Dowd. 1 :'30 P.M. - The Town Board reviewed the resolutions to be voted on at the .4:30 P.M. Organizational Meeting. 3:30 P.M. - The Town Board met with Greenport Village Mayor Stephen Clarke, Village Trustee Joanne Dolinar, Superintendent of Water S Sewer Gerald Hickson, Senior Planner Valerie Scopaz, Planning Board member Mark McDonald, Stewardship Task Force Chairman Thomas C. Samuels, and member Gregory A. Palast.--- Discussion ensued concerning the question of the preparation of a comprehensive review of the Hamlet Density (HDZ) zoning around Greenport Village, including Jem Commons, or should the Town Board move forward, on its own motion, . to rezone the Jem Commons parcel back to R-80. Mr. Samuels read a letter from the Stewardship Task Force, dated December 22, 1993 for then Supervisor-Elect Wickham: "Following recent actions by the current Town Board regarding the downzoning of certain properties and similar actions, the Stewardship Task Force, by Unanimous vote, adopted the following resolution for your immediate attention: 'RESOLVED: 1 '. We reiterate to the Town Board that no zoning changes be made which undermine our Task Force's pending TDR and related programs. And, 2. We respectfully request that. the soon-to-be sworn Town Board reverse any recent rulings by the prior Board which contradicts these policies.' We look forward to working with you and the new Town . Board in a- new and cooperative manner. . . . ." A proposed Resolution no. 60, prepared by Town Attorney Dowd, was discussed, and after minor revisions, there was unanimous agreement to place it on the Organizational Meeting Agenda for action. 4:35 P.M. - Work Session adjourned. ORGANIZATIONAL MEETING 4:30 P.M. The Organization Meeting of the Southold Town Board was held on Tuesday, January 4, 1994, at the Southold Town Hall, Main Road, Southold, New York. Supervisor Wickham opened the meeting at 4:30 P.M. , with the Pledge of Allegiance to the Flag. 64 JANUARY '4,' 1994 Present: Supervisor Thomas H. Wickham Councilman Joseph J . Dowd SUPERVISOR WICKHAM: It's a pleasure to see everybody here today. We have before us an agenda, that is limited largely to organizational matters with substan- tive matter towards the end of the agenda, and we don't have the normal business that we frequently have at Town Board meetings. I will just say, that the next meeting of this Board has been scheduled as a regularly scheduled meeting next Tuesday, a week from today, at 7:30 P.M. That meeting time was set back in December, and having said that we're ready to begin today's resolutions. I have to start off, because this is a Supervisor's appointment. There are a very few things that the Supervisor has the authority to do on his own, and I'm pleased to be able to appoint as the Deputy Supervisor for the rest of this year, Ruth Oliva, who's' sitting on my left here. 1 .-SUPERVISOR'S APPOINTMENT Supervisor Thomas H. Wickham hereby appoints Ruth D. Oliva as Deputy Supervisor of the Town of Southold for the term of January 1 , 1994 through December 31 , 1994. SUPERVISOR WICKHAM: I'm also pleased to appoint someone else, who should be here, but is busy manning a crisis telephone on at the moment. 2.-SUPERVISOR'S APPOINTMENT .Supervisor Thomas H. Wickham hereby appoints Lauren Krug Grant as Confidential Secretary to the Supervisor, effective January 1 , 1994 through December 31 , 1994. SUPERVISOR WICKHAM: Lauren is with us right now. There is a number of phone calls coming in, because of a serious power outage in the town, that the people call the Supervisor's Office about power failures, so she's in there. She had hoped to be with us this afternoon. You'll get to know Lauren, I hope, as in Supervisor's Office. COUNCILMAN TOWNSEND: I'm equally pleased to offer this resolution. I think we've got a great person here .for Town Attorney. 3.-Moved by Councilman Townsend, seconded by Councilwoman Oliva, it was RESOLVED that pursuant to Section 24 of the Town Law, the Town Board of the Town of Southold hereby appoints Laury L. Dowd as Southold Town Attorney, effective January 1 , 1994, she to hold such office until the first day of January next succeeding the first biennial town election. 3.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was declared duly. ADOPTED. 4.-Moved by Supervisor Wickham, seconded by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby requests Suffolk County District Attorney James M. Catterson to designate Southold Town Attorney Laury L. Dowd as a Special Assistant District Attorney. 4.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was declared duly ADOPTED. 5.