Dear Mr. Kerbs:
The following actions were taken by the Southold Town
Planning Board, Monday, September 15 , 1986 .
RESOLVED that the Southold Town Planning Board override
the Suffolk County Planning Commission' s resolution of denial
with regard to the minor subdivision for John and Margaret
Kerbs located at County Route 48 , Southold.
RESOLVED that the Southold Town Planning Board accept
and request compliance with Inspector John W. Davis ' report
No. 531 with regard to the required improvements on the access
road within the minor subdivision of John and Margaret Kerbs.
RESOLVED that whereas a formal application for the approval
of a subdivision plat entitled "John M. and Margaret A.Kerbs"
located at Southold was submitted to the Planning Board on
April 25 , 1986 and the filing fee of $550 was paid on _August
19 , 1986 , and
WHEREAS, a public hearing was held on said subdivision
application and plat at the Town Hall, Southold, New York
on Monday, August 25, 1986 at 7: 30 p.m. , and
WHEREAS, the requirements of the Subdivision Regulations
of the Town of Southold have been met by said subdivision
plat and application,
NOW, therefore, be it RESOLVED that the application of
John and Margaret Kerbs for approval of said subdivision
pla prepared by Rod Van Tuyl and dated as last amended
July 31, 1986 be approved and the Chairman be authorized
to endorsed approval on said subdivision plat.

Dear Mr. Orlowski:
The Suffolk County Planning Commission at its regular meeting on September
3, 1986, .reviewed the proposed subdivision plat, entitled, "Minor Subdivision -
John M. & Margaret A. Kerbs", referred to it pursuant to Section 1333 of the
Suffolk County Charter. After due study and deliberation it resolved to
disapprove said map for the following reasons:
1. The proposed subdivision will result in the creation of a landlocked
parcel; that is, a parcel that will not have frontage on an existing
or proposed public road. The creation of such a lot is contrary to
good subdivision layout principles and creates problems as far as
access by emergency and service equipment is concerned. This lack of
access could result in health, safety and welfare problems for the
future residents of the landlocked lot, not to mention potential
disputes over the use and maintenance of any right-of-way over an
adjacent parcel that may be created for the purpose of access.
Creation of a landlocked lot also places the Zoning Board of Appeals
in the awkward position of having to grant a building permit for the
lot under Section 280-a of the Town Law as the future owner of the
landlocked lot cannot be held responsible for the landlocked nature of
their parcel.

2. Creation of a subdivision with substandard lots, that is, lots whose
areas are less than the minimum required by the zoning classification
of the property, constitutes an overintensification of land use in a
groundwater sensitive area in what is meant to be a low density area.
Such action could establish a precedence for future subdivision of
this kind which would essentially be a circumvention of the Town
Board's action taken over the past years to upzone these groundwater
sensitive areas. The Commission feels that the Town Planning Board
should have the prerogative to review this type of application rather
than it being left to the sole discretion of the Zoning Board of
Appeals.

1 . The premises in question is located along the south
side of Middle Road , or County Route 48 , in the Hamlet of Southold ,
having a total acreage of 6 . 804 with frontage of 591 .88 feet and
lot depth at the westerly end of 289. 30 feet and at the easterly
end of 715 . 52 feet . The subject premises is identified on the
Suffolk County Tax Maps as District 1000 , Section 55 , Block 3 ,
Lots:. 3 and 4 . 1 (4 and 2 ) . The subject premises was conveyed in
two deeds at Liber 3441 pp . 33 and 36 , November 22 , ; 1952 , to

Lot #1 , exclusive of 25 ' right-of-way running along the westerly
side line ; (b) 62 ,000. sq . ft . for proposed Lot #2 , which is
presently improved with a single-family dwelling and accessory
garage/storage building located in the, rear yard ; (c ) 63 ,000
sq . ft . for proposed Lot #3 . . Proposed Lot #4 does not require
an area variance since it contains an area exceeding 80 ,000
sq . ft . in area and is intended for sin.glefami.'ly purposes .
3. The board i.s in agreement with the applicant as to
the unusual - shape , which lends to the adjustment of varied
lot area as proposed .
In considering this appeal , the board also finds and
determines : (a ) that sufficient practical difficulties have
been shown to warrant the granting of this variance ; (b ) the
circumstances are unique and not shared by all other properties
in the neighborhood ; (c ) there will be no substantial change
in the character of .the neighborhood or detriment to adjoining
properties ; (d ) the relief requested is not substantial ;
(e ) the difficulty cannot .be obviated. by some method feasible
for appellant to_ p_ursue other than a Variance ; (f) that the
variance will not. in turn cause a substantial effect of increased
population density or be adverse to the safety, health , weflare ,
comfort , convenience and order 'of .the town ; ` (g ) that in
view of the manner in which the diffi.c.ulty arose and in con-
sideration of all the above factors , the interests of justice
will best be served 'by allowing the variance , as conditionally
noted below.

