Moved by Justice Suter;- seconded by Councilman Valentine; RESOLVED: That the minutes of July 30, 1968, be and they -are -hereby approved.. Moved by Justice' Clark; seconded by Justice Suter; BUDGET NOTE RESOLUTION DATED AUGUST 13, 1968, ' AUTHORIZING THE ISSUANCE OF A BUDGET NOTE OF ' THE TOWN OF SOUTHOLD, SUFFOLK . COUNTY, NEW YORK, IN THE AMOUNT OF $25 ,000.00 FOR HOME RELIEF. BE IT RESOLVED: This 13th day .of August, 1968, be the Town Board of the Town of Southold, Suffolk County, New York, as follows :- Section 1. That, pursuant to the provisions of Subdivision 2 of Paragraph a and Paragraph e `of Section 29, and Section 108 of the Local Finance Law, Section 93 of the Social Welfare and Section 114xof the Town Law, for the purpose of paying the cost of home relief expendit- ures for which insufficient provision was made in the annual budget for the year 1968, there is hereby appropriated as a supplemental appropri- ation for home relief, the sum of $25 , 000.00, and there is hereby auth- orized to be issued, a budget note of the Town of Southold in the prin- cipal amount of $25 , 000. 00 which is the maximum of such object or purpose, which note shall mature on August '23, 1969. Section 2. That, subject to the provisions of the Local Finance Law,. the power to sell said budget note is hereby delegated to the Supervisor, the. chief fiscal officer: Such note shall be of such terms, form- and content, and shall be sold in such mariner, as may be prescribed by said Supervisor, consistent, however; with the provisions of said Local Finance Law of the State of New York, and shall be executed in the name of the Town of Southold by its Supervisor and ::hey_"seal of said Town shall be affixed thereto. Section 3. That said note shall be sold at private sale by the Town Supervisor at a price of not less than value and accrued interest, if any, and .upon due execution and sale of said note, the same shall be delivered to the purchaser upon .payment by him to .the Town Supervisor of the purchase price in cash; and the receipt of ' such Supervisor 'shall S be a .full acquittance to such purchase who shall not be obliged to see to the application of the purchase money. Section 4. The full faith and credit of the ' Town of Southold, New York, are pledged to the punctual payment of pricnipal and interest on said note. Section 5 . Moved by Justice Suter; seconded by' Councilman Valentine; RESOLVED: That on its' own motion the town board of the town 'of Southold "A" cause to be submitted to the voters of the town at a special town election the question of the adoption of the following propositidns : Shall the town of Southold "'A" severally and jointly with the towns of Shelter Island "B" , Riverhead "C", Southampton "D" and Easthampton "E" , petition the legislature of the state of New York, and . through its town board, take such other steps as said board may deem advisable to 'secure the creation acid erection ,of the county of Peconic out of said five `eastern towns of the county of Suffolk? and it is further RESOLVED, that said question be 'submitted in the following form: - ' Shall the town of Southold "A" petition 'the legislature and take other steps to create and erect the county of Peconic -from the five eastern towns of Suffolk County? and it is further RESOLVED, that a special town election be held on' the 5th day of November, 1968, with voting to be at each of the several election districts -within the town and with the polls to be open at six o 'clock in the forenoon and closed at nine o 'clock in the .afternoon, for the purpose of voting upon the foregoing proposition. Moved by Justice Suter; seconded by Councilman Demarest; RESOLVED: That Supervisor Albertson be and he hereby is authorized to sign the following agreement with Irving W. Miller; This is an agreement between Irving W. Miller,- Municipal Consultant, and the Town of Southold, relating to research to be performed pertinent to a proposed Peconic County. Irving W. Miller will formulate a budget` for the proposed Peconic County, as if he were the Budget Officer of such County. He will retain persons he sconsiders as expert to assist him. The resultant budget will be prepared in the format prescribed by the New York State Department of Audit and Control. Explanation of the pro- jected budget will be provided.For such research the Town agrees to pay a sum not to exceed $1200.00. Moved by Councilman Demarest; seconded by Justice Clark; RESOLVED: That- the bill of ' Thames River Corporation. for hauling out . and repairing MYSTIC ISLE in the sum of $30,580. 28 be and hereby is ordered paid. Moved by Justice Clark; seconded by Councilman Demarest; RESOLVED: That General Bills in the amount oT $6, 172. 81; Highway Bills in the amount of $33 , 841.02; Lighting District Bills in the amount of $3 , 970. 79 and Fishers Island. Ferry District Bills in the amount of $15 ,052.25 be and they hereby are ordered paid. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Valentine; Justices Clark and Suter. Joseph Hoey et al appeared before the Board requesting that the amount of the Bond be lowered for completion of roads, etc. in the subdivision know as Town Harbor Terrace. The Board will contact Supt. of Highways and engineers for more study. 