WE, the -undersigned, being members- of the Town Board -of the Town of
Southold, Suffolk County, New York, do hereby severally waive notice
of the time, place and purpose of ,the meeting of..the Town-.Board to be
held at -Greenport,� in the Town of southold, New York on Tuesday, .
February 23, 1965 at 1:30 P.M.- and do.hereby consent that the same, be
held on said date for the .transaction .of..any business which. may-prop-

A Special meeting of the Southold Town Board- was held -at the Supervisor' s
Office, 16 South Street, Greenport, New York, the meembers. of the Board
having waived notice of the time, place and purpose of the meeting.
The meeting was called:to order by the Supervisor at 1:30 P..M. with the
following= present: Supervisor. Albertson.; Councilmen Demarest and Valen-
tine; Justices Tuthill -and Clark; Town: Attorney Tasker and Town..Clerk
Richmond.
Moved by Justice' Clark ; seconded by Councilman .Valentine;
.RESOLVED BY THE TOWN BOARD OF..THE TOWN OF SOUTHOLD- IN;.THE COUNTY-OF,-
SUFFOLK, NEW YORK, AS FOLLOWS:
. Section _1. A Bond Anticipation-.Note of .this Town, in. the
principal amount of $43,.000, is hereby authorized .to.:be issued pursuant
to the provisions of the Local Finance Law-,. .constituting Chapter 33-a
of the Consolidated Laws of the State of New Yor7., .:for- the..specific
object or purpose as more fully described by the resolution entitled:
"Bond Resolution of the Town of Southold, New York, .. _
adopted. December 8:, 1964, authorizing the asquis-
Ition of certain land at---New Suffolk, , -in said
Town, as the site of a. Town Beach and Recreation
Area, stating .the .estimated maximum cost thereof.
is $44,.000, appropriating :said:-amount therefor and . a?a
authorizing thddissuanpe of. $44,000 serial bonds :of. said
Town to finance said appropriation. "
duly 'adopted. by the Town Board on the date therein referred to. Said
Note is to be issued in anticipation of the sale- of .serial bonds .of.
the Town heretofore authorized to be issued by said resolution. No
bond -anticipation notes are outstanding in -anticipation of the sale
of said bonds and the Note hereby authorized is..not a renewal note.
The period of maturity of the Note hereby authorized shall not exceed
one year from date, and said Note may be renewed pursuant to the
provisions of the Local Finance-:Law.'. .Said Note is not to be issued
in anticipation of bonds for an assessable .improvement.
Section 2. The terms, form and.-.details of said Note shall

Section 3 . Said Note is hereby. sold to NORTH FORK BANK AND
TRUST COMPANY, Mattituck, New York, at the price of par, . to .•bear..interest
at the rate of two and five hundredths per centum (2.051y.) per annum,
payable at maturity„ and the. Supervisor is .authorized to-deliver said
Note 'to said purchaser upon receipt of the principal amount, plus accrued
interest,' if any, from the date .of said Note to the- date of delivery.

Section 4. Said Note -.shall contain the recital of
validity prescribed by #52.0.0 of.. said Local finance Law, and ,shall_
be a general obligation of -the Town, payable.,as to both principal ,
and interest--.by a general tax upon all the taxable real property_
within the-- Town, without limitation of rate. or amount. The, faith
and credit of the Town is hereby irrevocably pledged to. the .punc-
tual. payment of the ,principal of and interest on said- Noteeand
provision shall be-made in the budget of the Town by appropriation
for,the the redemption of. the Note to mature in such year and for the
payment of interest to be due in such year.
Section 5. • .Said Note shall be executed in the name
of the. Town by .the ,Supervisor. and the corporate- seal of said Town
shall be affixed .thereto and attested by the Town Clerk.
Section 6. This resolution ski 1.1 take effect

WHEREAS, the Board-,desires to amend the provisions of- the Building ..
Zone Ordinance and the Building Zone Map forming a part thereof, as
hereinafter set forth, 1)
NOW,- -THEREFORE,--BE IT RESOLVED: That the Town_Clerk of the Town of
Southold- be and he hereby is authorized and' .directed to transmit to
the Planning Board of the Town of Southold a certified -copy of this
proposed amendment,% together with a .request, in writing to said
Planning Board instructing said Planning Board to prepare an official
report with- its recommendations on' ,-said proposed amendments, pursuant
to the provisions of Article • IX, Section . 900 of the Building Zone