-Moved by Councilwoman Oliva, seconded by Councilwoman Hussie, WHEREAS, Section 64 of the Town Law requires the Town Board to designate, by resolution, banks in the State in which the Supervisor or other officers of the Town shall deposit all moneys coming into their hands by virtue of their office; and JANUARY 4, 1994 65 WHEREAS, the Town. Board may require any bank, so designated, to deposit with such Board bonds or certificates of the United States, of the State of New York, or any county, town, city, village or school district of the State of New York, such security for such funds so deposited, but such bond or certificate shall be subject to the approval of the Town Board and shall be deposited in such place and held under such conditions as the Town Board may determine; now, therefore, be it RESOLVED that the following banks. are '.hereby designated for fiscal year 1994 as depositiories, and the following securities are hereby required as collateral for such cash balances in said banks: Bridgehampton National Bank $1 ,000,000.00 Fleet Bank $1 ,000,000.00 North. Fork Bank $1 ,000,000.00 Shamut Bank $ 100,000.00(no collateral required) Suffolk County National Bank $5,000,000.00 Suffolk County National Bank $5,000,000.00 (Tax Receiver's Account only) AND. BE IT FURTHER RESOLVED the Town Board hereby authorizes Supervisor Thomas Wickham to execute Collateral Agreements between the Town of Southold and the above designated banks and their Third Party Custodial Institutions, all in accordance with the approval of the Town Attorney; and be it FURTHER RESOLVED that authorization for increase and decrease of securities shall be subject to the approval of the Supervisor. 5.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was declared duly ADOPTED. 6.-Moved by Councilwoman Hussie, seconded by Councilman Lizewski, WHEREAS, Section 11 of the General Municipal Law requires that the Town Board may authorize the Supervisor, the chief fiscal officer of the town, to invest moneys . not required for immediate expenditure; now, therefore, be it RESOLVED that the' Supervisor is hereby authorized to deposit or invest moneys not required for immediate expenditure in special time deposit accounts, or certificates of deposit issued by a bank or trust company located and authorized to do business in this State, provided, however, that such time deposit accounts or certificates of deposit shall be payable within such time as the proceeds shall be needed to meet expenditures for which such moneys were obtained, and provided further that such time deposit accounts or certificates of deposit be secured in the manner provided in Section 11 of the General Municpal Law. 6.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was declared duly ADOPTED. 7.-Moved by Councilman Lizewski, seconded by Supervisor Wickham, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes the use of a facsimile signature to pay all checks,. drafts and other instruments for payment of money drawn upon the accounts of the Town of Southold by Supervisor Thomas Wickham, -except those third party checks, drafts or other instruments in amounts in excess of $5,000.00, drawn upon the following banks: Bridgehampton National Bank Fleet Bank North- Fork Bank Shamut Bank Suffolk County National Bank 7.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was declared duly ADOPTED. 8.-Moved by Councilman Townsend, seconded by Justice Evans, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes the advancement of funds from the General Fund - Whole Town Account during 1994 to the Nutrition Program, Home Aide Program, Adult Day Care Program, Brief Respite Program, Supplemental Nutrition Assistance Program, Expanded In-Home Services Program, and Youth Services Program, when needed for payroll and operation expenses (food, supplies, etc.) ; and at no_ time will the total advance payable to the General Fund - Whole Town Account from any one of the aforementioned programs exceed $20,000.00; said advances to be repaid to the General Fund - Whole Town Account within six ,(6) months from the date of the advance. 8.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor. Wickham. This resolution was declared duly ADOPTED. 66 JANUARY 4, 1994 9.-Moved by Justice Evans, seconded by Councilwoman Hussie, it was RESOLVED that the Town Board of the Town of Southold hereby grants permission to Supervisor Thomas H. Wickham to travel to Albany on Town business, as required throughout the year, and the necessary expenses for gravel, meals and lodging shall be a legal charge against the 1994 Budget. 9.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was declared duly ADOPTED. 10.-Moved by Supervisor Wickham, seconded by Councilwoman Oliva, it was RESOLVED that The Suffolk Times, Mattituck, New York, a newspaper regularly published in the Town of Southold, which has been entered as a second class mail matter, be and the same is hereby designated, effective February 1 , 1994, as the official newspaper of the Town of Southold, for the publication of all notices, resolutions, ordinances, and other matter required to be published. 