The Southold Town Board met at theooffice of the Supervisor, Albert M.
Martocchia; 16 South Street, Greenport, N.Y, on November 6, 1969, with
the following present: Supervisor Martocchia; Councilmen Demarest and
Valentine; Justices Clark and Suter; Town Attorney Tasker; Supt. of
Highways Dean and Town Clerk Richmond. Absent: Justice E. Perry -Edwards.
Moved by Councilman Valentine; seconded by -Justice Suter;
RESOLVED: That the minutes of the meeting of October 21, 1969, be -and
they are hereby approved.
Vote of Town Board: Ayes-Supervisor Martocchia; Councilmen Demarest
and Valentine; Justices Clark and Suter.
Moved by Justice Suter; seconded by Councilman Valentine;
RESOLVED: That the next meeting of the Town Board will be held at the
office of Supervisor Albert Martocchia, 16 South Street, Greenport,
New York, on Tuesday, November 25, 1969, at 3 :00 P.M.

RESOLVED: That the reports of the Police, Supervisor, Building Inspector,
Justice Suter, Fishers Isl&nd Ferry District and Town Clerk for the
month of October, 1969, be accepted by the Town Board and placed on file.

Valentine; Justices Clark and Suter.

RESOLVED: That Police -Chief Carl Cataldo -be and he hereby is authorized
to purchase three PFRK4 Rescue Kits for the Police Department,- the- sum
not to exceed $1000. 00.

RESOLVED: That Edward Kugler, Mattituck, N.Y. be and he hereby is appoint-
ed a Provisional Patrolman, Town of Southold, to serve at the pleasure
of the Town Board, unless otherwise provided for, and be it further
RESOLVED: That the compensation -for this position be fixed at $650-0. 00
per year payable bi=-weekly, said appointment to be effective as of
November 8., 1969, on a one year probationary period.-

RESOLVED: That the Town Board retain Finkelstine, Smith and Yakabowski
as Attorneys to represent the Planning BcErd on the enforcement of Town
Ordinances.

Moved by Councilman Demarest; seconded by Councilman Valentine;'
WHEREAS, a written petition, dated November 26, 1968, was heretofore '
and on November 6, 1969, duly filed with this board pursuant to Section
200 of- the Town Law of-- the State of New York for the improvement of high-
ways known as Ed' s Road, Victoria Drive,, Liberty Lane, Colonial Road,-
Summit Road and Columbia Road, -situate on Corey's Hill at Bay View in
said Town; all as shown on the survey attached hereto; and 'whereas it
duly appeares that such petition has been duly signed by the owners of
real estate owning at least one half of the entire frontage or bounds
on both , aides of said highways as aforesaid and whereas, it duly appears
that such petition was also duly signed by resident owners owning not
less than one-half of the frontage owned by resident owners residing
in or along the portion of such highways situate as aforesaid; and whore-
as such petition was duly acknowledged or proved by all the signers -
thereof in the same manner as a. deed to be recorded; and whereas the
maximum amount proposed to be expended for the improvement of said highway
as stated in the petition is the sum of $6, 000.00; and whereas the area

benefited,7by the improvement is hereby determined by the Town Board to
be all of the several lots and parcels of land fronting on and abutting
upon either side of said highways; it is, pursuant to the provisibns
of said Section 200 of the Town Law of the State of New York, hereby
ORDERED that .the .Town Board of the Town of Southold, Suffolk County,
New York, shall meet at the Village Hall at Greenport, in `said Town an
the 9th day of December, 1969, at 7 :30 P.M. . o' clock in the afternoon .of
that day, for the purpose of considering the said petition and hearing
all persons interested in the subject thereof concerning the same.

RESOLVED; That the registration fees for the members of the Local Narcotic
Guidance Council and for Chief Cataldo be and they hereby are ordered
paid in the. amount of $30.00.

RESOLVED: That Supervisor Albert Martocchia be and he hereby is authorized
to sign the contract for the repairs, painting and storing of the Police
boat, said contract having been received from Pierce Boat Yard, in the
amount of $550. 90.

RESOLVED: That George Fishery Building Inspector, Town of Southold, be
and he hereby is authorized to attend Inspector School in Monticello,
New York, and that all necessary expE`nses be a legal charge against the
Town of Southold.

