SOUTHOLD TOWN BOARD

WORK SESSION

9:10 A.M. - Superintendent of Highways Raymond L. Jacobs met with the Town
Board to discuss the . possible. termination of the contract with All American Fuel
--- Company --for. supplying- gas- and diesel products- to the -Town.- -.They- have---failed.- to_____ _.
meet the eight hour delivery requirement in each instance an order has been placed.
Supervisor Wickham and Town Attorney Dowd met with the owner of the company,
Ivan. Kovac, prior to this meeting, and Mr. Kovac would like to amend the response
time to 24 hours. Town Attorney Dowd said the bid specifications do specify eight
hours, but they could take the position that it would not be a breach until 24
hours. Some of the Board members, having reviewed the facts of the situation as
Presented by Superintendent of Highways Jacobs, expressed the opinion that the
contract should be rebid, and no further considerations given to All American.
Supervisor Wickham asked Mr. Jacobs to give them a trial of eight to .24 hours and
provide a set delivery schedule, and if that is breached, rebid. The Town Attorney
will send All American a letter setting forth these conditions.---Superintendent of
.Highways Jacobs then discussed the need for an equipment bond for the purchase
of a payloader (to replace a 14 year payloader) , and a street sweeper (to replace
a 27 year old street sweeper) . Mr. Jacobs advised the Board that the bond would
not increase his budget. A resolution, no. 16, was placed on the regular meeting
agenda authorizing the $185,000 Equipment Bond.
9:30 A.M. - Jeanne Ruland, Data Control Supervisor, met with the Town Board to
bring them up to date on the proposed Building Department new computer software
upgrade. The new software will have more fields to store information, the ability
to computerize records that are currently manually recorded, the ability to produce
permits and_ other, _forms,- calculate fees, as well as the entry_ and _maintenance of
subdivision' .information, variances, construction information, a reminder file and
reports for follow-ups, to name a few. The funds for this upgrade has already been
established in the 1994 Budget. Senior Building Inspector Tom Fisher, also in
attendance during this presentation, indicated that he is anxious to see the system
installed. Ms. Ruland also presented to the Town Board a breakdown of the Central
Data Processing 1994 Budgeted Expenditures, a copy of which is on file in the Town
Clerk's Office.
9:45 A.M. - Councilwoman Hussie led a discussion on a proposed resolution to
'approve the Updated Solid Waste Management Plan, and submit same to the DEC for
approval. The Board reviewed parts of the Executive Summary and agreed that they
would be satisfied to transmit the plan with one or two modifications which will be
drafted by Supervisor Wickham (resolution no. 17 to approve the SWMP was placed
on the regular.. meeting agenda) . The Board then discussed the possibility of having
the transfer station plans of Ovirka E Bartilucci reviewed by other engineers to
determine if there is a less expensive direction than the one proposed by D&B.
Supervisor Wickham will look into the cost of obtain the services of other engineers
and report back to the Town Board on March 8th.

