Lieblein orage Building SCTM# 1000-56-4-11 & 13.1 Dear Mr. Strang: The following resolution was adopted by the Southold Town Planning Board at a meeting held on Monday, February 14, 2000. The final public hearing was closed. The following resolution was adopted: WHEREAS, this proposed site plan, to be known as site plan for Budd's Pond Realty and William H. Lieblein Boat Storage Building is to construct a 10,000 square foot boat storage building; WHEREAS, Budd's Pond Realty and William H. Lieblein are the owners of the property known and designated as Port of Egypt, Main Road, Southold, SCTM # 1000-56-4-11 & 13.1; and WHEREAS, a formal application for the approval of this site plan was submitted on April 9, 1999; and WHEREAS, the Southold Town.Planning Board, acting under the State Environmental Quality Review Act, (6NYCRR), Part 617, declared itself lead agency and issued a Negative Declaration on September 13, 1999; and ' Port of Egypt - proposed amE.....d site plan �� Page 2 February 15, 2000 WHEREAS, this site plan, last revised November 20, 1999 was certified by,the Building Inspector on November 18, 1999; and WHEREAS, area, setback, and height variances were granted by the Board of Appeals on July 28, 1999; and WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold have been met; be it therefore _ BE IT RESOLVED, that the Southold Town Planning Board authorize-the Chairman to endorse the final survey dated July 7; 1999, with Suffolk County Department of Health Services approval stamp and last revised on November 20, 1999, subject to a one year review from date of building permit. The purpose of the variances requested is to permit the applicant to construct a large boat storage building to meet the increasing demands of customers who purchase boats and would like them to be stored and serviced inside a secure weather-proof facility. Applicant's existing storage facilities are filled up. 4. A number of people testified at the_public hearing that by placing boats now storage outside in a new boat storage building, the site would be improved and made more attractive, which would be a benefit t to the neighborhood as well as vehicles passing by on Route 25. 5. The neighboring properties north of Route 25 to the LIRR and south of Route 25 to Budd's Pond (Peconic Bay) are zoned Marine II. The proposed use is consist with this and surrounding properties,,as well as the stated goals of the Marine II Zoning District. 6. The Southold Town Planning Board ihas recommended approval of the requested variances. 7. The'Southold Town Trustees have issued a wetland permit for construction of the proposed boat storage building. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record before the Board, and personal inspection, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed boat storage building is consistent with the commercial marine business uses on this and surrounding properties. The indoor boat storage building will be a benefit to the neighborhood by helping to eliminate the need for outdoor boat storage, thus creating-a more attractive site that will enhance the appearance of the area. - 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because the lot size is nonconforming, and the .requested rear yard variance is required to properly locate the storage building on the non- conforming lot. The requested height variance of seven(7'� is de minimus. 3. The lot size area variance is substantial. The setback variance is not substantial in relation to the nonconforming size of the lot and reasonable placement of the proposed boat storage building. The height variance is de minimus. 4. The proposed variances will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because the Southold Town Trustees have reviewed the potential environmental impact of this proposal with respect to the adjoining wetland area, and have issued the applicant a wetland permit. No other evidence was presented to suggest that the proposed boat storage building would have any adverse effects on the physical or environmental conditions in the neighborhood or the district. Such representative may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). The permittee shall provide a person to accompany the Departments representative during an inspection to the permit jarea when requested by the Department. Gr6nting of this permit does not relieve the applicant of,the responsibility of obtaining any other permission, consent or approval from the U.S.Army Corps of Engineers, U.S. Coast Guard, New York State Office of General Services or local government which may be required. 4. All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project. 5. Any material dredged in the conduct of the work herein permitted shall be removed evenly, without leaving large refuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause damage to navigable channels or to the banks of a waterway. 6. There shall be no unreasonable interference with-navigation by the work herein authorized. 7. If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. The storage of construction equipment and materials shall be confined to within the project work site and or upland areas greater than 75 linear feet from the tidal wetland boundary. 5. The east and west areas adjacent to the building shall be planted with the vegetation specified in the permit and the applicant shall ensure a minimum of 85% survival of plantings by the end of five growing seasons. If this goal is not met, the applicant shall re-evaluate the restoration project in order to determine how to meet the mitigation goal and submit plans to be approved to the Bureau of Marine Habitat Protection, Building 40 SUNY, Stony Brook, NY 11790-2356. 6. Necessary erosion control measures i.e., haybales, silt fencing, etc. are to be placed on the downslope edge of any disturbed area. This sediment barrier is to be put.in place before any disturbance of the ground occurs and is to be;maintained in good condition until thick vegetative cover is established. i 7. The purpose of the variances requested is to permit the applicant to construct a large boat storage building to meet the increasing demands of customers who purchase boats and would like them to be stored and serviced inside a secure weather-proof facility. Applicant's existing storage facilities are filled up. 4. A number of people testified at the public hearing that by placing boats now storage outside in a new boat storage building, the site would be improved and made more attractive, which would be a benefit t to the neighborhood as well as vehicles passing by on Route 25. 5. The neighboring properties north of Route 25 to the LIRR and south of Route 25 to Budd's Pond (Peconic Bay) are zoned Marine II. The proposed use is consist with this and surrounding properties,.�s well as the stated goals of the Marine II Zoning District. 6. The Southold Town Planning Board has recommended approval of the requested variances. 7. The Southold Town Trustees have issued a wetland permit for construction of the proposed boat storage building. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record before the Board, and personal inspection, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed boat storage building is consistent with the commercial marine business uses on this and surrounding properties. The indoor boat storage building will be a benefit to the neighborhood by helping to eliminate the need for outdoor boat storage, thus creating a more attractive site that will enhance the appearance of the area. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because the lot size is nonconforming, and the requested rear yard variance is required to properly locate the storage building on the non- conforming-lot. .The requested height variance of seven (T is de minimus. 3. The lot size area variance is substantial. The setback variance is not substantial in relation to the nonconforming size of the lot and reasonable placement of the proposed boat storage building. The height variance is de minimus. 4. The proposed variances will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because the Southold Town Trustees have reviewed the potential environmental impact of this proposal with respect to the adjoining wetland area, and have issued.-the applicant a wetland permit. No other evidence was presented to suggest that the proposed boat storage building would have any adverse effects on the physical or environmental conditions in the neighborhood or the district. Only two of the possibilities are varying the roof lines along each building and making each of them a different design. Windows, real or simulated, ought to be rectangular with shutters. The recommended siding finish is board and batten, real or simulated, to relieve the length of the buildings! Doors and siding ought to be the same shade of gray and the standing seam roof a dark green. It is recommended that the landscaping on the North Road be moved forward to the proposed line of trees and planted on an undulating berm. A double row of evergreens, 8 to 10 feet high, planted on 10 foot centers is proposed. The East, West, and Southerly boundaries should be landscaped with a single row of 8 to 10 foot evergreens planted on 10 foot centers and placed outside the fence. A sprinkler system for the 'landscaping is included in this recommendation.
