RESOLVED that whereas, a formal application for the approval of a site plan entitled Lucas Ford located at Southold was submitted to the Planning Board on November 7, 1988 and, WHEREAS, the Zoning Board of Appeals granted a Special Exception for establishment of a new car dealership on January 12, 1989, with the following conditions: 1. Minimum 75 ft landscaped buffer along the front yard area as required by the Planning Board under its site plan review process; 2. Minimum 20 ft. buffer within the northerly yard area and southerly yard area, landscaping with the minimum six ft. high screening, staggered (or the minimum required under the site plan regulations, whichever is greater) ; 3 . Sign as submitted to the ZBA, is denied. 4. All plantings (trees, shrubs, etc. ) within buffer areas must be continuously maintained and properly irrigated for good growth; AND WHEREAS, The conditions of the Zoning Board of Appeal' s decision have been met. WHEREAS, said site plan was certified by the Building Inspector on April 3, 1989. �l NOW, therefore, be it RESOLVED that the application of Lucas Ford dated as received by the Planning Board office, April 3 , 1989, be approved and the Chairman be authorized to endorse the site plan with the following conditions: 1. The drainage for the site and the effect of the development on the adjacent street must be reviewed by the Highway Superintendent, and if necessary, the Town Engineer, before the issuance of a building permit. 2. A lighting plan for all light fixtures, including the lights on the building, must be submitted for review before the issuance of a building permit. 3 . PROPERTY FACTS/DESCRIPTION: The applicant's property is located on the west side of Horton Lane.in Southold. The property is improved with a car-truck sales dealership and is located in the B- General Business Zone District. There are two wall signs and one ground sign existing at the premises. BASIS OF APPLICATION: Building Department's January 15, 2002 Notice of Disapproval, denying sign permits under section 100-205.1C, 100-205D and 100-206B, for the reasons that four proposed (two wall and two ground signs) are not permitted; the code provides for a limit of two alternative sign or alternative combinations, and therefore four signs are excessive; applicant is also requesting two freestanding or ground signs instead of the code limitation for only one freestanding sign for each (one) road frontage; and internally illuminated signs are prohibited in this zone district. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on July 25, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. RELIEF REQUESTED: Applicants are proposing to remove two existing wall signs and one ground sign. As a replacement two new wall signs'on the rear of the building will be placed, and two ground signs are requested, one being a monument sign.and the.other replacing the existing ground sign in the same location, all as shown on the 9-27-88 site plan,map (prepared by John A. Grammas Associates) with handwritten notations added by the sign company for consideration. (Please see ZBA file, or sign company diagrams disapproved by the Building Department, for dimensions and color and related specifications of the signs.) REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, and personal inspections, the Board makes the following findings: 1. The grant of an area variance will produce an undesirable change in the character of the neighborhood or detriment to nearby properties. The illumination of the four signs, and an increase in the number of signs from two to four, are prohibited under the current Zoning Ordinance pertaining to signs. Use of illuminated signs is also prohibited in the B Business Zone. An increase of signs from a total of three to four is unwarranted for these types of non-conformities. The additional interior lighting of the proposed signs will create•.an unnecessary brightness, adverse to the neighborhood, with Page 2—July 25,2002 ZBA Appl.No.5117—Lucas Ford 59-3-32.1 at Southold late-night lighting and an unnecessary freestanding structure. The proposed use by applicant is to have,an, increase in illumination and signs, which is unnecessary and excessive because the business is visible from C.R. 48and Horton Lane, as well as other areas within view, during regular business hours. The alternative relief granted in this determination will provide for extra signage, allowing continued advertising and viewing for the business-before, during, and after business hours. 2. The benefit sought by the applicant can be achieved by some method feasible for the applicant to pursue, other than a variance. Externally lighted signs placed in accordance with Town Code are a viable alternative available to the applicant(instead of internally lighted signs). 3. The relief sought is substantial. The applicant's original request is for four (4) highly visible interior-illuminated signs to be kept lighted at all times, both day and night. The alternative relief for signs with code-permitted exterior lighting, grants of up to three signs (total), instead of the code limitation of two signs,is more in conformity with the intentions of the code provisions. 4. The relief applied for by applicants will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. There are properties adjacent and within view of the applicant's property which are zoned or used residentially or agriculturally. The adverse effect on the neighborhood, with late-night lighting and excessive sign structures, outweighs the benefit to the applicant. The proposed use to have an increase in illuminated signs for advertisement purposes is unnecessary because the business is visible from C.R. 48 during regular business hours. Exterior signage will continue to exist for the purposes intended by the applicant, before, during, and after business hours. 5. The difficulty has been self-created. BOARD RESOLUTION: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion offered by Member Horning, seconded by Member Orlando, and duly carried,to: DENY the application as applied for, and to GRANT ALTERNATIVE RELIEF for replacement of the two existing wall signs with two new wall signs, and replacement of one of the ground signs with one new ground sign, SUBJECT TO THE FOLLOWING CONDITIONS: 1. There will be no interiorly illuminated signs as proposed by the applicant on the building. 