RESOLVED: That pursuant to Section 215, subdivision 1-a of the Town
Law that the Board of Commissioners of the Orient=East Marion Park
District be and they hereby are authorized to designate one of their
members as Treasurer and Disbursing Officer for such District in place
of the Supervisor, and it is further
RESOLVED: That the Board of Commissioners of the Orient-East Marion
Park District be and they hereby are authorized to employ' the Town
Attorney of the Town of Southold to render professional services and
advice and to receive such compensation therefor as may be agreed
upon between the Commissioners and said Town Attorney.

Supervisor Albert Martocchia stated that he had received notice from
the Civil Service Commission granting a one year extension to
September 30, 1971 for Alfred Grebe, ' a member of the Planning Board of
the Town of Southold.

MEETING OF OCTOBER 6, 1970.
The Southold Town Board met at the office of Supervisor Albert M. Mart-
occhia, 16 South Street, Greenport, New York, on Tuesday, October 6,
1970 with the following present: Supervisor Albert Martocchia; Council-
man Rich; Justices Demarest and Suter; Town Attorney Tasker; Superinten-
dent of Highways Dean and Town .Clerk .Richmond. Absent: Justice E. Perry
Edwards and. Councilman Valentine.
Moved by .Justice Suter; seconded by Councilman Rich; .
RESOLVED: That 'the minutes of September 22, 1970 be and they hereby
are approved.
Vote of Town Board: Ayes-Supervisor Martocchia; Councilman Rich; Justices
Suter and Demarest.

RESOLVED: That the next meeting of the Town Board will be held at the
office of. Supervisor Albert Martocchia, 16 South Street, Greenport, ,
New York, on October 27 , 1970 at 3 :00 P.M.

Mrs_. John Richmond, Orient, spokesman for a group of residents, requested
the Eastern Long Island. Hospital to extend the deadline for closing the
maternity section beyond March 31, 1971 as they are proposing to take
action in obtaining an obstettician-gynecologist for the area. Two
committees have already been formed, one to help locate a doctor and the
other to help convince the residents of Southold Town that the maternity
wing is necessary. They request help from the Town Board. Justice Suter
and the Board promised to do everything in their power to help.
Mrs. Carl Cooper of Greenport asked the Board' s help in keeping the his-
torical St. Peters Evangelical Lutheran Church in Greenport. The 100
year old building with its lovely stained glass windows is for sale
and there is a chance that it will be moved from the community. Supervisor
Martocchia said that the Board has been considering renting a part of
the church to house the Narcotics. Council, but that the owner had turned
the .Board down. The Board promises to continue its efforts.

RESOLUTION OF THE TOWN OF SOUTHOLD, NEW YORK, ADOPTED
OCTOBER 6, 1970, APPROPRIATING $3 , 700 FOR THE REDEMPTION
IN PART, OF THE $7,400 BOND ANTICIPATION NOTE FOR PURCHASE "
OF TAX ACCOUNT MACHINE-1969.
Recital
WHEREAS, the Town of Southold (herein called "Town") , in- the County
of Suffolk, New York, has heretofore duly authorized, sold and issued its
$7,400 Bond Anticipation Note For Purchase of Tax Accounting Machine-
1969 pursuant to the provisions of the Local Finance Law, constituting
Chapter 33-a of the Consolidated Laws of the State of New York, and it
is now desirable to redeem said Note to the extent of $3, 700 from a
source other than the proceeds of the bonds in anticipation of which
said Note has been issued;
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD,
IN THE COUNTY OF SUFFOLK, NEW YORK, AS FOLLOWS :
Section 1. The amount of $3, 700, is hereby appropriated from funds
of the Town now available to said purpose to redeem, in part, on or be-
fore October 9, 1970, the $7 ,400 Bond Anticipation Note For Purchase of
Tax Accounting Machine-1969, dated October 10', 1969, maturing October 9,
1970, subject to prior redemption, numbered 2R-1, heretofore duly auth-
orized , sold and issued pursuant to the bond anticipation note resolut-
ion duly adopted by the Town Board on October 7, 1969, and the _Supervisor
is .hereby authorized and directed to set aside and apply said amount to
such partial redemption of said Note.
Section 2. This resolution shall take effect immediately.

