Moved by Councilman Valentine; .seconded by Councilman Demarest; WHEREAS, Southold Town Planning Board has prepared an official report ANd recommendation upon the Town Board 's Own Motion for a change of zone from ".B" Business District to "A" Residential and Agriculural District on certain property situated east side .of Kenney' s Road, Southold, New York, NOW, THEREFORE, BE IT RESOLVED: That a public hearing will be held by the Southold Town Board at the Supervisor ' s Office, 16. South Street, Greenport, New York, on Tuesday, January 23, 1968, at 7 :30 P.M. on the above mentioned petition and that the Town Clerk be and he hereby is authorized and directed to cause notice of said hearing to be pub" lished in the Suffolk Weekly Times pursuant to the requirements of law. Klein, Sr. to locate a single trailer on his property on Main Road, Mattituck, N.Y. be and the same ie hereby granted. for a six month period.. Moved by Councilman Demarest; seconded by Councilman Valentine; WHEREAS, " Costas Stars has made application to the Town Board trotdedicate a certain `road at East Marion, N.Y. to be known as STARS ROAD, more fully described in said .petition together with releases executed by the owner thereof, and WHEREASX the highway superintendent has inspected the said highway and has advised the Town Board that said proposed highway complies in all respects with the specificaitons for the dedication of highways in the Town of Southold, NOW, THEREFORE, BE IT RESOLVED: 'That in accordance with Section 171. of the Highways Law of the State of New York, consent be and the same is given to the Superintendent of Highways to make an order laying out the aforesaid highway to consist of lands described in said application and shown on certain maps attached to said application, and BE IT FURTHER RESOLVED: That the Town Clerk be and he .hereby is author- ized and directed to forthwith cause the dedication, release and deed to be recorded .in the office of, the Clerk of the County of Suffolk, N.Y. (A) ACQUISITION OF CERTAIN LAND SITUATE ON THE NORTHERLY SIDE OF MAIN ROAD, AT PECONIC, IN SAID TOWNS AS THE SITE OF A POLICE HEADQUARTERSBBM.MLDENG, AT AN ESTIMATED MAXIMUM COST OF. $6, 000 (B) APPROPRIATION OF SAID AMOUNT. THEREFOR,, AND. (C) ISSUANCE OF $6, 000 SERIAL BONDS TO FI_ NANCE SAID APPROPRIATIONS, (2) (A) ACQUISITION OF THE EXISTING BUILDING ON SAID SITE FOR USE AS SUCH POLICE HEADQUARTERS, AT AN ESTIMATED MAXIMUM COST OF $18, 000, (B) APPROPRIATION. The estimated maximum , cost of said specific object or purpose, including pre- liminary costs of surveys, .maps, plans and estimates and costs incidental thereto and .the financing thereof, is $6 , 000 and the said amount is .here- by appropriated therefor. Serial bonds of the Town in the principal amount of $6, 000 are hereby authorized to .be issued pursuant .to the Local Fianance Law, constituting , Chapter 33-2 , of the Consolidated Laws ,of the State of New York. (herein called "Law") , to finance - said appropriation and the plan of financing . includes the issuance .of said serial bonds and the levy and collection of taxes on all the taxable real ,property in the Town to pay the principal of said bonds and the interest thereon as the same shall be come due' and payable. . 20 Section 2 .. The Town is hereby authorized to acquire by pur- chase the existing building and origina-l - furnishings, equipment,-- mach- inery and apparatus required for the purpose for which said buildings is to be used, situate on the land 'hereinabove authorized to be - acquired in Section]lhereof, for use as such police headquarters and to grade and improve the site thereof. 'The estimated maximum cost of 's-aid spec- ific •object or purpose, including preliminary costs and costs incid- ental thereto and ,-the financing thereof, is $18, 000 "and the said amount is hereby appropriated therefor. Serial bonds of the Town in the princ- ipal amount of $18, 000 `are hereby authorized 'to be issued -pursuant to the Lawwto 'finance said appropriation and the plan of financing in- cludes the issuance of said serial bons and the levy and collection of taxes on—all—the taxable real property in -the- Town to pay the princ- ipal of said 'bonds and the interest thereon as the same shall become due and payable. Section 3. The Town is heregy authorized to reconstruct, ink; part, said building authorized to be purchased- for use as police head- quarters pursuant *to Section 2 hereof, and to purchase the original furnishings, -equipmeht, ' machinery and- apparatus required fot the pur- pose for which said building as so reconstructed, in part, is to be used. The estimated maximum cost of' said specific object or purpose, . including preliminary costs and costs incidental thereto and the financing thereof, is $6, 000 and said amount is hereby appropriated . therefor,' including the appropriation of $300 current funds 'now avail- able therefor to provide the down payment required pursuant to Section 107. 