The Southold Town Board -met at the office of the Supervisor, "Albert Martocchia,' 16 South Street, Greenport, New' York, on October 21, 1969 with the following present: Supervisor Martocchia; Councilmen. Demarest and Valentine; Justices Clark and Suter; Superintendent of Highways Dean and Town Clerk Richmond. Moved by Councilman Demarest; seconded by Justice Suter; RESOLVED: That the minutes of the meeting of October 7, 1969 be and they are- ,hereby approved. Vote of Town Board: Ayes-Supervisor Martocchia; Councilmen Demarest and Valentine; Justices Clark and Suter. Moved by Councilman Valentine; seconded by Councilman Demarest; RESOLVED: That the next meeting of the Town Board will be held at the office of Supervisor Albert Martocchia, 16 South Street, Greenport, New York, on Thursday, November 6, 1969, at 3 :00 P.M. Vote of Town Board: Ayes-Supervisor Martocchia; Councilmen Demarest and Valentine; Justices Clark and Suter. Moved by Justice Clark; seconded by Justice Suter; RESOLVED: That the Local Narcotic Guidance Council and Chief Carl !Cataldo be and `they hereby are authorized to attend a Conference on Narcotics on November 24 and 25, 1969, and that all necessary expense be a legal charge against the'Town. Vote of Town Board: Ayes-Supervisor Martocchia; Councilmen Dema'rest and' Valentine; Justices Clark and Suter: Moved by Justice Suter; seconded by Justice Clark; WHEREAS, Wunneweta Pond Association, Nassau Point,- New York, applied to the town Board for financial assistance in dredging the entrance of Wunneweta Pond, NOW,. THEREFORE, BE IT RESOLVED: That Supervisor Martocchia be-and he hereby is authorized to contribute half of the total cost up -to but not to exceed the sum of $475. 00 toward the cost of dredging the ent- rance of Wunneweta Pond, Nassau Point, Cutchogue, New York. Vote of Town Board: Ayes 'Supervisor Martocchia; Councilmen Demarest and Valentine; Justices Clark and Suter. Moved. by Justice Suter; seconded by Councilman Valentine; RESOLVED:" That George C. King, Fishers Island, N.Y. be and he' hereby is recommended as Civil Defense Coordinator for Fishers Island, replacing Adrian VanRiper, who has moved from Fishers Island. ` Vote of Town Board: Ayes-Supervisor Martocchia; Councilmen Demarest and Valentine; Justices Clark and Suter. Moved by Councilman Valentine; seconded by Justice Suter, WHEREAS, a map entitled "Map of proposed Orient-East Marion Park Dist rict,. ,situate in the Town of Southold, Suffolk County, New York. " showing, the boundaries of the proposed Orient-East Marion Park District has heretofore been filed in the office 'of the Town Clerk, and WHEREAS, the boundaries of the said proposed Park District are as follows : ALL that certain tract, piece 'or parcel of land, situate " in the hamlets of Orient and East. Marion, in the Town of Southold, County of Suffolk and State of New York, 'bounded and described as 'follows : BEGINNING at a point on' the southerly line of the Main Road, 860. 56 feet westerly along said southerly line from 'Shipyard ' Lane; from said point of beginning running the following nine courses : (1) Across said Main Road, North 270 40 ' 00" West 75. 72 feet, thence (2) North 330 .45 ' 40" West, 193. 16 feet; thence (3) North 360 03 ' 40" West 911.59 feet; thence (4) North 510 37 ' 20" East 493.45" feet; thence (5) North 280 15' ' '40" West 539.66 feet; thence (6) North 300 59 ' 20" West 269.10 feet; thence (7) North 340 15 ' loll West 859.26 feet; thence 7: .i 2 (8) South 530 59 ' 00" West 604. 90 feet; thence (9') North 350 51 ' 54" West 1320 feet, more or less, to ordin= ary high water mark of Long Island Sound; thence northeasterly and then easterly along said high water mark about 43, 000 feet to Orient Point; thence southwesterly along ordinary high water mark of Gardiners Bay about 26,600 feet; thence northeasterly along ordinary high water mark of Orient Harbor about 6, 000 feet; thence northwesterly along ordinary high water mark of Orient Harbor about 9, 000 feet; thence southwester.- ly along ordinary high water mark of Orient Harbor and Gardiners ,Bay about 15, 300 feet; ' thence. running the following five courses : (1) North 180 50 ' 30" West 470 feet, more or less, thence (2) North 330 30 ' 50" West 427. 54 feet; thence (3) South 580 49 ' 10" West 87.89 feet; thence (4) North 330 22 ' 50" West 812. 15 feet; thence (5) North 340 34 ' 40"West 1067. 74 feet to the point 'of beginning Excepting from the above any lands owned by the United States of America and any lands owned by the State of New York. WHEREAS, no improvements are proposed; and no amount Is proposed to be expended for improvements or for supplying of services within the territory of the said proposed park district, and WHEREAS, said map is on file in the Town Clerk 's Office, for public inspection, now, therefore, on motion of Councilman Valentine and seconded by Justice Suter it ORDERED, that the Town Board of the Town of Southold shall meet and hold a public hearing at Orient Schoolhouse, Main Road, Orient, in said Town, on the 6th day of November, '1969, at '8:00 P.M. (prevailing time) to consider such proposed establishment of such park district and to hear all persons interested in the subject thereof, concerning the ,same and for .such other action on the part of said Town Board with 'relation thereto as may be required or authorized by law. Vote of Town Board: Ayes-Supervisor Martocchia; Councilmen Demarest and Valentine; Justices Clark and Suter. ` Moved by Councilman Valentine; seconded by Councilman Demarest; WHEREAS, the Legislature by concurrent resolution of the Senate and