10.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This. resolution was declared duly ADOPTED. 11 .-Moved by Councilwoman Hussie, seconded by Supervisor Wickham, it was RESOLVED that The Long Island Traveler-Watchman, Southold, New York, a news- paper regularly published in the Town of Southold, which has been entered as a second class mail matter, be and the same is hereby designated, effective February 1 , 1994, as an additional newspaper of the Town of Southold for the publication of all notices, resolutions, ordinances, and other matter required to be published. 11 .-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was declared duly ADOPTED. 12.-Moved by Councilwoman Oliva, seconded by Justice Evans, it was RESOLVED that pursuant to Section 64(1-a) of the Town Law, a petty cash fund -is hereby established in the following amounts for the following individuals: Supervisor Thomas H. Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was declared duly ADOPTED. 13.-Moved by Supervisor Wickham, seconded by Councilwoman Oliva, it was RESOLVED that Supervisor Thomas Wickham be and hereby is designated to represent the Town of Southold at the annual meeting of the Association of Towns of the State of New York, to be hold in New. York City on February 20 , 21 , 22, 23, 1994, and to cast the vote of the Town of Southold pursuant to Section 6 of Article 111 of the Constitution and By-Laws of the Association of Towns; and be it further RESOLVED that Councilwoman Alice J. ' Hussie be and hereby is designated to act as the alternate delegate, to cast the vote of the Town of Southold at the annual meeting of the Association of Towns in the absence of Supervisor Thomas Wickham. 13.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was declared duly ADOPTED. 14.-Moved by Councilman Lizewski, seconded by Councilwoman Hussie,' it was RESOLVED that those officers and employees of the Town of Southold attending the annual meeting of the Association of Towns of the State of New York be and hereby are allowed a maximum of $600.00 per officer and employee for the actual and necessary expenses for registration, travel, meals, and lodging incurred while attending said meeting. 14.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was declared duly ADOPTED. JANUARY 4, 1994 67 SUPERVISOR WICKHAM: I'd just like to point out that $600.00 is a high figure, that people have not spent in some years. Most of us will not be spending the nights in the hotels: there, and we'll be going back and forth, and we'll spend just a small portion of that. That is the outside figure. 15.-Moved by Councilwoman Hussie, seconded by Councilwoman Oliva, it was RESOLVED that any Town official, elected or appointed, who is required to use his own automobile in the performance of his duty; shall be compensated" for travel expenses necessarily and actually incurred in carrying out the duties of his office, at a rate not to exceed twenty cents ($.20) per mile. 15.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was declared duly ADOPTED. 16.-Moved by Councilman Townsend, seconded by Justice Evans, WHEREAS, it is required by Section 27, Subdivision 1 of the Town Law, that the Town Board fix, from time to time, .the salaries of all officers and employees of the Town, whether elected or appointed, and determine when the same shall be payable, and that the salaries of the members of the Town Board, the. elected Town Clerk and the elected Superintendent of Highways shall not be fixed in an amount in excess of the amounts respectively specified in the notice of hearing on the preliminary budget published pursuant to Section 108 of the Town Law; now, therefore, be it RESOLVED 'that the annual salaries of the following elected town officials shall be as follows, to wit: Supervisor Thomas H. Terry as Registrar of Vital Statistics for the Town of Southold for the term beginning on January 1 , 1994 and ending on December 31 , 1997; and be it FURTHER RESOLVED that the salary of Judith T. Neville as Deputy Registrar of Vital Statistics for the term beginning on January 1 , 1994 and ending on December 31 ; 997. Registrar of Vital Statistics Judith T. Terry hereby appoints Linda J . Cooper as Sub-Registrar of Vital Statistics for the term beginning on January 1 , 1994 and ending on December 31 , 1997. Terry as Marriage Officer for the Town of Southold, effective January 1 , 1994 through December 31 , 1997. 21 .-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was declared duly ADOPTED. 22.