The Southold Town Board met 'at the office of 'the Supervisor, Lester M.
, Albertson, at Greenport, New York, on June 9, 1967 with the following
present: . Supervisor Albertson; Councilmen Demarest and Valentine;
Justice Clark; Town Attorney Tasker; Supt. of Highways Dean. and Town
Clerk Richmond.
Moved by Councilman Demarest; seconded by Councilman Valentine;
RESOLVED: That the minutes of the meeting of. May 23, 1967 and the Special
Meeting of June 7 , 1967- be and they are hereby approved.
Vote of Town Board: Ayes-Supervisor Albertson; . Councilmen Demarest

RESOLVED: That the next meeting of the Town Board will be held at the
office of the Supervisor, Lester M. Albertson, 16 South Street, Greenport,
N.Y. on Tuesday, June 27 , 1967 , at 3 :00 P.M.

RESOLVED: That the Board retain Dominic Aurichio as Attorney to repre-
sent the Town of Southold in court in the .Stron case, he to be paid: a .
reasonable compensation for his services.

RESOLVED: That the Town Board approves the furnishing of transportation
for a trip to Jones Beach on July 10, 1967 for. the Senior Citizen' s Org-
anization, Town, of Southold.

WHEREAS, William H. - Liebeknecht applied to the Town Board for permission
to lay .and maintain a well point and water pipe •on Town property at
Old Jule Lane, Mattituck, N.Y.
NOW, -THEREFORE, BE 'IT RESOLVED: That Raymond Dean, Superintendent of
Highways, be and he hereby is authorized to issue a permit to William
H. Liebeknecht, said permit to be drawn by Attorney Tasker, to maintain
a well point and water pipe on Town property.

RESOLVED: That Supervisor Lester M. Albertson be and .he hereby is author-
ized. to purchase certified clams to be distributed 'by the baymen's Assoc-
iation in the bays, creeks and inlets of the Town of Southold, the sum
not to exceed $15.00.00.

WHEREAS, a petition was received from Casbor Inc. , Frank Born, Treasurer,
requests a change of zone of certain property on Westphalia Road and
Middle Road, Mattituck, N.Y. described in said petition from "A" Resid-
ential and Agricultural District to "B-2 " Business District,
NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk 'cif the Town of South-
old be and he hereby is directed to. transmit this application to the
Planning Bca rd in accordance with "Section 901, Subdivision C -of Article
IX of the Building Zone Ordinance of the Town of Southold.

WHEREAS., Minnie Wilson applied to the Town Board for a single' trailer

NOW, THEREFORE, BE IT RESOLVED: That the application of Minnie Wilson
to locate a single trailer on the property of -Claude Wilson, Middle Road,
Cutchogue, N.Y, be and hereby is granted for a period of six (6) . months
from June 20, 1967.

ation duly made findings and determinations as required by law,
NOW, THEREFORE„ BE IT RESOLVED:. That the Supervisor be and he hereby
is authorized and dir.ected•:to execute on behalf of the Town Board the
findings .and .determinations as required by law, and it is further
RESOLVED: That the Town Clerk. be and he hereby is directed to issue a .
Bingo License to the Greenport Fire Department, Greenport, N.Y.

$58, 2.71. 36 be and they are hereby ordered paid.

RESOLVED: That the Superintendent of Highways of the Town of Southold be

RESOLVED: That this Town Board retains Reginald C. Smith, Howard W.
Finkel-stein and Pierre Lundberg, as Attorneys to represent this Board
and it' s Supervisor in any additional .proceedings or actions , including
the action now pending in the U. S.. District Court, Eastern District of
New York, they deem necessary to commence, defend or appeal, , in, order
to validate Sec. 203, Suffolk County Charter, as same was enacted by
Chapter 2,78 .'Law of 1958 and to represent said Board and it's Supervisor
in -any necessary manner to enforce the provisions of Section 3 of Local
Law No-14. year 1966 ; County of Suffolk, N.Y. and that said attorneys shall
be paid a ,reasonable compensation for their .services.