10:25 A.M. - Discussion on a proposed new "floating shopping center overlay zone"
within the general business district, and provisions for formula food restaurants;
- - both proposals of Supervisor Wickham. -Senior Planner Valerie- -Scopaz;--also in - -
attendance during this discussion, said the shopping , center zone must be carefully
defined, and distributed information from a "Shopping Center Development
Handbook". Councilwoman Hussie stated that she feels left out of the process, and
would like to be included in on the process from the beginning. Supervisor Wickham
said what the Town Board has before them is his proposal. There have been no
meetings with other people, and his proposal is an initial step to bring the issues
to .the Town Board and get things moving. In -reviewing the proposal, the -Board
members agreed that yes, the three steps: (1) Definition of formula-food
restaurants, (2) New zoning district, (3) Zones for Formula-food restaurants, is
the direction they would like to go. Councilman Townsend said that this should be
taken up by the Planning & Zoning Committee, and he will be calling a meeting very
shortly.---The Board next discussed a slight change in the specifications for the
generic directional signs, agreed to the amendment, and placed resolution -no. 18
on the regular meeting agenda.
10:55 A.M. - Discussion with regard to the possible purchase, from the County of
Suffolk, of a parcel of park and playground property on Bridge Lane, Cutchogue.
Councilwoman Hussie objected to the purchase of the property, citing 15 other
County owned parcels in the Town of Southold, and questioned why they have not been
offered for sale. It was believed that the taxes on this parcel have not been paid
for so many years, and it has now reached the point where 'it is to be auctioned, and
_-_ the Town.. has been offered.. the parcel for -the unpaid taxes. Councilman Townsend
said he feels the Town should acquire it, as it abuts a parcel where the County has
acquired: the development rights. Resolution no. 19 was placed on the agenda to
purchase.
11 :10 A.M. - Supervisor Wickham presented a proposal to the Town Board for the
reduction of the number of Stewardship Task Force hamlet meetings. Initially five
separate meetings were proposed. Now the Task Force has advised him that they
feel unequal to the task of putting on five separate events; it would put a serious
burden on relatively few shoulders. They would like to hold one meeting instead.
Supervisor Wickham proposes two meetings, one in Mattituck and one in Greenport,
and Tom Samuels, Chairman of the Task Force feels that would be manageable and
a good compromise. - Councilman Lizewski expressed the opinion that all hamlets are
different and due to the magnitude of the survey, he feels the five meetings that
were planned initially should still be held. Councilman Townsend suggested having
the two sites, but setting aside specific times for discussions on the different
hamlets. Councilwoman Hussie said that the Stewardship Task Force started out with
19 members,. and that has been reduced to about 11 people who actually attend.
She said she.would agree to two meetings, but if in the conduct of the meetings . it is
found there is a need for additional meetings, that should be addressed immediately.
11 :25 A.M. - Councilman Lizewski brought before the Town Board a discussion on
the abolishment of strip malls. He said strip malls have stripped hamlet business
areas of a certain amount of.- business. He asked when -does a -strip-.-mall become a"
shopping center? It was agreed that this subject should be put on the Planning
S Zoning Committee meeting agenda for discussion.
11 :30 A.M. - Supervisor Wickham brought before the Town Board proposals with
regard to Youth: (1) Move to carry out a Youth Activities Exposition, (2) Move
to establish a committee structure; (3) Move to create a part-time position of youth
coordinator. Councilman Townsend advised the Board that with regard to the Youth
Expo, he has a group of people who are providing an inventory of youth activities
in the Town. On the subject of committees, Supervisor Wickham stated he is now
having reservations about the need for two committees. Councilwoman Hussie stated
that youth has been an ongoing subject since the beginning of the year. Why not
let it sit for a while instead of trying to nail it down so quickly. Councilman
Lizewski told the Board that there are people in the community who have formed
youth groups and leagues and stuck with them. These are the base of the
structure. Councilwoman Oliva said she still believes there is a need for an Expo to get
things off the ground. It was the consensus of the Board to move ahead with the
Expo, and eventually the formation of only one committee which would fall into place
as a result of the Expo. With regard to the part-time youth coordinator position,
Supervisor Wickham explained his proposal for the terms of the position, and the
need to move ahead. Councilwoman Hussie said she would like to look at the position
after the Expo. Councilman Lizewski said he agrees with the concept, but believes
- the position can-be- -filled- by someone who is already -running -a--league-or- activi-ty"-- -
in town, and would work for less than the proposed $500.00 a month. Supervisor
Wickham suggested that a committee be formed who would put on the Expo, and by
March 8th would like to discuss progress on the Expo, and the formation of a
committee. He asked that Town Board members submit suggested members to him
as soon as possible.

12:25 A.M. - Recess for lunch.
1 :45 P.M. - Personnel matters: (1) Request from Scott A. Russell, Chairman of
the Board of Assessors, for a $25.00 raise, from $100.00 a day to $125.00 a day for
John Sherwood, Consultant to the Board of Assessors. It was discovered the
proposed increase. was not included in the 1994 Budget. Mr. Russell will be asked
to provide the Board with justification for the raise. (2) The Board agreed upon
the promotion of Building Inspector Thomas Fisher to Senior Building Inspector (see
resolution no. 20) . (3) Board agreed to the creation of the position of Personnel
Assistant (see resolution no. 21) . ' (4) Discussed with Senior Building Inspector
Fisher the need for additional full-time clerical help in the Building Department.
The concept of a full-time temporary Data Entry Clerk was considered. However,
it was discovered that it would probably be six to eight months before there would
be a need for such a person. It was finally decided that Supervisor Wickham would
call for a Clerk Typist civil service list. (5) Proposed resolution establishing a
minimum annual salary base of $20,000 for all newly elected or appointed officials
to be eligible for coverage under the Town of Southold's Employee Health Benefit
Plan (see. resolution no. 22) . Supervisor Wickham asked the Board to consider
permitting employees with a lesser base to pay the premium themselves and be
included in the Town's plan. (6) Proposed resolution to adjust the number of days
worked as reported for former Town Justice Raymond W. Edwards (see resolution
2:40 P.M. - 'The Board had a lengthy discussion on current policy decisions, -and
after making certain amendments, placed four of them on agenda for reaffirmation
(see resolution no. 24) .
3:15 P.M. - Receipt of the environmental review, from Cramer, Voorhis S Associates,
of the Roy A. E Joanne K. Schelin application for a transfer station on Cox Lane,
Cutchogue. The Board agreed an appointment should be ' arranged on other than
a Town Board day to meet with Mr. E Mrs. Schelin and their agent.---The Board re-
viewed the request of Detective Beth Wilson to attend a conference, and placed
resolution no. 25 on the agenda to approve same. They. also placed resolution no.
26 on the agenda granting permission to Building Inspectors Gary Fish and - John
Boufis to attend a conference.
3:30 P.M. - The Town Board met with Mr. Donald L. Rieb, Aid to the ,
Developmentally Disabled, Inc., to discuss the proposed group home on Greton
Court, . Mattituck. Mr. Rieb advised the Board that it would be a home for four
mentally retarded adults. It is a beautiful home on beautiful grounds, with the need
for minimal amount of rehabilitation as determined upon examination by an architect.
He said the fact it is not .near the hamlet shopping center is not a problem, nor a
factor. The residents are provided with transportation, they go to shelter
workshops- during-the--day- --have -24 hour -supervision, a--resident- manager--with an----- - -
awake staff person during the night. Eric Bressler, Esq. , representing residents
on Greton Court, made a presentation to the Town Board, indicating that residents
of Greton Court are ready to assist the Town Board in finding another site, and
think they can make superior suggestions. Supervisor Wickham reviewed his
proposal for forming a site selection committee, and outlining. a proposed charge (see
resolution no. 27) . The first meeting was scheduled for 10:00 A.M. , Tuesday,
March 1st, and it was agreed the committee should have a report by March 18th.
4:15 P.M. - The Town Board reviewed the proposed resolutions to be voted on at
the 4:30 P.M. regular meeting.

