Valentire ; seconded by Councilman Demarest; RESOLVED: That the regular meeting of the Town Board will beheld at the Fishers Island Fire House, Fishers Island, New York, at• 12: 30 P,M. on Tuesday, November 23, 1965 Vote 'of Town -Board: Ayes-Supervisor Albertson; Councilmen .Demar.est, and Valentine; Justices Tuthill and Clark. Moved by Justice Tuthill; seconded by -Councilman Valentine; RESOLVED: That the Southold.-Town -Board approves the- Planning Board Proposed Amendments, Rules and Regulations-.:for the..Subdivisions of.- Land, _ Town of Southold; to wit:_-- PROPOSED .AMENDMENTS RULES &' REGULATIONS FOR THE SUBDIVISION OF LAND TOWN OF SOUTHOLD 1, AMEND section on "PROCEDURE!' in regard to fee- for applications: 10 Acres or less - base -.fee ($50.00) fifty dollars; over 10 acres - base .fee plus. five ($5.00) dollars for each additional acre: or fraction' thereof in excess of ten acres. ALSO by adding a new paragraph under the fee: In addition, '• a highway inspection,,,;fee. of fifty .($50.00) per mile or fraction thereof will be charged:. 2.: on page )2:; under "PROCEDURES" , paragraph 3 shall be amended to read- as follows: At a regular meeting, the Planning Board will review the report consider all phases of the proposed subdivision and either approve or disapprove the tentative layout, whereupon the developer will be notified of. the approval or disapproval of the tentative layout as submitted. 3 . Byy, amending section 5 '-IMPROVEMENTS" , Subsection 2, item (b) ,by- adding a new item to be item b-2. Section 5, subsection 2, ; Iteih b, 2; All highways terminating at tidewater.'.must have a width of not less than 100 feet :for' a dis- tance of 100 feet back from the ordinary highwater mark of such tidewater: 4. By Amending section .•5-."IMPROVEMENTS," subse;ction:. 2, item (e)., to read, as-,follows:' Section 5, subsection 2 item (e) ; A width of_ not less than 70%.'. of the .bounds of the-°.highway: .shall be .her.einafter. known as the highway: area -from which all trees,,-brush,-,rocks, stumps., and .other obstructions shall be .thoroughly cleared and all such- material shall be removed from the .bounds .of. the highway. 5 . By amending section 5 "IMPROVEMENTS subsection 2,. item (g) by making (g) become (g-1) and-.adding a' new item .(g=2) to read as follows: Section 5, subsection 2, item g-2; Where- the surface is heavy loam or clay, remove to sandy subsoil and replace with bank run to grade. Sandy loam shall be used for the top six (6) inches as in subdivision g-1 above. fil-An 6. By amending Section 5 "IMPROVEMENTS" , Subsection 2, item (j ) to read as follows: Section 5,. subsection 2 , item (j ) ; After_:the. highway ,area has been properly graded, rolled and shaped to the approval of the Superintend- ent of_ Highways,. the twenty. four (24) foot section in the center of the highway area (hereinafter referred to as the road section) shall be stabilized with an application of (1) one gallon 6 - Sc"l bitumin- ous cut back per square yard mixed to a depth of (4) four inches. Within two months, and not less than- one (1)- month after stabilization, the• road section shall be rolled and properly prepared and an applic- ation of one half (z) gallon of Mc-2 bituminous cutback per square yard shall be applied with sufficient- sand to absorb the excess oil. In case of dry weather, the.:subgrade_ shall be wet down before the oil is applied. 7. Amend section 5 ".IMPROVEMENTS" , subsection 2, item (m) , to read as follows: , - Section 5, subsection 2, item (m) : Sidewalks shall be ,standard foVr (4) foot in width, f6ur. (4) inches thick except in driveways. where they must be not less than six. (6) ..inches thick. All curbs and gutters to be built to standard forms as they may be directed by..the superintendent of highways. On existing Town highways the Town will furnish the necessary engineering, grading, filling and labor; the property owners shall furnish the necessary ready mixed concrete and shall deliver such concrete to the site as directed, by the Superintendent of highways. The amount of sidewalk construction throughout the Town shall be -determined by the Town Board. 8. By .amending section 5 "IMPROVEMENTS" , by adding a new section to be subsection 4. Section 54"...subsection 4. A construction inspector retained by the, Town shall inspect-.all improvements, while- in the,-process of- construct- ion and it shall be the. duty of the subdivider to notify the Planning Board when the improvement is to be commenced and subsequently before it is completed. 9. By' amending section 5 "IMPROVEMENTS" , by adding. thereto. anew sub- section to be subsection 5, toread as follows: Section 5, subsection 5 . The Construction Inspector shall certify V to the Planning Board when all..improvements are completed as required by the regulations and specifications of the Planning..Board. " 10.By amending the section on "IDENTIFICATION AND DESCRIPTION",,. item .