88 Mrs. Mahler appeared before the Board in complaint of people camping next to them in tents and camp buses. The Building Inspector has given them warning that if they continue action will be taken. Moved by Councilman Valentine; seconded by Justice Suter; RESOLUTION OF THE TOWN OF SOUTHOLD, NEW YORK, ADOPTED AUGUST 13, 1968, AUTHORIZING THE REDEMP- TION, IN PART, OF A $17 , 000 BOND ANTICIPATION NOTE FOR PURCHASE OF A PAYLOADER-1967 , TO THE EXTENT OF $8, 500 AND APPROPRIATING SAID AMOUNT THEREFOR. RECITAL WHEREAS, the Town of Southold (herein called "Town") , in the County of Suffolk, New York, has heretofore duly authorized, sold and issued its $17 , 000 Bond Anticipation Note For. Purchase of a Pay- loader-1967 , and it is now desirable to redeem said Note to the extent of $8, 500 from a source other than the proceeds of the bonds in antic- ipation of which said Note has been issued; now, therefore, be it RESOLVED BY THE TOWN BOARD OF THE THE TOWN OF SOUTHOLD, IN THE COUNTY OF SUFFOLK: NEW YORK, AS FOLLOWS : Section 1. The $17, 000 Bond Anticipation Note For Purchase of a Payloader-1967 of the Town, hereinabove referred to in the Recital of this resolution, is: hereby authorized to be redeemed on or before August 9, 1967 to the extent of $8, 500 from funds of the Town now avail- able to said purpose, said funds being a source other than the proceeds of the bonds in anticipation of which said Note was issued, and -the said amount of .$8, 500 is hereby appropriated therefor. Councilman Valentine; seconded by Justice Suter; BOND ANTICIPATION NOTE RESOLUTION OF THE TOWN OF SOUTHOLD, NEW YORK, ADOPTED AUGUST 13, 1968, AUTH- ORIZING THE RENEWAL, IN PART, OF THE $17,000 BOND ANTICIPATION NOTE FOR. PURCHASE OF A PAYLOADER-1967 , BY THE ISSUANCE OF A NEW NOTE IN THE PRINCIPAL AMOUNT OF $8, 500. RECITAL WHEREAS, the Town`of Southold (herein called "Town") , in the County of Suffolk, New York, has heretofore duly authorized, sold and issued its $17,000 Bond Anticipation Note For Purchase of a Payloader- 1967, and . has duly authorized the redemption of the Note to extent of $8, 500 and it is now necessary and desirable to provide for the renewal, in part, of said Note by the issuance of a new Note in the principal amount of $8, 500,. now, therefore, be it r RESOLVED BY THE. TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF SUFFOLK, NEW YORK, AS FOLLOWS : Section 1. The $17 ,.000 Bond Anticipation Note For Purchase of a Payloader-1967 of the Town dated Augsut 11, 1967 , maturing August 9, 1968, subject to prior redemption, as extended by agreement, . numbered R-1, heretofore duly authorized, sold and issued pursuant to the bond anticipation note resolution duly adopted by the Town Board of said Town on August 8, 1967 , is hereby authorized to be renewed, in part, by the issuanace of a new Note in the principal amount of $8, 500, said Note dated August 11, 1967, having been heretofore duly author2�:ed to be redeemed from a source other than the proceeds of the bonds in ant- icipation of which said Note has been issued, to the extent of $8, 500 all as hereinabove referred to in the Recital hereof, pursuant to the provisions of the Local Finance Law, constituting Chapter 22-a of the Consolidated Laws of the State of New York (herein called "Law") . The maturity of said renewal Note herein authorized shall .hot be later than one year from its date, and said Note may be further renewed pur- suant to the provisions of Law. Section 2. The terms, form and details of said renewal Note shall be as follows : Amount and Title: $8, 500 Bond Anticipation Note For Purchase of a Payloader-1968 Dated: August 9, 1968 Matures : August 8, 1969, subject to prior redemption 19o. 3R-1 Denomination: $8, 500 Interest Rate: 2. 80/ per annum, payable at maturity Place of payment of .principal and interest: Supervis-or ' s Office, Greenport, New York Form of Note: Substantially in accordance with form prescribed by Schedule B, 2 of the Law. Section 3. Said Note is hereby sold to the SECURITY NATIONAL BANK OF LONG ISLAND, Southold Office, Southold, New York, at the price 'of $8, 500 to bear interest at the rate of two and. eighty hundredths per centum (2.80%) per annum, payable at maturity., and the Super- visor is hereby authorized to deliver said Note to said purchaser upon receipt of the purchase price, plus accrued interest, if any, from the date of said Note to the date of delivery. Section 4. . Said Note shall contain the recital of validity prescribed by Section 52.00 of the Law and shall be a general obligation of the Town, payable as to both principal and interest by a general tax upon all the taxable real property within the Town, without limitation of rate or amount. The faith and credit of the Town are hereby irrevocably pledged to the punctual payment of the principal of and interest on said Note and provisions shall be made in the budget of the Town by appropri- ation for the redemption of the Note to mature in such year and for the payment of interest to be due in such year. Section 5 . Said Note shall be executed in the name of the Town by it GSupervisor and the corporate seal of said Town shall be affixed thereto and attested by its Town Clerk. Section 6.