-Moved by Councilwoman Oliva, seconded by Justice Evans, it was RESOLVED that the Twon Board of the Town of Southold hereby appoints Raymond L. Jacobs as Commissioner of Public Works for the Town of Southold for the term beginning on January 1 , 1994 and ending December 31 , 1997; and be it FURTHER RESOLVED that the salary of Raymond L. Jacobs, Commissioner of Public Works of the Town of Southold, be set at $3,000.00 per annum, and the same shall be paid in regular bi-weekly payments; and be it FURTHER RESOLVED that the Town Clerk be and she hereby is instructed to file such certificates with the proper parties as are required by Section 30, Subdivision 3 of the Town Law. 22.-Vote of the Town .Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was declared duly ADOPTED. 23.-Moved by Justice Evans, seconded by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby appoints Richard Noncarrow, bank officer of the Suffolk County National Bank, as Deputy Receiver of Taxes for the Town of Southold, effective January 1 , 1994 through December 31 , 1994, he to serve in said position without compensation. 23.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was declared duly ADOPTED. 24.-Moved by Councilman Lizewski, seconded by Councilwoman Hussie, it was RESOLVED that pursuant to Section 142(1-A) of the Highway Law, the Southold Town Superintendent of Highways be and he hereby is authorized to purchase equipment, tools, snow plows and other implements and devices without prior approval of the Town Board in an amount not to exceed $10,000.00 for any one item during the period from January 1,; 1994 through December 31 , 1994. 24.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman O-liva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. JANUARY 4, 1994 69 25..-Moved by Councilwoman Hussie, seconded by Councilwoman Oliva, it was RESOLVED by the Town Board of the Town of Southold that the Commissioner of Public Works be and he hereby is authorized to purchase necessary supplies and equipment, without prior resolution of the Town Board, in an amount not to exceed $10,000.06 for any one item during the period from January 1 , 1994 through December 31 , 1994. 25.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. What is before us now, the next order of business, is to establish the various working committees of the Town Board. Historically the Town Board has divided up the responsibilities, and designated several standing committees. At the moment there are twelve standing committees of the Town Board, or have been twelve standing committees. The priviledge of nominating committees has traditionally been handled as a appointment to be made by the Supervisor. We have hadn't extensive discussion of this yet on the Board, and there will some further opportunity for discussion, and perhaps in fine tuning, but these are the appointments that I am offering this evening. I understand that most of the Board members are pleased with them, but there may be some additional work ahead. Whether, or not the Supervisor also has the priviledge of designating the charge to these committees is less clear, but I'm also going to outline some charges to the committees, where these new committees will be established where there's a major change in what currently exists. The first standing committee of the Town Board is that of the Police Committee, and we are statutory required to have a Police Committee to deal with grievances, etc. under the Police contract, and I will be the Chair of that committee. We'll continue to have a Planning and Zoning Committee; and I assume it will function more or less as it has in the past, a-nd Joe Townsend :has agreed to chair that committee. In place of the Legislative Committee of the past we are planning to have a Code Review Committee, and Ruth Oliva has kindly agreed to chair that one . In as much as it is a new name, we'll have to create that committee. That will take a special resolution. We can do it, and perhaps will do it, but before we do that, I'd like to read the charge to this committee to get a ,sense of the Board, whether they're comfortable with it, and would like to proceed with that resolution. The proposed charge for the Code Review Committee is to propose to the Board changes in the Town Code that would have one or more of these benefits, to save the Town money, to reduce or eliminate contradictory passages, to improve the prospects for full and fair enforcement, and to facilitate compliance on the part of Town residents. That would be the charge for a Code Review Committee, and this basically would take the place of what has been a Legislative Committee in the past. 76 JANUARY_' 4, 1994 COUNCILWOMAN HUSSIE: Would it also take care of new legislation that's proposed? SUPERVISOR WICKHAM: It would, but it need not. ' The thought was, that if there is _legislation proposed in the area of planning and zoning, for example, it would come out of the Planning and Zoning Committee, and if there is legislation in other areas they could come directly to the Board, but it need not come through that Code Review Committee. My feeling was, that to some extent that committee. although it has streamlined and assisted in certain ways, it has also impeded the movement of legislation in other areas, so it's basically to streamline and revise the Town Code, rather that to be a mechanism by which legislation is put up to the full Board. Is there an interest on the part of the Board in putting this to a resolution to put together this committee? 