RECITAL
WHEREAS, the Town of Southold (herein called "Town") , in the County of
Suffolk, New York, has heretofore duly authorized, sold and issued its
$14, 000 Bond, Anticipation Note for Purchase of Tax Accounting Machine-
1967 pursuant to the provisions of the Local Finance Law, constituting '
Chapter 33-a of the Consolidated Laws of 'theState' of New York, and it-
is now desirable to redeem said Note to the extent of $3,600 from a
source other thanthe proceeds of the bonds in anticipation of which'
said Note has been issued; now, therefore, be it
RESOLVED -BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF
SUFFOLK, NEW YORK, AS FOLLOWS:
Section 1. The amount of $3 , 60.0 is hereby appropriated from funds
of the Town now available to said purpose, to redeem, in part, on ,or
before October 11, 1968, the $14, 000 Bond Anticipation Note for Purchase
of Tax, Accounting Machine-.; 967 , dated October 'll-, 1967 , maturing October
11, 1968, subject ,to prior redemption„ numbered 1, heretofore duly� auth-
ized, sold and issued pursuant to the bond anticipation note reso1 ti°�n
duly adopted by the Town .Board on October 10, 1967 , and the Supervisor
is hereby authorized and directed to set aside and apply said amount to
such redemption of said Note.
Section 2. This resolution shall take effect immediately.

NEW YORK, ADOPTED OCTOBER 8, 1968, AUTHORIZING THE RENEWAL,
IN PART, OF THE $14, 000 BOND ANTICIPATION NOTE FOR PURCHASE
OF TAX ACCOUNTING MACHINE-1967, BY THE ISSUANCE OF A NEW `NOTE
IN THE PRINCIPAL AMOUNT OF $10,400.
Recital `
WHEREAS, the Town of Southold (herein called "Town") , - in the County of
Suffolk, New York, has heretofore duly authorized, sold and issued its
$14, 000 Bond Anticipation Note for Purchase of Tax Accounting Machine-
1967 and has authorized the, redemption of said Note to the extent of $
$3,600 from a source other than the proceeds of the bonds in anticipation
of which said Note has been issued, and it is now necessary to provide
for the renewal, in part, of said Note by the issuance of a new Note
in the principal amount of $10,400; now, therefore, be it
RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF
SUFFOLK, NEW YORK,. AS FOLLOWS :
Section 1. The $14, 000 Bond Anticipation Note for purchase of Tax
Accounting Machine-1967 , dated October 11, 1967, maturing October 11,
1968, subject to prior redemption, numbered l, .heretofore duly authorized,

sold and issued pursuant to the bond anticipation note resolution duly
adopted by the Town Board on October 10, 1967 , is hereby authorized to be
renewed, in part, by'-the issuance of a new Note in the principal amount
of $10, 500; said Note dated October 11, 196i having been heretofore duly
authorized to be redeemed from a source other than the proceeds of the
bonds in anticipation of -which said Note has been issued, to the extent
of $3, 600, all as hereinabove referred to in the Recital hereof, pursuant
to the provisions of the Local Finance Law, constituting Chapter 33-a
of the Consolidated Laws of -the State of New York,- (herein called "Law") .
The maturity of said renewal Note herein authorized shall not be later
than one year from its date and said Note may be further renewed pursuant
to the provisions of the Law. N
Section 2 . The terms, form and details of said renewal Note shall be
as follows : Amount and Title $10, 000 Bond Anticipation Note for Purchase
of Tax Accounting Machine-1968.
Dated: October 11, 1968.
Matures : October' 10, 1969, subject to prior redemption. '
Number and Denomination: $10,400.
Interest Rate: 2. 65/o per annum, payable at maturity.
Place of payment of principal and interest: Office of
Supervisor, Greenport, New York.
Form of Note: Substantially in accordance with the form
prescribed by Schedule B, 2 of the Law.
Section 3. Said Note is hereby sold to the SECURITY NATIONAL BANKOF
LONG ISLAND, Southold, Office, Southold, New York, at the purchase price of
$10,400, to bear interest at the- rate of two and sixty-five hundredths per
centum (2.65/) per annum, payable at maturity, and the Supervisor is here-
by authorized to deliver said Note to said purchaser upon receipt of the
said purchase price, plus accrued interest, if any>,i from the date of said
Note to the date of delivery.
Section 4. Said Note shall contain the recital of Validity prescribed
by S 52.00 of the Law and shall be a general obligation of the Town, payable
as to both principal and- interest by a general' tax upon all the taxable
real property within- the Town, - without limitation of rate or amount. The
faith and credit of the Town are hereby irrevocably pledged to the punctual
payment of the principal of and interest on 'said Note and provisionashall
be made in the budget of the Town by appropriation for the redemption of
the Note to mature in such year and for the payment of interest to be due
in such year.
Section 5. Said Note shall be executed in the name of the Town by its
Supervisor and its corporate seal shall be affixed thereto and attested
by its Town Clerk.
Section 6. This resolution shall take effect immediately.

