The meeting was called to order by Supervisor Lester M. Albertson at 12: 30 P.M. with the follfwwng present: Supervisor Albertson; Councilmen Demarest and .Valentine; Justices Tuthill; Clark and Edwards; Town Attorney and Town Clerk Richmond. .Moved by Councilman Valentine.; seconded- by Justice Clark RESOLVED: That the next meeting :of the Town Board will be held at the office of the Supervisor,' Lester- M. 'Albertson, 16 South Street, Greenport, New York, on December 7, 1965, at 3: 00 P.M. Vote of Town Board:-Ayes'.Supervisor Albertson; Councilmen Demarest and Valentine; -Justices Tuthill', Clark and Edwards. Moved by Councilman Demarest; secnnded by Councilman Valentine; ' WHEREAS, ,Carlisle Cochran; Southold, N.Y. and Stanley Droskoski, Orient, N.Y. have served the Town of Southold as Police Patrolmen for a period of one and one-half years, NOW, THEREFORE, BE IT RESOLVED: That the salary of Carlisle Cochran and Stanley, Droskoski be and hereby are increased from $6300 to $6500 per year effective as of November 27, 1965 . Vote of Town Board: Ayes-Supervisor Albertson; gounallmen Demarest and Valentine; Justices Tuthill, Clark and Edwards. At 12:30 P.M. Supervisor Albertson opened the Hearing on the Fishers Island Ferry as advertised according to law, minutes of which were taken by a Secretary from Fishers island. Moved by Councilman Valentine; seconded by Justice "Clark; RESOLVED: That the Superintendent of Highways of the Town of Southold be authorized to advertise for bids and to .purchase from the lowest responsible bidder, the follow.dmg: 10, 000 lin. feet of snow fence with pickets 1'hx2 inches, spaced 2 inches apart, 4 foot high stained red, with 5 double strands 'of 12h gauge galvanized lire, in 100 lin. foot rolls. 1,000 6-foot-studded posts with flanges or anchor plates on posts, Posts shallM& less than 8.65 lb. each. Albertson, be and he hereby is authorized to advertise for bids for one (1) used car for use by the Supervisor. Albertson be and he hereby is authorized and directed to advertise for bids for proposals to furn- ish to the Town of Southold Six (6) new 1966 Police Cars and to trade in Five (5) used Police cars. County, New .York. ; WHEREAS, the Bca rd of Commissioners of the Fists s Island Ferry District, in the Town of Southbld,� Suffolk County, New York, has, pursuant to resolution duly adopted November 1, 1965, approved and recommended that the facilities of said Ferry District be increased and improved by the acquisition of an' additional ferry boat at a cost estimated not to exceed $165, 000, ' to .be used on the authorized routes of said Ferry District and has caused preliminary plans and specifications for the construction thereof to be prepared by Blount Marine, ship- builders and licensed naval architects, and has duly submitted to and filed with the Town Board of said Town of Southold, a -signed copy of such resolution and a 'written petition dated November 4, 1965, requesting that said' Town Board hold a public hearing to consider such increase and improvement of the facilities of said Ferry District and to make funds available pursuant to Chapter 699 of the Laws of . 1947, as amended, and the, Local Finance, Law to finance said increase and improvement_ of the facilities and to take other action in connect- ion therewith, all as more fully• described and referred to in said petition, together with such preliminary plans and specifications, all of' which have been- examined by the said Town Board; WHEREAS; pursuant to an order adopted -on November 9, 1965, said-Town Board duly called a- public hearing to consider said increase and. improvementsof the facilities of said District at' said estimated cost and certified copies of said order were duly published and posted pursuant -to the provisions of' the Town Law, and WHEREAS, a public hearing has been duly Meld by said Town Bold on this 23rd day of November, 1965, at 12:30 o'clock P.M. The Town of Southold, in the County of Suffolk, New York, hereby appropriates the amount of $165, 000 for the imcrease and improvement, of the facilities of Fishers_ Island Ferry District, in the Tcw n of Southold, -by the acquisition of an Iadditional ferryboat, including original equipment, machinery and'. apparatus required therefor, pursuant to the definite plans and specifications heretofore prepared,by Blount Marine, , shipbuilders and licensed naval architects, as .authorized pursuant to..said resolution" and order adopted by the -,Town Board of said Town on November 23, 1965, here- inabove .referre'd. to in the REcital hereof, heretofore approved by the Board. of Commiss-id)ners��of said Ferry District and hereby approved. The estimated maximum cost of said specific object or' purpose, .including preliminary. costs and -costs incidental thereto and' the financing thereof is .