Absent: Justice E. Perry Edwards. _ Moved by Justice Clark; seconded by Justice Suter; RESOLVED: That the minutes of the July 15, 1969 meeting be and they hereby are approved. RESOLVED: That the, Town Board make it's official visit to Fishers Island on Tuesday, August 12, 1969. The meeting will be called to order at 1:00 P'.M. The Supervisor is hereby authorized to provide transportation and plans-for-the boat to leave Sterling Harbor at Greenport, .N.Y. at 9:00. Moved by Councilman Demarest; seconded by Justice Suter; AN ACT to enable persons sixty-f`ive years of age or over to file late applicationss.for partial real property tax exemption on or .,during a ninety day period after the enactment hereof for . the fiscal year nineteen hundred . sixty-nine or fiscal year nineteen hundred sixty- nine-nineteen hundred seventy. : The People of the State of New York, represented .in Senate and Assembly, do, hereby enact as follows :- Section 1. Notwithstanding the provisions of subdivision four of section four .hundred sixty-seven of the real property tax law, persons sixty-five years of age or over who •had previously applied - . and qualified for partial exemption from the tax on real property a pursuant to the provisions of said section and who failed to reapply for such -exemption for the .fiscal year nineteen hundred sixty-nine or the fiscal year nineteen sixty-nine-nineteen hundred seventy,; . whichever applies; may file late applications for such exemption with- in ninety days after this act becomes law, proveded that the munic- ipality in which the real property is situated passes a resolution or local law permitting such late filing and providing for the credit- ing of such exemption against the taxes levied or to be levied during the aforesaid fiscal year. This act shall take effect immediately. WHEREAS, by Chapter 724 of the Laws of 1969 section 467 of the real property tax law, which granted .partial tax exemption of real estate - - owned by persons of limited income over the age of 65 years, was modified to permit the filing of late applications for such exemption for -the fiscal year 1969 or the fiscal year 1969-1970, and WHEREAS, said chapter requires the municipality involved to adopt a resolution permitting such late filing, and WHEREAS, it is the desire of the Town Board of the Town of Southold to make the privilege of . such . late application applicable to all eligible elderly .persons within its boundaries, NOW, THEREFORE, BE IT RESOLVED: That the Town Board of the Town of Southold, pursuant to section 467 of the real property tax law as amended by Chapter 724 of the Laws of 1969 hereby grants to persons of 65 years of age or over who_ have premiously applied and qualified for partial exemption from the tax on real -property and who failed to reapply for such exemption for the fiscal year 1969 or the fiscal year 1969-1970, the privilegeto file late applications for such exemptionsas provided in said Chapter 724 of the Laws of 1969, and it is further RESOLVED: that a certified copy of this resolution be forwarded by the Clerk of this Board to the Assessors of the Town of Southold. Moved by Justice Suter; seconded -by J•astice Clark; RESOLVED: That the Superintendent of Highways of the Town of Southold, be 'authorized to advertise for bids and to purchase from the .lowest responsible bidder, the following items, more or less, as needed:= 20, 000 lin. feet of snow fence with pickets 12 x 2 inches, spaced 2 inches apart, .4 .feet high stained red, with five (5) double strands of 122 gauge galvanized wire, in 100 lin. foot rolls. 2,000 - 6 ft. steel fence posts. Moved by Justice Suter; seconded by Justice Clams ; RESOLVED: That .Chester Melot, Mattituck, N.Y. be. and he hereby is appointed Attendance Officer, subject to the written approval of the District Superintendent of Schools, throughout the Town, except such schools as are otherwise provided fior by Section 3.213 of the Education Law, and be it further RESOLVED: That such attendance officer shall be removable at the ` pleasure of the District Superintendent of Schools, and be it further ' RESOLVED:. .That the compensation of such attendance officer be fixed at $1200..00 per year, payable in regular monthly installments, he to pay-his own expenses, and be it further RESOLVED: -That the Town Clerk be and he hereby is instructed to' notify Chester Melot and the D istrict Superintendent of Schools of the appointment. Moved by Councilman Valentine; seconded by Justice 'Suter; WHEREAS, the Senior Citizens, Southold Town, request the use of four (4) buses for transportation to Natuee`s Gardens, up the Hudson, NOW, THEREFORE, BE IT RESOLVED: That the Town of Southold furnish transportation for . the Senior Citizens as requested. Moved by Councilman Valentine; seconded by Councilman Demarest;' WHEREAS, the Town of Southold, in order to provide for 6 planning study contributing -to an overall program for its future community, .desires to participate in the federal-state Urban Planning Assistance Program as authorized by Section 701 of. the Housing Act of 1954, as amended, and Article 19-k of the New York State Executive Law, and WHEREAS, the New York State Office of Planningg . Coordination, under authority of Article 10-k of the New York State Executive Law, iss the -official . state agency designated to administer state funds under the provisions of Section 701 of the Housing Act of 1954, .as attlended, ' now, therefore be' it RESOLVED: That the Town Board of the Town of Southold hereby requests the New York State. Office of .Planning Coordination to provide planning assistance under authority of Article 19-k of the New York State Executive Law, with such financial assistance as may be provided by ,the United States .Department of Housing and Urban Development, under author- ity of Section 701 of the Housing Act of 1954, as amended,' and Article 19-k of the New York State Executive Law. Such planning assistance is more particularly described in' the project application attached hereto 184 and made a part of this resolution as if fully set forth herein. RESOLVED„ that if' the aforesaid application is approved and accepted by both the Director of the New York State Office of Planning Coordination and the Department of Housing and Urban Development, ,the Southold Towne Planning .Board shall enter into •.a formal agreement with the New York State .Office ' of Planning Coordination to undertake the project described in the approved application and to pay to the State of New York its share of the estimated total cost of the said project, together with such other terms and conditions "as may be deemed necessary and appropri- ate to carry out the said project. RESOLVED: That the Southold Town Planning Board .hereby agrees to have available, in the year the project is to be completed, the sum of $367.00 dollars, or so much thereof as may be mecessary to -'contribute a sum not to exceed '16 2/3 per centum (16 '2/3%)of the total cost of_ said project, to be paid to the State of New York, on condition that the above-mentioned application is approved by both the Department of Hous- ing and Urban Development and the Director of- the New York State Office of Planning Coordination. RESOLVED: that the Planning Board shall assume the costs of operating and maintaining its own planning board or commission 'including such services as clerical, personnel.]_ office, space, equipment,materials, communication and travel, as such costs cannot be charged to the Urban Planning Assistance Program. RESOLVED: That it is understood that current planning services may not be charged to the Urban Planning Rssistance Program. RESOLVED: That the Chairman of Planning' Board of the Town of Southold - be and hereby is authorized and empowered to execute in the name of the Town of Southold all necessary applications, contracts and agreements to implement and carry out the purposes specified in this resolution. Vote of Town Board: Ayes-Supervisor Martocchia; Councilmen Demarest and Valentine; Justices Clark and Suter. r Moved by Councilman Demarest; seconded by Councilman Valetine; WHEREAS, the petition of Frank Murphy, Mattituck, N,Y. and Stephen Doroski, Southold, for a change of zone from "A" Residential and Agric- ultural District to "B" Business District have been sent to the Planning Board for their recommendation and report, and WHEREAS, it is required to send all property within 500 feet of County Roads or property to the Suffolk County Planning Board, NOW, THEREFORE, BE IT RESOLVED: 'That these petitions be sentto the-" Suffolk County Planning Board for their recommendation and report. Moved by Justice Clark; seconded by Councilman Valentine; WHEREAS, a petition was received from Abe -Goldrich requesting a change of zone of certain property on Middle Road, *Southold, N.Y. described in said petition from "A" Residential and Agricultural District to "B" Business .District, NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of the Town of Southold be, and he hereby is directed to ••transmit this application to the Planning Board in accordance -with Section 901, Subdivision C of Article IX of the Building Zone Ordinance of the Town •of Southold. Vote of Town Board: Ayes-Supervisor Martocchia; councilmen Demarest and Valentine; Justices Clark and Suter. • Moved by `Councilman Demarest; seconded by Justice Suter; WHEREAS, Stephenson Beach Inc. is the owner of real property at Orient and East Marion, New York-, consisting of a beach fronting on Long' Island Sound and meadow and wetlands fronting on Orient Harbor, and WHEREAS, a meeting of' the stockholders of Stephenson Beach, Inc. was held on July 21 , 1969, at which: time the following resolution was adopt- ed, to wit:- "RESOLVED, that ,the Officers of the Corporation ate hereby authorized and directed to take such action as may be appropriate to arrange for all or substantially all of the real property owned by this Corporation, or all of the stock of this Corporation, to be given to a new park district to be created for the Orient-East Marion area, 1:85 subject to appropriate conditions regarding the maintenance. of the wet lands and the beach area of such property. " and WHEREAS,, this board deems it in the public interest that .a park district be created for the Orient-East. Marion area in the Town of Southold for the purpose of taking title to the real property of Stephenson .Beach, Inc. in 'accordance with the resolution of the . stock'holders of said corporation, hereinbefore set forth ` NOW, THEREFORE, BE IT RESOLVED pursuant to the provisions of Article 12-A of the Town Law,` the sum of $200.00 be and the same hereby is appropri- ated to pay the cost of preparing a general map showing the proposed Orient-East Marion Park District, and it is further ' RESOLVED: That this resolution is .subject to a permissive referendum. Moved by Councilman Valentine; seconded by, Justice Clark; RESOLVED: That the Town