Re: Access to Lot No.' 4 - Minor Subdivision for John and Margaret
Kerbs at Southold.
Comments:
The 25 ft. R.O.W. to above lot is more or less level and meets C.R. 48
at about the same elevation. From visual observation there could be
a slight minus grade to the south. The approximate location of the
R.O.W. was determined by using a scaled distance from the house on
Lot No. 2 and measured with Mr. Kerbs.
Test hole on plans, adjacent to the R.O.W. shows .4" of dark,.brown loam,
2'8" of brown loam and 1 '6" of light brown clay before reaching sand
and gravel.
Recommendations for access road in. the 25 ft. R.O.W. :
1 . Road width 15 ft. (280-A requirement) with 4 ft. shoulders.
2. Remove loam for 12" in the 15 ft. width and grade to an even
profile.
3. Backfill loam excavation with a compacted grade of clean fill to
a depth that when the following courses are placed the final
surface is 4"± above the existing ground.
4. Place a 6" compacted course of bankrun sand, loam and gravel.
Gravel content to be 25-30%,
5. Place a top course of 3/4" stone blend or crushed concrete so that
when compacted the depth will be 2".
6. Do not ,forsee. any drainage problems at this time.
Although this access is 356 ft. in length it serves only one lot and
a road width less than '15 ft. might- be considered.
Mr. Kerbs does not intend to construct this access road in the immediate
future.

Dear Mr. Kerbs:
The following action was taken by the Southold Town Planning
Board, Monday, May 5, 1986.
RESOVLED that the Southold Town Planning Board refer the
following comment to the Board of Appeals with regard to the
proposal for John and Margaret Kerbs located at Middle Road,
Southold:
1. The Planning Board cannot endorse this proposal since
three of the lots are less than the minimum zoning of 80, 000
square feet.

The proposed plat shall be complete in all aspects and shall show
the following minimum information:
a. Name.of map; for example, Minor Subdivision - John J. Jones;
Subdivision Map of Property of John J. Jones; John J. Jo-es
Plat. Names must be distinct. A map containing the words
"proposed subdivision map" in the title will be considered a
preliminary map and a map containing the words "sketch plan"
in the title will not be accepted. Duplicate names within a
municipality will not be accepted.
b. Hamlet (village) and town in which property is located.
c. Name of the licensed land surveyor who surveyed the property
and prepared the proposed subdivision map.
d. Total area of the parcel.
2 e. Proposed lot numbers for all parcels within subdivision.
f. Area of each lot.
Ogg. Sufficient data to readily determine the location, direction,
and length of all property boundaries, street lines, and lot
lines.
h. Zoning classification of property. (May be stated in referral
letter.)
i. Tax Parcel Identifier Number.
Note: Section 7209.2 of the New York State Education Law pro-
hibits the alteration of any plans, specifications , plats,
and reports to which the seal and signature of a licensed
land surveyor has been applied and bearing a statement that
alteration of the.document is a violation of the State
Education Law. (See Ap
pendix 7 for excerpts of Section 7209
of the State Education Law.)

Please be advised that in reviewing your recent application
for a proposed major subdivision, it was the consensus of the
Zoning Board members not to schedule same for a public hearing
at this time. It is our understanding that the Planning Board
has denied your application for a major subdivision for noncompli-
ance with Chapter A106 , Subdivision Regulations , of the Code,
which is not within the jurisdiction of the Board of Appeals.
It is suggested that a revised plan be submitted to the
Planning Board for their reconsideration. Once the Planning'
Board has given favorable views, we will then be in a position
to schedule your application for public hearing.
