Tuthill Moved by Councilman Valentine seconded by Justice Clark WHEREAS, the proposed Local Law No. 1 - Year 1967 was hereto- fore introduced by Justice Clark and pursuant to a resolution, public hearing was held on the matter of the adoption of the following local law on September 7, 1967, at 7:30 P. M. in the Supervisor's Office, 16 South Street, Greenport, New York, at which interested persons were given an opportunity to be heard, and WHEREAS, this Board deems it in the best interest that the following local law be enacted, now, therefore BE IT ENACTED that the following local law be enacted: I r A local law establishing,a. housing code for the Town of Southold. Be it enacted by thIe Town. Board of the T owa of Southold as follows- ARTICLIL General Provisions 141 TITLE : This Kcal Lacy shall be lmown as '''I he flouslrag Code of the Town of Southold. '° 10 2 1Tlilr+, Sl:: The ,purpose of this Cede is to provide basic and uniform standards governing the .condition, occupancy and maintenance of residential premises, and establishing reasonable safegE-iar<is for the safety, health and welfare of the occupants and users thereof. This Local Law shall tame effect ten (10). clays from the date of filing with the Secretary of State. § 104 SCOPE This Cods shalt apply to residential premises as follows:.' a) :hots, plots or parcels of land on which residential buildings, building's of rraixed occupancy or accessory structures are located; b) esidenti al buildings, including one- and two-family dwellings and multiple dwellings, except as specifically excluded in Section 1 5; c) Resideiitial occupancies in buildings of mixed occupancy; and d) Accessory structures, accessory to residential occupancies. 105 NON-APPLICABILITY This Code shalt'not apply to mobile homes and mobile home courts, or to transient type occupancies Lind uses including, but not limited to, nursing and convalescent homes, hot.els, motels, tourist camps, farm labor camps, travel trailers and trailer parks, and other forms of temporary housing. 0 6 A,PPLICATION a - The provisions of this Code shall supersede local laws, ordinance codes, or regulations to the extent that such laws, ordinances, codes or regulations are inconsistent with the provisions of this Code, provided that mAhing herein contained shall be construed to prevent the adoption and enforcement of a law, ordinance, code or regulation which is Ynore restrictive or.establishes a higher standard than those provided in this Cf.,,de and such more restrictive requireinent or higher standard shall govern during the period in, which it is in effect.. b - Where a provisioii of this Code is' found to be in conflict with a provision of-a 'Zoni"11g, building, electrical, plumbing, fire, safety, health, water supply or sewage disposal 1!,)w or ordinance, or regu- lation adopted pursuant thereto, or other local law, ordinance, code or regulation, the provision or requirement,which is the snore re- strietive or which establishes the higher standard shall prevail. i 07 a U F.tS,R EN C E T 0 NU, V'V' YG R K S T A T EP B U 1 ILD 1 N G �THE CUNSTI-IUCTION'CODE AND G M LAVVS • Installations, alterations and repairs to residential premises, and materials, assenalblies and e4u], "ment utilized in�connection there-P with, shall be reasonably safe to persons and property and in -2- conformity with Applicable statutes' 'of the State of New York, and ,irders'a, rules aM regulations issued by authority thereof. ARTICLE E ITT Fire-Safety Requirements §401. PROIRMATED ACCUMULATIONS AND STORAGE It shalt be prohibited: (1) to accu-mulate or stare on residential premises, except in -14- approved locations, any highly flammable or explosive matter, such as paints, volatile oils, cleaning fluids and similar materials, or any combustible ref-use liable tp spontaneous combustion, such as waste Paper, boxes, rags or similar materials; and (2) to accumulate or store materials an fire ire escapes or stairs, in stairways or passageways, at doors or windows, or in any other locations where in.the event of fire such niaterials a my obstruct egress of occupants or interfere with fire- fighting operations. 402 FIREPLAC.US a - Fireplaces and similar construction used, or intended to be used -For burning fuel in open fires shall be con-nected to approved chimneys and shall be installed so that nearby or adjacent combustible material and structural members shall not be heated to unsafe temperatures. b - Hearths and linings or other parts of fireplaces exposed directly to flame-shall be of materials that will nut melt, disintegrate. , shall, or shatter at hi& temperatures. c - Mrood mantels and trim on fireplaces shall be placed and attached zo that they cannot be heated to unsafe temperatures or ignited by sparks or embers froin the fire. Albertson at 19:30 P.M. Moved by Councilman Valentine; seconded by Councilman Demarest; , RESOLVED: That $500.00 be and hereby is transferred as follows : From sur- plus Fund to property purchase fund for option agreement with Charles Slama and Lovese Slama, his wife, for purchase of property, Peconic, N.Y. Vote of Town Board: Ayes- Supervisor Albertson; Councilmen Demarest and Valentine; Justices Tuthill and Clark. Moved, by Councilman Demarest; seconded by Councilman Valentine; WHEREAS, Charles. and Louise Slama, his wife, have agreed to give the' Town of Southold an option to purchase property at Peconic, generally bounded North and East by land owned by the Town of Southold, South by Main Road and West by land of• Sternemann for the sum of $23, 500.00 , said option to expire on March 1, 1968, and WHEREAS, this Board . deems it in the public interest that the Town obtain an option to purchase the said premises on the aforesaid terms, NOW, THEREFORE, BE IT RESOLVED: That the Supervisor be and- hereby- is auth- orized and directed to enter into an option agreement with Charles Slama and Louise Slama, his wife, in consideration of the sum' of $500.00 to purchase premises hereinabove described for the sum of $23, 500.00, said - option to be exercised on or before March 1, 1968.
