Moved by Justice Suter; seconded by Councilman Valentine; A RESOLUTION AUTHORIZING THE ISSUANCE OF $22,.000 SERIAL BONDS OF THE TOWN OF SOUTHOLD, SUFFOLK COUNTY, NEW YORK, FOR THE PURPOSE OF PAYING THE COST OF ACQUISITION OF CERTAIN REAL PROPERTY FOR USE BY THE, CUTCHOGUE NEW SUFFOLK PARK DISTRICT OF SAID TOWN AND THE CONSTRUCTION OF A BUILDING THEREON. WHEREAS, proceedings have heretofore been conducted pursuant to the provisions of Chapter 763 of the Laws of 1960 and Article 13 of the . Town Law by which it has been determined to be in the public interest to acquire certain real property and construct thereon a building for use as a comfort station for the Cutchogue New Suffolk Park District, and , WHEREAS, it is now desired to authorize the financing of the cost thereof, NOW, THEREFORE, BE IT RESOLVED: By the Town . Board of the Town of Southold, Suffolk County, New York, as follows : SECTION ... The specific objects or purposes for which the serial bonds herein authorized are to be issued are the acquisition of certain real property for the use of the Cutchogue New Suffolk Park District at a maximum estimated cost of $11, 000, and the construction on said real property of a building for use as a comfort station at a maximum cost of $11, 000. SECTION 11. The aggregate maximum estimated cost of the aforesaid specific objects or purposes is $22, 000, and the plan for the financing thereof is by the issuance of $22, 000 serial bonds of said. Town, here- by authorized to be issued pursuant to the Local Finance Law. SECTION 111. It is hereby determined that the period of probable usefulness applicable to the acquisition of real property described in Section 1 hereof is thirty years, pursuant to subdivision 21 (aX) of para- graph a of Section 11. 00 of the .Local Finance Law, and the period. of probable usefulness applicable to the construction of a -building des- cribed in Section 1 hereof is fifteen years, pursuant to subdivision 11 (c) of said paragraph and section. It is hereby further determined that the maximum maturity os. said bonds will exceed five years. SECTION 1V. The faith and credit of said Town of Southold, New York, are pledged for the payment of the principal of and interest on said bonds as the same become due and payable, There. shall annually be assessed upon all the taxable real property in said CutchogueuNew Suffolk Park District, at- the same time. and in the same manner as other Town charges, an amount sufficient to pay said principal and interest as the same become due and payable, but if not paid from such source, all the taxable real property within the said Town shall be subject to the levy of ad valorem taxes without limitation as to rate or amount sufficient to pay the principal of and interest on said bonds. SECTION T. . Subject ,to the provisions of the Local Finance Law, the power to authorize the issuance of and to .sell bond anticipation Notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the -Supervisor;- -the chief fiscal ,officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Supervisor, consistent with the provisions of the Local Finance Law. 201 SECTION VI. The validity of such bonds may be contested only if: 1) Such bonds are authorized for an object or purpose for which said Town is not authorized to expend money, or 2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied wi.th, and an action, suit or proceeding contesting such validity is commenced within twenty days of the date of such publication, or 3) Such bonds are authorized in violation of ,the provisions. of the Constitution. SECTION VII. This resolution, which takes effect immediately, shall be published in full in the Suffolk Weekly Times together with a notice of ,the Town Clerk in substantially the form provided in Section 81. 00 of the Local Finance Law. Moved by Justice Suter; seconded by Councilman Valentine; A RESOLUTION AUTHORIZING THE ISSUANCE OF $1, 500 SERIAL BONDS OF THE TOWN OF SOUTHOLD, SUFFOLK COUNTY, NEW YORK, TO PAY THE COST OF ACQUISITION OF EQUIPMENT FOR THE USE DF THE CUTCHOGUE NEW SUFFOLK PARK DISTRICT OF SAID TOWN. . WHEREAS,, proceedings have heretofore been conducted pursuant to the pro- visions of Chapter 763 of the Laws of 1960 and Article 13 of the Town Law by which it has been determined to be in. the public interest to , acquire certain equipment including an aluminum boat and lifeguard stand for use by the Cutchogue New Suffolk Park District, and WHEREAS, it is now desired to authorize the financing of the cost thereof; NOW, THEREFORE BE IT RESOLVED BY THE TOWN- BOARD OF THE TOWN OF SOUTHOLD, SUFFOLK COUNTY, NEW YORK, AS FOLLOWS : Section 1. The class of objects or purposes for which the serial bonds herein authorized are to be issued issthe acquisition of certain equipment for the use of the Cutchogue New Suffolk Park Distrtct. of .the _Town of Southold, Suffolk County, New York, at a maximum estimated cost of $1, 500. Section 2 . The plan for the financing of the aforesaid .class of objects or purposes is by the issuance of $1, 500 serial bonds of said Town, hereby authorized to be issued pursuant to the Local Finance Law. Section 3 . It is hereby determined that the period of probable usefulness applicable to the aforesaid class of objects or purposes is five years, pursuant to subdivision 35 of paragraph a of Section 11. 