TAX ACCOUNTING MACHINE-1969, BY THE ISSUANCE OF A NEW NOTE
IN THE PRINCIPAL- AMOUNT OF $3, 700.
RECITAL
WHEREAS, the Town .of Southold (herein called "Town") , in the county
of Suffolk, New York, has heretofore duly authorized, sold and issued its
$7,400 Bond Anticipation Note For Purchase of Tax Accounting Machine-1969
and has duly authorized the redemption of said Note •to the extent of
$3, 700 from a source other than the proceeds of the bonds in anticipation
of which said Note has been issued, and- it is now necessary to provide
for the renewal, in part, of .said Note by the issuance of a new Note in
the principal amount of $3, 700;
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN OF SOUTHOLD, IN THE COUNTY
OF SUFFOLK, NEW YORK, AS FOLLOWS :
Section 1. The $7,400 Bond Anticipation Note For Purchase of Tax
Accounting Machine-1969, dated October 10, 1969, maturing October 9,
1970, subject to prior redemption, numbered 2R-1 heretofore duly author-
ized, sold and issued pursuant to the bon_d 'anticipation Note resolution
duly adopted by the Town Board on October 7, 1969, is hereby authorized
to be renewed, .In part, by the issuance of a new Note in the principal
amount of $3, 700; said Note dated October 10, 1969 having been heretofore _
duly authorized to be redeemed from a source other than the. proceeds of
the Bonds in anticipation of which said Note has been issued, to the
extent of $3, r7,00,- all as hereinabove referred to in the Recital. hereof,
pursuant to the provisions of the Local Finance Law, constituting Chapter
33-a of the Consolidated Laws of the State of New York (herein called
"Law") .The maturity of said renewal Note herein authorized shall not be
later than one year from its date and said Note may be further renewed
pursuant to the provisions of, the Law.
Section 2. The terms, form and details of said renewal Note -shall

Section 3. Said Note is hereby sold to Security National Bank of
'Long Island, Southold, New York, at the purchase price of $3 , 700 to
bear interest at the rate of Three and ninety-five hundredths per centum
(3.95/) per annum, payable at maturity, and the Supervisor is hereby a
authorized to deliver said Note to said purchaser upon receipt of the
said purchase price, plus accrued interes, if any, from the date of said
Note to the' date of delivery.
Section 4. Said Note shall contain the recital of validity pre-
scribed by S. 52. 00 of the Law and shall be a general obligation of
the Town, payable as to both principal and interest by a general tax
upon all the taxable real property within the Town, without limitation
of rate ' or amount. The faith and credit of the Town are hereby irrevoc-
ably -pledged to the punctual payment of the principal of and interest
on said Note and provisions shall be made in the budget of the Town by
appropriation for the redemption of the Note to mature in such year and
for the payment of interest to be due in such year.
Section 5. Said Note shall be executed - in the name of the Town
by its Supervisor and its corporate seal shall be affixed thereto and
attested by its Town Clerk.
Section 6. This resolution- shall take effect immediately.

Bid for gasoline was opened and read at 10 :00 A.M. as advertised. Only
one bid was received as follows : R. A. McCallum,. Inc.-. 1504 per gallon.

WHEREAS, R. A. McCallum, Inc. was the lowest bidder for 300, 000 ,gallons
of special gasoline �()or as much as may be required)
RESOLVED: That supervisor Albert Martocchia be and he -hereby - is directed
to enter into a contract with R. A. McCallum Inc. for purchase of 300, 000
gallons of special gasoline (or as much as is required) at the price
of . 1504 per gallon for the use of the Southold Police, Highway Depart-
ment and all other Town cars, said contract for a period ,from October 1,
1970 to September 1, 1971.

WHEREAS, Abe Goldrich, 1077 East Broadway, Woodmere, N.Y. by petition
verified the 24th day of June, 1970, petitioned the Town Board for a
change of zone of certain property situated in Southold, N.Y. described
in said petition from "A" Residential and Agricultural District to
"B" ,Business District; and
WHEREAS, the said petition was referred to the Planning- Board •.for its .
official recommendation and report, and
WHEREAS, the Town•Board, pursuant to due notice thereof, held a hearing
thereon on the 22nd day of September, 1970, '- at which time all interested
persons were given an opportunity to- be heard,
NOW, THEREFORE, BE IT RESOLVED: That the Southold Town Building Zone
Ordinance, including the Building Zone Maps, be amended from "A" Resid-
ential and Agricultural -District to "B" Business District 'on the follow-
ing described property:

200 tons of No. 1 Grade Cayuga (or equal) Rock Salt (more or less as
needed) delivered in 100 pound paper bags by truck to Peconic, N.Y. .

Agricultural District to "B2 " Business District on certain property
near the Village of Greenport,
.NOW, THEREFORE, BE IT RESOLVED: That a public hearing will be held by '
the Southold Town Board at the Supervisor ' s Office, 16 South Street,
Greenport, New York, on October 27, 1970 at 7 :30 P.M. on the above
mentioned petition and that the Town Clerk -be and he hereby is authorized
and directed to cause notice of said hearing to be published in the Long
Island Traveler-Mattituck Watchman pursuant to the requirements of law.

