Albertson, Greenport, N.Y. on Thursday, November 7, 1968, at 3 :00 P.M. with the following, present: Supervisor Albertson; Councilmen Demarest and Valentine; Justices Clark and Suter; Superintendent of Highways Dean, Town Attorney Tasker and Town Clerk Richmond. .. Moved by Councilman Valentine; seconded by Justice Clark; RESOLVED: That the next regular meeting of the Town Board will be held at the office of Supervisor Lester M. Albertson, 16 South Street, Greenport, N.Y. on Tuesday, November 26, 1968. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Valentine; Justices, Clark and Suter. WHEREAS, the Town Board of the Town of Southold, New York, has met at the time and place specified in the notice of public hearing on the Preliminary Budget, , and heard all persons desiring to be heard thereop; now, thereofre, be it RESOLVED: That the Town Board of the Town of Southold does hereby adopt such Preliminary Budget as originally compiled as the. annual budget of the Town of Southold for the fiscal year beginning on the lst day of January, 1969, and that such budget as so adopted be entered in detail in the minutes of the proceedings of this Town Board and be it further RESOLVED: That the Town Clerk of the Town of Southold shall prepare and certify in duplicate, copies of said Annual Budget as adopted by the Town Board of the Town of Southold, together with the. estimates, if any, adopted pursuant to Section 202-A, subdivision 2 of the Town Law, and deliver one copy thereof to the Supervisor.. of the Town to b.e presented by him to the, Board of Supervisors of the County of Suffolk dated November 7, 1968. Moved by Justice Suter; seconded by Justice Clark; WHEREAS, Stanley Sledjeski requests a reduction in his Bond of $9000.00 for completion of roads in Sunset Knolls, Mattituck, N.Y. , and WHEREAS, the said roads are nearly completed and have been inspected by the Superintendent of Highways, NOW, 'THEREFORE, BE IT RESOLVED: That the Bond of $9000.00 _for inspection of roads in Sunset Knolls be and hereby is reduced to $4500. 00. Albertson be and he hereby is authorized to sign the wage contract between the Police Benevolent Association and the Town of Southold as prepared by the Town Attorney and agreed to be the Police Benevolent Association and the Southold Town Board. Gagers, Southold, N.Y. has made -application to the Town Board 'to dedicate a certain road at Southold, N.Y. to be_ known as "CUSTER AVENUE" more fully described in said petition together with release executed by the owners thereof, and WHEREAS, the Highway Superintendent has inspected the said Highway and has advised the 'Town Board that said proposed highway complies in all respects with the specifications for the dedication of Highways in the Town of Southold, NOW, THEREFORE, BE IT RESOLVED: That in accordance with Section -171 of the Highway Law of the State of New York consent be and the same is given to the Superintendent of Highways to make an order -laying out the aforesaid highway to consist of lands described in said app- ' lication as shown on certain maps attached to said application, and " BE IT FURTHER RESOLVED: That the Town Clerk be and he hereby -is auth- orized and directed to forthwith cause the dedication, release and _ deed to be recorded in the offece of the .Clerk of the County of Suffolk, New York. Moved by Justice Suter; seconded by Councilman Demarest; WHEREAS, the Southold Town Planning Board held a public hearing on the proposed amendments of the Subdivision Regulations of the Town of Southold, an( WHEREAS, the Southold Town Planning Board has passed these proposed amendments by unanimous vote and requests the Town Board to' give final approval, RESOLVED: That this Town Board' appioves the following Subdivision Regul- ations as presented by the Planning Board: PROPOSED AMENDMENTS TO SUBDIVISION REGULATIONS OF TOWN OF S'OU'THOLD AS DATED SEPTEMBER 26, -19'68. ARTICLE III SECTION 1. SKETCH PLAN A. Submission of Sketch Plan , Applicant shall submit to the Planning Board (at least` two weeks prior to the regular meeting of the Board) six copies of a ,Sketch Plan of the proposed subdivision with road profiles and contours at 5 foot elevations. Such .Plan shall comply with the requirements of Article V, Section 1. ARTICLE III SECTION 4. PLAT FOR MAJOR SUBDIVISION A. Application for Approval The subdivider. shall, within dine year after the Conditional Approval of the Preliminary Layout, file with the Town 'Clerk ari applicat- ion (in duplicate) for approval of all 'or part of the .proposed subdivis- ion, using the approved application blank. Th4s, the subdivider may dev- elop the subdivision in progressive stages instead of in its entirety.' But no Vubdivision or portion thereof shall be considered unless it has frontage on a public street; abuts an existing street on the Town' s Official Map; or an approved street for which a bond has been filed under Paragraph E, below, A Highway Inspection fee of 2% of 'the amount of the bond as estimated by the Town Engineer for streets and 'improve- ments proposed in the, subdivision shall be paid prior to final plat approval. , . . , Failure to 'submit all or a .portion of the Subdivision Plat with- in six months shall automatically cancel the Preliminary Layout Condit- ional Approval, unless a request for an' extension of time is granted by the Planning Board. Such extension shall be -granted only if the proposed subdivision fully conforms to the zoning regulations in effect at the time such extension is applied for. ARTICLE III SECTION 5. REQUIRED IMPROVEMENTS