WHEREAS, the Owner has title to certain lands situate, lying and being
at Southold, in the Town of Southold, County of Suffolk and State of New York;
said lands hereinafter being more particularly described; and
WHEREAS, it is the, Owner Ts intention that the aforesaid land be divided
into a minor subdivision consisting of two lots;
NOW, THEREFORE, the following described land shall be restricted
as hereinafter set forth:
BEGINNING at a monument set on the-westerly line of Boisseau Avenue
at the northeasterly corner of land of Bucci and the southeasterly corner of
the premises herein described;.
RUNNING THENCE along said land of Bucci, South 81 degrees 16 minutes
50 seconds West 247. 81 feet to a monument and. land of Barczak;
THENCE along said land of Barczak, North 8 degrees 57 minutes 30
seconds West 263.42 feet to the southerly line of Middle Road; "
THENCE along said southerly line of Middle Road, two courses:
(1) Northeasterly on a curve to the left having a radius of 2325. 01 feet,

Planning Board of the Town of Southold, the said land shall be subject to the
following covenants and restrictions:
1. No lot shall be subdivided or any lot line changed in any manner at
any future date unless authorized by the Southold Town Planning
Board.
2. If Lot 1 is to be used for residential use vehicular access 'to the
lot shall be restricted to Boisseau Avenue.
3. If Lot 1 is used for commercial use vehicular access to the lot shall
be located no closer than 50 feet to the westerly end of the curve
that connects the southeasterly side of Middle Road with the westerl
side of Boisseau Avenue. .
4. Any driveway for Lot 1 located on Boisseau Avenue shall be located
in the southerly part of the lot near the southerly lot line.
5. All driveways that are created shall have a turnaround provision,
such as a T-shaped shunt, so that vehicles leaving the site will not
have to back out into the traffic stream on either .road.
6. All stormwater runoff resulting from the development and improve-
ment of this property shall be retained on site by adequate drainage
structures so that it will not flow out into Middle Road or into the
intersection of Middle Road and Boisseau Avenue.
7. Approval of this subdivision shall be made subject to its meeting
the requirements and standards of the Suffolk County Department
of Health.Services.
DECLARANT does hereby further warrant, covenant and represent
that the foregoing restrictions and agreements shall bind the undersigned, _
his heirs, successors and assigns, and any and all persons or persons

DESCRIPTION OF ACTION
The minor subdivision of Harold E. Tuthill., located at
Southold.
The project has been determined not to .have a significant
effect on the environment for the following reasons :
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation it is assumed that there is no objection
nor comments by that agency.
Because there has been no response in the allotted time
from the Suffolk County Department of Health Services it
is assumed that there is no objection nor comments by that
agency.
The project will meet all the requirements of the Code of the
Town of Southold Subdivision of Land Regulations.

NOTICE IS HEREBY GIVEN that pursuant to Section 276 of the Town
Law, public hearings will be held by the Southold Town Planning
Board at the Town Hall, Main Road, Southold, New York, in said town

BEGINNING at a monument set on the westerly line of Boisseau
Avenue at the northeasterly corner of land of Bucci and the south-
easterly corner of the premises herein described; running thence
along said land of Bucci, S . 810 16 ' 50" W. - 247 .81 feet to a mon-
ument and land of Barczak: thence along said .land of Barczak,
N. 80 57 ' 30" W. . - 263 .42 feet to the southerly line of Middle Road;
thence along said southerly line of Middle Road, two courses:
(1) Northeasterly on a curve to the left having a radius
of 2325 . 01 feet, a distance of 241.62 feet; thence
(2) Southeasterly on a curve to the right having a radius
of 67 .23 feet, a distance of 158 .53 feet to said westerly line of
Boisseau Avenue; thence along said westerly line of Boisseau Ave. ,

Dear Mr. Raynor:
The Suffolk County Planning Commission at its regular meeting on September
2, 1981, reviewed the proposed subdivison plat entitled, "Minor Subdivision -
Donald Tuthill", referred to it pursuant to Section 1333 of the Suffolk County
Charter. After due study and deliberation it resolved to approve said map sub-
ject to the following eight conditions deemed necessary to help preserve the
traffic safety and carrying capacity of Middle Road:
1. No lot shall be subdivided or any lot line changed in any manner at
any future date unless authorized by the Southold Town Planning Board.
2. If Lot 1 is to be used for residential use vehicular access to the
lot shall be restricted to Boisseau Avenue.
3. If Lot 1 is used for commercial use vehicular access to the lot shall
be located no closer than 50 feet to the westerly end of the curve
that connects the southeasterly side of Middle Road with the westerly
side of.Boisseau Avenue.
4. Any driveway for Lot 1 located on Boisseau Avenue shall be located in
the southerly part of the lot near the southerly lot line.
5. All driveways that are created shall have a turnaround provision, such
as a T-shaped shunt, so that vehicles leaving the site will not have
to back out into the traffic stream on either road.
6. All stormwater runoff resulting from the development and improvement
of this property shall be retained on site by adequate drainage struc-
tures so that it will not flow out into Middle Road or into the inter-
section of Middle Road and Boisseau Avenue.

7. Approval of this subdivision shall be made subject to its meeting
the requirements and standards of the Suffolk County Department of
Health Services.
8. Conditions 1 through 7, inclusive, shall be filed as covenants and
restrictions in the County Clerk's office prior to or concurrent
with the granting of approval of this subdivision.

I wish to sell a part- of my lot to my son, Donald E,., Tuthill.
I will keep the southern section of 40,000 sq. ft. where my house
and buildings are located. My son plans to continue using the
northern section as a garden area.
