Albertson, at Greenport, on Tuesday, March 6, 1962 at 3: 00 P.M. with the following present: Supervisor Albertson; Councilmen Demarest and Grath- wohl; Justices Tuthill and Clark; Supt. of Highways Price; Town Attorney Tasker. and Town Clerk Richmond. , Moved by Justice Clark; seconded by Councilman Grathwohl; RESOLVED: That the minutes of the meeting of February 20, 1962 be and they hereby are duly approved. Vote of Town Board: Ayes- Supervisor Albertson; Councilmen Demarest and Grathwohl;. Justices Tuthill and Clark. Moved by Justice Tuthill; seconded by Justice Clark; RESOLVED: That the minutes of the Special meeting of February 26, 1962, be and they hereby are duly approved. Albertson, at 16 South Street, Greenport, N.Y. on Tuesday, March 27, 1962, at 3: 00 P.M. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Grathwohl; Justices Tuthill and Clark. Moved by Councilman Demarest and seconded by Councilman Grathwohl; WHEREAS, the Town Board heretofore authorized the Supervisor to advertise for bids ,for the purchase of reefer coats for the Southold Auxiliary police and WHEREAS, the Supervisor caused:7.a notice to bidders to be placed in the official. town newspaper which notice provided that bids would be received until March 6, 1962, and WHEREAS, at a meeting held on Feb. 20, 1962, the Town Board erroneously opened a bid for such reefers and awarded the bid to Levin' s Men' s . Shop, NOW, THEREFORE, BE IT RESOLVED that the resolution awarding said bid be rescinded for the reason that said bid was opened and awarded prior to the date stated in the published notice t� bidders. Albertson be and he hereby is directed to enter into a lease with the Mattituck Gun Club, Inc. providing for the right to use the pistol range belonging to Mattituck Gun Club, Inc. for' practice and training of Southold Town Police, said range being located at East side of Cox Lane, Cutchogue, Suffolk County, N.Y. , said lease to provide that the Town of Southold Police be permitted the use of the pistol range at such times as is agreeable to Mattituck Gun Club, Inc. for a term of 4-years beginning the lst , day of January 1962 for the sum of $200.00 which sum will be paid on or before March 15; 1962. Albertson be and he hereby is author- ized and directed to advertise for sealed proposals for operation of the concession stand and facilities at the Southold Town Beach inri.Arshamomoque for a term of five (5) years from the 31st day of May, 1962 under the terms and conditions contained in the prepared form of agreement by Town Attorney Tasker . Guest, appointed Airport Attendant, in the sum of $5000.00 be and the same is hereby approved as to its form, manner of execution and sufficiency of sureties therein. Marshall appointed Junior Clerk in the sum of $5000 .00 be and the same is hereby approved as to its form, manner of execution and sufficiency of sureties therein. Moved by-Justice Clark-; seconded by Justice Tuthill: RESOLVED: That Supt. of Highways Price be and he hereby is authorized to advertise for bids for one screen conveyor . Moved by Councilman Demarest; seconded by Justice Clark; WHEREAS, the Superintendent of Highways has advised the Town Board that it is necessary to acquire additional real property for the housing and storage of highway machinery, trucks and equipment, and WHEREAS, the Superintendent of Highways has advised the Town Board that the owners of real property adjacent to the present highway building formerly owned by RRymond Davids, deceased, have agreed to convey the real property hereinafter described to the Town Board for the sum of $5, 000.00, NOW, THEREFORE, BE IT RESOLVED. that the Superintendent of Highways of the Town of Southold be and he hereby is authorized and directed to enter into a contract with and to purmhase from Dora F. Davids, Winston F. Davids, Robert L. Davids, Wilma C. Roberts, Nelson C. Davids and Ray- mond H. Davids the following described real property for the sum of $5000.00: ALL that certain plot, piece or parcel of land, situate, lying and being at Peconic, in the Town of Southold, County of Suffolk and State of New York, more fully bounded and described as follows: BEGINNING at a point on the easterly line of land of, th e Davids Estate -and the westerly line of land of the Town of Southold North 30 degrees, 10 minutes 50 seconds West 208.32 feet from the northerly line of the Main Road; running thence along land of said Davids Estate South 48 degrees 40 minutes 000 seconds West 244.84 feet to the northeasterly corner of land of Sternemann; thence along land of Davids Estate North 33 degrees 31 minutes 20 seconds West 822 .85 feet to land of Dobek; thence along said land of Dobek North 46 degrees 42 minutes 20 seconds East 271.00 feet; thence along land of Debek and land of Surozenski South 32 degrees 34 minutes 30 seconds East 557 .89 feet; thence along land of Latham and along land df the Town of Southold South 30 degrees 10 minutes 50 seconds East 278.41 feet to the poi3at of beginning. Containing 4.923 acres. BE IT FURTHER RESOLVED: that the cost of acquisition of the aforesaid property be paid from general funds of the Town of Southold. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Grathwohl; Justices Tuthill and Clark. 