The Southold Town Board met at the office of the Supervisor, Lester
M. Albertson, at Greenport, N.Y_ . on July 13, 1965, with the following
present: Supervisor Albertson; Councilmen Demarest and Valentine;
Justices Tuthill and Clark; Town Attorney Tasker`; Supt. of Highways
Price and Town Clerk Richmond.
Moved by Justice Clark; seconded by Justice Tuthill;
RESOLVED: That the minutes of the meeting of June 25, 1965 be and .
they hereby are approved.
Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest
and Valentine; Justices Tuthill and Clark.

RESOLVED: That the next meeting of the Town Board will be held at .

RESOLVED: That the Town Clerk of the Town of Southold be and he here-
by is directed to request the Long island Lighting Company to install
one (1) 400 MV OHSL on pole 4865 (LILCO & NYTCO) corner of Sage Blvd.
And Route 25, Greenport, N.Y. in the east-West Greenport Light District.

RESOLVED: That the Southold Town Board of the Town of Southold approves
the action of the Fishers Island Ferry District in the purchase of fuel
oil from Spicer Oil Co., -the lowest bid being 11.05.

WHEREAS, the Supreme Court of the United States of America has directed
the several states to apportion both houses of• their legislatures on a
population basis, and
WHEREAS, we believe this decision to be an- invasion of the States'
rights to determine their own system of representation, and
WHEREAS, Senator 'Dirksen has proposed an amendment to the United States
Constitution which- reserves to the States the sole right to determine
their own system of representation,
NOW, THEREFORE, BE IT RESOLVED: That this Board wholeheartedly supports
the Dirksen amendment, and be it further
RESOLVED: That the Clerk of the-Board be and hereby is authorized and
directed to send telegrams to the Hon, Jacob Javits and Hon. Robert
Kennedy, our United States Senators, respectfully requesting their
complete support of the Dirksen amendment and that they assist in the
memorialization of Congrees .to this effect .

WHEREAS, a petition was'received from- James Olsen requesting a change
of zone of certain property in Mattituck, New York, 'described in said
petition from "A"" Residential and Agricultural District to "B-2"
Business District,
NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of the Town of South
old be and he hereby is directed to transmit.-the -application to the
Planning 'Board in accordance with Section 901, Subdivision C of Zrticle
IX of the Building Zone Ordinance of the Town of Southold.

BOND RESOLUTION OF THE TOWN- OF SOUTHOLD, NEW YORK, ADOPTED
JULY 13, 1965, AUTHORIZING THE PURCHASE OF A PAYLOADER
TO BE USED AT THE TOWN REFUSE DISPOSAL AREA IN CUTCHOGUE
IN SAID TOWN, STATING THE ESTIMATED MAXIMUM COST THEREOF
IS $36, 000, APPROPRIATING SAID AMOUNT THEREFOR AND AUTHORIZ
ING THE ISSUANCE OF $36, 000 SERIAL BONDS OF THE TOWN TO
FINANCE RAID APPROPRIATION.
Section I. The Town of Southold, ih the County' of Suffolk, New York,
is hereby authorized to purchase a motor vehicle, described as a
Payloader, to be used at the Town Refuse disposal area, in Cutchogue;
in said Town. The estimated maximum cost of -said specific object or
purpose, including preliminary costs and costs incidental thereto and
the financing thereof, is $36,000 and the said amount is hereby approp-
riated therefor. The plan of financing -includes the issuance of $36, 000
serial bonds of the Town and the levy of a tax upon' all the taxable
real property in the Town to pay the" pr"incipal of and, interest on said
bonds as the same shall become due and payable.
Section II. Serial bonds of the Town of Southold in the principal
amount of $36, 000 are hereby authorized to be issued pursuant to the
provisions of the Local Finance Law, constituting Chapter 33-a of the
Consolidated Laws of the State of New. York, to finance said appropri-
ation:
SECTION III. The following ad diti:onal.).matters; are "hereby determined
and declared:
(a) ' The period of probable 'usefulness of the specific "object or
purpose for which the bonds authorized by this resolution are to be
issued, within the limitations of Section 11.00 a. 29 of said Local
Finance Law, is five (5) years.

(b) Current funds are not required by said Law to be provided as a
down payment prior to the issuance of the bonds hereby authorized or of
any notes issued in anticipation of the sale of such bonds, pursuant
to the provisions of ##107.00 d.5. of said Local Finance Law.
(c) The proposed maturity of the bonds authorized by this resolution
may not exceed . five (5) year.
Section 4._ Each of the serial bonds authorized by this resolution and
any bond anticipation notes issued in anticipation of the sale of said
bonds shall contain the recital of validity es prescribed by $52.00 of
said Local Finance Law and said bonds and any notes issued in antici-
pation of said bonds, shall be general obligations of the Town, payable
as to both principal and interest by general tax upon all the taxable
real property within the Town without limitation of Late or amount.
The faith 'and credit of the Town are hereby irrevocably pledged to the
punctual payment of the principal of and interest on said bonds and
provisionsshall be made annually in the budget of the Town by approp-
riation for (a the amortization and .redemption of the bonds and any
notes in anticipation thereof to mature in such year and (b) the
payment of interest to be due and payable in such year.
Section 5 . Subject to the provisions of this resolution and of said
Local Finance Law, and pursuant to the provisions of ##30.00 and #
50.00 and ## 56.00 to 60.00 of ,said Law, the powers and duties of the
Town Board relative to prescribing the terms,' form and contents and
as to the sale and issuance of the bonds and any notes issued in antic-
ipation of said bonds, are hereby delegated to the Supervisor, chief fis-
cal officer of the Town.
Section 6 . The validity of the bonds authorized by'this resolution
and of any notes issued in anticipation of said bonds, may be contested
only if:
(a) such obligations are. authorized for an object or putpose
for which the Town is not authorized to expend money
(b) the provisions of law which should be complied with at the
date of the publication of such resolution, are not substant-
ially complied with, and an action, suit or proceeding contesting
such validity, is commenced within twenty days aft 11 er the date of
such publication, or1_4 .
(c) such obligations are authorized in violation of the provisions
of the constitution.
Section 7. This resolution shall take effect immediately.

