MEETING OF AUGUST 4, 1970 ,
WAIVER OF NOTICE OF TOWN BOARD MEETING
WE, the undersigned, being members of the Town Board of the Town of
Southold, Suffolk County, New .York, do hereby severally waive notice
of the time, place and .purpose• of the meeting of the ..Town Board to
be held at Greenport, in the Town of Southold, on the 4th day of
August, 1970, and do hereby consent that the same be held on said
date for the transaction of any business which may properly come
before said meeting. Dated: August_ 4, 1970.

' WHEREAS, ,this Board has , been advised that Warner, Madaio and Winters
are conducting activities on property at. Oregon Road, Mattituck,
New York, in violation of -the zoning ordinance- of the Town of
Southold, and
WHEREAS, this Board deems it imperative that appropriate legal action
be taken to restraim such violation,
NOW, THEREFORE, BE IT RESOLVED: That the firm of Smith, Tasker and
Finkelstein be and they hereby are retained- to take such legal action- _
on behalf of the. Town of Southold ,as they deem appropriate with re- .
spect to such violation.

Meeting of August 13., 1970
Fishers Island, New York
The Annual Fishers .Island meeting of the Southold Town Board was held .
atFishers Island School on Thursday, August 13 , 1970, at 1:00 P.M. with
the following present: Supervisor Martocchia; Councilmen Rich and Valen-
tine; Justices Demarest, Suter and Edwards ; Supt. of Highways Dean; .
-Town Attorney Tasker and Town Clerk Richmond.
Supervisor Martocchia introduced the visiting State, ..County. and. Town�
Officials attending the meeting
Moved by Justice Suter; seconded by Councilman Valentine;
RESOLVED: That the minutes of July 28, 1970 be and they hereby, are approved.
Vote of Town Board: Ayes-Supervisor Martocchia; Councilmen Valentine and
Rich; Justices Demarest, Suter and Edwards.
Moved by Councilman Valentine; seconded by Councilman. .Rich;
RESOLVED: That the next meeting of the Town Board will be ,held at the
Superviosr ' s Office, 16 South Street, Greenport, New York, on Tuesday,
August 25, 1970, at 3 :00 P.M.

RESOLVED: That the report of the Building Inspecbbr, Board of Appeals,
Justice Suter, Supervisor and Town, Clerk for the month of July 1970,
be' accepted by the Town Board and placed on file.

Supervisor Martocchia ,-opened the meeting for discussion of .any problems
the Fishers Island residents might have. The dredging of West Lake was.
discussed. Many residents are in favor of the dredging but there were
objections as to where a .satisfactory spoil area could be found. Mr.
Maxwell Porter read the following letter and requested that it be 'made
a part of . the records :
My name is Maxwell Porter. I and my son, Eliot Porter, each own property
on Isabella Avenue which adjoins a marshland.

In 1934 I built a home which faces south overlookkng the marshland
and for the .past thirty-six years. hay.e. enjoyed this marsh with its
abundance of -interesting birds. There we. see. Red Wing Black Birds,
Yellow Warblers, Long Billed :Marsh Wrens, Coopers Hawks , Brown
Thrush, Cat Birds and many other .species.
We are in favor of the proposed dredging of West Harbor but strenu-
ously object Ito .the s.ucjgestion of destroying this marshland by filling
any part of it with the dredging from the harbor.
It is. apparently a .natural drainage and runoff of surface water from
the surrounding higher elevations. There is a ditch which is usually
effectively kept open -preventing this from becoming a mosquito swamp.
We assume that the dumping of such dredgings into the marsh .would create
a long lasting stench, would obliterate the natural growth of the
marshland, and might affect .the drainage. All .this wild adversely affect
the surrounding properties. We acknowledge that such filling might
temporarily. be .an advantage to the present owner of the marsh but would
seriously affect the values and well being -of .others. We .feel certain
that different locations can be found to put. the .dredgings which would
not cause a hardship, a nuisance and an unsightly mess-to. the nearly
tax paying land and home owners. Respectfully, Maxwell S. Porter

The pollution problem in the harbors was discussed, including the new
law on holding tanks on boats .
Many residents felt the ferry rates were too high for year round and
Senior citizens. he residents requested State or County Aid, since they
have no state andlcounty roads to keep in condition and their only means
of transportation to the maintland is by ferry.
Recess was called at which time everyone was invited to the Legion Hall
where a light lunch and coffee were served by the ladies of Fishers Island.
Meeting was reconvened aboard the return boat TEX at 5 :00 P.M.

RESOLVED: That General Bills in the amount of $23, 342. 11; Highway Bills
in the amount of $15 , 510. 07 ; Lighting Bills in the amount of $4, 861.76
and Fishers Island Ferry District Bills in the amount of $15, 523.86
be and the same are hereby ordered paid.

WHEREAS, the expiration date for Alfred Grebe as a member of the Southold
Planning Board is October 1, 1970,
NOW, THEREFORE, BE IT RESOLVED: That Supervisor Martocchia request the
Civil Service Commission for a one year extension of time for Alfred Grebe.

WHEREAS, Sam Brown applied to the Town Board for a single trailer renewal
permit dated July 13,, 1970,
NOW, THEREFORE, BE IT RESOLVED: That the application of Sam Brown to
locate a single trailer on his property off Middle Rd. , Cutchogue, N.Y.
be and hereby is granted for a period of six months.

RESOLVED: That $1800. 00 be and hereby is transferred from Contingent '

WHEREAS.,-_the. Associati•on. ..respectfully .request the closing of a portion
of Pike Street, . Mattituck, from the corner. of Wickham Avenue west to
the Town Parking lot for activities,
NOW, THEREFORE, BE IT RESOLVED: That the Southold Town Board- grants
said request.,

RESOLVED: That Donald J. Brown,, Architect, . Mattituck, N.Y. be. retained
for the building of the Police S.ta.tion -and .that all _contracts be. first
approved by the Town Attorney, Robert .Tasker.