56.-Moved by Supervisor Wickham, seconded by Councilman Townsend, it was RESOLVED that the Town Board of the Town of Southold hereby creates a new Town Board Standing Committee, to be known as the Code Review Committee. The purpose of the Code Review; Committee is to .propose to the Town Board changes in the Town Code that would have one or more of these benefits: (a) Save the Town money; (b) Reduce or eliminate contradictory passages; (c) Improve the propects for full and fair enforcement; (d) Facilitate compliance on the part of Town residents. 56.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski; Supervisor Wickham. This resolution was declared duly ADOPTED. SUPERVISOR WICKHAM: The next committee is not strictly speaking a standing committee of the Town Board, but it's been a very important one, that ,has been ably chaired by Councilwoman Hussie, and that's the Solid Waste Task Force, and she has kindly agreed. to stay on in that capacity. The next one, the Finance Committee, has not been active in the last couple of years, so I will simply read the proposed charge to the' Finance Committee, which I would chair. The charge is as follows, to review receipt and expenditure of funds on an ongoing basis and to compare same with budget__ projections, to evaluate and, if feasible, help the Town implement a system of budgeting by department or cost-center, to consider and, if feasible, help the Town implement a capital budget, to review various Town policies in respect of, overtime worked, risk management, cash management and investment policies, internal controls, debt management, including short and long term debt, and .any other policies in regard to our financial controls in the Town, and finally to assist the Board, the Town Board, in evaluating the annual indepen- dent audit and the periodic New York State audit. This is the charge that I'm refining for the Finance Committee of the Town Board. Those are the only committees that I'm currently proposing for this Board. 57.-SUPERVISOR'S APPOINTMENTS TOWN BOARD STANDING COMMITTEESS - 1994 POLICE: Supervisor Wickham, Chairperson PLANNING S ZONING: Councilman Townsend, Chairperson CODE REVIEW: Councilwoman Oliva, Councilperson FINANCE: Supervisor Wickham, Chairperson SUPERVISOR WICKHAM: Instead of having committees to do the work that has been done in the past, I would nominate liaisons, or people on the Board, who will take particular interest in a particular issue, deal with them, and not necessarily form committees. Those liaisons for the particular area, that I'd like to propose are, of course, Fishers Island, Justice Louisa Evans, who I hope will be the liaison with anything that happens on Fishers Island. To deal with matters of youth in this town, Joe Lizewski spoke about the need to move ahead, and not to just drop the ball in the area of youth, and Joe, I'm pleased that you'll be willing to take on' that role. We have had an ongoing relationship with the North Fork Animal Welfare League, and the Dog Shelter. Alice Hussie has agreed to continue in that role. Have you not, Alice? COUNCILWOMAN HUSSIE: Right. ' JANUARY 4, 1994 77 SUPERVISOR WICKHAM: We have a Park, Beaches, and Recreation, which is at the moment unspoken for, and I think we're going to have to do a little more homework before we can address that one. We have a Personnel Committee, which has been ably handled in. the past, and I'm asking Alice to take that on, herself, as a liaison, and call upon. the rest of us, as need be to assist her in that area. The Scavenger Waste Treatment Plant in Greenport is a plant built by the Town of Southold, but managed by the Village of Greenport. It's the interaction of those .two muncipalities that involve quite a bit of time, and effort, and Ruth Oliva has agreed to be our liaison with the Scavenger Waster Treatment Plant. (tape change) Business relation- ship, and to develop a strategy, and a means by which the town can more closely, and have a stronger relationship with the business community here, and finally there are two additional liaisons, that we're looking for, that have yet to be designated. We'll have to have a little discussion at subsequent meetings, a liaison for the Human Services area, and one for the Performing Arts. Both of these are very important for the Town of Southold, and when we have a chance to discuss them a little more fully, we'll