The condition in the Planning Board's resolution granting final approval provided that the applicant file with the Planning Board a Declaration of Covenants and Restrictions to the effect that the remaining Witherspoon property to the west of the two lot minor subdivision be not further subdivided. The applicant's . attorney filed a declaration. However, it did not explicitly contain the requested restriction. Apparently, no further action has been taken by the Planning Board. The Zoning Code permits the development of the lots on the minor subdivision with a minimum lot size of 40, 000 sq. ft. It would appear to me that the best procedure is for: the Planning Board to schedule a new hearing for the final approval of the subdivision, and thereafter approve the same with the same conditions and then require that a new declaration be prepared and filed to contain the conditions required by the. Planning Board. Yours very truly, ROBERT W. TASKER RWT :aa CORWIN AND GLICKMAN ATTORNEYS AT LAW 114 MAIN STREET GREENPORT, N. Y. 11944 TELEPHONE 516 . 477-0800 STANLEY S. A cursory review of the properties indicate that the availability of suffi- cient potable water for the map designated as Old Town Park at Southold is questionable and should require a test well prior to approval for home con- struction. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no. significant adverse effects to the environment were likely to occur should the project be implemented as planned; The NYSDEC has no object to the project as it does not appear that the project lies within the jurisdiction of the Tidal Wetlands Act due to distance of tidal watery The Suffolk County Department of Health Services has stated .that it is expected that the conditions will be suitable for water supply and sewage disposal; The project will meet all requirements of the Code of the Town 'of Southold Subdivision of Land regulations. Schul ze, S cretary Southold Town Planning Board enc. Planning Boar . -4 ' March 2 1979 The Southold Town Fire District Officers Association would like to recommend the following changes and additions to the regulations for Subdivisions pertaining to requirements for firewells for your consideration. Eliminate the number of dwellings required for each firewell. The determination as to the need for fire protection should. be at the discretion of the fire district involved. Location of firewells should be determined by the Officers of the Fire District. A map of the proposed subdivision should be sent to the Commissioners of the Fire District. The Fire District will respond within 30 days as to the need of firewells. The well should be at least 8 inch minimum, 20 foot stainless steel screen minimum, mesh to be determined as to type of strata encountered, should produce 350 CPM. Final testing and approval by the Board of Commissioners with notifications of acceptance to the Planning Board. Thank you for consideration and cooperation. /s/ Henry F. Moisa, Secretary 1-1r. Raynor feels that this should be taken under consideration as well as some of the ideas that were worked on in January and sit down with the Tozm Attorney soon and work out what should be -out in the Code. The decision of where the fire hydrants and/or firewells should be has to come from the Planning Board but the Fire Commissioners have more experience and the Board should try to utilize their suggestions and recommendations. Mr. Wall was asked how this would affect Fishers Island and he said they go overboard and had the equipment to take care of this and wouldn't , be in need of fire hydrants or firewells. Charles Witherspoon minor subdivision. Stanley Corwin, Esq. appeared. Both lots are oversized so the board would require restrictive fi covenants so there would be no application for resubmission. Mr. Corwin was asked if there would be any objection to a covenant that there be no further subdivision of the parcel directly to the west of number 1. Tyr. Corwin said he didn't feel he could y make that representation foi/the owner. Then he said he could give a covenant not to subdivide the adjacent piece. Flacke May 21, 1979 Muriel Brush Town of Southold Planning Board Main Street Southold, New .York 11971 . Dear Ms. Brush: We have received your letters requesting lead agency status for the projects listed below. We have no objections and are listing our comments for each below: 1. Minor subdivision of Old Town Park at Southold, Catherine Bitsis -- This project may lie within State jurisdiction under the Tidal Wetlands Act as it appears to lie within 300' of tidal wetlands. We note that each of the lots meets the minimum 4.0,000 sq. ft. requirements. We will make further review on receipt of application. 2. Minor subdivision of Peter Sledjeski, Orient -- It does not " appear that this project lies within the jurisdiction of the ,Tidal Wetlands Act due to distance from tidal water and ele- vation. 3. Minor subdivision of Charles Witherspoon, Southold -- It does not appear that this project lies within the jurisdiction of the Tidal Wetlands Act due to distance of tidal water. 4. Minor subdivision of Thomas & Jean Jones, Wickham Creek, Cut- chogue -- As this parcel lies on the tidal body of water, a tidal wetlands application will be required from this Depart- ment. We note that the parcels being created are both comprised of a minimum of 40,000 sq. ft. when further development ,of this property must be in compliance with the development restrictions of the Tidal Wetlands Act.