RESOLVED: That the Southold Town Board release the Bond of $18, 000 on
Fairview Park Sec. II, owned bydDaniel, Smith & Bros. as recommended by
the Southold Planning Doard for the completion 'of roads in the subdiv-
ision known as Fairview Park, Southold, N.Y.

RESOLVED: That the Southold -Town Clerk be and he hereby is directed to

RESOLVED: That the Southold Town Board approves the following agreement -
between Fishers Island Ferry District and Alfred S. Bicknell :
This Agreement made. this lst day of October, -1968, by and between THE FISH-
ERS ISLAND FERRY DISTRICT, a district created under Chapter 699. of the Laws
of 1947 , as amended, having its principal place of business at Fishers
Island, Town of Southold, Suffolk County, New York, hereinafter called the
District, and ALFRED S. BICKNELL, residing at Fishtown Road, Mystic, Conn. ,
hereinafter called the Operator.
WITNESSETH:
WHEREAS, the District by virtue of Chapter 699 of. -the Laws of 1947, as
amended, is -authorized to operate: a _public ferry for the transportation for
hire of persons and vehicles and goods, wares and merchandise between
Fishers Island,. New- .York and. New London, in the State of Connecticut, and
WHEREAS, said District is also authorized to contract with a private
person or persons or a corporation for the independent operation of such
ferry upon such terms and conditions as may be mutually- agreed upon; and
WHEREAS, said District is the owner of two vessels, one known as the -
motor vessel MYSTIC, _ISLE, and the other known as the motor vessel OLINDA,-
hereinafter referred to as the Vessels, and desires to vontract with the
Operator, for the operation of said Vessels between Fishers Island, New
York and New London, Connecticut,
NOW, THEREFORE, the parties hereto do mutually agree as follows :
1. The District hereby agrees to hire the Operator and the Operator hereby
agrees . to . operate the Vessels for the periods of time and upon the terms
and conditions set forth herein. The Vessels shall be operated by the
Operator exclusively in accordance with the requirements of the District
and the terms and conditions hereinafter set forth., principally for ferry
service between Fishers Island, New York, and New London, Connecticut,
and for such occasional charter trips and such other trips as the District
may designate.
2 . The Operator hereby covenants and agrees to comply with all of the
applicable federal, state and local .laws, rules and regulations in the
performance of this agreement..
3. It is understood and agreed that .the Operator shall be required to
operate .th,e Vessels in conformity with the schedules from time to time
promulgated. by, the Dist rict ,,sub.ject to the f.o.11owing,. to wit:
(4) Except as otherwise provided herein, the motor vessel Olinda shall
be operated by the .Operator only during the five (5) month period commenc-
ing on the 15th day_ of May, and ending on the 14th day of October in each
and every year during the term of this agreement. During the aforesaid
five (5) month period, theeoperator shall not be required to operate. said
vessel in excess of five (5). days in any one week, nor more than eight (8)
hours in any one day.
(b) Except as otherwise proveded herein, the motor vessel Mystic Isle
shall be operated by the Operator each and every day during the term of
this agreement, proveded however, the Operator shall not be required to
operate such vessel in excess of twelve (12) hours in any one day,.
(c) Notwithstandirjg the ..provisions of paragraph 3 (a) and 3 (b) .hereof,
the district may, in its discretion, schedule such -additional ferry trips
and charter beyond the time periods, spec-ified in paragraph 3 (a) and 3 (b)
as may be required for the public convenience and necessity .(hereinafter -
referred to as "extra trips") . The operator agrees to operate the vessels
on such extra trips, but shall be entitled to additional compensation there-
for in the amount .set ,forth in paragraph 8 (c) .hereof.
4. The Operator .shall .at. his .or its ,own . cost,-and expense during the time -
of this agreement:
(a) Perform all preventative maintenance on the Vessels, their machinery,
appurtenances, spare parts and freight handling vehicles and equipment and
keep and maintain the Vessels, their machinery, appurtenances, spare
parts and freight handling vehicles and equipment in an efficient, safe
and clean condition and obtain all necessary licenses and certificates and
comply with..all federal,. .sta,te and loca:l .laws, rules and regulations , affect-
ing-- the operation of the. Vessels. The Operator shall provide all fuel and
oil required in the use and operation of freight handling vehicles. In the
event that there is a disagreement between the Operator and the District
as to the obligation of the Operator under . the provisions of this paragraph,