• CAPITAL NOTE RESOLUTION OF THE TOWN OF SOUTHOLD,
DATED JUNE 9, 1967 , . AUTHORIZING THE ACQUISITION OF
CERTAIN LAND ON GARDINER'S '.BAY EAST OF THE VILLAGE
OF GREENPORT, IN SAID TOWN,, AS THE. SITE OF A TOWN
BEACH AND RECREATION AREA, AT THE .ESTIMATED MAXIMUM
COST .OF $18, 500.00, AND AUTHORIZING THE ISSUANCE OF
-AN. $18.,500.00 -CAPITAL NOTE OF SAID TOWN TO PAY THE
COST THEREOF.
BE IT RESOLVED, by the Town Board of the Town of Southold, Suffolk
County, New ,York, as follows :
Section l: The Town of Southold, in the County of Suffolk,
New York, hereby authorizes the acquisition by purchase of a certain
piece or ,parcel 'of land bounded on .the north by Manhanset Avenue, on the
east .by Gardiner ' s .Bay; on -the south by land of Morris , and on the- west
by land of the. Town of Southold, in said Town of Southold, as a, site .of
a Town Beach and recreation area, said piece or. parcel -of land being
more particularly described as follows :
ALL that certain plot, piece or parcel of. land, situate,
lying and being east of the Villa.ga of .Greenport', 'in the
Town of Southold, Suffolk .County, New York; bounded and
described as follows :
BEGINNING at a point formed by the intersection of the south-
erly line of Manhanset Avenue with the high water. mark of
Marion or .Gardiner ' s Bay and running thence southerly along,
said ordinary high water mark of Marion or Gardiner 's Bay
275 feet, more or less; to. the northerly. lin'e of land now
or formerly of Lillian S. Morris; running thence along land
last mentioned 150 feet, more or less;, :to the easterly line
of Gull Pond .Inlet; running thence northerly .and northwester-
ly along the easterly line of Gull Pond Inlet to said south�-
erly line of Manhanset Avenue,, thence easterly along, said south-
erly line of .Manhanset .Avenue 200 . fee.t; .more or less.:; • to , the
ordinary high water mark of .Marion or Gardiner ' s Bay. and the
point or place of beginning.
Reserving, however, unto the sellers a right-of-way 20 feet
in width along the westerly boundary line of tYe .above, des-
cribed premises for the purposes of ingress and egress to
and .from Manha•nset -_Avenue and other lands of the �.sellers
lying south of the above described premises -
Subject to rights-of-way of record, if any, of others over
the above described premises.
Section 2. The estimated maximum cost of said specific object
or purpos.e•,. , including preliminary costs of 'maps, plans ,-surveys . and est-
imates and costs incidental thereto and the financing thereof is- $18, 500.00
and the said amount is .hereby appropriated . therefor. The plan gf financ-
ing the aforesaid object or purpose ,.is by .the issuance of An .$18,'500.00
capital note., which is hereby authorized .to be issued pursuantlto, the ..
provisions of the Local . ' Finance Law.,
Section 3. It -is hereby determined• that subdivision. 2.1)-(a)
of paragraph a of .section ll.00 of . the Local Finance Lave applies:.'..tq. such
object or purpose, and that the period of probable•usefulness .thereof
is thirty. years, ;but the maturity ' of- the capital note hereby. ,authorized
will not exceed five years.
Section 4. It is hereby determined that no down payment is
necessary in connection with the aforesaid object or purpose.
Section 5 . The faith and credit of the To of Southold,
Suffolk County, New York, are hereby irrevocably pledged to the payment
of the principal of and interest on,.such note. An amount sufficient to-
pay the principal and interest on . such. capi:tal note . shall ..be included
in the-tannual budget and levied: as a part of the taxes 'for .the fiscal
year Iin which .the same matures.
Section .'6. Subject-.to .the provisions of the Local.. Finance Law,
the power , to sell such note .is. hereby- delegated to the Supervisor, the
chief fiscal. officer,' Such note . shall .be of such terms, .form and con-
tents, and shall. be sold in such manner, as maybe prescribed (b� the
Supervisor, consistent with. the provisions of the Local. Finance .Law.

Section 7 . The -validity of ..such note may be contested
only if: (1). .Such :Note is authorized for an object or purpose
for which said, Town .of Southold, is not authorized
to expend money„ 'or
(2) The provisions of, -law which should be compled with -
t at the date .of: publication of this resolution are
not substantially -.complied with, and an action,
suit or proceeding contesting such validity is comm-
enced within twenty days after the date of such pub
lication, or
(3) Such..note is authorized .in violation _of. the provisions
of the Constitution.
Section 8. This resolution takes effect immediately and
shall be published .in -full in "THE SUFFOLK WEEKLY TIMES" , . Greenport, ,
. . New York, the .official newspaper 'of the Town of- Southold, together
with a notice of -the Town. Clerk in substantially the form provided '
in Section 81:00 of the Local Finance Law.

The. resolution having received at least a two-thirds vote .of the
members of the Town Board, was declared by the Supervisor to be duly
adopted.
The meeting was recessed to reconvene at '7 :30- P,.M.
. The .meeting of the Southold Town Board reconvened at 7 :30 P.M. .on the
.same day with the following. present:. Supervisor .Albertson; Councilmen
Demarest and Valentine.; Justice Tuthill; ..Town Attorney Tasker and Town
--Clerk Richmond.

RESOLVED-.. That Robert J,. Conway, Southold, . N.Y. be and he .hereby. is
appointed Seasonable Police Patrolman of -the Town of ..Southold, N.Y.
to serve at the pleasure of the Town Board unless otherwise provided
for, and ,be it further
RESOLVED:' That the compensation be .fixed at. $100.00 per-,week payable
biweekly and that this appointment take effect on June 10;. 1967.

WHEREAS,, the said petition was referred to the Planning Board for its
official recommendation..'and- report, and
WHEREAS, the Town Board pursuant to due notice thereof. held . a hearing
thereon on the 9th day of June, .1967 at which time all .interested
persons. were given an opportunity to be heard,
