MEETING OF SEPTEMBER 21, 1965.
The Southold- Town Board met at the office of the Supervisor;` ,Lester
M. Albertson,_ -:at -Greenport, New York, on_September _21, ,2965 ,with- the
following present: Supervisor Albertson;' Councilmen Demarest arid•.- .

WHEREAS, by resolution adopted.by this, Town Board on the l7thday;.of
August, 1965, a public hearing was authorized,to be held in -the .matter
of the adoption of ,the "Good Order Ordinance", and
WHEREAS, said hearing was held by the Town Board..on the 7th .day; of
September, :1965, at. which time all interested persons were",given _
an opportunity.tobe heard, and
WHEREAS, this Board deems it in the best interest of the Town of .South-
old that the Southold Town "Good Order:-Ordinance"•:.be adopted, -.
NOW, THEREFORE, BE IT RESOLVED: That the Town Board of the Town of
Southold enact the following Ordinance: to wit-
"GOOD ORDER ORDINANCE"
Section 1. No person •or persons: shall consume alcoholic beverages from
any container while operating any kind of a vehicle, or as a passenger
of any kind of vehicle, or as a pedestrian on any public highways with-

Section 2. Any person who shall violate any provision of this ordin-
ance shall be guilty of an offense, and conviction thereof shall be
punishable by imprisonment in the County Jail for a term not to ex-
ceed six months or by a fine not to exceed $50.00, or both fine and
imprisonment.
Section 3 . If any clause, sentence, paragraph, section or part of
this section shall be adjudged by any Court of competent jurisdiction
to be invalid, such judgment shall not affect, impair or invalidate
the remainder thereof, but shall be confined in its operation to the
clause, sentence, paragraph, section or part thereof, directly in- y
volved in the controversy in which such judgment shall have been
rendered.

WHEREAS, Burton Potter Post #185 American Legion, Greenport, N.Y.
applied to the Town Clerk for a Bingo License Amendment, and
WHEREAS, the Town Board has examined the application and after invest-
igation duly made findings and determinations as required by law,
NOW, THEREFORE, BE IT RESOLVED: That the Supervisor Be and he hereby
is authorized and directed to execute on behalf of the Board the
findings and determinations required by law, and it is.` further
RESOLVED: That the Town Clerk be and he hereby is directed to issue
an amended Bingo License to the Burton Potter Post #185 American ,
Legion, Greenport, AT.Y.

WHEREAS, John C. Tuthill has applied to the Town Board -for a single

NOW, THEREFORE, BE' IT RESOLVED: 'That the application of John C.' Tuthill
Mattituck, New York, to. locate *a single trailer on his own property,
Elijah Lane, `Mattituck, 'New York,: be and-hereby is granted for occupancy
for 'a period of six (6) months.

WHEREAS, James J. Olsen, by,petition verified the 13th day of July,
1965, .pet11tioned the Town Board for a change of zone on certain real
property described in' said -petition, from "A" Residential and Agricult-
ural District to "B-2" Business District, and
WHEREAS, the said petition was referred to the Planning Board for
its official recommendation and report, and =
WHEREAS,---the Town''Board pursuant to due notice thereof', held a hearing

Wilsberg and Harold Wilsberg have heretofore filed an application
with the Town Board for the discontinuance of a .Town highway;_ in said
application and. .shown on the, map. attached thereto, . and, said.. appli-
. . , cants. have filed a. duly executed ."release ,covering the•,area..,of.said,.
highway to be abandoned,. and -
WHEREAS, this Board deems it in the best interest that -the portion,
of the highway, described in said" application be discontinued.. in view
.of the ,fact that - said:.highway,,has been., realigned and resurfaced re-
pulting in the, discontinuance. of, the. use of the .area described in
said _application•. for" highway. purposes, ' -
RESOLVED, ,that tonsent' be and the same hereby is given that the
Town Superintendent of Highways make an. order discontinuing as. a
Town highway that portion of the .Town highway known'as --Old-,Main -
Road", more . fully described in the aforesaid application and map.,. .,
all 'in accordance with the provisions of Section. 171 of the,.High-
way -Law,of the., State of.New York, and it; is further.
RESOLVED, that the Supervisor of the. Town .of Southold execute, ac-. .
knowledge and deliver quit claim deeds on behalf of said Town, con-
veying to the abutting owners thereof the portion of said highway
abandoned as hereinabove described.

Letters were received from the following: Mr. William Liebeknecht,
Principal of Mattituck. High School, commending Mr. William Januick,
Southold-- Town Bay Constable, for the fine professional manner in
which he handled a boating violation on the bay; frowtthe Cedar
Beach Park Association favoring an anti-noise control ordinance
which the Town Attorney is presently investigating; from Mayor
A. Barrett Jenkins of Wouthwold, Suffolk, England, thanking us for
the program and map sent to them during our Summer of History, and
advising us that they will be permanently kept in a glass case in
the Southwold Council Chamber. Also received by the Board was a
Certified Resolution from the Town of Shelter Island expressing
their sincere appreciation to the Town of Southold for their able
assistance when an emergency occurred on the.,waters of Peconic
Bay on- August 27th, 1965.