00 of the Law. Serial bonds in the principal 'amount of $5, 700 are hereby authorized to be issued pursuant to the .Law to finance the bal— ance of said appropriation. The plan of financing includes the use of said $300 current funds, the issuance of serial bonds of the Town iii.i the principal -amount of '$5,-700 and the levy of a -tax upon all the tax- able -real property 'in the Towne to pay- the principal of said bonds and the- interest thereon as the same shall become due `and payable. The following additional matters a-re hereby de- temined:and declared: (a) The estimated total cost of acquiring said land and said buildingaand' reconstructing; )inipart, -said building, including preliminary costs and costs of surveys; maps; plans, estimates and hearings and costs indiden)tal thereto and the financing thereof, is $30, 000. ) (-b)- The' period of probable usefulness of acquiring- said land, `the' specific object or purpose -for which said -$6, 000 • serial bonds authorized pursuant ,to Sectionl;- hereof are to--be issued; -is,- within 'the limitations of -Sect-ion 11,.00 a.' 21 of the Law, -thirty (30) years, but the maturi-ty -of said bonds shall not exceed ten (10) years. (c) `The period of -probable usefulness of acquiring- said building, being of Class "C" construbt�irQntae defined by- the provisions of Section 11. 00 a. 11 I(c) of the Law, the specific object or purpose for' which -s-did $18, 000 serial bonds authorized 'pursuant to Section 2 . hereof are to be 'issued, is, within the limitations of -Section 11 . 00 a. ll. (c)"'of- the Law, -fifteen (15) years; but the maturity of the bonds herein authorized to be issued shall not exceed seven (7) years. (d) The period 'of probable usefulness of reconstructing, in part, said building, the specific object or purpose, for which 'the $5', 700 serial -bonds '-authorized pursuant to Section 3 hereof are to' be issued, ' is, within the limitations 'of- Section 11. 00 a. 12. (a) - '(3) of the Law, ten (10) "year. (e) Current- -funds are not required to be provided prior - to the issuance of said $6, 000 and $18, 000 serial bonds authorized pursuant to " Sections 1. and 2. , re' spectively, • of this- resolution 'or any bond..anticip'ation notes issued in anticipationi- thereof, pursuant -to the provisions of "Section 107. 00 d. `4. of the Law. ('f) Current funds -are required by the Law to be provided• prior to the issuance of 'said $5, 700 serial bonds authorized pursuant - to Section •3, of this resolution or any bond anticipation notes -issued in anticipation thereof -and such current finds in •the amount of $300 are now available to said purpose from surplus moneys of the Town' and the chief fi'sca`l officer is hereby authorized and `directed to s'et aside said current funds and apply them solely to the specific object or purpose hereinabove described an said Section 3. 21 (.g) 'The proposed maturity of the bonds authorized by this resolution will exceed five (5) year. Section 5 . Each of, the, bonds 'authcr ized 'by this, resolution and an.y, bond anticipation. notes issued in' anticipation of _said bonds, shall contain the recital of 'validity prescribed by Sectiori '52.00 of the' Eaw and.-said bonds and, any notes issued in anticipation therof, shall be general obligations 'of the Town, payable as to both principal and interest by a general - tax: upon all the taxable real property within the- Town- wi'tYiout-.' lim'itation of rate or amount. The faith and -credit of the Town" are hereby irrevocably pledged 'to the punctual payment of the principal and interest on said bonds and any notes 'issued in anticipation of said bonds and provision shall be made annually in the budget of the Town by appropriatiori for- (a) the amortization and redemption of the bonds and notes to mature "in such gear -and (b) the payment of interest to be due and payable , in such year. Section' 6. ' Subjec't to the provisions of 'this resolution and of the Law, and pursuant tD the provisons of Section 30.00 relative to the authorization of the issuance of bond anticipation -notes and of Section. 50. 00 and Sections 56. 00 to '60.00' of the Law, the powers and duties of the Town' Board relative to' prescribing the terms, form and contents and asllto the sale and issuance of the bonds herein authorized and of any , notes:" issued in anticipation' of said bonds,' and' the renewals there- of, are hereby delegated to the chief fiscal officer of the Town. Section 7 . ` The validity of the bonds- authorized' by this resolution, and 'of any notes issued in anticipation of said bonds; may be contested- only if : (a) such obligations are authorized -for an object or purpose for which` the Town ' is not. authorized to' expend- money,' or (h) the provisions of law which should be complied with at ' the"date; of the publication of ' such 'resolution-, are not substantially complied with,' arid an action, `suit or proceeding contesting sucli valid- ity, is