the decision of the District concerning such duties shall be final,and the
Operator hereby agrees to conform to such decision.
(b) Maintain all engines, machinery and equipment in accordance 919
with manufacturers ' instructions and orders, specifications and maintenance
manuels.
(c) Be responsible for all injury or damage to the Vessels, their
engines and equipment resulting from the negligence of the Operator in the
maintenance and/or operation of the Vessels.
(d) Paint the entire surfaces of the Vessels above the guard rail at
least once each year during the term of this agreement. Whenever painting
is required, before paint is applied, all surfaces shall be properly chipped,
scraped, sanded, cleaned and otherwise properly prepared and red lead primer
applied prior to the application of the paint. In addition to the foregoing,
the Operator shall be required to properly maintain all interior and exterior
surfaces of the Vessels in a manner acceptable to the District.
(e) Inspect all compartments, shaft alleys, line shaft bearing and pack-
ing glands daily and properly maintain the same.
(f) In the event that the repairs and maintenance to the Vessels re-
quired to be performed by the Operator shall require the said Vessels
to temporarily removed from the feery service, the Operator shall so advise
the District and the District will authorize, such removal from service at
such times and for such duration as will not unreasonably interfere with
the ferry service. However, it is contemplated by the parties that the
Operator will endeavor to perform such repairs and maintenance work at
such times as the Vessels would normally be out of service by reason of
lay-up or periodic haul-out.
(g) Shall furnish all personnel, tools and equipment as and when re-
quired for the proper operation, maintenance of the Vessels.
(h) Hire the necessary employees, including. freight handlers, required
for the proper operation of the Vessels for the loading, unloading and hand-
ling of all passengers, cargo, freight and vehicles.
(i) Hire all necessary freight agents to be employed at the New London
and Fishers Island terminals.
(j ) Employ at the Operator ' s expense a suitable person as purser on
the vessel OLINDA to sell fare tickets, collect fares and pay over the same
to the District, and procure and keep in force during the term 'of this
agreement, a bond for said purser in the amount of $5 , 000. 00 conditioned
upon the faithful performance of the duties of said purser.
(k) Be liable for all claims for lost, damaged, broken, stolen or miss-
ing cargo as well as any and all expenses incident to the operation and
maintenance of the Vessels. In the event that a question or dispute arises
concerning any claims for lost, damaged, broken, stolen or missing cargo
between the Operator and any other person, the District daall have' the right
to determine the justness of such claim, and the Operator agrees to accept
the determination of the District concerning any such claims. In the event
that the Operator fails to pay any claim determined to be just by the Histric,
the District may pay said claim and the amount so paid shall be a charge
against the Operator and the District shall have the right to deduct the
amount of such claim from the next monthly payment due the Operator.
(1) Maintain in a safe, clean and efficient manner, the ferry terminal
including the electric ramps located 'at New London, Connecticut, and furnish
all fuel, heat, water, electricity, telel3hones and other utilities required
at said terminal. Unless authorized by the District in writing, the Operator
shall not permit said terminal to be used for any purpose other. than those
necessary and incidental to the operation of the ferry. service..
(m) In the event that the Operator fails or neglects to keep the Vessels
clean and in a condition acceptable to the .District, the District shall have
the right to engage persons to remedy such condition and the cost and ex-
pense of the same shall be a charge against the Operator and the District
shall have the right to deduct such cost or expense from the next monthly
payment due the Operator.
(n) Provide and keep in force during the term hereof cargo and mail
insurance policies in the amount of $10, 000. which shall name as insured
the Operator, the District and the Town of Southold. Certificates of such
insurance shall be furnished to the District.
(o) Provide and .keep in force .during the term hereof liability insurance
policies of insurance covering all vehicles and equipment owned and/or
furnished by the Operator in connection with this agreement which policies
shall be in the amoun t of $500, 000. bodily injury in respect to any one
accident; $300, 000. bodily injury in respect to injuries to any one person