WHEREAS, John C. Tuthill, has applied to the Town Board for a single
trailer renewal permit dated October 1969,
NOW, THEREFORE, BE IT RESOLVED: That the application of John C. Tuthill,
Mattituck, N.Y. for a single trailer to be placed on Elijah Lane, Matti-
tuck, N.Y. be granted for a period of six (6) months. .

WHEREAS, a petition was received from Case Bros. , Cutchgoue, N.Y. re-
questing a change of zone of certain property described in said petition
from "A" Residential and Agricultural District to "B-2 " Business District,
NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of the Town of South-
old be and he hereby is directed to transmit this application to the
Planning Board in accordance with Section 901, Subdivision C of Article
IX of the Building Zone Ordinance of the Town of Southold.

preliminary budget, and heard all persons desiring to be heard thereon,.
NOW.. THEREFORE: BE IT RESOLVED: That -the Town Board of the Town of-'.. . . -
Southold does hereby adopt -:such Preliminary Budget as originally. compiled
as the Annual Budget of the Towri -of. Southold for the fiscal year beginning
on the lst day of January, 1970, and that such Budget as so adopted ,be _
entered in detail in the minutes of the proceedings of this Town 'Board,
and be it further
RESOLVED: That the Town Clerk of 'the, Town of Southold shall prepare and
certify in duplicate, copies of said Annual Budget as adopted by the
Town Board of the Town of Southold,' together with the estimates, -,if any,
adopted pursuant to Section '202A; subdivision 2 of the �Town Law, and
deliver one copy thereof to the Supervisor of the Town :to be presented
by him to the Board of Supervisors of the County of Suffolk. Dated:

The Town Board meeting reconvened at the Orient School, Orient, N.Y.
Moved by Councilman Demarest; seconded by Justice Clark;
In the Matter of the Establishment of the
Orient-East Marion Park District, in the
Town of Southold, Suffolk County, New York,
pursuant to Article 12 A of the Town Law.
WHEREAS, a map has been duly filed in the Town Clerk ' s Office, and
WHEREAS, an order was duly adopted by the Town Board of the Town of
Southold Qn the 21st day of October, 1969, reciting the filing of said
map, that no improvements are proposed, the boundaries of the proposed
Orient-East Marion Park District, the fact that the map is Flon file in
the Town Clerk ' s Office for public inspection and stating all other
matters required by law to be stated, and specifying the 6th day of
November, 1969, at 8:00 o' clock P.M. on that day, as the time, and the
Orient Schoolhouse, Main Road, Orient, in the said Town as the place
where the said Town Board would meet to consider said map and the pro-
posed establishment of said District, and to hear all persons interested
in the subject matter thereof, concerning the same, and to take such
action thereon as is required or authorized by law, and
WHEREAS, such order was duly published and posted as required by law, and
WHEREAS, a hearing on said matter was duly held by said Town Board on
the 6th day of November, 1969, at 8:00 o' clock P.M. of said day at the
Orient Schoolhouse, Main Road, Orient,_ in said Town, and full discussion
of the matter have been had, and all .persons desiring to be heard, having
been heard,
NOW, upon the .evidence given upon such hearing, and upon motion .of
Councilman Louis Demarest, seconded by Justice Henry Clark, it. is
RESOLVED AND DETERMINED:
(a) That the notice of Hearing was published and posted as required
by law, and is otherwise sufficient.

(b) That. all property and property owners within the proposed
Orient-East Marion -Park District, are benef itted thereby.
(c) That all property and property owners benefitted are included
within the limits of the proposed Orient-East Marion Park District.
(d) That it is in the public interest. to establish said Orient-
East Marion Park District. I .
FURTHER RESOLVED AND DETERMINED that this Boaed in all respects approves
the establishment of the- Orient-East Marion Park District in the Town
of Southold, Suffolk County, New York, to embrace the territory described
in and containing the following boundaries, to wit:-
ALL that certain tract, piece or parcel of land, situate in the
hamlets of Orient and East Marion, in the Town of Southold, County
of Suffolk, and State of New York, bounded and described as
follows:
BEGINNING at a point on the southerly line of the Main Road,
860. 56 feet westerly along said southerly line from Shipyard
Lane; from said point of beginning running the followingnine
courses :
(1) Across said Main Road, North 270 40 ' 00" .West 75. 72 feet;. thence
(2) North 330 45 ' 40" West, 193. 16 feet; thence
(3) North 360 03 ' 40" West 911. 59 feet; thence .
(4) North 510 37 ' 20" East 493.45 feet thence