A Regular Meeting of the Southold Town Board was held on February 24, 1994,
at the Southold Town Hall, Main Road, Southold, New York. Supervisor Wickham
opened the meeting at 7:30 P.M. , with the Pledge of Allegiance to the Flag.

SUPERVISOR WICKHAM: I'd like to briefly summarize the policies, and you'll be
hearing them later on, that the Board operates under, and one of those policies
calls for an opportunity for the public to address the Board on any issue, or. issues
that are of concern to on the resolutions that we will be enacting. I think you
have a copy of the agenda that lists all those resolutions. We're asking people
to keep their comments within five minutes on those comments. Similarly, after the
meeting, opportunity is also there for people to comment on any other matter, that
they wish to bring to the attention of the Board after the resolutions have been
adopted. We'd also like to keep those comments brief, and to the point. Having
gone over that, we have some regular business to undertake tonight in connection
with the routine things, that the Board does. We have a series of resolutions,
that are up for a vote, and we have some comments from the Board, and from the
public at the end. So, if I can begin with some of the regular business that the
Board undertakes. There are no public hearings this afternoon. Joe, would you

to bring to your attention, and we have twenty-nine resolutions, and perhaps,
Joe would like to begin with the first one. Are there people in the public, who

RESOLVED that the Town Board. of the Town of Southold hereby grants permission
to Recreation Supervisor Kenneth Reeves to' attend the New York State Recreation
and Park Society Conference to be held from April 17 through 20, 1994, at The
Nevele Resort and Country Club, Ellenville, New York, and the actual expenses
for meals, lodging, registration, using' a town vehicle for travel, shall be a legal
charge to A7020.4, Recreation Administration, Contractual Expenses.

and 2:00 P.M., provided they file with the Town Clerk a One Million Dollar

RESOLVED that the Town Board of the Town of Southold hereby accepts the
$97,070.00 certified check from The Freidberg Partnership as a bond for roads,
and improvements in the major subdivision of "West Mill", Mill Road, Mattituck,
_-- which amount was approved -by the Town Board on April 20, 1993; and be it
FURTHER RESOLVED that the Town Clerk be and she hereby is authorized and -
directed to place the check in an interest bearing savings account.

Assistance for the proposed Environmental Assessment for Airport Development
for Elizabeth Field Airport, Fishers Island, all in accordance with the approval
of the Town's Consultants CES Engineers, Inc.

Section 1 . The Town of Southold, in the County of
Suffolk, New York (herein called "Town" ) , is hereby authorized to
purchase, for use by the Town Highway Department, (i) a three yard
Payloader at the estimated maximum cost of $78 , 500 and (ii)
Street Sweeper at the estimated maximum cost of $106 , 500 . The
estimated total cost of both items of said specific object or
purpose, including preliminary costs and costs incidental thereto
and to the financing thereof, is $185, 000 and said amount is herebv
appropriated therefor, including the appropriation of the proceeds
of sale of the Town' s existing Model 60 International Harvester
Payloader and Mobile Street Sweeper hereby authorized to be applied
to such costs . The plan of financing includes the issuance of
$185, 000 serial bonds of the Town to finance said appropriation,
the application of such proceeds of sale to payment of such costs ,
or to payment of the principal of and/or interest on said bonds or
any notes issued in anticipation of said bonds, and the levy and
collection of taxes on all the taxable real property in the Town to
pay the principal of said bonds and the interest thereon as the
same shall become due and payable .

Section 2 . Serial bonds of the Town in the principal
amount of $185, 000, are hereby authorized to be issued pursuant to
the provisions of the Local Finance Law, constituting Chapter 33 -a
of the Consolidated Laws of the State of New York (herein called
"Law" )-, .to finance said appropriation.
Section 3. The following additional matters are hereby
determined and declared:
(a) The period of probable usefulness of each item, of
said specific object or purpose for which said $185 , 000 serial
bonds authorized pursuant to this resolution are to be issued, .
within the limitations of Section 11 . 00 a. 28 of the Law, is hereby
determined to be five (5) years .