Clerk be and he hereby is directed to request the Long Island Lighting Company to install 175 MVOH street lights on poles #79 and #96 on Nassau Point Causeway, Bay Ave. , Cutchogue, Vote of Town Board: Ayes-Supervisor Martocchia; Councilmen Demarest and Valentine;' Justices Clark .and Suter. Justice Martin Suter reported on the Conference he attended stating that it wa's most educational. iylure . .by Councilman Valentine congratulated Chief Carl Cataldo and the Southold Police Department on the award received .by them from the State Traffic Safety Council of New York, which read as follows : Southold 'Police Department For Outstanding .Achievement in Accident Prevention. A Cdrtificate of Recognition In appreciation of outstanding performance for Traffic Safety. This interest and support has contributed to safety on our highways for all citizens and is hereby gratefully acknowledged. July, 1969. Mr. Nelson Axien appeared before the Town Board requesting the Board to restrict the beaches to residents and house guests only, as the beaches have been crowded the last few weeks. Mrs. Theodore Bittner _requested an ordinance on Aerial spraying, suggesting that permission 'from property owners within 1500 feet be required. Mr. Kingsley Smith requests a. Building Code for the Town of. Southold. Mr.' Robert Trubenbach reported on the speed on Hobart Road, Southold, Moved by Justice Suter; seconded by Justice Clark; RESOLUTION OF THE TOWN OF SOUTHOLD, NEW YORK, ADOPTED JULY 29, 1969, APPROPRIATING $4, 250 FOR THE' REDEMPTION, IN PART, OF THE $8, 500 BOND ANTICIPATION NOTE FOR PURCHASE OF A PAYLOADEk-1968. Recital WHEREAS, the 'Town of Southold (herein called "Town") , in the County of Suffolk, New York, has heretofore duly authorized, sold and issued its $8, 500 Bond Anticipation Note For Purchase of a Payloader.-1968, and it is now desirable to redeem said Note to the extent of $4,250 . from ,a' source other than the proceeds of the bonds iri anticipation of which said Note has been issued.; now, therefore, be it RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY . OF SUFFOLK, NEW YORK, AS FOLLOWS : Section 1. The amount of $4, 250 .is hereby appropriated from funds now available to said purpose to redeem,. in part,. on or before August 8, 1969, the outstanding $8, 500 Bond Anticipation Note For Purchase of a Payloader-1968 of the Town hereinahbve referred to in the Recital of this resolution, said funds .being a source other than the proceeds of the bonds in anticipation of which said. Note has been issued. 186 Section 2. This resolution shall take effect immediately. (herein called "Town") , in the County of Suffolk, New York ' .has duly authorized,, sold and issued its $8, 500 Bond Anticipation Note For Purchase of a Payloader-1968 and has duly appropriated $4,250 for the redemption, in part, of said Note and it is now necessary and desirable to provide for the renewal, in part, of said Note by the issuance of a new Note in the principal amount of $4, 250; now, therefore, be it RESOLVED ,BY THE TOWN BOARD OF THE .TOWN OF SOUTHOLD, IN THE COUNTY' OF SUFFOLK, NEW YORK, AS FOLLOWS : Section 1. The $8, 500 Bond Anticipation Note For Purchase of a Payloader-1968 of the Village, dated August 9, 1968, maturing August 8, 1969, subject to prior redemption, numbered 3R-1, heretofore duly authorized, sold and issued pursuant to the bond anticipation note I esolution duly adopted by the Town Board on August 13, 1968, is here- by authorized to be renewed, in- part, by the issuance of annew Note in the principal amount of $4, 250; the amount of $4, 250 having been heretofore duly appropriated from a source other than the proceeds. of the bonds in anticipation of which said Note has been issued, to redeem, in part, said Note dated August 9, 1968, all as hereinabove referred to .in the Recital hereof, pursuant to the provisions of the Local Finance Law, constituting Chapter 33-a of the Consolidated Laws of the State of New York (herein called "Law ") . The maturity of said . renewal Note herein authorized shall not be later than one year from its date and said Note may be further renewed pursuant to the provis- ions of the Lana. Section 2. Law. Section 3. Said Note is hereby sold to the SECURITY NATIONAL BANK OF LONG ISLAND` Southold' Office, Southold, New York, 'at the purchase price of$4,'250, to bear interest at the rate of three and ninety hundredths per centum (3.-90/0)" -per annum, payable at maturity, -and the Supervisor is hereby authorized to deliver said Note to said purchaser upon receipt of the purchase price,, plus accrued interest, if any, from the date of said Note to the date of -delivery. ' Section 4. Said Note shall contain the recital of` balidity prescribed by Section 52. 00 of the Law and shall be a general obIli.g- ation of the Town, payable as to both principal and interest by a •gen= eral tax upon all the taxable real property within the 'Town,- without limitation of rate or amount.' The faith and credit of the Town are here- by irrevocably pledged to the pucntual payment of the principal of and interest on said Note 'and provision shall be made in the budget of the . Town by" appro.priation for the redemption of the Note to mature in such year and for the payment of interest to be due in such year. Section 5. Sai'd Note shall be executed in the name of the Town by its Supervisor and the corporate seal of the Town shall be ,affixed, thereto 'and "attested by its Town Clerk. Section 6.
