternative for appellants to pursue
.other than a variance;
(f) the variance will not in turn be adverse to the
safety, health, welfare, comfort, convenience, or order of the
town, be adverse to neighboring properties, or alter the essential
character of the neighborhood.
Accordingly, on motion by Mr. Grigonis, seconded by
Mr. Goehringer, it was
RESOLVED, to GRANT reduction in the westerly side yard
setback for the proposed addition for storage purposes, as applied
under Appl. No. 4076 in the Matter of the Application of FUTURE
SCREW MACHINE PRODUCTS, INC. (HUFE) .
Vote of the Board: Ayes: Messrs. Grigonis, Doyen, Dinizio,
Villa and Goehringer. This resolution was duly adopted.

This is in response to your request of January 6, 1992 for
this Board' s comments on the above referenced property.
The Planning Board is in favor of this application to
replace an existing fence with an attached structure to protect
the conveyor belt from the weather.
The Board has requested a written statement from the
applicant that no new employees will be hired as a result of
this addition and that there will not be a more intensive use of
the property.
The applicant has been notified that a site plan will be
required for this addition.

1. STRICT APPLICATION OF THE"bRDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because appellant ,proposes to replace an existing fence with
an attached shed/lean-to for storage and protdction of machine shop tools
used to feed materials into the building. Existing machinery is due to
be replaced and the new machinery requires greater protection from the
weather than the present fence affords . There is no means' other than by
the granting of a variance that will enable the appellant to use the
property as a machine shop with the new machinery: The requested variance
is not substantial and will have no adverse impacts or effects in the
surrounding neighborhood or the use district.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because the machine shop which is
relatively small in size has unique requirements for its operation
which include feeding of materials into the machine shop tools . These
materials are fed -through the side of the building and the materials
must be protected from the weather for the machine to work properly.
3. The Variance would observe the. spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the property .has a fence already .in the
locatiof1ii.of the proposed structure. The fence would be replaced by an
attached shed structure to enable the operation of the machine shop to
continue. The proposed shed will have no more of an impact on the
-- character of the district or surrounding properties than the existing
fence which .it will- replace. The fence has been 10 feet from the
property line. The proposed shed would be placed approximately 10 ' 8"
from the property line. The proposed variance would create no *additional
traffic, noise or other adverse impact in the district. In fact, such
impacts , if any, would be reduced by enclosure of the area as proposed.