(b) The proceeds of the bonds herein authorized and any
bond anticipation notes issued in anticipation of said bonds may be
applied to reimburse the Town for expenditures made after the
effective date of this resolution for the purpose or purposes for
which said bonds are authorized. The foregoing statement of intent
with respect to reimbursement is made in conformity with Treasury
Regulation Section 1:103-18 of the United States Treasury
Department .
(c) The proposed maturity of the bonds authorized by
this resolution will not exceed five (5) years .
Section 4 . Each of the bonds authorized by this
resolution and any bond anticipation notes issued in-'ariticipation
of the sale of said bonds shall contain the recital of validity as
prescribed by Section 52 . 00 of the Law and said bonds and any notes
issued in anticipation of said bonds, shall be general obligations
of the Town, payable as to both principal and interest by general
tax upon all the taxable real. property within the Town without
limitation of .rate or amount . The faith and credit of the Town are
hereby irrevocably pledged to the punctual payment of the principal
of and interest on said bonds and any notes issued in anticipation
of the sale of said bonds and provision shall be made annually in
the budget of the Town by appropriation for (a) the amortization
— - and redemption, -of -the- bonds and any notes in anticipation the-reo- -
to mature in .such year and (b) the payment of interest to be due
and payable in such year.

Section 5 . Subject to the provisions of this resolution
and of the Law and pursuant to the provisions of Section 30 . 00
relative to the authorization of the issuance of bond anticipation
notes and of Section 50 . 00 and Sections 56 . 00 to 60 . 00 of the Law,
the powers and duties of the Town Board relative to authorizing
bond anticipation notes and prescribing the terms , form and
contents and as to the sale and issuance of the bonds herein_
authorized and of any bond anticipation notes issued in
anticipation of said bonds, and the renewals of said bond
anticipation notes, are hereby delegated to the Supervisor, the
chief fiscal officer of the Town.
Section 6 . The validity of the bonds authorized by this
resolution and of any notes issued in anticipation of the sale of
said bonds, may be contested only if :
(a) such obligations are authorized for an object or
purpose for which the Town is not authorized to
expend money, or
(b), the provisions of law which should be complied with
at the date of the publication of such resolution_
are not substantially complied with,
and an action, suit or proceeding contesting such validity, is
commenced within twenty days after the date of such publication, or
(c) such obligations are authorized in violation of the
provisions of the constitution.
- Section- -7 . -.- This - bond resolution shall -take effect
immediately and the Town Clerk is hereby authorized and directed to
publish the foregoing resolution, in full , together with a Notice
attached in substantially the form prescribed by §81 . 00 of the Law,
in "THE LONG ISLAND TRAVELER-WATCHMAN, " a newspaper published in

Southold, New York, and the "SUFFOLK TIMES, " a newspaper published
in Mattituck, New York, each having a general circulation in t:he

RESOLVED that' the Town Board of the Town of Southold hereby authorizes the
purchase, from the County of Suffolk, a parcel of park and playground property
(1000-84-1-6.18) , for the unpaid property taxes in the approximate amount of
$480.00.
COUNCILMAN TOWNSEND: That resolution is slightly misleading, because since
the County has bought it, and stripped it, basically there is no park or playground
use of the property. Anybody that buys it could put a house on it. The original
intent was that it be park and playground property, but it went for taxes, because
the Board's policy was not to accept dedication of that kind of property, property
that was set aside for park and playground from developers at that time. That's
created a problem in that the taxes don't get paid sometimes, and the County sells
the property to the bidder after offering it to the Town. We've been offered this
property for $480.00, and' it looks like it's. something that we should control. It's
adjacent- to a-farm;-. than has the development rights preserved; -provides a buffer- - -
between a series of houses, that are adjacent to that farm, and it may well be a
good location for part of a bike path, because it's seems to connect a couple of
main streets. So, that's basically the story behind this resolution.

COUNCILWOMAN HUSSIE: A bit of explanation at this point. This does not mean
we're hiring another person, but actually giving the title to a job that is being
done. This is' somebody in the Accounting Department, who does more work for
personnel than anything else, and it more closely describes her duties here in
Town Hall.

System for the same period; and
WHEREAS, days worked reported to the Retirement System do not appear to
reflect Mr. Edwards' dual role as Fishers Island Town Justice and Councilman for
the period of January 1 , 1982 to December 31 , 1986; and
WHEREAS, the Town Board has reviewed a typical month of service to determine
the number of days per month which should have been reported for Raymond W.
Edwards and has determined that said days reported should have been 18.67 per
month for the period of January 1 , 1982 to December 31 , 1986; now, therefore,