(t) , as follows: "IDENTIFICATIOM AND DESCRIPTION" , item (t)_. The minimum .width of any pavement shall be twenty four (24).� feet. 11. By',amending.. the section .on "IDENTIFICATION AND.'.DESCRIPTMON"' , . item (w) , as follows: "IDENTIFICATION AND.DESCRIPTION" , item (w) ; The minimum .thickness for sidewalks. shall be. four. (4) inches of: .1; 2:4 concrete mixture or equal. 12. By amending section 9, "DETAILS OF CONSTRUCTION IMPROVEMENTS'".'.sub section 1. to read as follows: Section 9 subsection (b-1) The entire sewerage system and the disposal of sanitary and storm sewerage shall be planned and built to comply with the requirements of the New,York state Department.. of, Health and of the Suffolk County Department of Health., but in all cases, all liquids must,be returned to the . soil except where such system is to .be .connected to a municipal sewer system. 13 . By amending section 9 "DETAILSr OF CONSTRUCTION IMPROVEMENTS" sub- section 2, to read as follows: Section..9, : subsection 2: The water distribution- system shall comply with the requirements of the New York State Department of. Health and the Suffolk County Department of Health. , 19 14. By amending section 9 "DETAILS OF CONSTRUCTION IMPROVEMENTS" N ,byadding a new section 3; and thus moving all other 'subsections up one number. New section!,�i3 to read as follows: Section 9, subdivision 3:. All man=made waterways and/or canals - - must; have the approval of the Planning Board. . 15. By amending--Section-. 9, "DETAILS- OF CONSTRUCTION IMPROVEMENT" subsection 3 through -5 inclusive, by: subsection 3 -to be renumbered 'subsection 4 4 5 . 5 16. By amending section 9 "DETAILS OF CONSTRUCTION IMPROVEMENT" , subsection 6 by adding .a new phrase: section 9, subsection 6, = In ,lieu of making the improvements ' as specified ---------'of the parties thereto. CEf the Planning Board shall decide at' any-time during the term of the performance Bond, (upon. inspection -by it' s cons tructi .n- inspector) that the extent of the building development that has taken place in the subdivision is not" sufficient to warrant ------------------- of such procedes. Moved by Justice Tuthill-; seconded .by Councilman Demarest WHEREAS, Martin Filla ,appiied to the Town Board for a single trailer renewal permit dated November 5, 1965, NOW, THEREFORE, BE IT RESOLVED: That the application of Martin Filla to locate a single trailer on his property at Oregon Road, Mattituck, N.Y. be: and hereby is granted for a six (6) month period. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Valentine; Justices Tuthill and Clark . Moved by Councilman Valentine;' sec conded by Councilman 'Demarest; WHEREAS, Isadore Krupski has applied to the Town Board for a single trailer renewal: permit dated November 3, 1965, NOW, THEREFORE, BE IT'.RESOLVED: - That the application ' of Isadore Krupski to locate a single trailer on his property at Peconic, N.Y:' be and hereby is granted for a six (6) month period.. Tasker., Esq. , presented to the Board •a signed copy of a resolution of the Board of Commissioners of the Fishers Island Ferry ;-- District; adopted, at a .special meeting of the Commissioners on November 1, 1965, entitled "Resolution Recommending and Approving an Increase and Improvement of the Facilities of the Fishers Islmd Ferry District of the Town of,, Southold, New York" togdther with a petition of the Commissioners of the Fishers Island Ferry District, dated November 4, 1965, requesting that the Town Board adopt an order calling a meeting of said Board dor the purpose of holding a public hearing, upon due notice, to consider acquiring an additional ferry boat for use on the authorized routes of said ferry district at an estimated cost of $165, 000.,• and approving the retainer of Blount Marine, Licensed naval Architects, and Robert W. Tasker, E°sq. , as counsel to said district for said increase and improvement of facilities. Mr. Tasker also presented the plans and specifications with respect to said ferry boat, .which were examined_ by the Town Board and turned over to the Town Clerk for -filing in the Town Clerk' s Office. That the undersigned are the duly ;qualified Commission- ers of the Fishers Island Ferry District, in the Town, of Southold, Suffolk . County, New York. 2. That your petitioners have been concerned for some time with the need of acquirin a add't *o l ferry boat for -use ,on is eras , s an the authorized routes of said/terry Distric , being an increase and improvement of the facilities of the said Ferry District, and have retained Fount Marine, of Warren, Rhode Island, licensed naval archit- ects, ,to ,prepare preliminary plans .and specifications for constructing such ferry boat and Robert .W. Tasker, Esq. , maintaining offices at 425 Main 'Street,. Greenport, New York,, as attorney in connection there- with. 3 . That said architects, Blount Marine; have prepared. pre- liminary plans and specifications annexed hereto as Exhibit "A" and made a part hereof, for constructing such a ferry boat. - 4. That pursuant to resolution duly adopted November 1, 1965, - annexed hereto as Exhibit. "B" a. nd made a part hereof, , your petitioners have appwed said preliminary plans and specifications and have recommended that such a ferry boat be acquired at a cost estimated not to exceed .