As you are aware, we had submitted for such declaration to you in October of 1991. Your response at that time was that a site plan review application was to be made. We did not submit it to you immediately, in hope of first receiving favorable Suffolk County Health Department Board of Review hearing determination, which we have recently obtained. Our client, Mr. James Navas, is anxious to proceed with implementation of a new sanitary disposal system (designed in conformance with current Health Department Standards) which was mandated by that regulatory body in order to reopen the existing restaurant. This new sanitary disposal system will be better capable of treating anticipated sewage flows as compared to the older septic disposal system. Since the existing restaurant is within the existing Historic District of Mattituck Hamlet, we are planning to maintain the site and building in the same rustic and rural setting it has occupied for many decades. On-site parking is available for twenty (20) cars and at the design rate of 3/persons per car meets the anticipated restaurant usage of 60 patrons. The existing gravel drive and grass areas will be restored to equal or better condition following construction of the new sanitary disposal system and will continue to provide a rural and rustic setting for the existing restaurant. January 6, 1992 We are hopeful that a negative declaration can be determined as quickly as possible for our client's application, in order that the existing restaurant can be expeditiously reopened. If you have any questions or comments regarding this request and submission, please call us at your convenience. We therefore transmit herewith for your consideration a duly executed site plan application with attached money order of$205.00 to cover application fee, nine (9) copies of site plan(signed and sealed) showing proposed septic disposal system and other details, four (4) copies of certified site survey, one (1) copy of short environmental assessment form and one copy of current letter of review from Mr. Douglas Feldman of the SCDHS. Full EAF Components: The full EAF is comprised of three parts: ,;.. Part 1: Provides objective data and information about a given project and its site. By identifying basic project data, it assists a reviewer in the analysis that takes place in Parts 2 and 3. Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially- large impact. The form also identifies whether an impact can be mitigated or reduced. If the action is in the Coastal Area, d you are a state agency, complete the Coastal Assessment Form before proceeding with this assessment. 5 Part 2—PROJECT IMPACTS AND THEIR MAGNITUDE Responsibility of Lead Agency eneral Information (Read Carefully) In completing the form the reviewer should be guided by the question: Have my responses and determinations been reasonable? The reviewer is not expected to be an expert environmental analyst. • Identifying that an impact will be potentially large (column 2) does not mean that it is also necessarily significant. Any large impact must be evaluated in PART 3 to determine significance. Identifying an impact in column 2 simply asks that it be looked at further. • The Examples provided are to assist the reviewer by showing types of impacts and wherever possible the threshold of magnitude that would trigger a response in column 2. The examples are generally applicable throughout the State and for most situations. But, for any specific project or site other examples and/or lower thresholds may be appropriate for a Potential Large Impact response, thus requiring evaluation in Part 3. • The impacts of each project, on each site, in each locality, will vary. Therefore, the examples are illustrative and have been offered as guidance. They do not constitute an exhaustive list of impacts and thresholds to answer each question. • The number of examples per question does not indicate the importance of each question. • In identifying impacts, consider long term, short term and cumlative effects. Instructions (Read carefully) a. Answer each of the 19 questions in PART 2. Answer Yes if there will be any impact. b. Maybe answers should be considered as Yes answers. c. If answering Yes to a question then check the appropriate box (column 1 or 2) to indicate the potential size of the impact. If impact threshold equals or exceeds any example provided, check column 2. If impact will occur but threshold is lower than example, check column 1. d. If reviewer has doubt about size of the impact then consider the impact as potentially large and proceed to PART 3. e. If a potentially large impact checked in column 2 can be mitigated by change(s) in the project to a small to moderate impact, also check the Yes box in column 3. A No response indicates that such a reduction is not possible. This must be explained in Part 3. 1 2 3 Small to Potential Can Impact Be IMPACT ON LAND Moderate Large Mitigated By Impact Impact Project Change 1 . The Southold Town Planning Board, as lead agency, has determined that the proposed action described below will not have a significant effect on the environment and a Draft Environmental Impact Statement will not be prepared. Name of Action: Proposed Site plan for Savan Restaurant SCTM# : 1000-14.0-3-37 Location: Main Road, Mattituck SEQR Status: Type I ( ) Unlisted ( X) Conditioned Negative Declaration: Yes ( ) No ( X) Description of Action: Reopening existing restaurant. Page 2 Savan Restaurant SEAR Negative Declaration Con't. Reasons Supporting This Determination: An Environmental Assessment has been submitted and reviewed and it has been determined that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. The applicant will have to comply with the requirements of the Suffolk County Sanitary Code (SCSC) and all relevant standards of water supply and sewage disposal systems. Design and flow specifications, subsurface soil conditions, . and site details will be reviewed fully at the time of Suffolk County Department of Health Services (SCDHS) application review. This impact is not considered significant due to the anticipated project compliance with established requirements of the Suffolk County Sanitary Code (SCSC) and the Suffolk County Department of Health Services (SCDHS) and the required obtainment of relevant permits. Because there has been no correspondence received from the New York State Department of Environmental Conservation in the allotted time, it is assumed that there are no comments or objections from that agency. The project involves reopening an existing restaurant on a 11,782 square foot site. The site and area are zoned for restaurant use ,by the Town of Southold, thus the proposed action is consistent with zoning. A review of the proposed site plan by the Principal Building Inspector resulted in a recommendation that the two existing cesspools must be pumped and removed to the . Town Landfill. The applicant has agreed to this condition. For Further Information: Contact Person: Robert G. As you are aware, we had submitted for such declaration to you in October of 1991. Your response at that time was that a site plan review application was to be made. We did not submit it to =of mediately, in hope of first receiving favorable Suffolk County Health Department Review hearing determination, which we have recently obtained. We therefore transmit herewith for your consideration a duly executed site plan application with attached money order of$205.00 to cover application fee, nine (9) copies of site plan (signed and sealed) showing proposed septic disposal system and other details, four (4) copies of certified site survey, one (1) copy of short environmental assessment form and one copy of current letter of review from Mr. Douglas Feldman of the SCDHS. Your expeditious review and declaration will be appreciated. Respectfully submitted, E.S. KALOGERAS, P.E. CONSULTING ENGINEER E.S. Kalogeras, P.E. ESK:ph cc: Mr. James Navas Mr. Douglas Feldman E. S.