00 of the Local_ Finance Law. It is hereby further determined that the. maximum maturity of. said bonds will not exceed five years. Section 4. The faith and credit of said Town of Southold, New York, are hereby pledged for, the payment of the principal of and interest on said bonds as the same become due and payable. License, and WHEREAS, the Town Board has examined the application and after investig- ation duly made findings and determinations as required by law, NOW, THEREFORE, BE IT RESOLVED: That the Supervisor be and he hereby is authorized and directed to execute on behalf of the Town Board the find-, ings and determinations as required by- law., and it is further RESOLVED: That the, Town Clerk be and he hereby is- directed to issue a Bingo License to the Marian Council #3852 Knights- of Columbus. Moved by Councilman Valentine; seconded by Justice Clark; RESOLVED: That the Southold Town Board will accept a Bond of $68, 000 as recommended by the Southold Town Planning Board for roads and improve— ments in the subdivision known as SUNSET KNOLLS, Section 2, Mattituck, New York, developed by Stanley Sledjeski, subject- to the approval, of- ,the Town Board in writing, by the Highway Superintendent and the Town Engineer. Supervisor Albert Martocchia reported that Civil Service Department at Albany has •granted a one-month extension in service to Alfred R. Grebe, a member of the Planning Board. A letter in opposition to the acquisition by the County of Suffolk of the, Pinecrest Dunes area in Southold for a County Park was read. A letter was read from the Society of Friends in support of Open Housing. The Southold Peconic Civic Association wrote regarding concern that problems similar to the South side of_ the Island might now spread to our area unless action is taken now to prevent it. John Raff appeared before the Board relative to traffic conditions in the ,Town of Southold. Moved by Justice Suter; seconded by Justice Clark; RESOLUTION OF THE TOWN OF SOUTHOLD, NEW YORK,, ,ADOPTED OCTOBER 7 , 1969, APPROPRIATING $3, 000 FOR THE REDEMPTION IN PART, OF THE $10,400 BOND. ANTICIPATION NOTE FOR PURCHASE OF TAX ACCOUNT MACHINE-1968. Recital WHEREAS, the Town of Southold (herein called "town") , in the County of Suffolk, New York, has heretofore duly authorized, sold and issued its $10,400 Bond Anticipation Note For Purchase of Tax Accounting Machine- 1968 pursuant to the provisions of the Local Finance Law, constituting Chapter 33-a of the Consolidated Laws of the State of New York, and it is now desirable to redeem said Note to the extent of $3, 000 from a source other than the proceeds of the bonds in anticipation of which said Note has been issued; NOW, THEREFORE, BE IT RESOLVED: BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD, COUNTY OF SUFFOLK, NEW YORK, AS FOLLOWS: Section 1. The amount of $3 , 000 is hereby appropriated from funds of the Town now available to. said purpose to redeem, in part, on or before October 10, 1969, the $10,400 Bond Anticipation Note For Purchase of Tax Accounting Machine-1968, dated October 11, 1968, maturing October 10, 1969, subject to prior redemption, numbered R-1, heretofore duly authoriz- ed, sold and issued pursuant . to the bond. anticipation note- resolution duly adopted by the Town Board on October 8, 1968, and the Supervisor is hereby authorized and diredted to set aside and apply said amount to such partial redemption of said Note. NEW.NOTE IN THE PRINCIPAL AMOUNT OF . $7,400. Recital WHEREAS, the Town of Southold (herein called "town") , in the County of Suffolk, New York, has heretofore duly authorized,- sold and issued its $10,400 Bond Anticipation Note For Purchase of Tax Accounting Machine- 1968 and has duly authorized the redemption of said Note to the extent of $3 , 000 from a source other. than the proceeds -of the bonds in 'anticipat- ion of which said Note has been issued, and it is nww necessary to provide, for the renewal, in part, of said Note by the issuance of a new Note in the principal amount of $7,400; NOW, THEREFORE, BE IT RESOLVED ,BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF SUFFOLK AND STATE OF NEW YORK, AS FOLLOWS : Section 1. The $10,400 Bond Anticipation Note For Purchase of Tax Accounting Machine-1969; subject to prior redemption, numbered R-1., here- tofore duly authorized, sold and issued pursuant to the bond anticipation Note resoltuion duly adopted by the Town Board on October 8, 1969, is hereby authorized to be renewed, in,- part, by the issuance of a new Note in the principal amount of $7 ,400; said Note dated October 11, 1968 having been heretofore duly authorized to be redeemed from a source other than the proceeds of the bonds in anticipation of which said Note has been- issued, to the extent of $3, 600, ' all is hbo-einabove referred to in the Recital hereof, pursuant to the provisions of the Local Finance Law, constituting Chapter 33-a of the Consolidated Laws of the State of New York (herein called "law") . The maturity of said renewal Note herein authorized shall not be later than one year from its date and said Note may be further renewed pursuant to the provisions of the Law. Section 2. The terms, form and details of said renewal Note shall be as follows : Amount and Title: $7 ,400 Bond Anticipation Note For Purchase of Tax 'Accounting Machine-1969 Date: October 10, 1969 Maturity: October 9, 1970, subject to prior redemption Number and Denomination: 2R-1 $7 ,400 Interest Rate: N4.85 / per annum, payable at maturity Place of Payment of Principal and Interest: Office of the Supervisor; Greenport, New York. Form of Note: Substantially in accordance with the form prescribed by schedule B, 2 of the Law. Section 3Said; Note is hereby sold to the NORTH FORK BANK AND TRUST COMPANY, Mattituck, New York, at the purchase price of $7 ,400 to bear interest at the rate of -four and eighty-five hundredths per centum (4.85/) per annum, payable at maturity; and the Supervisor is hereby authorized to deliver said Note to said purchaser upon receipt of the said purchase price, plus accrued interest, if any, from the date of said Note to -the date of delivery. , Section 4. Said Note shall contain the recital of validity pre- scribed by Section 52. 00 of the Law and shall be a general obligation of the Town, payable as to both principal and interest by a general tax ,upon all the taxable real property within the Town, wihhout ,limitation of rate or amount.
