The Southold Town Board met at the office; of the Supervisor, Albert
Martocchia, Greenport, New York, on February 25, 1969 with the ,follow-
ing present: Supervisor Martocchia; Councilmen Demarest and Valentine;
Justices Clark and Suter; Town Attorney Tasker; Superintendent of High-
ways Dean;- Town Clerk Albert Richmond. Absent: Justice E. Perry Edwards.
Moved by Councilman ,Valentine; seconded by Councilman Demarest;
-RESOLVED: -That the minutes ,.of February 6, 1969 be and they hereby are
approved.

RESOLVED: That the next meeting of the Town Board will be held at the

WHEREAS, William A. Steiner has applied to the Town Board for a single

NOW, THEREFORE, -BE IT- RESOLVED: That the application ,of William A. Steiner
to locate a single trailer on his property on John' s Road, east side of
Main Road, Mattituck, New York, be and hereby is granted for a six (6)
month period.

Main Road, Mattituck, N.Y. be and hereby ,is granted for a ssx ,(6) Month
period. ,

RESOLVED: That the Southold Town Board will accept a Bond of $26, 500
as recommended by the Southold Planning Board.for the roads, drainage
and requirements for improvements in the Subdivision known as "Jackson' s
Landing, Mattituck, New York.

WHEREAS, a revised petition was received from Francis and Steve Doroski
requesting a change of zone of certain property, Southold, N.Y. describ-
ed in said petition from "A" Residential and Agricultural District to
"B" Business District, ,
NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of the Town of
Southold be and he hereby is directed to transmit this application
to the Planning Board in accordance with Section 901, Subdivision C
of Article IX of the Building Zone Ordinance of the Town of Southold.

certain properties in Southold, Greenport and East Marion, N.Y. ,
NOW, THEREFORE, BE IT RESOLVED: That a public hearing will be held by
the Southold Town Board at the Supervisor's Office, 16 South Street,
Greenport, New York, on Wednesday, March 19, 1969, at 7 :30 P.M . on, the
above mentioned petitions and that the Town Clerk be and he hereby .is
authorized and directed to cause notice of said hearings to \be published
in the Suffolk Weekly Times pursuant to the requirements of law.

RIATING .SAID AMOUNT THEREFOR.
RECITAL
WHEREAS, the Town of ,Southold (herein called "Town") ,, in the
County of Suffolk, New York, has :heretofore , duly authorized,- sold and
issued its $1,6, 000 Bond Anticipation Note For Land Acquisition-1,968
and it is now desirable to redeem said Note to the, extent of ,$8, 000 .
from a source other than the proceeds of the bonds in anticipation .
of which said Note has been issued; .now, .therefore be .it
RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE
COUNTY OF SUFFOLK, NEW -YORK, AS FOLLOWS :
Section 1. The $16,, 000 Bond Anticipation Note For Land _Acquis-
iti,on-1968, -.of the Town, hereinabove referred to in the Recital of ,this
resolit.tion, is hereby authorized to be redeemed on or before February
28,. 19,69, to the extent of $8, 000 from funds _of, the Town now available
to said purpose, said funds being a source other than the proceeds of
the .bonds in anticipation of which said Note was issued, and the said
amount of $8,000 is hereby appropriated therefor.
Section -2— This resolution shall -take effect immediately.

ORIZING THE RENEWAL, IN PART, OF THE $16, 000 BOND
ANTICIPATION NOTE FOR LAND ACQUISITION-1968, BY THE
ISSUANCE OF A NEW NOTE IN THE PRINCIPAL AMOUNT OF
$8, 000.
RECITAL
WHEREAS, the Town of Southold (herein called (Town") , in the
County Of Suffolk, New York, has. heretofore duly authori;zed, sold and
issued its $16, 000 Bond Anticipation Note For Land Acquisition-1968,
and has duly authorized the redemption of the Note-to the 'extent of $
$8, 000 and it is now necessary and desirable to provide for-. the renewal,
in part, of the said Note by the issuance of a new Note in the principal
amount of $8, 000; now, therefore, be it
RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE
COUNTY OF SUFFOLK, NEW YORK$ AS FOLLOWS :
Section l. . The .$16, 000 Bond Anticipation Note For Land
Acquisition-1968, of the Town, .dated March 1, 1968 maturing February 28,
1969, subject to 'prior redemption, numbered 3R-1, heretofore duly auth-
orized, sold and issued pursuant to the bond anticipation note resolution
duly adopted by the Town Board of said Town on February 13, 1968 is
hereby authorized to be renewed, in part, by the issuance of a new Note
in the principal amount of $8, 000, said Note dated March 1, 1969, having

been heretofore duly authorized to be redeemed from a source other
than the -proceeds of the bonds in anticipation of which said Note
has been issued, to the extent of $8, 000, ' all as hereinabbve referred
to in the Recital hereof, pursuant to the provisions of the Locallt'•`Pinance
Law, constituting Chapter 33-a of the Consolidated Lawssof the State
of New York (herein called "Law") . The maturity of said renewal Note
herein authorized shall not be later - than one year from its date, - and
said Note may be further renewed pursuant to the provisions of the Law.
Section 2. The terms, form and details of said renewal Note
shall be as follows :

