Dear Ms. Steelman:
The following resolution was adopted by the Southold Town Planning Board at a
meeting held on Monday, May 13, 2002:
The final public hearing was closed.
The following resolution was adopted:
WHEREAS, Michael Lynn is the owner of the property known and designated as Bedell
Cellars, located at 36225 Main Road in Cutchogue; and
WHEREAS, this site plan for Bedell Cellars is for a 4,669 sq. ft. addition to an existing
winery; and
WHEREAS, this site plan was certified by the Building Department on May 9, 2002; and
WHEREAS, the Town Engineer has reviewed the drainage calculations and the
Planning Board has accepted his recommendation for approval; and
WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental
Quality Review Act, (Article 8), Part 617, declared itself lead agency and issued a
Negative Declaration on January 14, 2002; and
WHEREAS, a final public hearing was closed on said application at Town Hall,
Southold, New York on May 13, 2002; and

Monitoring well data has shown that turf maintenance and agriculture can add significant
nitrogen to the groundwater. Data from golf courses shows an average nitrogen coTieentraation of
approximately 4 Mg/L and data from farm fields shows that nitrate levels from agricultural
practices exceed 6 Mg/L in groundwater.

60 units (based on 1 unit per acne) would be allowed in Zones 111, V, and Vl, and
approximately 120 units would be allowed is other zones (based on 2 units per acre). This
assumes full yield. Actual yield would likely be lower based on either a standard
20,000140,000 sq.ft. yield map or 80% of adjusted gross land area.
—�j • If a vineyard wishes to construct a winery and"wine tasting" facility, tanly that portion of the
vineyard not in crops may be used for calculation of population density equivalent.
+ For condominiums or like units intermingled.with a. golf course, the golf course portion of
the project must be separated out of the parcel area. Density would be based on the
remainder'of the parcel.
+ For golf Courses, density for accessory uses such as clubhouse or restaurant, may be derived
from those areas not actually used for play such as parlong, area of buildings and area of anY
wooded portions of the parcel that are not part of the golf course.
For prat-existing developments where land has been set aside for agriculttaral use or
recreational.turf, the same rules apply. Hence, a partially developed parcel may not claim
density credit for acreage used for agriculture or recreational turf, regardless of density
allocation formulas that were originally used in the review and approval of the initial
development proposals.

Dear Mr. Fedelem,
Our office has made an application to the Suffolk County Department of Health Services
for a new sanitary system for the Agricultural Building at Bedell Cellars. The Farmland
Committee approved this building at their meeting on July 25, 2000. Upon receipt of the
SCHO's "Notice of Incomplete Application" and subsequent discussions, they noted that
the calculation for allowable density for the sanitary and waste water flow (300 gallons per
day multiplied by the total number of acres) would need to be changed to exclude the
acreage where the Development Rights have been sold.
For the purposes of our current application, this change does not effect us. But looking Into
the future, this interpretation would greatly effect our proposed expansion to the existing
Winery. The Winery is located on 2.6 acres of land where the Development Rights have
not been sold. The allowable density (300 gpd x 2.6 acres) for the sanitary and waste
water would be 780 gpd. The current sanitary and waste water flow is 1139 gpd. The
proposed expansion to the Winery would require an additional 1306 gpd for a total of 2445
gpd. This proposed increase in sanitary and waste water flow would greatly exceed the
allowable density.
if the allowable density calculation utilized the entire acreage (300 gpd x 49.42 Acres)the
allowable would be 14,826 gpd . The proposed increase in sanitary and waste water flow
of 2445 gpd would be far below the allowable.

In recent discussions with the SCHD regarding this matter, we have been told that our
application for the sanitary system for the agricultural building will be processed with total
acreage allowed in the density calculation and that they are having " further meetings"
regarding the density restrictlons on the acreage where the Development Rights have not
been sold.
In discussions with Mr. Benny Orlowski of the Farmland Committee, he suggested that we
send you a Site Plan and an explanation of our concerns with the Health Department so
this issue could be placed on the Agenda for the Farmland Committee's meeting on March
27, 2001. We would appreciate the Committee's consideration and input wlth the Health
Department on this matter. If we can answer any questions please do not hesitate to call.

Whenever the Code calls for a public hearing, this section
shall apply. Upon determining that an application is complete,
the board or commission reviewing the same shall fix a time
and place for a public hearing thereon.The board or commission
reviewing an application shall provide.for the giving of notice:
A. By-causing a notice giving the time, date, place and
nature of the hearing to be published in the official
newspaper within the period prescribed by law.

Dear Ms. Adhya,
With regard to the above referenced project, we have been asked to respond to your
inquiry concerning the SEQR review of the basement area under a portion of the
proposed 4,669 sq. ft. addition to the existing winery.
A careful and complete SEQR review of this proposal was performed, and as lead
Agency,the Southold Town Planning Board issued a Negative Declaration on January
14,2002.The environmental impact of the basement area was a part of that determination.
It has been the policy of the Planning Board to consider basement floor area, especially
within wineries, as storage areas integral to the wine aging process,but not buildable
floor area.. While occasionally viewed by the public,these basement areas are not a
critical site.plan element. In fact, in this project, a large portion of the surface area of the
addition is dedicated to terraces just above the basement. The Planning Board considers
this feature an enhancement, which contributes to good site planning.
We hope that this clarifies this matter, and will help complete your review.

As per our conversation today, I am writing to request an interpretation of the SEQRA
determination dated January 14, 2002.
As part of the Suffolk County Health Department review, they requested a copy of the
SEQRA determination from the Town. The Negative Declaration was submitted to the
reviewing engineer, Tanima Adhya. Ms. Adhya has questioned the SEQRA
determination" Description of Action" that refers to a 4, 669 sf addition to an exitsting
winery. The description does not refer to the Basement area that is under the proposed
addition and the terraces.
What is the Town"s interpretation regarding basements in reference to SEQRA?
Can the Negative Declaration be amended or can a letter be written to the SCHD
regarding Basements.
If I can answer any additional questions, please do not hesitate to call.

On Tuesday, November 13th, the Planning Board reviewed the proposed addition
amendment to the site plan for Bedell Cellars. The plan appears to be basically
complete and a copy of the plan is being sent to the Building Department; to
Jamie Richter for drainage review; and to the Architectural Review Committee for .
their review. You will be notified upon receipt of all comments.
Because the proposed addition is less than 5,000 square feet, this particular
application is considered to be exempt from SEQRA review.
It would be appreciated if the lot coverage calculations could be provided for the
developable portion of the winery property, as opposed to the.entire acreage
planted to grapes.

Public Hearings
Under the current site plan application procedure, the process for
reviewing a site plan application is: a public hearing is not scheduled and
held by the Planning Board until after, among other things, the site plan
has received a stamped Health Department approval.
.The applicant shall now have the following options:
1. To follow the established procedure, or
2. To have the Planning Board schedule and hold a public hearing on
the site plan application and have the Planning Board vote on the
proposed conditional site plan prior to the applicant receiving
Health Department approval subject to the following conditions:
