The Southold Town Board met' at the office of the Supervisor, Lester M.
Albertson, 16 South Street, Greenport, New York, on September 6, 1966.
The meeting was called to order at 3 :00 P.M. with the following present:
Councilmen Demarest and Valentine; Justices Tuthill and Clark; Town
Attorney Tasker; Superintendent of Highways Dean and Town Clerk Richmond.
Moved by Justice Clark; seconded by -Councilman Valentine;
RESOLVED: That Councilman Demarest act as Chairman of the meeting in
the absence of Supervisor Albertson, who was taken sick and was unable
to attend the meeting.

THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN. THE COUNTY OF SUFFOLK,
NEW YORK,- HEREBY RESOLVES (by the favorable vote of not) less •than
three-fifths of all the. memb'ers of said Board) AS FOLLOWS:
Section 1. The Town of Southold, in the County of Suffolk,
New York (herein .called 'Town") , is hereby au.thorized. to acquire by
purchase, condemnation or otherwise, the certain piece or parcel of
land bounded by the northwesterly line. of Lower Road and the south-
westerly line of .Ackerly_ Pond Lane, in said Town, as the site of a new
Town Hall, said piece or parcel of land containing 28. 71 .acres,. more
or less, and being more particularly described by, metes: and bounds
as follows : All that certain plot, piece or parcel 'of land, with the
buildings and improvements thereon erected, situate,: lying and being
at Southold, in the Town of Southold, Suffolk County, New York, bounded

and described as follows : Beginning at a point on the northwesterly line
of Lower Road . at .the, southeasterly corner of land of Terry; from said
point ,of beginning running along said northwesterly line of Lower- Road
the .following two courses and distances :- (.1) South 32 degrees 12 minutes
10 seconds West, 598.83 feet; thence (.2) South 53 degrees 15 minutes 50
seconds West .1003. 61 feet to .land of Faucon; thence along said land of

beginning. The estimated maximum cost of said specific object or pur-
pose, including preliminary costs of surveys, maps, plans, estimates
'and hearings and costs incidental thereto and the financing- .thereof,
is $60, 000 and capital notes in the principal amount of $3, 000.. tp
provide the down payment required b1a the .Local Finance Law, constitut-.
ing Chapter 33-a of the 'Conso.lidated Laws of the State of New.York_
(herein called "Law") , and serial bonds in the principal amount of
$57 , 000 of the Town, are hereby authorized to be issued to finance the
amount of $60, 000 hereby appropriated therefor. The plan of financing
includes the ,-issuance of said capital notes and said serial bonds to
finance said appropriation, and .the levy and collection .of_ taxes on all
the taxable real property in the Town to pay the principal of said notes ,
and bonds and the interest thereon as the same shall become due and
payable. ,,
Section 2. The Town is hereby authorized. to construct a
new .Town Hall on said site hereinabove authorized- to be acquired in
Section 1 hereof,-- to grade and improve said. site and purchase the orig-
inal furnishings, equipment, machinery and, apparLtus required for the
purpose for which said Town,Hall . is tg .be used. Thia estimated maximum
cost .of-said specific�_ objeot ox •purpose, , including preliminary costs and
costs incidental .thereto and the financing .thereof, is . $1, 240, 000 and
capital notes in the principal amount of $62 , 000 to provide the down
payment required by the Law. and 'ser:ial bonds in. the principal amount of
$1, 17,8, 000, of the. Town,. are hereby authorized to be-- issued to finance
the amount of $1,.240, 000 hereby appropriated. therefor. The plan of
financing, includes. .the issuance -of said. capital notes and serial bonds
to finance said appropriation., and the levy and collection of taxes on
all the taxable real property .in the Town to pay..the principal of said
notes and bonds and the interest ..thereon ,as . the same shall become due
and payable.
Section- 3—The following additional :matters are hereby
determined and declared:-
(a) The estimated, total cost of acquiring said land and
constructing said new Town Hall, . includin.g ,pre.liminary costs . of surveys,
maps, plans, estimates and hearings and costs incidental thereto and
the financing. thereof, is $1, 3Q0, 000.
(b) The period of- probable usefulness - of. acquir�.ng _said
land, being-. the ,specific object or purpose for which said $3, 000 -capital
notes and said $57 , 000 serioa.l bonds authorized by this resolution,
are to be issued, within the limitations o,f .Section 11.00 a. 21 of the
Law, is thirty (30) years.
(c) The period of probable usefulness of constructing said
new Town Hall, being the specific object or: purpose (6or which said
$62, 000 capital notes and said $1, 178,,000 serial bonds authorized by
this resolution .are to be issued, within _the .limitations of Section .
ll.00 a. 11. (a) (1) of the Law, is thirty (30). years.
(d) Current funds are required .by the Law to be provided
prior to the issuance of the serial bonds authorized by this resolution,
or any- bond anticipation notes in anticipation of the sale of .such bonds,.
and such current funds in the respective amounts of $3, 000 and $62 , 000
will be provided from the- proceeds of the capital notes hbrei.n author-
ized to be issued.
(e) The proposed '.maturity of the bonds authorized by this
resolution will exceed five (5) years.
Section 4. Each of the notes and bonds authorized by this
resolution and any bond anticipation notes issued in anticipation of
said bonds, shall contain the recital of validity prescribed by Section
52. 00 of the Law and said notes and bonds and any notes issued in antic-
pation of said bonds, shall be general obligations of the Town, payable
as to both principal and interest by a general tax upon all the taxable
real property within the Town without limitation of rate or amount.
The faith and credit of the Town ,are hereby irrevocably pledged to the
punctual payment of the principal of and interest on said notes and bonds
and provision shall be made annually in the budget of the Town by
appropriation for (a). the amortization and redemption of the notes and
bonds to mature in such year and (b) the payioen.t of interest to be due
and payable in such year.
Section 5 — Subject to the provisions of this resolution and
of the Law, and pursuant to the provisions of Section 30.00 relative to
the authorization of the issuance of bond anticipation notes and of
Section 50.00 and Sections 56. 00 to 60.00 of the Law, the .powers and
duties of the Town Board relative to prescribing the terms, form and
contents and as to the sale and issuance of said notes. and bonds, and
any notes issued in anticipation of said bonds, or the renewals thereof,
are hereby delegated to the ,Supervisor, the chief fiscal officer of the
Town.
Section 6. The validity of the notes and bonds authorized
by this resolution and of any notes issued in anticipation of said bonds,
may be contested only if:-
(a) such obligations are authorized for. an object
or purpose for which the Town is not
authorized to expend money, or
(b) the provisions of law which should be complied
with at the date of publication of such resolution-,
are not substantially complied with,
and .pt..- ,nl...action, suit or proceeding contesting such validity, is commenc-
ed within twenty days after the date of such publication, or
(c) such obligations are authorized in violation of the
provisions of the constitution.
Section 7 . A proposition for the approval or disapproval
of this resolution shall be submitted to the qualified voters of the
Town at a .Specia.l Town Election to be held on SEPTEMBER 30, 1966, and
this resolution shall take effect upon approval of the proposition by
said voters of the Town at that referendum vote.

The. TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF SUFFOLK,
NEW YORK, HEREBY RESOLVES, AS FOLLOWS:-
Section 1. A Special Town Election shall be held in the
Town of Southold, in the County of . Suffolk, New York, in said Town on
SEPTEMBER 30, 1966, at 8 :00 o ' clock A.M. (D.S .T.) and polls shall remain
open until 9:00 o' clock P.M. (D.S.T.) , or as much .longer as may be
necessary to enable the voters then present to cast their votes. Voting
will be at the following polling places :-
No. 1 Fishers :Island Fire House, Fishers Island, N.Y.
No. 2 . Town Clerk ' s Office, Main Road, Southold, N.Y.

Section 2 . The Town Clerk of said .Town shall cause the Notice
of such Special Town Election to be published at least onee in the
"LONG ISLAND TRAVELER-MATTITUCK WATCHMAN" , a newspaper published in
Southold, New York and designated the officialnnewspaper of the Town
and in the "NEW LONDON DAY", a 'newspaper published in New' London,
Connecticut, and having a general circulation `in Fishers Island, in
the Town, and to be posted on the signboard of the Town maintained
pursuant to subdivision 6 of Section 30 of the Town Law and in at
least five (5) public places in said Town, said publication and posting
to be at least ten (10) days before such Special Town Election.
Section 3. Said Town .Clerk is hereby authorized and directed
to include in the Notice of the Special Town Election as hereinafter
set forth notice that the Town Board will submit on its own motion at
the said Special Town Election, for the approval or disapproval of the
voters of the Town, the Proposition therein set forth.
Section 4. At said. Special Town Election, the vote upon the
said Proposition shall be by ballot label and the only persons qual-
ified to vote upon the said Proposition shall be persons who are
both electors of the Town and who are the owners of property in the
Town assessed upon the last preceding ' aseessment roll thereof.
Section 5 . Election inspectors and ballot clerks for . each ' , '
polling place at said Special Town Election shall be selected by the
Town Board on its own motion from the list of election inspectors
and ballot clerks previously designated by said Town Board for general
election purposes.
Section 6. Said Notice shall be in 'substantially the

An abstract of such resolution, concisely stating the purpose and effect
thereof, is as follows :- „
FIRST: AUTHORIZING the Town of Southold ("town") to acquire by `purchase,
condemnation or otherwise, the certain land bounded by the northwesterly
line of- Lower, Road and the southwesterly line of Ackerly Pond Lane, in
the Town, as the site of a new Town Hall; DESCRIBING said land `by metes
and bounds; STATING the estimated maximum cost thereof is ,$60, 000;
AUTHORIZING issuance of $3, 000 capital notes to provide the' down payment
and $57, 000 serial bonds, to finance $60, 000 appropriated therefor and
STATING the plan of financing includes the issuance of said capital notes
and, -serial bonds to finance said appropriation and the levy and collection
of taxes on all the taxable real property in the Town to pay the princi-
pal of said notes and bonds and the interest thereon as the same - shall
become due and payable.
SECOND: AUTHORIZING the Town to construct a new Town Hall on- said site
hereinabove authorized to be acquired, to grade and improve said site
and purchase the original furnishings, equipment, machinery and apparatus
required therefor; STATING the estimated maximum cost thereof is: $1, 240,
000; AUTHORIZING the issuance of $62, 000 capital notes to provide the
down payment and $1, 178, 000 serial bonds to finance $1, 240, 000 appropri-
ated therefor and STATING the plan of financing includes . the issuance of
said capital notes and serial bonds to finance said ,appropriation and
the levy and collection of taxes on all the taxable real property in
the Towntto pay the principal of said notes and bonds and the interest
thereon as the same 'shall become due and payable;
THIRD: DETERMINING that (a) the estimated total cost of , acquiring said
land and constructing said Town Hall is $1, 300, 000, (b) the period of
probable usefulness of acquiring said land, being the specific- object
or purpose for which said $3 , 000 capital notes and $57 , 000 bonds are to
be issued, is 30 years, (c) the period`of probable usefulness of const-
ructing said Town Hall, being the specific object or purpose for which
said $62 , 000 capital notes and $1, 178, 000 bonds are to be issued, is
30 years, (d) current funds are .required to be provided prior to the
issuance of .such bonds or any notes in anticipation thereof and such
current funds will be provided from the proceeds of said capital notes
and (e) said serial bonds will, have a maturity in excess of five (5)
years;
FOURTH: DETERMINING that said notes and bonds and any notes iasued in
anticipation of said bonds shall be general obligations of the Town
and PLEDGING to their payment the faith and credit of the Town;
FIFTH: DELEGATINGto the Supervisor the powers and duties as to the
issuance of said notes and bond's and' any such notes in anticipation of
said bonds ar the renewals thereof;
SIXTH: STATING the vaJ dity of the notes and bonds authorized by the
resolution or any notes in anticipation of sa-id bonds, may be con-
tested only if ) a) such obligations are authorized for an object or
purpose, for which the "Town is not authorized to expend money, or
(b) the provisions of law which should be complied` with at, the date of,
publication of, the resolution are not substantially complied with and
an action, suit or proceeding is commenced within 20 days after such
date' .of publication, or (c) such obligations are authorized in violation
of the constitution; and
SEVENTH: PROVIDING that the resolution shall be 'subject to a referendum
vote and submitted as a Proposition at a Special Town Election on
SEPTEMBER 30, 1966. and that said resolution shall take effect upon
approval of the .Proposition.
No person shall be qualified to vote upon the said Proposition unless
he/she is an elector of the Town and the owner ` of 'property assessed upon
the last preceding Town assessment roll.

$1350. 00 for the Town share for brochures of the new Town Hall.

RESOLVED: That Supervisor Albertson be and he hereby is -requested to
contact the State Traffic Commission to survey traffic conditions
and place the necessary safety signs in front of Truman 's Beach Area,

RESOLVED: That George Muir of East Marion, N.Y. ,be and he hereby is

of $7 . 50 per day for each school day worked; effective as of September
7 , 1966, he to serve at the pleasure of the Town Board.

WAIVER OF NOTICE OF SOUTHOLD TOWN BOARD MEETING
WE, the undersigned, being members of the Town Board of thb Town
of Southold, Suffolk County, New York, do hereby severally waive
notice of the time, place and purpose of the meeting of the Town
Board to be held at ,Greenport, New York, in the Town of Southold,
on Saturday, September 10, 1966, and do hereby consent that the
same be held on said date for the transaction of any business
which may properly come before said meeting.

A special meeting of the Southold Town Board was held at the
Supervisor ' s Office, 16 South Street, Greenport, N.Y. on Satur-
day, September 10, 1966, the members of the Town Board having
waived notice of the time, place and purpose of the` meeting. The
meeting was called to order by Supervisor Lester M. Albertson.
Moved by Justice Clark; seconded by Councilman Valentine;
WHEREAS, Burton Potter Post #185 American Legion, Greenport, N.Y.
applied to the Town Clerk for, a Bingo License Amendment, and
WHEREAS, the Town Board has examined the application and after in-
vestigation duly made findings and determinations as required by law,
NOW, THEREFORE, BE IT RESOLVED: That the Supervisor be and he hereby
is authorized and directed to execute on behalf of the Board the
findings and determinations required by law, and it is further
RESOLVED: That the Town Clerk be and he hereby is directed to issue
an amended Bingo License to the Burton Potter Post -#185 American,
Legion, Greenport, N.Y.

RESOLVED: That the Southold Town Board release the Bank Book and
securities in lieu of a Bond of $18, 000 (Section 4) and Bond No.
56-57-234 for $12 , 000 (Section 3) , Eastern Shores, as recommended
by the Southold Planning Board for the completion of roads in the
subdivision to be known as Eastern Shores, Section 3 and 4, Greenport,
New York, owned and developed by H.J.S . Land and Development_ Corp-
oration.
Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest
and Valentine; Justice Tuthill.

RESOLVED: That Supervisor Albertson be and he hereby is authorized
to enter into a Sales Contract with Clinton Hummel & Ors. for the
purchase of approximately 275 feet of beach property adjacent to
Manhanset Ave. , Greenport, N.Y. . Vote of town Board: Ayes-Supervisor
