The lead agency has determined that the proposed action described below will not have a significant effect on the environment and that a Draft Environmental Impact Statement need not be prepared. Title of Action: Riverhead Building Supply Corp. Change of Zone SCTM: 1000-046-01-2.1 SEQR Status: Unlisted Action Project Description: The subject application involves a change of zone from Hamlet Density (HD) to Light Industrial/Planned Office Park (LIO). Location: The 3.5 acre subject site is located on the south side of NYS Route 25 (Main Road), approximately 170 feet west of Moore's Lane in the hamlet of Greenport. Reasons Supporting This Determination: This determination is issued in full consideration of the Criteria for Determination of Significance contained in 6 NYCRR Part 617.7, the Long Environmental Assessment Form Parts I, H and the following specific reasons: 1. The Town of Southold Planning Board reviewed the subject application and recommended a negative declaration for the change of zone for the following reasons:surrounding properties are mostly commercial,the nature of the use will not require large volumes of water nor generate large volumes of wastewater,and the change of zone to LIO is in keeping with the commercial 7-11 store to the north and LIO zone to the west. 2. Through inspection and consultation of environmental references it has been determined that the site does not contain sensitive environmental resources. 3. The proposed action will not set significant precedent,as it represents a unique scenario. 4. The size and location of the subject site makes it less desirable HD residential uses,in consideration of adjacent land uses (including the Riverhead Building Supply facility to the west,7-11 convenience store to the north and the LIRR tracks to the south) and in view of the inability to provide adequate on-site buffers. 5. The existing Riverhead Building Supply facility is considered to be pre-existing and non-conforming with respect to building setbacks. Approximately 330 linear feet of existing structures on the existing Riverhead Building Supply property are within 5 feet of the common property line with the subject site. The current Town of Southold Zoning Code requires a minimum side yard setback of 30 feet in the LIO zoning district,25 feet of which must be landscaped when adjacent to parcels zoned HD. If residential development on the subject site were to occur it may be adversely impacted by the lack of adequate buffering.on the adjacent site to the west. 6. The proposed action would permit the expansion of the existing building materials storage and sales use and would allow for the better design of the facility,with side yard buffers from adjacent residential sites to the east,allowing for a more appropriate transitional zone. 7. In consideration of site characteristics and surrounding land uses,LIO zoning would permit the highest and best use of the subject site. 8. Although the action was not specifically recommended in recent master plan updates,the action appears consistent with Town comprehensive planning in consideration of site specific issues. 9. The proposed action is for a change of zone and further review under the Planning Board site plan review process will be necessary prior to development of the subject site. At that time,various aspects of the project may be addressed including buffered setbacks,site layout,and locations of sanitary and stormwater structures. 10. Proposed project is not of significant magnitude or impact to warrant the preparation of a Draft EIS,and will not cause a significant burden on natural or community resources. Further, its small size and poor location prohibits adequate buffering of a dense residential use from commercial uses to the north and west. The Zoning Code currently provides for a 25' landscaped buffer between the Light Industrial/Planned Office Park (LIO) District and the Hamlet Density Residential District (HD) containing the Driftwood Cove cooperative apartments. During the site plan review for this site, the Planning Board will insure adequate buffering between the two properties. The question of whether an action may be significant is not always easy to answer. Frequent- ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine significance may have little or no formal knowledge of the environment or may be technically expert in environmental analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting the question of significance. The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature,yet flexible to allow introduction of information to fit a project or action. Full EAF Components: The full EAF is comprised of three parts: Part 1: Provides objective data and information about a given project and its .site. By identifying basic project data, it assists a reviewer in the analysis that takes place in Parts 2 and 3 ?art 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides guidance as to whether an impact is likely,to be considered small to moderate or whether it is a potentially- large impact. The form also identifies whether an impact can be mitigated or reduced. Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the impact is actually important.