Land Acquisition - 1969
Dated,: February 28, 1969
Matures : February 27, 19701 subject to prior redemption
No. 4R=1 Denomination:- $8, 000 ,
Interest Rate: 3-1/4/ per annum, payable at maturity

Supervisor 's Office, Greenport, N.Y.
Form of Note: Substantially in accordance with form,
prescribed by Schedule B, 2 of the Law.
Section 3. Said Note is hereby sold- to the SECURITY NATIONAL
BANK- OF-LONG ISLAND, Southold, Office, Southold, New York, ".- at the
price ,of $8, 000 . to bear interest at the rate of three and one-quarter
per centum (3-1/4/) per annum, payable at maturity, and the Supervisor
is hereby authorized to deliver said Note to said purchaser upon receipt
of the purchase price, plus accrued interest, if any, from the date of
said Note to the date of delivery.
Section 4. Said Note shall contain the recital of validity
prescribed by S. 52.00 of the Law and shall be a general obligation of
the Town, payable as to both principal and-interest by a general tax
upon all the taxable real property within 4he Town, without limitation
of rate or amount. The faith and credit of the Town are hereby irrevoc-
ably pledged to the punctual payment of the principal of: and interest
on said Note and provision shall be made in the budget of. the Town
by appropriation for the redemption of the Note'� to mature- in ,such year
and for the payment of interest to be due inss.hch year.
Section 5. Said Note shall be executed in the name of the Town
by its Supervisor and the corporate -seal of said t6wn shall be affixed
thereto and attested by its Town Clerk.
Section 6. This resolution shall take effect immediately.

RESOLVED: That this Town Board go on record as'- being opposed, to the
following Bill:
AN ACT to prohibit subdivisions of the state from discriminating in
the use of public 'parks-, beaches or recreational facilities to residents
of` the state -because of non-residency in the aforesaid political sub--
divisions.
The- People ,of the- State- of New York, represented in� Sbnate and
Assembly, do enact as follows :
Section 1. Notwithstanding any other provisions of any general, special
or local law, or of any rule or regulation, 'it shall be unlawful'_ for .a
political subdivision of the state to deny access to,: or the use of a
public park, beach or recreational facility to a resident of the state
of New York, on the same terms and conditions which -are applicable to
a resident of the politicJl' subdivision having control.of the park,

beach or facility. Any agreement or covenant which limits or restricts
such access or use,' to residents of such political subdivision .shall' be
unenforceable. This act shall take effect immediately.

RESOLVED: That the Town Board of the Town of Southold recommends. the
passage. of Senate. Bill 2799-Assembly- 5166 as follows,:
AN ACT :to:Famend the town law, in relation. to screening facilities re-
quired by zoning, boards of appeals and zoning ordinances in the county
of Suffolk. The people of the State of New York represented in- Senate
and Assembly, do enact as follows :_
Section 1. Subdivision fifteen-c of section one hundred thirty of the
town law, as last amended by chapter eight hundred twenty of the laws
of nineteen hundred sixty_eight, is hereby amended to read as, follows:
15-c. Screening facilities in the towns of the counties of Nassau,
Suffolk, Rockland and Westchester required by ,zoning boards of appeals
or zoning ordinances. Any town- in -the counties of Nassau, Suffolk,
Rockland and Westchester may adopt an ordinance giving to the appropriate
officials of such tow, upon the direction of the. town .board, the right
and power to erect, replace, repair - or maintain fences., trees, plantings,
shrubbery or- other screening on land located .in, such town where such
screening facilities are required by direction of a town board of zoning
appeals or by zoning ordinance and there is a failure to comply with such
direction, and if, . after giving thirty days ' notice by registered mail
addressed to the. owner ,,of record of such land- at the address shown on
the last preceding assessment roll, such fences, trees, plantings, shrub-
bery or other; screening are not so. erected., replaced, repaird or main-
tained by or on behalf of such owner; and the: town board may provide . for
the assessment. of all costs and expenses so. incurred by the town, in. ,
connection with any action taken as above, against the land on which such
screening facilities are located.
Section 2. This act shall btake effect immediately.