and $100, 000. property damage in respect to, any one accident. Such policies
shall name the Operator, the .,District and the Town of Southold as insureds.
Certificates of such insurance shall be furnished by the Operator to .the
District-
(p) Procure and keep in force during the term hereof Federal Longshore-
men' s Harbor Workers ' Compensation insurance for the benefit of all freight
agents and freight handlers and the required- insurance for the benefit of
all employees employed on the Vessels in accordance with the Federal ,Merchant
Marine Act. Certificates of such insurance shall be frunished to the District.
(q) During the. time that either of the Vessels is hauled out. for repairs
as hereinafter provided,. or during any period of time when either of the
said Vessels is temporarily removed from service by the District. for any
reason, the Operator agrees to operate such other comparable vessel as
may be furnished by the District for a period of five (5) days without
adjustment of compensation, After the first five (5) days, in the event
that the cost of operating such substitute vessel is greater than the cost
of operating the Vessel out of service, the Operator shall be paid such
additional cost upon the presentation of proof of such extra cost satis-
factory to the District; if, however, such cost. is less than the cost of -
operating the Vessel out of service, such reduced cost shall -be deducted
from the monthly payments due the Operator.
(r) Furnish to the District at the expense of the Operator a standard
performance, and payment -bond in an amount equal to three times the average
regular payment to. be made to the Operator as hereinafter provided.
(s) Notwithstanding the foregoing provisions of paragraph 4, the Oper-
ator shall not be required to repair and/or maintain the motor vessel -
'Olinda during the seven (7) ' month period in each year during the term here-
of when said vessel is not being operated in the feery service of the
District.
5. The District shall at its own cost and expense during the term of this
agreement:
-(a) At least twice in each year, cause. all. engines of the Vessels to
be inspected, adjusted and tuned. .
(b) During any periods of time that the Vessels are out of service
as proveded in paragraph 4 (q) hereof to provide a comparable vessel for
the use of the Operator if the same is deemed necessary by the District,
and- to make adjustments in compensation to the Operator in accordance with
paragraph 4 (q) hereof.
(c) Make all repairs to the Vessel which are not espressly set forth
herein as a responsiblity of .the, Operator..
(d) Employ at its own expense .a purser who shall be required to sell
tickets on the .Vessel Mystic Isle and to perform such other duties as
may be required by the District.
(e) Maintain the ferry terminals at Fishers Island,. New York including
the ramps and appurtences and furnish all .fuel, water, heat, electricity,
telephones and utilities necessary at said. terminal..
(f) Procure and keep in force during the term of this agreement hull
. and liability insurance on- the Vessels and public, liability insurance
covering, all piers, docks and terminals. Such insurance policies shall name
the District, the Operator and the Town of Southold as insureds,.
(g) Supply and .furnish all machinery parts, equipment,'- filters, fuel
oil, lubricating oils and grease required in the maintenance and operation
of the Vessels during the term of this agreement.
(h) �Cause said Vessels to be hauled out of water when deemed necessary
at which- times the bottoms , hulls, below the guard rails and bilges of the
Vessels shall be cleaned and painted and zincs replaced.
(i) Provide .suitable vehicles for towing freight flats and freight
trucks required in loading and unloading cargo.
6. The District and/or the Town Board of the Town of Southold shall have
the right at any time to demand that the Operator discharge any of his
or its employees on the Vessels .or in the terminals for any reason