Accounting &- Finance Department to adjust the number of days worked as

SUPERVISOR WICKHAM: It's the practice of the Town Board to adopt a series
of policies that govern the procedures, and the way in which the Board operates.
We normally do this from the Organizational Meeting of the year. This time we are
adopting these policies from time to time throughout the year. This afternoon we
- have four of these-policies to be adopted-, and I would--just-like--to read- them over.- -- -
quickly. First is the policy on discussions with other Boards of the Town. This
is substantially the same as it was last year. The policy with respect to Town
Board Work Sessions, this is a modest change in that formerly a particular time
of day was given for Town officials to do that, Town employees to do that. The
third policy with respect to speaking at public hearings, there is no change in
that policy. Lastly, with respect to domicile in the Town of Southold, this has
a modest change in that formerly we would require the person to relocate to the
town within 60 days. Now, we are encouraging it.

amends the following Town Board Policy Decisions:
POLICY ON DISCUSSIONS WITH OTHER BOARDS OF THE TOWN
RESOLVED that the Town Board of the Town of Southold hereby establishes the
policy that the Town Board will not discuss matters which are properly in the
province or the discretion of the Planning Board, Board of Appeals, or Town
Trustees concerning applications pending before those boards, unless the Supervisor
shall decide, after consulting with the Town Attorney, and the applicable board,
that special circumstances exist which justify a waiver of this policy.
POLICY WITH RESPECT TO TOWN BOARD WORK SESSIONS
RESOLVED that the Town Board of. the Town of Southold hereby establishes the
- policy--that- henceforth Town- personnel shall have priority in.-addressing- the Tow_ n_
Board Work Session.
POLICY WITH RESPECT TO SPEAKING AT PUBLIC HEARINGS
RESOLVED that the Town Board of the Town of Southold hereby establishes the
policy that individuals shall be allowed a maximum of ten (10) minutes to address
the Town Board at a public hearing; written comments of any length, in response
to a public hearing, will be accepted by the Town Board at the hearing and shall
be made a part of the hearing file.

home; priority shall be given to finding a site in Mattituck; due consideration shall
be given to factors such as proximity to hamlet center, services, traffic, etc. ; and
finally, to recommend to the Town Board an optimum home, taking into consideration
the foregoing criteria; and be it further

agenda. This was put together at the last minute. It's a difficult problem, when
we have to have the afternoon meeting, to get everything on. This is one to relate
to the Land Preservation Committee, who's committee is down two people, and
we're advertising for. positions. We advertised. We got one name, and there's still
one more opening. The time to submit resumes has ended. So, whereas, the
responses to the ad _are insufficient to fill the number of vacancies on this Land
Preservation Committee, now, hereby extends for a period of one month the time
.within which applicants from within the town are invited to submit their resumes
for service on the Land Preservation Committee.

SUPERVISOR WICKHAM: That completes our business for this afternoon. What
would the public like to speak to the Board about tonight? Yes?
FRANK CARLIN: Frank Carlin, Laurel, representing the Carlin Watchdog Group.
I changed it from Committee to Group. I seen this in the paper, formula to limit
fast food restaurants. My comment this evening is to Councilwoman Oliva. Someone
told me about this, and I looked into it. I called Carmel , and I checked it out,
and I passed 'it1hrough the Planning Board. We got to travel 3,000 miles across
the country to listen to what somebody else is trying to tell us, an area where
there's rich people, very small, and try to compare that to Southold Town.
Come on, let's be reasonable about this issue here. I think it sizing up when a
woman said, a Planner out there, when she said Burger King,. or McDonald's will
not want to come into this town. We're very tiny. We have no strip zoning. We're
only one square acre, one square mile, and one square mile, if you look at it,
is 640 acres. Behind my house there's only 350 acres, and it's not very much.
When you look at it in square feet it's 43,560 square feet, so comparing the Town,
and you get the-Planning Board -on there, the people--on the- Planning -Board- must
be the amount of people living in town. How can you compare Carmel to Southold
Town and try to pass something like this through the people? Drive-in restaurants
will be changed to take-odt restaurants, according to Councilwoman Oliva, and
that leaves Burger King and McDonald's out of that category, because they, also,
offer eating on the premises. Well, if you're going to pass that rule only t6ta-ke:ou
food, then you're going to have to look at a lot of restaurants in Southold Town,
because there's lot of restaurants in Southold Town, where you can take out food
and also eat it there. So, let's be fair out it. Councilman Townsend said something
here. He said, I don't think we can keep them out of the town. It's a constitutional
issue here, but we can make it so that they won't want to come in, and he, also,
said in here, that put it in a shopping center, there will be no parking space,
which he's right. How can you put a fast food restaurant in the ASP Shopping
Center, especially in the summer months, when you have a movies? You have a
drive-in bank. You have ASP. You have no traffic lights. You have no turning
lane. How can you want to say you want to have it rather in that area, rather
than have it isolated away? It don't make sense to me. We have enough fender
benders in there now, and accidents. You better use common sense on this issue
here. It's been going on now for three years. I'll be glad when it's over with,
one way or another. But to call California, using my tax money, speaking to some-
body that probably you never even seen. You don't understand what the area is,
and listening to them, to use that as a crutch to come up with something when
final.ly_ we'.re _so-_far_despera.te,_ _we're going to the ,bottom of the__barrel-on this
thing, we're got to go to California. I'm concerned now in the future, that when
we want to make decisions here we're going to calling all over the country, and
listen to everybody. else. Let's step up to the plate, make a decision, and live
with it. It's awful. You can't have it in a shopping area. There's no way you
can have it in a shopping area. I don't care what LaGrande says, or anybody
else. It don't work in this town. You even said so yourself. I listened to you
at the Work Session here, about we can't compare other areas with Southold,
because every areas unique. It's different. You can't make a comparison here.
There's no way you can do this, and let's limit it to 20,000 feet, 20,000 square
feet, excuse me. Twenty thousand square feet is not even a half acre. We
require to build on a residential lot two acres zoning. Let them rent or buy two
buildings, so you come in, and you want to open up a fast food, or whatever
restaurant in a shopping center, you're going to have to be required to rent two
buildings,which is expensive. I don't know what it is about this issue here. I'm
beginning to think, are we afraid of the competition here? That if this one
facility opens up, are we afraid of the competition? What are we afraid of here?
What is it going to do, this area? You going drop an atomic bomb here, or some-
thing? Don't use things like this, please. Don't go travel 3,000 miles, and try
to compare, because Clint Eastwood lives there. He doesn't make my day.