$165, 000. The `plan .of financing is the' issuance bf serial bonds of the .Towri of Southold in 'the principal .amount of $165;000 and, the -levy and-collection of taxes' on all 'the taxable real property in said .Town to pay the. principal of and interest thereon as the -same shall become due and payable. . The cost 'of acquiring said , ferry "boat shall be . raised by a tax 'upon all the taxable real property of the district, at the same time, in the same manner ,and.by the same officers as. Town charges are raised by a-' tax therein' and' when collected shall be paid by the tax therein and the amount of such special assessments will be budgeted as an offset to the taxes thus to be levied. Section 2: ' 8erial bonds of the Town `of Southold 'are hereby authorized to be issued in the -principal 'amount of $165, 000 pursuant to the provisions of the Local Finance Law, constitutimj'Chapter 33-a of the Consolidated Laws of ,the State of New York, 'to finance said Section­3. The following additional matters are hereby deter- mined and stated: (a) The period of probable usefulness of the specific object or purpose for which "the bonds authorized ''by this"'resolution are to be issued, with- n .the limitations of .Section ll, .a.' 26 of said Local Finance Law, is ten . (10)' years. ` (b) Current funds are not required' by said Law to be provided prior to the issuance of ,the bonds authorized by'.this' resolution, or any notes in anticipation, "thereof, 'pursuant tb the provisions of Section 107.00 d. 3 (i) of said Local Finance Law. (c) . The proposed maturity` of the bond authorized by' this res- olution may exceed . five -(5) years. Section 4: Each of -the bonds, authorized by .this- resolution" and any notes in anticipation_ thereof •shall contain the recital-:of validity prescribed by #52.00 'of said -Local Finance"L'aw 'and' said bonds and "any notes issued in anticipation of said bonds shall be general. obligations of the Town of Southold, payable as to both principal' and interest by a general tax upon all the taxable real property- within the-Town ' without limitation as to rate or amount. The faith and credit of the Town of Southold are hereby irrevocably pledged to the puncual payment of the principal of 'And interest on said bonds and` .pnv- vision shall be made annually in the budgets of the Town by appropriation for (a)- amortization and .redemption of. the bonds to mature in such year and (b) -the payment' of interest to- be due and payable. in' .such year. Section 5.' Subject to the .provisions' of .this resolution and of said Local' Finance Law, 'and pursuant to the provisions of #30.00 relative to .the •author`ization of the issuance of' bond' anticipation notes and of $50.00 and ###56.00 to 60.00 of 'said Law, the powers- and duties of the Town Board relative to 'prescribing `the" terms; • form and contents and as to the sale ' and issuance of the' bond's' ' hereby. authorized 'and any notes issued -in anticipation thereof- are hereby delegated to the Supervisor ' as 'the 'chief ,fiscal officer of 'the- Town.' Section 6. The validity of `the bonds. authorized by this reso- lution and of any bond anticipation notes issued in anticipation of said bonds, may"be contested only, if: ` (a) such obligations'are' authorized for an object -or .purpose, for which the Town is not authorized to expend money, ' or'' (b) the provisions of law "which should be complied with .at the date 'of "the .publication of such resolution, are not , substant ially complied with,;- and. an action-, suit or proceeding contesting suuhhvalidity,' is commenced within twenty -days after' the, date of such publication, 'or' "(c) "such 'obligations" are authorized in violation of thee. provisions of the constitution. Fishers Island Ferry District, in the Town of Southold, by the acquisition of an additional. ferry boat, including original equipment, machinery and $pparatus required therefor, pur- suant to the definite plans and ppecif-ications heretofore prepared by Blount Marine, shipbuilders and licensed naval architects, as authorized pursuant to said resolution and order adopted by the Town Board of said Town on November 23, 1965; APPROVING said plans and specifications heretofore approved by the Board of Commissioners; STATING the estimated maximum cost of said specific object or purpose is $165, 000 and the plan of financing is the issuance of $165,000 . serial bonds and the levy and collection of taxes on all the taxable real property in said Town to pay the principal of and interest on thereon as the same shall become due and payable; the cost of acquir- ing said ferry boat shall be raised by a tax upon all the taxable real property of the district, at the same time in the same manner and by the same officers as Town charges are raised by a tax therein and when collected shall be paid by the tax therein and the amounts _ thereof will be budgeted as an offset to the taxes thus to be -levied; THIRD: AUTHORIZING $165, 000 serial bonds of the Town to be issued pursuant- to the provisions of the Local Finance Law; FOURTH: DETERMINING AND STATING the period of probable use- fulness of the specific object or purpose for which the bonds authorized by this resolution are to be issued, is tbn (10) years; current funds are not required by said Law to be provided prior to the issuance of the bonds authorized by this resolution, or any notes in anticipation thereof, pursuant to the provisions of Section 107.00 d. 3 (i) of said Local Finance Law; the proposed maturity of the bonds authorized by this resolution may exceed five (5) years; 1480 FIFTH: DETERMINING that said bonds and any notes issued - in anticipation' of said bonds shall be general obligations of the Town and,PLEDGING to their .payment the faith and credit of 'the Town.