RESOLVED- AS FOLLOWS: Section 1. The Town Clerk 6f the Town of Southold,
in the County of Suffolk, New York, is hereby directed to publish the
foregoing bond resolution in full, in the Suffolk Weekly Times, a news-
paper published in "Greenport, New York, having a general circulation in
said Town and hereby designated. as the official newspaper' of said Town
for sucy publication,' together with the Town Clerk' s statutory notice
in substantially the form prescribed by section 81.00 of 'the Focal
Finance Law of the State of New York.
Section 2. This resolution shall take effect immediately.

WHEREAS, Dr . Schaefer has requested permission to run a water pipe on
Town property, and
WHEREAS, the Highway Superintendent has examined the situation. and re-
commends the issuance 'of a permit therefore,
NOW, THEREFORE, BE IT RESOLVED: That the Town Board hereby authorizes the
Supt. of Highways to issue a permit for the placing of a water pipe
within the bonds of the Town Highway.

WHEREAS, Frank Kull has applied to the Town Board for a single trailer
renewal permit dated 1965,
NOW, THEREFORE, BE IT RESOLVED: That the -application of Frank Kull to
locate a single trailer on his property, Indian Neck Lane, Peconic., N.Y.
be and hereby is granted for occupancy for -a six (6) month period.

RESOLVED:` That the Southold -Town Board will accept �a Bond of $12, 000
as recommended by the Southold Planning Board for the completionof
roads and water in the subdivision "Eastern Shores-Section 311,
Greenport, N.Y.

WHEREAS, an amended petition was received from William J. Pollert re-
questing a change of zone of certain property in Greenport, N:Y. des—
cribed in said -petition from "A" Residential and Agriculural District
to "B-2" Business District,
NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of the Town of
Southold be and he hereby is directed to transmit the application to
the Planning Board in accordance with Section 901,% Subdivision C of-
Article IX of the Building Zone Ordinance of the Town of Southold.

Agricultural District to "M-111 ,Multiple Residence District,
NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of the Town of
Southold be and he hereby. is directed to transmit this application to
the Planning Board in accordance with Section 901, Subdivision C of
Article IX of the Building Zone Ordinance of -the Town of Southold.

WHEREAS, Southold Town -Planning Board has prepared -an official report
and recommendation upon the petition of Katherine J. Schafer for a
change of zone from "A" Residential and Agriculural District to "B-2"
Business 'District on certain property `in Orient, N.Y.
NOW, THEREFORE, BE IT RESOLVED: That a public hearing will be held by
the Southold Town Board at the ' Supervisor ' s Office, 16 South Street,
Greenport, N.Y. on August 10, 1965 at 7: 30 P.M. on •the above mentioned .
petition and that the Town Clerk be and -he hereby is authorized and
directed to cause a notice of said `Hearing to be published in the
Suffolk Weekly 'Times pursuant to the requirements of law. -

RESOLVED: That the Superintendent of Highways of the Town of Southold
be authorized to advertise for bids and to purchase from the lowest
responsible bidder, for immediate delivery one- (1) Bulldozer.

RESOLVED: That upervisor Lester M. Albertyson be and he hereby is
authorized to purchase one new copying machine for Town use. _.

RRESOLVED: That the Supervisor, Lester M. Albertson, be and .he hereby is
authorized to hire Douglas Robertson, to supervise the numbering of
houses in the Town of Southold at the rate of. $2.00 per .hour .

WHEREAS, THE Commerce and .Industry Fund in -the Annual Budget for the
current year is $3000.00, and.
WHEREAS, of such sum. appropriated, $3000.00 remains unexpended to date,
NOW, THEREFORE, BE IT', RESOLVED: That $500.00 of said unexpended balance
be and the. same is transferred to Economics Opportunities Committee,
other expense, and that the amount heretofore appropriated for said
purpose be and the same is increased in the amount of $500.00.

RESOLVED: That General Bills in the amount of $10, 584.04; Lighting

Bills in the amount of $13, 210.34 and Highway Bills in -the amount of
$22, 129.12 be and the same ,are.hereby ordered paid..:

A letter was received from Mr. Arch Davis offering twenty pin oaks for
public use.
A letter was received from Kimogenor.. Point Corporation, New Suffolk,
New York, requesting the Supervisor to have the County consider a
dredging .project at the north of West Creek. This request was for-
warded to the County Superintendent of Public Works.
A letter was read from the Mayor of the Town of Southwold, England,
thanking the Supervisor for .the programs and information concerning
our 325th Anniversary Celebration.

Mr. Knowles and Mr. Prellwitz .were .present to thank the Town Board for
having the County dredge :in Richmonds Creek.