SUPERVISOR WICKHAM: Frank, would you like one of us to respond?
FRANK CARLIN : Yes, I know you're trying to keep me to five minutes. I know
you passed that new_law. Now_ you have a reason to pass it, and I know why you're_
passing it, because you don't want to listen. You think it's too hot. Like President
Truman once said, if you can't stand the heat, stay out of the kitchen. One more
thing I want to say to you, Tom, if you don't mind. Give me another three seconds.
A while back you said, you had no problem with a fast food restaurant provided
it meets the Planning Board, and the Zoning Code rules. But, now all of a sudden,
you're for changing it to eliminate it here. Now, you're changing it around, now.
Before through the rules we have, you were quoted, providing it met the Zoning
Code, and the Planning Board, which in my opinion it does. But, now you want
to pass a formula restaurant bill, that will change that .around, if you won't be here.
think you're flipping over, Tom. You're changing.
SUPERVISOR WICKHAM: Thank you, Frank. Does anyone from the Board like to
respond?
COUNCILWOMAN OLIVA: We would just encourage Mr. Carlin. There will notification
in the paper, that Mr. Townsend is having a Planning and Zoning Committee meeting,
and this whole subject will be discussed very thoroughly, and I think you'll better
understand where we're coming from, Frank. I don't think we're trying to outlaw
fast food restaurants. I think we're trying to put them in the proper prospective
of what Southold Town should look like. But, we're not going to outlaw them, but
I'd like to explain it to you at another time, when we can sit down at the table,
and talk about it, and I think you'll understand.
FRANK CARLIN: Mrs. Oliva, I'm saying that, putting it in a shopping center
is not the best thing.
COUNCILWOMAN OLIVA: I didn't say where we .were going to put it. I said in
the best area, Frank. Come and talk to us about it, when we can sit down at the
table in a conversational tone.
FRANK CARLIN: It seems to me everytime we run into a problem, the1 easy way
out is let's change the Zoning Code, instead of facing the facts, and making a
decision, and live with it.
COUNCILWOMAN OLIVA: Maybe we'll have to do both.
FRANK CARLIN: You'll probably have to.
SUPERVISOR WICKHAM: Thank you, Frank. Is there anyone else who would like
to address the Board on any subject?
WEST RUROEDE: My name is West Ruroede. i've-resided in this township for quite
some time. 'In case it's news to any of you I suffer from a mental disorder of some
sort. Thirty-two different psychiatrists are at a loss to figure out what my latest
diagn..osis: _is, and: b.a.ck when: 1 wa.s carted off to Green port H.osp_ital back on _November
9th, I went there because the hospital is always there when I needed it. I, after
a week without sleep, troubles, gee, . I just tossed and turned, and couldn't sleep
for ' a week. If you can believe that one. I went to the hospital, they sent for the
Town Police. I'm not a sick man. Ask those thirty-two psychiatrist who have heard
the story of what I survived in Riverhead Correctional Facility eleven years ago.
The fact of the matter is, I was tortured beyond belief. At the end of four days
without food, and three days without .water, I succumbed to the wishes of the
guards, and I consumed my own feces out of self survival. It was not a very
pleasant circumstance, and because I lived through it, each and every psychiatrist
I've seen since, has just passed the football. You're crazy. That never happened.
Come down to my office. I'll call the cops. Well, I've used the Freedom of Information
Laws as best I can, and I've written to Mr. Droskoski, the Chief of the Town Police
numerous: requests. I've lost track of them. Perhaps Mrs. Terry could have an
accurate number of the number of times I've walked in there and bothered her
.personnel for Freedom of Information. Well, my Freedom of Information to Chief
Droskoski is a number of tapes with Police radio transmission, and incoming calls
to the Police, and I'm sick and tired of it. I'm standing up here, not because I'm
crazy. I don't take their drugs anymore. Therefor I have no pseudwsanity, or any
other catch words for those who are mentally inclined. Anyway, dear Chief Droskoski
asked me to come in when I had a large number of Freedom of Information requests,
and, gee, he said, what's the problem? I said, hey, gee, it's people like you
stepping on me_every chance you can, and never defended me _when I try to file