2. The pre-existing, non-conforming ground mounted sign will not be illuminated after 10pm, or before 6am. 3. No other interior-lighting of signs, or other ground signs, are granted in this decision. When it happens, I speak to the owner, and usually, after a few reminders, he complies and removes them. Last week he told me he had inquired of the town and was told it was within his rights to park on the buffer. Bob Kassner of the Planning Department has told me otherwise previously and again when I asked him last week, and he advised me to write to you. Although the well-being of Southold hardly depends on the presence or absence of Mr. Lucas ' illegally parked trucks, Mr. Lucas isn' t acting fairly or honestly, as far as I can tell, and I hope you take action to remove this violation. His business really doesn't really suit. the residential and agriculture neighborhood that surrounds it, but since he was able to build it there, so it will remain. But he should. not be able to violate the site plan that was designed to -mitigate the impact of his business on his neighbors. Moreover, with his acres of highly visible .parking available, he hardly needs the illegal parking. In April of this year, the Planning Board approved the site plan for the above-referenced building with a condition that a lighting plan be submitted for review prior to the issuance of a building permit. Ordinarily, this Board does not approve a site plan with such a condition. Usually it requires that the lighting plan be submitted before it grants approval. In fact, this information had been requested in March (see enclosed copy of letter) , but it was not provided. In this particular case, your representative, Tom McCarthy of Gray Construction, indicated that time was of the essence, and that there was every intention of complying with the Planning Board' s concerns that the lighting not be intrusive. In the spirit of cooperation, the Planning Board agreed to approve the site plan with the condition that the lighting be addressed prior to construction. A copy of the approval resolution is attached for your information. Unfortunately, a lighting plan was not submitted prior to the issuance of a building permit, but rather when construction was nearly completed. In October, a request for a Certificate of Occupancy was made. At that time, it was noted that the lighting that had been installed was not the same as that shown on the plan that had been submitted! At this point, the Board could have requested strict compliance with the submitted plans before recommending issuance of the Certificate of Occupancy. Instead, so that the scheduled opening date of the dealership would not be delayed, the Board, once again in the spirit of cooperation, recommended the issuance of the Certificate of Occupancy, with the condition that the lighting on the site be reduced in its intensity. Attached please find a copy of the Board' s November recommendation to the Building Department. Given this Board' s efforts to accomodate your construction schedule, we find it puzzling that, to date, nothing has been done to ameliorate the unacceptable lighting. It would be most appreciated if the numbers and the intensitylof the lights would be reduced as noted in the Board' s November 2, 1989 memorandum. He asked if a member of_ the Planning staff would go out with him. I accompanied him this afternoon. Following is a list of my observations. The observations are based on the October 12th inspection and field report: 1. The swale and low berm on the north side of the property (next to Markel' s property) have notbeen installed. However, the topsoil for the berm is piled on-site and the work is scheduled to be done. 2. The lighting that was installed generally consists of two high intensity rectangular lights per stanchion. The lights are directed at the building and perpendicular to the building. Victor asked the site foreman (Tom McCarthy) to make sure the lights did shine off the property. I recommend a night inspection. 3 . The entrance curbing appears to be in accordance with the Building and the Highway departments' request that the curbs not extend to the street. A memorandum has been sent to Ray Jacobs asking for his review. 4. The water tank at the northwest corner of the property was supposed to be removed at Victors request, but had not been at the time of our inspection. The well will remain because it is for the irrigation system. 5. The slope of the parking area around the drain at the entrance of the building has been lessened to the extent possible. 6. The showroom has been deemed accessible to the handicapped by Victor. All handicapped parking spaces have been placed at the closest point of entry and adjacent to a ramp. 7. The front yard has been covered with sod. Street trees have been installed as per specifications. The side and rear yards will be seeded at a later date. The applicant has asked for a C.of O. by October 31st so that they can meet their scheduled opening date of November 1st. (SBB No, 87447) Dear Mr. Jacobs: We have reviewed the lack of drainage facilities on Horton Lane at the location .of the above referenced site. Our calculations have determined that three 10 ft. . diameter leaching basins-each 12 ft. deep will be necessary to handle the road runoff. It is not evident from the site plan exactly where the existing low point is located. Some slight grading of the road shoulder may be necessary to create a flow line to the location of the actual low point. The basins should be interconnected with 1511 C.M.P. or equal for ease of maintenance and to avoid the tendency of smaller pipes to plug up with debris. We would suggest that this drainage installation be added to the site plan by the developer so there is not an oversight in the future. The next step is to send the plans to the Building Department for certification; however the following information needs to be included on the site plan. Some of the items below reference the new zoning code which was adopted by the Town Board and which became effective on. February 1, 1989. All site plans are being reviewed again to ensure compliance with the new code. Therefore, while some of the items mentioned in this letter may not have been mentioned in your previous consultations with the Planning Board and its staff, they must be included in order to bring the plan into compliance with the Town Code. 1. Outdoor lighting may not exceed 14 feet in height and must be located within the front one third of the lot depth pursuant to Section 100-101 B. (12) . Please indicate this on plan. 2. - Calculations for loading areas and parking spaces must be in accordance with Sections 100-191 and 192 A. ( 3) . Please include the calculations and show the sales lot area, and the loading area on the site plan. 3 . Landscaping in the front yard must comply with Section 100-191. K. ( 2) .The Board suggests a mix of . slow-growing,shade tolerant, low maintenance plantings, not to exceed four feet in height. Please indicate the planting location and type on the site plan. 4. If you intend to install underground or above ground gasoline or diesel fuel storage tanks or propane tanks, these must be noted on the plan. 5. Revised elevation drawing needs to be submitted pursuant to the Board's request of October 19, 1988. The Board requests this pursuant to Section 100-252. I. and M. The new building should be compatible with the existing and proposed professional office development on neighboring lots on County Road 48. Please include elevations for all four sides. 6. All electric utility lines shall be shown as being underground. Finally, Section 100-213 C. requires that the trees in the evergreen buffer area surrounding the property be at least 6 feet in height. Also, the Zoning Board of Appeals stated that the minimum height of the buffer plantings was to be six feet. This should be stated on the site plan. Section 100-214.A. requires that interior landscaping be provided in parking areas. The Board is waiving that requirement for the following reason: that the proposed site plan shows ten percent more landscaping than is required by the Code. Upon receipt of a revised plan that incorporates all of the above-noted changes, the Planning Board will proceed with the certification process.