II. -By amending Article . II, Section .200 of said

SECTION 200 - USE-DISTRICT-REGULATIONS-

III. By amending Article..III, Section 300, Subdivision.

bathing beaches.,: bathhouses or boathouse-s.
4 -. Agrinultural .Farms, poultry. farms, nurseries,
greenhouses and truck gardening (does not include farms for the
breed.ing.-or. raising of ducks) .
..:' 5 - The following uses when authorized as a special
exception by the Board, of Appeals as hereinafter provided:
.(a) The conversion of any.,building in .existance _at
the effective date hereof to a two family dwelling.
(b). The •erection or construction of a two family
dwelling provided that the lot .shall have an area
of not'. less than twenty-five thousand (25, 000) square
feet and a frontage of not less. than two hundred

V. By amending Article. IIIA, Section 350 of said Ordinance
to read as follows:
SECTION 350 - In the _"M" Multiple Residence District, no
building or premises shall be used, and no building shall be hereafter
erected- or altered unless otherwise provided in this Ordinance except
for one (1) or more of the following uses:
1. All .permitted .uses in "A" Residential and Agriculural
and fm---1 Multiple Residence: Districts.
2. Hotels and motels.
3..:Tqurist cottages. -_(More than one (1) Tourist Cottage
may be permitted -on a lot when. author.ized as a special exception by
the Board of Appeals as hereinafter provided.)
4.. Tourist camps,, ,when authorized as, a special exception
:by the .Board of _Appeals aLa.-,hereinafter provided.
5. Marinas for the docking, mooring or accomodation. of
non-commercial boats when authorized as a special exception by the
Board of Appeals as hereinafter provided.
6. Accessory uses on the same lot with and customarily
incidental to.. any -permitted use and not involving the conduct of a
sepatate business.
VI. By amending said Ordinance by inserting therein a
new Article to be Article III-to read as_.follows:
ARTICLE III B
"M-1" Multiple Residence District
SECTION 370 - In the "M-111. Multiple Residence District
no building or premises shall be used, .and.no building-_shall be hereafter
erected or altered unless otherwise provided in this Ordinance except
for one (1) or more of the following uses:
. .1. All permitted uses in "A" Residential and
Agricultural Districts'.
2i Dwellings designed- for and occupied by not more
than four : (4) families:_
3 . Boarding and-tourist houses.
4� Accessory uses on the same -lot with and cust-
omarily incidental to any permitted uses and.. ...,
not involving, a separate business.
SECTION 371.- All premises -in the . "M-1"-.Multiple
Residence District shall comply with the provisions.. of Article IIIA
with respect to building height, building area, size of- lot area,
front yard, side yards, rear yard, off-street parking. area and signs.
VII. By amending Article IV, Section;400 of said
Ordinance to read as follows:
SECTION 400 In :the II.BII Business District, no
building or premises shall be used, and no building shall be hereafter
erected or altered unless otherwise provided in,, this Ordinance, except
for one X1) or more of the following uses
1. All permitted uses 1n the "A" Residential and
Agriculural,' '"M" Multiple Residence;,
Multiple Residence, "B-1" :Business and "B-2"Business

2: Storage Houses.
3. Icemanufacturers.
4. Expresskcarting or hauling offices or stations.
5. Yards for storage and sale of fuel and building
materials.
6. Printing plants.
7. Bookbinding plants.

9. Creamery, butter and cheese making and milk
bottling and distributing plants.
10. Carpenter shops.
11.- Plumbing shops.
12. Blacksmith Shops.
- '13. -Electrician shops:
14. Upholsterer shops.
15. Tinsmith - shops.
16. Painter shops
17. Marinas, commercial docks, commercial fuel docks
and piers.
18.- Ferry docks and ferry houses.
19.. Boat yards, boat storage yards and .boat storage
basins.
2.0. Any manufacturing, fabricating, .treating, convert-
ing, finishing, altering or assembling, _ in connect-
ion with the afaresaid ;permitted uses and which is a necessary incident
and accessary to the preparation of articles to 'be sold primarily on
the premises or to the performing of a service' primarily for residents
of the- neighborhood.
21. . Accessory use on the same lot:with and cust-
omarily indidental3.to any of the above- permitted uses.
22. The stripping: of land to secure satisfactory top
soil for 'grading or other purposes is permitted, provided material. so
obtained is used on the immediate premises, If a building. is being
constructed or altered material excavated in connection with such
construction or - grading on the premises may sold however. Cement
block manufacturing, ,and natural• production uses - such as the '-excavat-
ion for sale of sand, gravel, clay, shale or other natural mineral
deposit are permitted Inly as a special exception by the Board of Appeals.