commenced within twenty days after the date, of such publication, or (c) - such obligations are authorized in-' violation of the pro- visions of the constitution. Section 8. "This' resolution shal'1 -take, effect thirty (30) days after its adoption, unless- within thirty (30) days after its adoption there shall be filed 'with the ,Town Clerk, in accordance with Article 7 of ' the*' Town Law, , a petition signed and acknowledged by electors 'of the Town of the number required by law, qualified to ' vote upon 'a proposition to raise acid expend money, protesting against this resolution. and re- questing that it be submitted 'to 'the electors of the '`Town for 'their approval' or disapproval`; "in which case' this resolution shall take' effect when' approved"by the affirmative_ vote of" a majority of` the. qualified electors- of the Town, voting upon a proposton 'for its approval at a referendum held in accordance with the Town Law: Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Valentine; Justice Tuthill. The Town ' Clerk of 'the 'Town of Southold; in the County of Suffolk,'. New York; shall, within ten (10) days'.'after the, adoption of the bond resoltuion 'referred- to in ' the. form of. Notice here- inafter set forth in 'Section 3 hereof, .'cause to be published at *'least -once in "THE SIIFFOLK WEEKLY TIMES" a newspaper published in Greenport, New York, having a general circulation within said Town and hereby designated as, the official newspaper of said Town, and to be posted on the signboard 'maintamned pursuan't­to 'sub'division '6 of Section 30 of the Town Law; a Notice which '-shall''set forth the date of adoption of said forego-ing -resolution and contain-an abstract -thereof concisely stating' "its purpose and" effect:` 2.2 Section 2. Town .to pay the principal of said bonds and the interest thereon as the same shall be come due and payable; THIRD: AUTHORIZING the Town to reconstruct, in, part, said building, including purchase of the. original furnishings, equipment, machinery and apparatus requrred for the purpose for which said build- ing as so reconstructed, in part is to .be used; STATING the estimated maximum cost thereof, is '$6",000 ' APPROPRIATING said amount therefor, including the appropriation of. $300 current funds. available therefor to provide' the down 'payment required; AUTHORIZING the issuance, of $5, 700 serial borids . pursuant ,to' the Law, to finance the balance• of 'said approp- riation;` and STATING the `planes of financing includes the use' of 'said current funds, the issuance of said serial bonds and the levy of a tax upon all the 'taxable' real property in the Town to pay the principal of said bonds and the interest thereon as the "same shall become due and payable; 'FOURT.H;DETERMINING AND DECLARING that the estimated total cost of acquiring said land and the said building and recorstructing, in part, said' bu"ilding, is $30, 000; 'that the period of probable usefulness of acquiring- said" land; is thiryt (30) years, `but the maturity of the bonds hrerin- authorized to be issued therefor will not exceed ten (10) years; that the period of probable usefulness of' acquiring said building, being a Class "C" building as defined pursuant to the providions of Section 11.00 a. 11 (c) of the _ Law 'is fifteen (15) years, :but the maturity-of the' bonds herein authorized to 'be' issued therefor shall not exceed. seven (7) `years; that the period of, probable usefulness"of ' reconstruct- ing, in part e,' said building, is ten (10) years; ' that current 'funds are hb-t required to be 'provided prior to the issuance 'of said' $6, 000 and $18, 000 bonds or any bond anticipation notes issued in anticipation thereof; that current funds 'are required to be, prov'ided prior to the issuance of siid $5, 700 bonds or any bond anticipation notes issued in anticipation thereof and such current funds in the amoynt',of $300 are now available to said purpose and AUTHORIZING AND DIRECTING the . chief fiscal officer to set aside said current funds' and apply them solely' to the. ppecifici.object or purpose hereinabove described in paragraph THIRD.- and DETERMINING AND DECLARING, that the proposed maturity"of the bonds -authorized by this resolution will exceed five (5) years;.' FIFTH: DETERMINING that said bonds and-any notes- issued . in anticipation of said bonds, shall be general obligations of the Town- and PLEDGING to their payment . the faith and credit of the Town; SIXTH: DELEGATING to the chief fiscal officer the`.'powers and duties as to the issuance of said bonds and any notes 'issued `in antic- ipation of said bonds and the renewals thereof; and SEVENTH: `'PROVIDING -that this resolution shall take effect thirty days after its- adoption, 'unless' within thirty days petition for its submission to' the' electors •shall be "filed' in accordance with law, protesting against the resolution and requesting it to be 'submitted to the electors for their- approval' or' disapproval.