C. Inspection of Improvements In order to assure that all Town specifications and requirements are met during the construction of all. required improvements,, and. to assure the satisfactory completion of improvements.' and. utilities, as required by the Planning Board, a construction inspector representing the. Board shall inspect . the improvements during the. progres.s of. con-. , struction. It shall be the duty of the subdivider to notify the Plan ning Board and Highway- Department two days prior to the commencement or completion of any work on each stage or. operation, of. the construct- ion of improvements. Said construction inspector shall, after complet- ion of construction, certify to the Planning Board that all required improvements have been constructed as required by the Board. In addition, the subdivider shall furnish a certified set of drawings showing all improvements. as constructed, in. the same detail as required for the approved. Subdivision Plat. ARTICLE VI. SECTION. 3. STREET DESIGN 1 G. Watercourses Where a water course separates a proposed street from abutting property,.: provision shall be made for access to all. lots by means of culverts or other structures of design approved by the Town Superin- tendent of Highways. l 1 ' Where a subdivision is traversed by a watercourse, drainage way, channel or stream, there shall be proveded a storm water easement or drainage right-of-way- as required by the Town Superintendent of Highways. Necessary drainage structures . must be provided to receive all run off waters from natural drainage areas outside of, the subject subdivisiorii,swhich will in any way tend to create a drainage problem within the subdivision area. Moved by Councilman: Valentine; seconded by Justice Suter; ..,. , ._ WHEREAS, the Southold Town Planning Board held a public hearing on the. proposed Amendments to Highway Specifications of the Town of Southold, and WHEREAS, the Southold Town Planning Board passed these Highway Specif- ications by unanimous vote and request the Town Board to give final approval, BE IT RESOLVED: That the Town Board .approves the following Highway Specifications as presented by the Planning Board: PROPOSED AMENDMENTS TO HIGHWAY -SPECIFICATIONS OF THE TOWN OF S.OUTHOLD Item 3 =i-add paragraph: All roads shall be laid out in a "station mark" system showing elevations, percentage of _grade distances between station marks, all drainage pipes, drainage structures, recharge basins, etc. to be clearly shown on both map and profile map of each road. All profile maps to be on a large scale, clearly and legibly printed with not more than one (1) road on one page or sheet. Item 5 - 2nd sentence: A guard rail shall be installed along the entire dead end line. Such guard rail shall be of galvanized steel (flex-beam type) 182 inches in width mounted on 6" x 6" x 4 ' posts dipped in .creosote to a depth of 39" and placed in the ground to a depth of 30" . A standard stop sign shall be placed in the center of the dead-end in the rear of the guard rail. Item 11 - add paragraph: Full length concrete curb on both sides of all roads are required unless waived by the Superintendent of Highways and the Planning Board. Integral curb and gutter shall be installed at all intersections for at least ten (10) feet each side of the curve and at least ten (10) feet each side of a drainage inlet- structure intake. Integral curb and gutter on both sides of any road having a grade of 5/0 or more. Vote of Town Board: Ayes- Supervisor Albertson; Councilmen Demarest and 120 Valentine; Justices Clark and Suter. Tuthill has applied to the Town Board for a single-- trailer renewal permit dated- October 29, 1968, NOW, THEREFORE, BE IT RESOLVED: That the application of John C. Tuthill, Mattituck, N.Y. for a single .trailer to be placed on Elijah Lane, Matt ituck, N.Y. be granted for a period- of six (6) months. Moved by Councilman Demarest; seconded by Justice Clark; WHEREAS, John Feier, North Road, Greenport, New York, by petition verified the 31st day of May, 1968, petitioned the Town Board for a change of zone of certain real property described in- said petition from "A" Residential and Agricultural District to "M" Multiple Residence District, and . - WHEREAS, the said petition was referred to the Planning Board for its, official recommendation and report, and WHEREAS,- the Town Board pursuarit to due notice thereof, held a. hearing thereon on the 7th day of November, 1968, at which time all interested_ persons were given an opportunity to be heard, NOW, THEREFORE, BE IT RESOLVED: That the Southold Town Building Zone Ordinance including the Building Zone Maps, be- amended from "A" Resid- ential and Agricultural District to "M" Multiple Residence District on the following described property: BEGINNING at a point on the soutHs:ea:y side of Middle Road (C.R. 27, North Road) ' where the same is intersected by the •westerly side of land now or formerly of Village of Greenport, 'which-point is distant 350.68 feet: westerly from the corner formed by the intersection of the southerly side: of said Middle Road with the westerly side of Moore ' s Lane, and from said point of beginning, running -thence along said land south 40 01' 10 east, 1106.60 feet; running thence still along said lurid, south 840 53 ' 30" west, 474. 24 feet; running thence still along said land north 40 • 06 '- 10" west, 830.50 feet to- the southerly side of Middle Road, running thence along the south- erly side of said Middle Road, north- 550 01 ' 10." east, 554. 24- feet to the point or place of be- ginning.
