Box 728 Southold, New York 11971 APRIL 24, 1986 7: 30 P.M. - REGULAR MEETING The Regular Meeting of the Board of Town Trustees was held on April 24, 1986 at the Town Hall, Main Road, Southold. President Smith opened the meeting. at 7: 30 P.M. Present were: President Henry P. Smith Vice President John M. Bredemeyer, III Trustee Ellen M. Larsen Trustee Phillip J. Goubeaud Trustee Albert Krupski Clerk Ilene Pfifferling Bay Constable Don Dzenkowski Trustee Smith advised that the next regular field inspection will be held on May 22, 1986 and the next regular meeting will be held on May 29, 1986 to commence at 7: 00 P.M. Moved by Trustee Larsen seconded by Trustee Bredemeyer it was RESOLVED to APPROVE the JUNE 1986 Mooring. Renewals. Vote of the Board: Ayes: All This resolution was declared duly adopted. Trustee Smith gave the Monthly Report as follows !for March 1986: Application Fees $40. 00, Dock & Ramp Fees $126 . 75, Wetland Inspection Fees $20. 00, Wetland Application Fees $950 . 00 and Mooring Renewal Fees $220. 00 for a total of $1 , 356 . 75. Trustee Smith advised that the Public Notices, were posted on the bulletin board for the public to review. We will continue with the Communications. 1 . Helmut Spitzenberger regarding property located at 560 Gull Pond Lane, Greenport. I believe this has to do with Mr. Larry Tuthill and Mr. Terry Latham of the same address. Mr. Helmut Spitzenberger appeared before the Board in regard to this matter. Royal Gifford, Laughing Water Property Owners Association, Inc. regarding a request for a determination on the need of a Wetland Permit. The Trustees will inspect this property during their inspections on May 22 , 1986 . 8 . Frank Kujawski, Jr. requesting to withdraw a request for a waiver on behalf of Mr. & Mrs. Joseph Duggan, Snug Harbor Road, East Marion. 9. Robert Costanzo requesting a waiver of the Wetland Ordinance for removal of tree stumps and to clean up the remains of. Hurricane Gloria, New Suffolk Ave. , Mattituck. The Trustees have inspected this property and a wetland permit will be required for this work. 10. Fredrica Wachsberger, Chairperson, Committee for the Preservation of Hallock' s Bay regarding Wetland Application No. 373 for Alexander Koke on Narrow River, Orient. 11. James Redman, N.Y.S.D.E.C. regarding Uncertified Shellfish Lands. 12. Charles A. Mebus regarding road run off into Jockey Creek, Southold. We have spoken to the Highway Dept. regarding the drain that runs into the creek, and they are going to clean this area out, where it has shoaled up in the creek. 13. Glenn Just, Land Use Company regarding the application for Phillip L. Friscia. 14. Jerrold H. Mulnick, Senior Regional Shellfish Specialist Dept. of Health and Human Services, Food & Drug Administration regarding New York Shellfish Sanitation Program Appraisal. 15. Simon Weston, President, Cleaves Point Property Owners Association regarding property on Maple Lane, Greenport. 16. Richard Mot •=schinbacher regarding wetland application no. 336 . Board of Trustees -. April 24, 1986 - Page 3. 17. Michael J. Hall, Esq. on behalf of Gerard Gallian. Mr. Hall appeared before the Board regarding the application submitted for Mr. Gallian and it was determined that Mr. Gallian will have to remove the garden on his property that is adjacent to the creek..and restore that portion of the property to it' s natural state. 18. Southold Town Baymen' s Association regarding the Southport Project. 19. Stephen Shilowitz, A. I.A. requesting an extension on his wetland permit. Moved by Trustee Bredemeyer seconded by Trustee Goubeaud it was RESOLVED to APPROVE the extension requested for Mr. Shilowitz for a period of six months, permit will expire-on November 26, 1986 . Vote of Board: Ayes: All 20. Henry E. Raynor, Jr. regarding the Richard Cantwell application. Mr. Raynor sent a letter advising that Mr. Cantwell was agreeable to dredge no more than three feet. Trustee Smith: We will proceed with our resolutions until 8 : 00 P .M. Albert will you take number one? 1. ALBERT ROKE - LEAD AGENCY DECLARATION Moved by Trustee Krupski seconded by Trustee Bredemeyer it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Albert Roke for a Wetland Permit on certain property located on 2955 Wells Ave. , Southold. 