have additional appointments. We have, in addition to that, other areas that we'll be discussing in greater length, and I don't want to spend a lot of time on it today, but to say that there are three additional, probably commissions, or committees, that we' will be discussing, and I'll just mention them briefly, because we're not going to actually establish them at this time. One is a Commission on Taxes, how to deal with the issue of taxes in this town, and to provide some restraint on the tendency for increased taxes. Another is a committee to evaluate the management in Town Hall, and the allocation of space, office space within this building. It _ doesn't take more than two days on the job to see that the allocation of space in this building is- a serious question, and one that has bearings on the interaction, interrelation of the different departments here. Rather than the Supervisor try to take that on himself, I'm going to move at a subsequent meeting the establishment of a committee to help look into those questions that each department can have a full and fair input into, so that we can evaluate space requirements, and interaction among departments. Finally, we have had in the past a Groundwater Resources Committee. This is a complex area because there are so many different people, who have input into the Groundwater Resources area. It's very important. The Town . Board has concerns. The Planning Board has concerns. The Trustees have concerns, and we have at the present time a Groundwater Resources Advisory Committee. I'm going to want to give additional thought to this before coming to the Board, and trying to enact something, and I will have some additional information on that in subsequent meetings, too. Consequently,. we can do a resolution at this time to abolish various committees, that have in past handled a lot of this work. I would like to move at this time. COUNCILMAN TOWNSEND: I'd like a discussion on the motion. SUPERVISOR WICKHAM: We'll have the motion, then we'll have some discussion on it. 58.-Moved by Supervisor Wickham, seconded by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby abolishes the following Town Board Standing Committees: Dog Shelter, Disposal Area, Scavenger- Waste, Commerce S Insustry, and Legislative, effective immediately. COUNCILMAN TOWNSEND: Is there any kind of legal standing these committees have? Is there provision in Town law that we're not providing for now by eliminating these committees? I'd like to know if we're jeoparding anything. This is something the Town has done at it's. own discretion. There's no particular basis. TOWN CLERK TERRY: This has been done before. Some of these committees were created two and four years ago. COUNCILMAN TOWNSEND: Right, but a committee, as such, has no standing legally? I mean, I'm concerned about a liaison versus. . SUPERVISOR WICKHAM: There is a requirement for a Police Committee. Contractually, legally, we have to have that, and we do. The ones that are being abolished, I don't believe we have any legal requirements to .maintain. COUNCILMAN TOWNSEND: Okay. Is the entire Town Board still part of each committee? 7"p JANUARY 4, 1994 SUPERVISOR WICKHAM: No. I would like to clarify my move about that,, but it is just my personal view. COUNCILMAN LIZEWSKI : Is it just your view, or is it what it's going to be?" SUPERVISOR WICKHAM: I think it's not necessarily the way it's going to be. If the rest of the Board feels otherwise, I'd like to change it. My view is, that we designate a Chairman. I would like each Chair to come, up with a proposal of Who her or she would like to serve on that committee. Other members of the Town Board are free to attend, but the committee would be comprised of the people that the Boar ultimately agrees should be on that committee. COUNCILMAN LIZEWSKI : Let me ask you one other thing. Since you sort of decided that a committee, say a Zoning and Planning Committee, will bring forward to the Legislative Committee, not bring it to the Legislative Committee, but bring it right to the Town Board, that means that the Town Board won't have any idea until that, basically Code change is being brought to us about what it's about, since it's not going through one of the committees. The main function of this Board is to legislate, so basically we're just going to get hit with changes in Code by other committees, that we don't even know about until they get here. SUPERVISOR 'WICKHAM: That is a potential danger, if the Board members don't participate in, or don't have any involvement or knowledge of what's doing on. COUNCILWOMAN OLIVA: Can I just add? The way it used to be done, I hope we can start this again, is that at every Work Session each Councilperson can make a report on the committees, that they serve on, and give a report to the rest of the Town Board