$165, 000.,, all as more particularly described and referred to in said resolution. 5 . That as a result. of said preliminary plans and specif= ications and petitioners' own knowledge• of the ,future, needs of the District your petitioners believe that it is imperative that proceed- ings be instituted immediately to obtain the approval of this Board, for the - said increase and improvement of facilities and the financing thereof. - - '171 6 . That the Town Board of the Town of Southold is empowered to calla public hearing- after due notice, to hear all persons inter- ested in and to 'consider- the said increase and improvement of facilities of the F'i'shers Island Ferry District and after determination that it- is in the public interest., to approve and order such acquisition. WHEREFORE, your petitioners pray that the Town Board of the Town of Southold adopt- an order .calling a meeting of said-'Town Board for the ,purpose of holding a public hearing after due notice to con- sider acquiring an additional ferry-boat for use .on the authorized routes of said Ferry District, at an estimated maximum cost of $165,000. , being an increase and improvement of the facilities of said District, and further that the Town Board approve the retainer of Blount Marine, licensed naval architects, and Robert W. Tasker, Esq. , as counsel to said Ferry' District, for said increase and improvement of: facilities, and WHEREFORE,' your petitioners further pray that, should your Honorable Body find, after a`public hearing, that it is - in the public interest-to °so increase and improve the facilities of `said District, that you- adopt an order approving the acquisition of such a ferry boat,- and -authorize the Chairman of -the Board of Commissioners of said District to enter into a contract of the acquisition of such a ferry boat, pursuant to the provisions of said Chapter 699 of the Laws of 1947, as amended and WHEREFORE, your petitioners further pray that in order to finance said increase and improvement of facilities of said Fishers Island Ferry District funds be made available' by'the issuance' o'f ' obligations of the Town of- Southold in the principal amount of not to exceed $165, 000., pursuant to Chapter 699 of the Laws of 1947, . as amended, and the' Local Finance Law and- that a sum sufficient to pay the' 'interest and the principal of such obligations- as the same shall become due and payable shall be. assessed, levied and collected from the several lots and parcels of land within said Ferry Distr ict,, - in' the . same manner and at the same time ast:bther Town charges. The Town Board of the Town of Southold, in .the County of Suffolk, New York, hereby ratifies, confirms and approves the retainer by the .Board of Commissioners of Fishers Island Ferry District in the Town of Southold, of Blount Marine, shipbuilders and licensed naval architects, and Robert W. Tasker, Esq. , . in connection with the increase and improvement of the facilities of said Ferry District as her-einabove described in the recitals hereof. Section 2. Island Ferry District, .in. the Town of Southold, - Suffolk County, New York. ---------------------------------------------- WHEREAS, the Board of Commissioners of the Fishers Island Ferry District, in the Town of Southold, Suffolk County, New York, has, pursuant to resolution duly adopted November 1, 1965, approved and recommended that the facilities of said Ferry District be in- creased and improved by the acquisition of an additional ferry boat at a cost estimated no.t, to exceed $165,,000, to be used on the auth- orized routes of said Ferry District and has caused preliminary plans and specifications for the construction thereof-�:to be prepared by Blount Marine, shipbuilders and licensed naval architects, and has duly submitted to and. filed with -the Town Board of said Town of Southold, a signed copy of such resolution and a written petition dated November 4, 1965, requesting that said Town Board hold a public hearing to consider such increase and improvement of the facilities of said Ferry District and to make funds available pursuant to ,Chapter 699 . of the. Laws of 1947, as amended, and the Local .Finance Law to finance said increase and improvement of the facilities and to take other action in connection tiherewith, all as more fully described and referred to in ,said petition_ , together with such pre- liminary plans and specifications, all of which have been examined. .by said Town Board; now, therefore, be it ORDERED, that a meeting of the Town _Board of said Town of Southold be held at the Fishers Island Fire House in the Fishers Island -Ferry District, in said Town, on the 23rd day of November, 1965, at 12:30 o'clock P.M. (E.