1 . Vote of Board: Ayes: All This resolution was declared duly adopted. 2 . JOHN A. BERTANI - PERMIT EXTENSION Moved by Trustee Larsen seconded by Trustee Krupski it was RESOLVED to APPROVE the request made by John A. Bertani to amend his permit no. 1684 in Goose Creek, Southold to reflect a 6 ' x 20 ' floating dock, as recommended by his contractor to accommodate his boat. 2 . Vote of Board: Ayes: All This resolution was declared duly adopted. 3. BERNARD 0. ..& ELEANOR I. MONSON - PERMIT EXTENSION Moved by Trustee Smith seconded by Trustee Larsen it was RESOLVED to Approve the extension on the Wetland Permit No. 183 on behalf of Bernard 0. & Eleanor I . Monson said permit will expire on OCTOBER 25 ..- 1986 . 3 . Vote of Board: Ayes: All This resolution was declared duly adopted. 4. JAMES C. MCMAHON - PLACEMENT OF SCALLOP STRUCTURES Moved by Trustee Bredemeyer seconded by Trustee Goubeaud it was RESOLVED to APPROVE the request made by James McMahon, Administrator of Southold' s Community Development Office to place two structures Board of Trustees - April 24, 1986 - Page 4 . in Little Bay and two structures off Brown' s Point, Hallocks Bay and to place an on/off stake at Narrow River to monitor the Bay Scallop grow out- activities. 4. Vote of Board: Ayes: All This resolution was declared duly adopted. 5 . ROSE SAHM - MOORING APPROVAL Moved by Trustee Goubeaud seconded by Trustee Larsen it was RESOLVED to APPROVE the mooring application for Rose Sahm of Hill Road, Southold to place an offshore mooring (150 Lb. ) in Town Creek, Southold. 5. Vote of Board: Ayes: All This resolution was declared duly adopted. 6. MARK GORDON MOORING APPROVAL Moved by Trustee Krupski seconded by Trustee Goubeaud it was RESOLVED to APPROVE the mooring application for Mark Gordon to take over a mooring previously used by Alec Elak in Richmond Creek, Southold. 6. Vote of Board: Ayes: All This resolution was declared duly adopted. 7. JANET MADDAMS - EXTENSION ON PERMIT Moved by Trustee Smith seconded by Trustee Krupski it was RESOLVED to APPROVE the request made by Costello Marine Contrac- ing Corp. on behalf of Janet Maddams for an extension on her Permits 170 and 2072 for a period of six months. Said permits will expire on October 24, 1986 . 7. Vote of Board: Ayes: Trustee Smith, Bredemeyer, Krupski, Goubeaud Abstain: Trustee Larsen - This resolution was declared duly adopted. 8 . EDWARD J. ZIMNOSKI - MOORING APPROVAL Moved by Trustee Larsen seconded by Trustee Krupski it was RESOLVED to APPROVE the mooring application for Edward J. Zimnoski to place an on/off stake in Mattituck Creek, Mattituck. 8. Vote of Board: Ayes: All This resolution was declared duly adopted. 9. JOHN B. BRUSH, JR. - MOORING APPROVAL Moved by Trustee Bredemeyer seconded by Trustee Krupski it was RESOLVED to APPROVE the mooring application for John B. Brush, Jr. to place an offshore mooring in Mattituck Creek, Mattituck. 9. Vote of Board: Ayes: All .'This resolution was declared duly adopted. 10 . JANET FURST - MOORING APPROVAL Moved by Trustee Goubeaud seconsed by Trustee Larsen it was RESOLVED to APPROVE the mooring application for Janet Furst to place an offshore mooring in Little Creek, Cutchogue. 10. Vote of Board: Ayes: All This resolution was declared duly adopted. Board of Trustees - April 24, 1986 - Page 5 . 