deemed prejudicial to the proper operation of such ferry service.
7. All insurance required to be furnished by the Operator pursuant .to
the terms of this agreement shall be in such form and with such insurance
companies and underwriters as the District and the Town Board of the Town
of Southold shall approve. Proof of payment of all insurance premiums shall
be presented to the District. The District and the .Town Board of the Town
-of Southold reserves -.the right to review all insurance porcured by the
Operator in connection with this agreement.
8. As compensation for the services to be performed by the Operator as
herein provided, the District agrees to pay the Operator as follows:
(a) The sum of TWO THOUSAND SIX HUNDRED and No/100 DOLLARS ($2, 600.00)
per month during the five (5) month period from May 15th to October 14th
in each year during the terms hereof for the operation and maintenance,
pursuant to the terms of this agreement, of the motor vessel Olinda.
(b) The sum of SEVEN 'THOUSAND SIX HUNDRED and No/100 DOLLARS (�7,600.00)
per month for eacn ana every month during the term hereof for the. operation
and maintenance, pursuant to the terms of this agreement, of the motor
vessel Mystic Isle.
(c) The sum of FIFTY and No/100 DOLLARS ($50. 00) for each extra trip
of the motor vessel Olinda and the sum of ONE HUNDRED TWENTY-FIVE and No/100
DOLLARS ($125. 00) for each extra trip of the motor vessel Mystic Isle.
(d) The aforesaid month and extra trip payments shall be payable to
the Operator 'on or about the fifteenth of the month following the render-
ing. of services therefor.
91his agreement shall become effective on the lst day of October, 1968
and shall terminate, except as hereinafter provided, on the 30th day of
September, 19.71.
10. This agreement may be terminated as follows:
(a) At any time by either party hereto or by the Town Board of the
Town of Southold upon ninety days written notice to be sent to the other
party by registered mail,.
(b) This agreement shall terminate with respect to either Bessel upon
the total or constructive loss of such Vessel. Provided, However, that if
the District provides a comparable vessel within thirty days after such loss
then and in that event, this agreement shall not be so terminated with
respect to either of said Vessels. In the event that the District shall
provide a comparable vessel to replace the Vessel lost, the Operator shall
not be entitled to compensation for the period from the date of loss of
the Vessel to the date that such comparable vessel is put into operation.
(c) In the event that the Operator fails to comply with any of the
terms and conditions of this contract, the District or the Town Board of
the Town of Southold may terminate this contract by giving seven days
notice 'by registered mail to the Operator,
11. The Operator shall not assign or subcontract this contract nor any of
the work to be performed hereunder without the express written approval ,
of the District and the Town Board of the Town of Southold.
12. The Operator shall not directly or indirectly engage in any other
activity which will compete, conflict or interfere with the operation of
the ferry service which- is the subject of this agreement.
13. It is understood and agreed that all understandings and agreements
heretofore had between the parties hereto are merged in this agreement, w
which alone fully and completely expresses the agreement of the parties,
and that the same is entered into after full investigation, neither -party
relying upon any statement or representation, not embodied in this contract,
made by the other. This con-tract may not be changed orally. This agreement
shall bind the heirs, executors, administrators, successors and assigns
of the respective parties hereto.
14. It is further understood and agreed by and between the parties hereto
that this agreement shall not be effective until the same has bee approved
in writing by the Town Board of the Wown of Southold, Suffolk County,
New York.