members to bring them up to date on what has transpired, if they've had any meeting in that time, or if there's any proposed legislation, that will be coming to the Board, so they have the opportunity to discuss it, and you're going to have to go to the Town" Attorney anyway to draw up the Code changes, and have them brought to the Town Board for complete discussion before anything is put out for public hearing. This is the way it was always done before. " COUNCILMAN LIZEWSKI : I'm just concerned about participation by people on the Town Board going to the meetings. We have to know what's going on all the time. COUNCILWOMAN• OLIVA: Sure. , Any Town Board member can always go to any meeting. It was, always that way. COUNCILMAN LIZEWSKI : Okay. I just want to make sure the participation is "still. . I mean I came in" here many a night, and went to other Town Board meetings of other committees just to keep abreast of things. SUPERVISOR WICKHAM: You'd be most welcome. My thought was not to require each member of the Town Board to come to each meeting. Anyone is most welcome. COUNCILMAN LIZEWSKI : We'll be notified? SUPERVISOR WICKHAM: All would be notified. TOWN CLERK TERRY: It's the law. We must do that. SUPERVISOR WICKHAM: Anything else, Joe? COUNCILMAN TOWNSEND: So, basically, you just put one name on the committees. SUPERVISOR WICKHAM: For those Chairmen to decide who they would like to serve on the committee. COUNCILMAN TOWNSEND: And the liaison would be just one person, so let's review the committees we're keeping, Police, Zoning and Planning, Code Review, and Solid Waste Task Force. Is that a committee now? SUPERVISOR WICKHAM: Is not a standing committee, but it is a Task Force. We have a motion on the floor, we have a second, is there anymore discussion on it? This resolution was declared duly ADOPTED. 59.-SUPERVISOR'S APPOINTMENTS: LIAISONS FISHERS ISLAND: Justice Evans YOUTH: Councilman Lizewski NFAWL/DOG SHELTER: Councilwoman Hussie PERSONNEL: Councilwoman Hussie SCAVENGER WASTE PLANT: Councilwoman Oliva BUSINESS: Councilman Townsend SUPERVISOR WICKHAM: We have one more item of business that has come to us, that has basically come to the Board in a number of different ways over the last few weeks, in many ways going back six or more months ago. As the Town has seen the problem of increased density, and increased development in and around the Greenport area. There's been increasing expressions of concern about the impact that it's had on Greenport, -and this came to a head in December, when a change of zone was granted to a parcel just north of the Village of Greenport, which will exacerbate what many of us have seen as a serious problem. there. The Stewardship Task Force of the town has written to us indicating that they, and others in the Planning Department, or the Planning Board, have looked at this .with deep concern in view of the wish of the Task Force, the Planning Board, and many of us in the Town Board, to institute a program of Transfer of Development Rights, and in a effort to try to rationalize the development process throughout the town, and not have it concentrated in certain areas. Consequently, the Town Board has reviewed this 'afternoon a proposal, that would commit the Town to reviewing various parcels in the town, which we feel are particularly_ sensitive, and which are particularly conducive to a development bias that could unduly affect the future of this town in ways that would set back the process for some period of time. There_ is a great .deal of interest on the Board in stepping back, and looking at the full range of development potential in the town; to rationalize it, to protect those parts of the town, that are particularly vulnerable, and at risk. The resolution, that we're going to take up in a moment, would do that in a limited area. It would do it in those areas, that have been zoned in the Hamlet Density mode, the Hamlet Density Zone. We're taking up that Hamlet Density Zone at this time, because it is a particularly sensitive one. It is a zone, which permits two, and even as many as four homes per acre with the provision of public water, and public sewerage. In that sense it is particularly sensitive, and it is particularly problematic given the provision of public water and public sewerage in this town. The motion on the table, which I'll read in just a moment, would commit the Town to reviewing those parcels, and their place in the comprehensive planning framework in this town at this time. 60.