11. SIDNY OLMSTED Moved by Trustee Krupski seconded by Trustee Goubeaud it was RESOLVED to APPROVE the application for Sidny Olmsted to place two spiles in Mattituck Creek, Mattituck, with the provision that if there is a problem with navigation, deter- mined by the Bay Constable, that one spile will be removed. 11. Vote of Board: Ayes: All This resolution was declared duly adopted. 12 . STEPHEN W. O 'LEARY Moved by Trustee Larsen seconded by Trustee Goubeaud WHEREAS, the Board members have personally viewed the property located at 770 Old Salt Road, Mattituck and are familiar with the premises in question and the surrounding area; and WHEREAS, the Board has-considered all tle documentation submitted concerning this request: and WHEREAS, the Board made the following findings of fact: 1. By this request, appellant requests a waiver of Chapter 97 from the Code of the Town of Southold to construct a 17. 6 x 25 ' attached deck to the existing residence. 2. The subject property is located on the Map of Property located in Mattituck; more particularly known on the Suffolk County Tax Map Designation: Dist. 1000, Section 144, Block 5-14 In considering this request, the Board finds and determines 1. The project as proposed will not adversely affect the Wetlands of the Town. 2 . The project as proposed will not adversely affect the health Safety and general welfare of the people of the Town. NOW, THEREFORE, BE IT RESOLVED that Stephen W. O 'Leary be and hereby is granted a WAIVER of the Wetland Ordinance for the construction of a 17 . 6 ' x 25 ' attached deck on premises located on 770 Old Salt Road, %Mattituck, New York. 12. Vote of Board: Ayes: All This resolution was declared duly adopted. 13. ETHEL & ARTHUR TOAN - LEAD AGENCY DECLARATION Moved by Trustee Smith seconded by Trustee Bredemeyer it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Ethel & Arthur Toan for a Wetland Permit on certain property located on Rush Lane, Southold. 13 . Vote of Board: Ayes: All This resolution was declared duly adopted. 14 . LOUISE MOYLE - LEAD AGENCY DECLARATION Moved by Trustee Bredemeyer seconded by Trustee Larsen it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Louise Moyle for a Wetland Board of Trustees - April 24, 1986 - Page 6 . permit on certain property located on 1820 Minnehaha Blvd. , Southold. 14. Vote of Board: Ayes: All This resolution was declared duly adopted. 15 . HELMUT SPITZENBERGER - LEAD AGENCY DECLARATION Moved by Trustee Goubeaud seconded by Trustee Larsen it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Helmut Spitzenberger for a Wetland Permit on certain property located on Gull Pond Lane, Greenport. 15. Vote of Board: Ayes: All This resolution was declared duly adopted. 16. JOSEPH DUGGAN - LEAD AGENCY DECLARATION Moved by Trustee Larsen seconded by Trustee Goubeaud it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Joseph Duggan for a Wetland Permit on certain property located on Snug Harbor Road, Greenport. 16. Vote of Board: Ayes: All This resolution was declared duly adopted. 17. LONG ISLAND LIGHTING CO. , JOHN A. WEISMANTLE, VICE-PRES. Moved by Trustee Krupski seconded by Trustee Goubeaud it was RESOLVED that the Southold Town Trustees DECLINE DECLARING THE LEAD AGENCY in regard to the State Environmental Quality Review Act in the matter of the application of John A. Weismantle, Vice- President on behalf of the Long Island Lighting Co. for a Wetland Permit on certain property located on Island View Lane, Greenport to Rocky Shore Road, Shelter Island. 17. Vote of Board: Ayes: All This resolution was was declared duly adopted. 18. MARY DEMARTINO - LEAD AGENCY DECLARATION Moved by Trustee Larsen seconded by Trustee Smith it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Mary DeMartino for a Wetland Permit on certain property located on Willow Terrace Lane, Orient. 18. D.E.C. requesting an inspection and recommendations regarding this proposal. 28. VOTE OF BOARD: AYES: ALL THIS RESOLUTION WAS DECLARED DULY ADOPTED. 29.