VIII. By amending said Ordinance by inserting therein a
new Article to be Article IV A to read as .follows:
ARTICLE IV A
"B-1" Business District
-
SECTION 420 - In the B-1" Business District, no building
or premises shall be. used and no building shall be hereafter erected
or altered unless otherwise provided in.this Ordinance except for one
(1) or more of the following uses:
1. All permitted uses in the "A" Residential and
Agricultural, "M" Multiple Residence, "M-1"
Multiple Residence and "B-2" Business Districts.
2. The following .uses when authorized as a special
exception by the Board of Appeals as hereinafter
provided;,
Places of� amusement.
b. Public garages..
C. Gasoline service stations.
d. New and used car lots.
e. Fishing stations. .
3. Accessory uses. on .the same lot with and customarily
inc idental . to any permitted uses and not involving
a separate business.
SECTION 421 - All premises 'in the 'IH-1" Business
District shall comply with the provisions of Article IV with respect
to building height, building area, front yard, rear yard, density
of population, signs, _size of -lot area and off-street parking Berea.

2. One (1) and two (2) family dwellings provided that such
dwellings comply with the provisions of Sections 301
to -308, inclusive, of this Ordinance.
3 . Multiple dwellings.
4. Hospitals. -.
5. Clinics. :
6. Nursing Homes.
7. Offices. ,
8. Banks and financial institutions.

9. Retail stores.
10. .Resta_urants.
11. Bake shops (for on-premises sales)
12. Laundromats and similar establishments. .
13. Tailor' , dry cleaners' and .milliners' shops.
14. Shoe repair shops.
15. Jewelers';, opticians' watch and clock shops and
similar establishments.
16. Marinas for the docking, mooring and accommodation
of non-commercial boats, . .including the sale of fuel
and Ioi1 primarily for the use of boats accommodated
in such marina.
17. Lodges, chapter houses and clubs-.
18. Accessory uses on the-.same lot with and customarily
incidental to any permitted uses and not involving
a separate business.
SECTION 441 - All premises in the "B-211 Business. .
District .shall comply with the provisions of Article IV with respect
to building height, building area, front yard, -rear yard, density
of population, signs, size of lot area and off-street parking area.

MEETING - OF MARCH 9, -1965
The Southold Town Board met at the office of Supervisor Lester M.
Albertson at Greenport, N.Y. on Tuesday, March 9, 1965. The meeting
was called to order at 3:00 P.M. with the following present: Super-
visor Albertson; . Councilmen- Demarest and Valentine; Justices Tuthill
and Clark; Town Attorney Tasker and Town Clerk Richmond.
Moved. by Justice Clark; seconded by Councilman Valentine;
RESOLVED: . That the minutes of the regular meeting -of February 16,
1965 and 'the Special meeting of February. 23, 1965 be and hereby
are duly approved.
Vote of .Town Board: Ayes-Supervisor Albertson; Councilmen Demarest
and Valentine; Justices 'Tuthil.l -and Clark.
.Moved by councilman Demarest; seconded by Councilman Valentine;
RESOLVED: That the next regular meeting of the Town Board will be
held at the office of the Supervisor, Lester M. Albertson, 16
South Street, Greenport, New York, on Tuesday, March 23, 1965, at
3:00 P.M.

RESOLVED: That this Board request the enactment by the New York
State Legislature of Senate Bill Intro, 1133, Print 1761, and- the
Assembly companion Bill entitled"An Act to Amend the Town Law-
in Relation to'Regulation :of Hunting and- the Discharge of Firearms
in Towns -of the County of Suffolk" .

WHEREAS, a petition was received from Robert Waddington, Jr. request-
ing a change of zone of certain property known as -North Dumpling
Light, located between Fishers Island and the Connecticut Coast
Line between Groton and Mystic, Connecticut and described in said
petition from "A" Residential and Agricultural District to "B"
Business .Distriet,
NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk bf the Town of
Southold be and he hereby is directed to transmit the application
to the Planning Board in accordance with Section 901, Subdivision
C of Article Ik of the Building Zone Ordinance of -the Town of
Southold.
Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest
and Valentine; Justices Tuthill and Clark.

RESOLVED: That the report of Howard M. Terry, Building Inspector,