-Moved by Supervisor Wickham, seconded by Councilwoman Oliva, WHEREAS, the Town of Southold finds that a considerable time has passed since the HD zoning within the Town of Southold has been evaluated; and WHEREAS, during this time there have been considerable changes in the physical, social and regulatory aspects of development within the Town; and WHEREAS, during this time the Town of Southold has revised its comprehensive plan as regards hamlet density of development throughout the Town; and WHEREAS, during this time limitations have arisen in the Village of Greenport's ability to provide water and sewer infrastructure to support hamlet density zoning in areas outlying the Village; and WHEREAS, the R-40 parcel shown on the attached Exhibit A was integrally related to the Jem Commons HD zone which was granted on December "7 , 1993, so that any comprehensive review of that HD. zone requires a review of that R-40 parcel as well; and WHEREAS, the Southold Town Stewardship Task Force has recommended the develop- ment and adoption of Transfer of Development Rights and other related programs or techniques which may have an impact on the character and location .of future development within the Town of Southold;. 8 JANUARY 4, 1994 NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby resolves to undertake the preparation of a comprehensive review of the vacant HD zones within the Town of Southold and the described R-40 parcel, and directs the staff to prepare a plan for conducting such review. It's just an absolute joy, better than sitting back down there, and I'm really looking forward to four .really productive years working with a Board, I think, that you're going to be very, very pleased with. SUPERVISOR WICKHAM: Alice is recuperating from a cold. Are there any comments from the audience tonight? .MICHAEL CROTEAU: I'd like to wish you all a Happy New Year to start with. My name is Michael Croteau. I'm coming here as two capacities. The first is as a resident of Southold, and the second is as a general partner of a partnership, the Bayview-South Harbor Partnership, which is being formed, and is in the process of purchasing Stepnoski farm for those of you who didn't know about this already. We're working with Peconic Land Trust to preserve,what was going to beat one time, a zone change for a very dense subdivision . At any rate, we should be closing in February, at some point, and restoring the farmhouse, and trying to maintain that part of Southold as open space as much as we can. Secondly, I think that a number of issues that were talked "about tonight have to do with the next thing I'm going to talk about. I want to use this forum as a means of publicizing something, that I don't feel is being publicized properly, and it's regarding the public meeting, that the Fire Department is having tonight, which I know a lot of people in Southold don't know about. This meeting is going disseminate information regarding a proposed substation, which happens to be on that same Stepnoski farm, on three acres that was divided before' George Stepnoski died. The Fire Department is looking to ask the Town to approve through a vote two $400,000.00 to build what they're calling a substation. Eight hundred thousand dollars sounds like a substantial substation to me, and I'm not sure that the Town Board has any jurisdiction over JANUARY 4, 1994 v this, nor do I know if there's any means, as far as the publicity, and how these things are brought to the public within Southold, but what I'd like to do here is, to say that the' thing has been very underpublicized. There is a meeting tonight, and there's vote next week. It's going to impact the taxpayers of Southold in the Southold Fire District, and I don't feel that it's necessary, even though the Fire Department does a wonderful job here. It is a volunteer organization. I don't think we need two firehouses, the size of what we have down the road here, to not only payfor and build,but 'to maintain, and run over the process of how many years the rest of us live here. I think, as you said, as far as the Tax Committee, it's time for some fiscal restraint. I think we're really paying for a lot of things that have been done in the past few years, that weren't necessarily needed, or done properly, and that bonding is something that's going to put more burden on all of us down the road; as we live here. I know it may not be the pp.roe,r point to bring before the Town Board. I'm using it as a public forum, so that 'anybody.that."lives in Southold knows about it, and the vote is next Tuesday night. COUNCILWOMAN HUSSIE: That's for the Southold Fire District, though. It's not the whole town.. MICHAEL CROTEAU: It's Southold Fire District. The resolution was initially voted on between the Commissioners on November 9th. They waited to publicize it two days before Christmas. The first public meeting is tonight and the next vote is the 11th. I , also, think that if this vote were done at a different time of year, there may be a lot more people, who are property owners, who are not prepared to pay the brunt of this $800,000.00 over the years, that could be present to vote on this.