RESOLVED: That thbSouthold Town Board approves the action •of 'the Commiss-
ioners of the Fishers Island Ferry District on the following resolution
with the change of date of effectiveness from August 16, 1968 to October
16, 1968: _
WHEREAS, the Manager has 'requested that consideration be given to a wage
increase, and
WHEREAS, the 'Board of Commissioners have agreed that-an adjustment is in
order at this 'time,''
THEREFORE, 'BE IT RESOLVED: '"That the Manager 's salary shall he $8'000 per year,
and be it further
RESOLVED: That in addition to • the above mentioned that-=Building' #k239 shall
be supplied with 'the position in consideration of the salary of'' $8000 per
year, and be it further
RESOLVED: That subject increase shall be effective October 16, 1968.

WHEREAS, a public hearing was ,held by the Southold Towh Board, and
WHEREAS, an error was discovered "in the procedure, the village of Greenport
not having received a notice of the change, it�was' voted to re-advertise
for a new hearing. The Southold Town Planning Board has prepared an official
report and recommendation upon the petition of1,John Geier, Greenport, N.Y.
for a change of zone from "A" Residential and Agricultural District to
"M" Multiple Residence District,

WHEREAS, Ruth T. Preston, Ida Belle Latham, Robert L. Muir and Helen
Muir have made application to the Town Board to dedicate a certain road
at Greenport, N.Y, to be known as Wiggin Lane, more fully described in
said petition, together with releases executed by the owners thereof, and
WHEREAS, the highway Superintendent of the Town of Southold has- inspected
the said highway and has advised the Town Board that said proposed high-
way complies in all respects with the specifications for the dedication of
highways in the Town of Southold,
NOW, THEREFORE, BE IT RESOLVED: That in accordance with Section 171 of the
'Highway Law of the State of New York consent be and the same is given to
the Superintendent of Highwasy to make an order laying out the aforesaid
highway 'to' consist of lands described in said application as shown on
certain maps attached to said application and be it further

RESOLVED: That in behalf of the citizens of the Town of Southold the Town
Board adopts this resolution in tribute to the memory of Robert J. Byrnes
the first resident of the Town of Southold to give his life for his country
in the Vietnam conflict,
Robert J. Byrnes was born on May 24, 1946 and h(% boyhood and youth are an
example of dedicated participation in the facets of community life which

denote the good and active citizen. He was a Boy Scout leader, an active
member of his church, and a graduate of Southold High School where he
was a good student and member of several clubs.
Robert J. Byrnes was a loyal, citizen of his country as evidenced by
his service record in the United States Army. He served his country
in Vietnam as a Staff Sergeant and on September 22 , 1968, gave his_
life for his country 's cause.
IT IS FURTHER RESOLVED: That a copy of this resolution be made a part
of the minutes of the Town Board and a copy ,thereof be transmitted
to his family in ci'jpdertto extend to the members of his family an express-
ion of the sincere sympathy. on their loss and appreciation for the' fine
. eRample set by Robert J. . Byrnes for the youth of this community.

Resolution proposed: I propose. that the six month probation in regard
to Police Chief Carl Cataldo be extended for another six months sicne
he failed to move into the Town of Southold as of this date and there
is no evidence that he has contracted to do so in the near future. In
our interview with.. Mr. Cataldo of March 8, 1968 Supervisor Albertson
stated in paragraph one "you have to live in the community" . Also
in answer to a question by Supervisor Albertson Mr. Cataldo replied
"as . far .as moving, . I,.would say the maximum time involved would be six
months" . Since it was my understanding. that we were appointing a uniform-
ed Chief of Police who would be a resident of out town and this has not
been accomplished I feel that it is only fair to our residents that no
permanent appointment be allowed at this time.