BOND RESOLUTION APPROPRIATING $6, 000 FOR THE IMPROVEMENT OF
TOWN ROADS, IN SAID TOWN, .STATING THE ESTIMATED MAXIMUM COST
THEREOF, IS .$6, 000 AND AUTHORIZING THE ISSUANCE OF $6, 000
SERIAL BONDS OF THE TOWN TO FINANCE SAID APPROPRIATION.
Recitals
WHEREAS,following receipt of a petition in due form a public

hearing duly called and held for the improvement of the existing highways
known as Eds Road'; Victoria Drive, Liberty Lane, Colonial Road, Summit
Road and Columbia Road (herein called "Improvement" and "Streets" ,
respectively) , in the Town of Southold (herein called "Town") , in the
County of Suffolk, New York', by the paving and resurfacing thereof, at
an estimated maximum cost of $6, 000, the Town Board of the Town determin-
ed, pursuant to resolution kduly adopted on January 13 , 1970, that the
notice of such hearing was published and posted as required by law and is
otherwise sufficient and that it is in the public interest to make the
Improvement pursuant to the definite plans, specifications and estimate
of cost to be prepared by the Town Engineer; now, therefore, be it
RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF
SUFFOLK, NEW YORK (by the favorable vote of not less.. than two-thirds of
all the members of said Board) , AS FOLLOWS :
Section 1. The Town hereby appropriates the amount of $6, 000 for
the construction and installation of pavement of. sand and gravel, water
bound macadam or penetration process with single surface treatment on and
along the Streets, Town Highways in the Town, all in accordance with the
map, plan and specifications and estimate of cost prepared by the Town
Engineer-, her6lnhbove referred to in the Recitals hereof, and hereby
approved. The estimated
maximum cost of said specific object or purpose, including preliminary
costs and: eosts incidental thereto and the financing thereof, is $6, 000
and the plan of financing includes the issuance of serial bonds of the
Town in the principal amount of $6, 000 and the assessment, levy and coll-
ection of assessments from the several lots -and parcels of land which
the Town Board shall deem especially benefitted thereby to pay the
principal of said bonds and _the interest thereon so much upon and from
each as shall be in just proportion to the amount of benefit which the
Improvement shall confer upon the same.
Section 2. To finance said appropriation, serial bonds of the
Town are hereby authorized to be issued in the principal amount of
$6, 000 pursuant to the provisions of the Local Finance Law, constituting
Chapter 33-a of the Consolidated Laws of the State of New York (herein
called "Law") .
Section 3 . The period of probable usefulness. of the specific
object or purpose for which the onds authorized pursuant to this resol- -
ution are to be issued, within the limitations of Section 11. 00 a. 20.
of the Law, is five (5) years.
(b) Current funds are not required to be provided prior to the
issuance of the bonds authorized pursuant to this resolution, or any bond
anticipation notes issued in anticipation thereof, pursuant to the pro=
visions of Section 107. 00 of the Law.
(c) The proposed maturity of the bonds authorized pursuant to .this
resolution may oxceed five (5) years.
Section 4. Each of the bonds authorized pursuant to this resolution,
and any notes issued in anticipation thereof, shall contain the recital .
of yaflzd t'�re]#escribed by S 52. 00 of the Law and said bonds and _any notes
issued in anticipation of said bonds shall be general obligations of the
Town, payable as to both principal and interest by general tax upon all
the taxable real property within -the Town without limitation of rate or
amount. The faith and credit of the Town are hereby irrevocably pledged
to the punctual payment of the principal of and interest on said bonds and
provisions shall be made annually in the budget of the Town by appropri
-
ationfor (a) the amortization and redemption of, the bonds. to mature in
such year and (b) the payment of interest to be due and payable in such
year.
Section 5. Pursuant to the provisions of this resolution and pursu-
ant to the provisions of S 30. 00 relative to the authorization of the -,
issuance of bond anticipation notes and S 50 and Ss 56.'OO .and 60. 00 of
the Law, the powers and duties of the Town Board relative to .prescribing
the terms, form and contents and as to the sale and issuance of said
bonds and any notes issued in anticipation of said bonds, or bhe renewals,
thereof, are hereby delegated to the Supervisor, the chief fiscal officer
of the Town.
Section 6. The vaildity of the bonds authorized pursuant to this
resolution may be contested .only if:
(a) such obligations are authorized for an object or purpose for
which the Town is not authorized to expend money,' or

(b) the provisions of law which- should be complied with at the
date of publication of such resolution, are not substant-
ially complied with., and an action, suit or proceeding con-
testing such validity, is commenced within twenty days after
the date of such publication, or
(c) such obligations are authorized' in violation of the provisions
of the constitution.
Section 7. This resolution shall take effect immediately.

Section 1. The Town Clerk of the, Town of Southold. in the County
of Suffolk, New York, is hereby directed to publish the foregoing- bond
resolution, in full, in The Long Island Traveler Mattituck Watchman, a
newspaper published in the Town of Southold, New York, and having a
general circulation in the Town,- which newspaper is hereby designated as
the official newspaper of the Town for such publication, together with
the Town Clerk' s statutory Notice in substantially the form as prescribed
by Section 81. 00 of the Local Finance Law of the State of New •York,
Section 2. This resolution shall take effect immediately.

FURTHER RESOLVED: That such premliminary budget shall be filed in the
office of the Town Clerk where it .'shall be available for inspection by
any interested person at all reasonable hours, and be it
FURTHER RESOLVED: That this Board shall meet at 3 :OO, o ' clock .p.m. on the
5th day of November, 1970, for the purpose of holding a public hearing
upon such preliminary budget, and
FURTHER RESOLVED: That the Town .Clerk,give notice of such hearing in. the
manner provided in Section 113 of the Town, Law, and that such notice be