58 Moved by Justice Clark; seconded by Councilman Demarest; WHEREAS, the Town Board of the Town of Southold desires to amend the Building Zone Ordinance of the Town of Southold as hereinafter provided, NOW, THEREFORE, BE IT RESOLVED that said ordinance shall be amended as follows: I. By amending Article III, Section 300 of said ordinance by inserting therein a new subdivision to be subdivision lA to read as follows: 1A- Two (2) family dwellings,, when authorized as a special except- ion by the Board of Appeals as hereinafter provided. II. By amending Article III, Section 300, subdivision 7 to read as follows: 7 - Accessory buildings, including one (1) private garage, when such accessory buildings are located in the rear yard, or a private garage c:Fr3thin or attached to the dwelling. III. By amending Article IV, Section 408, subdivision (b) , Subsection 2 to read as follows: 2 . Exceed in width one hundred (100) percent of the horizontal measurement of such wall. IV. By amending Article IV, section 408 by inserting therein a new subdivision to be subdivision (c) to read as follows: c. ROOF SIGNS - Inlieu of a wall sign authorized by the prededing subdivision (b) , a roof sign shall be permitted provided that the same is attached -to or incorporated in a roof which sign shall advertise only the business conducted in the building upon which it is attached, and provided that such sign does not: 1. Exceed two (2) square feet in total area for each lineal , foot of such roof, and 2. Extend above the highest point of the roof in the case of pitched roof, and in all other cases exceed two (2)., feet six (6) inches in heighth above the highest point of the roof, and 3 . Project beyond the edge of the roof. V. By amending Article VII, Section 705, to read as. follows: SECTION 705 - For each application or Appeal to the Board of Appeals as hereinafter provided, there shall be a fee of five dolloars ($5 .00) accompanying the Application or Appeal. , and BE IT FURTHER RESOLVED: That the Town Clerk be and he hereby is author- ized and directed to transmit t copy of this resolution to the Southold Planning Board together with a written request instructing said Planning Board to prepare an official report concerning the .same pursuant to Section 901 of the Building Zone Ordinance of the Town of Southold. Albertson be and he hereby is 'autho- ized to advertise for sealed bids and purchase from the lowest bidder 360 feet of 9 gauge wire to be installed at the Town Dump, Cutchogue, N.Y. Moved by Justice Clark; seconded by Councilman Demarest; RESOLVED: That the Town Clerk be and he hereby is directed to request the Long Island Lighting Company to remove two (2) 100 cp aerial street lights, one on LILCO pole #425, corner of Bay Home Rd. and Route 25, .and one on pole #396 (NYTCO) East of Town Harbor Lane on the north side of Route 25, Southold, N.Y. , and replace them with MV Lights, also install one 100 cp light on Pole #5 on Laurel Lane, Southold, N.Y. , all in the Southold Light District. Moved by Justice Tuthill; seconded by Councilman Demarest; RESOLVED: That the Town Clerk be and he hereby is directed to request the Long Island Lighting Company to install one 100 cp aerial street light on LILCO Pole ##4 on Holden Avenue, Fleet' s Neck, Cutchogue, in the Cutchogue Light District. Moved by Councilman Grathoohl; seconded by Justice Tuthill: RESOLVED: That the Town Clerk be and he hereby is directed'_-to request the Long Island Lighting Company to install one 100 cp aerial street light on LILCO Pole #9 on Grathwohl Road, one on LILCO Pole #3 on Fisher Road in New Suffolkk, both lights in the Cutchogu-e Light District. Albertson be and he hereby is auth- orized and directed to advertise for bids for proposals to furnish to- the Town of Southold six (6) new police cars and to trade in five (5) used police cars. Moved by Justice Clark; seconded by Justice Tuthill: RESOLVED: That General Bills in the amount of $10, 221.49; Lighting District Bills in the amount of $2, 583 .47; Fishers Island Ferry District Bills in the amount of $8, 929.51 be and the same are hereby ordered paid. Copy of letters acknowledging the receipt of the letter of' the Suffolk County Board of Supervisors regarding the nuclear salt water plan in the Town of Southold were received from Governor Rockefeller and State Assemblyman Prescott B. Huntington. A letter was received from Merwin Gruschkin, the present operator of Town Beach Concession Stand..-- and Facilities, advising the Town that he is unable to continue operation of said Concession Stand and therefore requests that Town of Southold cancel the agreement dated May 11, 1960.. A letter was received from the State Traffic Commission denying a re- quest for a lower speed limit on Bay Avenue, Cutchogue, N.Y. Adjournment was at 5: 30 P.M. Albert W. Richmond Town Clerk MEETING ' OF MARCH 13, 1962 WAIVER OF NOTICE OFTOWN BOARD MEETING WE, the undersigned, being members of the Town Board of the Town of Southold, Suffolk County, New York, do hereby severally waive notice of the time, place and purpose of the meeting of the Town Board to be held at Greenport, in the Town of Southold, New York on Tuesday, March 13, 1962, and do hereby consent that the same be held on said date for the transaction of any business which may properly come before this meeting.