reports, when it's a report against a man, who assaulted me in Joanthony's, pulled
my back out, send me to the hospital .the next day for shots and xrays, when dear
Chief of. Police Droskoski -is sitting on his hands as far as West Ruroede is concerned,
and always will. My request for twenty some odd tapes., useless. Chief Droskoski
is earning $90,000.00 to sit on his hands. He's doing a damn good job of it. I, for
one, Avv_e this area comparable to anyone in here, and I wasn't even born here.
I'd .love to. be a taxpayer some day. I'd like to sail on my license to work on any
ship in the free world,but.-until-.I- can conduct myself on land, I don't have a
chance. I'm here because the new Town Board has promised politics out the
window. People will come first. I'm hanging on by my toenails as best I can. I've
never hurt anyone other than myself. I'm not a threat to myself, or the general
public. I just stand up for what's obviously right, but, . when the Police cart me
off in straight jacket up to King's Park six times, like they have, oh well, West
is out of mind, out of sight, he won't bother you again. Well, I made it out in record
time. I've had it. I'm sleeping fast. Will someone from this Town Board, please,
acknowledge that Chief Droskoski has a responsibility to provide me with those
tapes that I've requested in the time to review these tapes. I'm not running off,
or running out of state, or running from justice. I'm going to stay here, and I'm
going waste your tax dollars, and I'm going to get some justice in one way or
another, and if I don't, well, I'll have to take a little boat ride. I'll sit here, and
see if anyone can give me a answer for this one, aside from the Town Attorney,
aside from- the -Tow-n--Cler.k.
SUPERVISOR WICKHAM: Anyone from the Board like to address that?
TOWN CLERK TERRY: I know you don't want me to answer, West, but you do
know that we responded each time, and the Chief just said, he's put them aside.
Now, I don't know what happens when you talk to him, but you know that we've
done our end of it, and he writes back, and says that they're set aside.
WEST RUROEDE: Oh,wonderful. I'm not allowed.
TOWN CLERK TERRY: This is another part of it.
WEST RUROEDE: Chief Doroski claims that, you're not allowed to listen to these.
This is priviledged information. The Chief has written , so much Crap , spelled with
a c, that I got all these letters, and jumble, and proof, and foil, and freedom.
There's no freedom. He's covering up the corruption, the white collar corruption,
that's prevalent, not just Greenport, but dear little Southold, too. I'll leave you
alone, unless you can think of something better.
COUNCILMAN TOWNSEND: I don't know if it's better to say, but I'll be happy
to act as intermediary, or talk to you and the Chief, if you want to stop by my
office.
WEST RUROEDE:1 I stopped by your office last week, and we discussed this very
matter. You weren't the least bit helpful
COUNCILMAN TOWNSEND: I must not have understood. You made some vague
references about the Police—being unhappy with the Police. We didn't talk about
this.
WEST RUROEDE: I don't just have delusions of persecution. It is clear cut record.
The Town Attorney here wanted to go to Southold P. B.A. , and ask for my
prolific record, ever since I survived Riverhead Correctional Facility, I was a
maritime graduate (tape change.) I need a job.
SUPERVISOR WICKHAM: Any other comments from anybody else in the public? If
not I'll turn to members of the Board, if they have anything they'd like to comment
on. Joe, do you have anything?
COUNCILMAN LIZEWSKI : No.
SUPERVISOR WICKHAM: Alice? Joe?
COUNCILMAN TOWNSEND: What we did on the agenda was a resolution authorizing
us, somewhat belatedly, to attend the Association of Towns, and I think it's possible
somebody may--be�-interested in- what went-on there, and we might- run -through-the
members that attended it to ask them what they learned, and I'll be happy to start.
SUPERVISOR WICKHAM: Go ahead.

COUNCILMAN TOWNSEND: It's been awhile since I've been to that, and I only had
one day to go, on Monday, but I found it fascinating. I attended the sessions on
Planning and Zoning. I attended a couple of sessions, as I said, primarily on
Planning and Zoning, and I went because I'm head of the the Planning and Zoning
Committee, and we didn't have anybody from our Planning Board, or Zoning Board
there, and thought it would be interesting to get an update, as to what is going
on. Basically I was interested to note that the first speaker was William A. Sharp,
who comes from Southold Town originally. He's the son of Becky Sharp, and he's
an attorney for the Department of State, and he ran through all the latest case
law on Planning and Zoning matters to show changes in the way these cases have
been judiciated recently, and it was fascinating. Also, he discussed in some detail
the new Z. B.A. laws, that were enacted in '93, or I guess not enacted, but went
into effect in 1993. That was fascinating to me, because I was familar with the
old basis for granting variances, and now they're dramatically different, and in some
respects the Board have a lot more latitude, which reflects a general trend in planning
and zoning. There's been a lot more latitude in the way Planning Boards can review
site plans. They can work for positive changes in the Town. There's another fellow
in that same meeting, a guy named Sheldon Damski, who talked about things like
incentive zoning f-which--is one- of things --1'm talking about, -where--you can--give--some -
body maybe a greater density for accomplishing certain goals of the town. We had
done that a little bit in our affordable housing districts. The afternoon session
was pretty interesting, also. They talked about a new form of development called
neo-traditional development. It's one of those fancy names for going back to basics,
where you look. at your human villages, what we call our hamlets, but basically which
start out with a small shopping area, and was gradually integrated into residential
areas, and there is usually a central square of open space, and the spaces were
all human. There were sidewalks. There was on-street parking. You didn't have
to drive everywhere. It's an interesting concept. It was expressed in sort of
utopian terms, but to a degree we're working towards that same goal here. We're
trying to figure out how to focus our growth in the hamlets, how to make the spaces,
you know the commercial spaces more interesting, more productive, and so it was
very valuable information, to see the kinds of tools that they were employing. They
talked about changes in the environmental impact statements, and the SEQRA process.
There was an interesting session. The last session was on a loan. .an agency, I'm
trying to remember the name, that provides very low interest loans based on a very
low interest bond rate, or sewer and storm runoff projects. The Trustees are con-
sidering some road runoff projects, and the funding that's available under these
loans would make it much more affordable for the Town to accomplish an awful lot.
So, I got some valuable information there. Basically, it's called the Environmental
Facilities Corp. Anyway, I felt it was valuable. I was glad I was able to attend,
- and 1'd like to--hear-from-some- of the other people.
JUSTICE EVANS: I attended Monday and Tuesday. As a Justice I'm required to
take twelve hours of recertification per year, and Justice Tedeschi, and myself,
sat through our twelve hours, and learned some interesting updates on the law.
Unfortunately, it meant that I couldn't go to any of the other Association of Town
meetings, but I did fulfill my educational requirements for the year.
SUPERVISOR WICKHAM: Ruth?
COUNCILWOMAN OLIVA: I wasn't there. I stayed here, and minded the fort.
SUPERVISOR WICKHAM: Ruth, as you all know, is the Deputy Supervisor. I did
attend .two days of those meetings, and she looked after the shop, as she said.
I just wanted to briefly comment on two things. One is, the last resolution of the
afternoon calls for continuing to look for people, who would like to serve the Town
on the Land Preservation Committee. If you think you know of people who could
make a contribution to the town, this is a very important committee, there is still
roughly a million dollars left of bonded money to finance. acquisitions of open space
for the Town's Open Space Program. We need qual.ity people, who can assist the
Town Board in making important decisions as to where and how open space should
be maintained in this town. I'd, also, like to mention that at 8:30 tomorrow morning
we're having .a_..meetin.g .of- the Town Board. It's a specially scheduled meeting to
continue the Work Session that we had this morning, specific to the review of hamlet
density parcels . You know that the Board has undertaken this review. We have ,
a report, and tomorrow we'll begin reviewing that report, and seeking a consensus
of views on the part of the Board. Frank, another couple minutes comment?

FRANK CARLIN: Just a quick comment. I hope that the Town Board would take
this gentleman more seriously, becuase he's asking for help, and somebody on the
Town Board should look into it, and help him out, make phone calls, whatever.
But, anyway, help the guy out. He's asking for help. I put my faith in the Town
Board, that they will try to help the guy out. He came up here, as a citizen asking
for help.
SUPERVISOR WICKHAM: Thank you. I'm sure something will be done. Any -other
comments from the Board? Joe?
COUNCILMAN LIZEWSKI : I want to say, I'm glad to see that the criticism to Town
Board members attending this Association of Town has come to a halt. People realize
people can go to this thing with a benefit in mind. I can remember two years ago,
when I went for the first time, I received a good slap on the wrist from the taxpayer's
association, TaxPac, and the newspapers, for trying to better myself as a new
Town Board member, and I'm glad that that hasn't happened this time around.
COUNCILWOMAN HUSSIE: While we're talking about Association of Towns, I'm going
to pick up Joe's gauntlet, so to speak, and talk about what I found out, and I was
thinking about things you might be interested in. I spent most of my time, not
at the Association of Towns section of it, but in my area of expertise, which is,
as you all know, is solid waste', and so I attended the solid area of this, and one
of the first things, that we discovered was, something that we know, of course,
and that is that Thomas Jorling has stepped down as the Commissioner of the DEC,
and the designate Commissioner is Langdon Marsh, who made a very interesting
announcement, and one that I think is going to be important to us, and that is,
that many more of the decisions, and the handling of applications, etc. , are going
to be done-on a more local level, than they have been in the past. I found that
refreshing, and I think it's also hopeful. The other thing, that I found out, this
is a general way, is that Southold is in pretty good shape . Compared
to some other towns, who are still floundering around, we're doing okay.