Assembly has proposed an amendment to Article _Fourteen of the State Constitution, in relation to the conservation and protection 'of natural resources and acenic beauty and the development and improvement of Agricultural lands, an amendment generally known as -the Conservation Bill ' of Rights; and WHEREAS, the aforesaid Conservation Bill of Rights provides that the policy of the State shall be to conserve and protect its natural re- sources and scenic beauty and encourage the development and improve- ment of its agricultural lands for the production of food and other agricultural products; and WHEREAS, in implementing this policy, the Legislature is required to include adequate provision for the abatement of air and water pollution and of excessive and unnecessary noise, the protection of agricultural - lands, wetlands and shorelines, and the development and regulation of water resources, and the establishment of a State Nature and Histori- cal Preserve for the use and enjoyment of the people; and WHEREAS, the goals of the Conservation Bill of Rights consonant- with the policy of the` Town Board of the Town of Southold in furtherance of the protection of clean air, pure water, freedom from excessive and unnecessary noise, and protection of the natural, 'acenic, hist- oric and esthetic qualities of the environment, NOW, THEREFORE, BE IT RESOLVED: That the Town Board of the Town of, ' Southold endorses approval by the people at the forthcoming general election of the proposed amendment to Article Bourteen of the State Constitution in relation to the conservation and protection of natural resources and scenic beauty as set forth above, and directs publication of this Resolution for the information of all voters who will be' en- titled to vote at said election. TEXT OF PROPOSED AMENDMENT NUMBER THREE Section 1. Resolved (if the S nate concur) , That-,-Section four of article fourteen of the constitution 'Be renumbered to be section five and a new section four inserted therein to read as follows : Section 4. The policy of the state shall be to conserve and protect its natural resources and scenic beauty and encourage the deVelop- ment and improvement of its agricultural lands for the production of _, food and other agricultural products. The legislature, in implementing this policy, shall include adequate provision for the abatement of air and .water .pollution and of excessive and necessary noise, the protection of agricultural lands, wetlands and shorelines, and the development and regulation of water resources, The legislature shall further provide for the acquisition of lands and waters, including improvements .thereon and any interest therein, outside the forest preserve counties and the dedication of properties so acquired or now owned, which because of their natural beauty, wilderness character, or geological, ecological or historical significance, shall be preserved and administered for the use and enjoyment of the people. Properties so dedicated shall constit- ute the state nature and historical preserve and they shall not be taken or otherwise disposed of except by law enacted. by two successive regular sessions of ,the legislator. ,Section 2. RESOLVED (if the Senate concur) , That the foregoing amend- ment be submitted to the people for approval .at . the general election to be held in the year nineteen hundred sixty-nine, in accordance with the provisions of the election law. Moved by ,Justice Suter; .seconded by Councilman Valentine; WHEREAS, George McCarthy has applied to the Town .Board for a single trailer renewal permit dated September, 25, 1969, NOW, THEREFORE, BE IT RESOLVED That the application of George McCarthy to locate a single trailer off Route 25, Laurel, N.Y. be and hereby is granted for a six (6) month period. Vote of Town Board: Ayes-Supervisor Martocchia; Councilmen Demarest and 'Valentine; Justices Clark and .Suter. - Moved by Councilman Demarest; seconded by Justice Clark; WHEREAS, Southold Town Planning Board has prepared an official ' report and recommendation upon the petition of Abe Goldrich .for a change of zone on certain property from "A" Residential and Agricultural District to "B" Business District on .Middle- Road, Southold, N.Y. and .the petition of Henry .Taca for a change of zone on .certain property from "A" Resident- ial and Agricultural District to "C" Industrial District on Middle Road, Cutchogue, N.Y. , NOW, THEREFORE, BE IT RESOLVED: That a public hearing will beheld by . the Southold -Town Board at the Supervisor' s Office, 16 South Street, Greenport, New York, on Tuesday, November 25, 1969, at 7 :30 P.M. on the above mentioned petition and that the Town Clerk be and he hereby is authorized and directed to cause notice of said hearing to be published in the_,Suffolk. Moved by Councilman Demarest; seconded by Justice Clark; WHEREAS, Clifford Tyler, Sr. has applied to the .Town Board for ,a permit to establish a Travel Trailer Park on his property, Cutchogue, N.Y. NOW, ; THEREFORE, BE IT RESOLVED: That a public hearing will be held by the Southold. Town _Board at the Supervisor 's Office, Greenport, N.Y. on Tuesday, .November 25, 1969, at 8:00 P.M. on the application of Cliff- ord Tyler, Sr.- for a permit .to operate a- Travel Trailer Park on .his property; School Street, Cutchogue, N.Y. Vote of Town Board: Ayes-Supervisor Martocchia; Counclmen Demarest and Valentine; Justices- .Clark and Suter. Jarvis` Ve.rity, 'and, Edward Kajeski appeared before the Board requesting transplant' of bug escallops from Mill Creek to Pete Neck. The 'Town Board will study this request. The Civil.
