Martocchia on Tuesday, September 8, 1970, at 3 :00 P.M. with the following present: ,Supervisor Martocchia; Councilmen Valentine and Rich; Justices Demarest and Suter; Town Attorney Tasker; Superintendent of Highways Dean and ,Town Clerk Richmond. Absent: Justice E. Perry Edwards. Moved by Justice Suter; seconded by Councilman Valentine; RESOLVED: That the minutes of the meeting of August 25, 1970 be and they hereby are approved. Vote of. Town Board: Ayes-Supervisor Martocchia; Councilmen Valentine and Rich; Justices Suter and Demarest. Moved by Councilman Valentine; seconded by Councilman Rich; RESOLVED: That the next meeting of the Town Board will be held at the ; office of Supervisor Albert Martocchia, 16 South Street, Greenport, New York, on Tuesday, September 22, 1970, at 3 :00 P.M: Vote of Town Board: Ayes-Supervisor Martocchia; Councilmen Valentine and Rich; Justices Demarest and Suter. Moved by Justice Suter; seconded by Councilman Rich; RESOLVED: That the reports of the Building Inspector, Justice Suter, Police' Department and Town C1erk .for the month of August, 1970, be accept- ed by the Town Board and placed on file. Vote of Town Board: Ayes-Supervisor Martocchia; Councilmen Valentine and Rich; Justices_ Demarest and Suter. Moved by Councilman Valentine; seconded by Justice Suter; RESOLVED: That the electricity be turned on at the newly acquired telephone building in Cutchogue, N.Y. and that the Supervisor be authorized to sign the contract with the Long Island Lighting Company. Vote of Town Board: Ayes-Supervisor Martocchia; Councilmen Valentine and Rich; Justices Demarest and Suter. Moved by Councilman Valentine; seconded by Justice Suter; RESOLVED: That the Supervisor, Albert Martocchia., be authorized to adver- tise for bids and to purchase from the lowest responsible bidder 300, 000 gallons of premium gasoline or as much as may be needed for the Town of Southold. Vote of Town Board: Ayes.'Supervisor Martocchia; Councilmen Valentine and Rich; Justices Demarest and Suter. Moved by Councilman Valentine; seconded by Councilman Rich; RESOLVED: That Justice Suter and the Building Inspector, Howard Terry, distribute the- House Number Books to the following: Highways Department, Long Island Lighting Company, Police, New York Telephone Company, Fire Departments, Post Offices and Supervisor. Vote of Town Board: Ayes-Supervisor Martocchia; Councilmen Valentine and Rich; Justices Demarest; Justices Demarest and Suter. Moved by Councilman Valentine; seconded by Councilman Rich; RESOLVED: That Detective Henry Stepnoski be and he hereby is authorized to attend Narcotic School, New York City, Police Academy on Oct. 20, 21, and 22 , 1970 and that all necessary expenses be a legal charge against the Town of Southold. Vote of Town Board: Ayes-Supervisor Martocchia; Councilmen Valentine and Rich; Justices Demarest and Suter. Moved by Justice Demarest; seconded by Justice Suter; RESOLVED: That James Wood be hired by the Town of Southold to make a speed traffic survey of all town roads in the Town of Southold at a fee of $450. 00. Moved by .Justice Suter; seconded by Councilman Rich; WHEREAS, Captain Kidds Water Company applied to the Town Board for per- mission to lay a water main under a town road, Mattituck, New York, NOW, THEREFORE, BE IT RESOLVED: That Raymond Dean, Superintendent of Highways, be and he hereby is authorized to issue a permit to Captain Kidd;s Water Company, said permit to be drawn by .Town Attorney Tasker. Vote of Town Board: Ayes-Supervisor Martocchia; Councilmen Valentine and Rich; Justices Demarest and Suter. Moved by Councilman Valentine; seconded by Councilman Rich; WHEREAS, Robert W. Vanderbeck applied to the Town Board for permission to lay a water main under a Town Road (namely, West Creek Drive) in Cutchogue, • New York, NOW, THEREFORE, BE IT RESOLVED: That Raymond Dean, Superintendent of Highways, be and he hereby is authorized to issue a permit to Robert W. Vanderbeck, said permit to be drawn by Town Attorney Tasker. Vote of Town Board: Ayes-Supervisor Martocchia; Councilmen Valentine and Rich; Justices Demarest and Suter. Moved by Justice Suter; seconded by Justice Demarest; RESOLVED: That Superintendent of Highways Dean be and he hereby is authorized to attend New York State Highway Superintendent Conference, Niagara Falls, New York on September 16, 17 and 18, 1970, and that all necessary expenses be a legal expense against the Town. Vote of Town Board: Ayes-Supervisor Martocchia-; Councilmen Valentine and Rich; Justices Demarest and Suter. Moved by Councilman Valentine; seconded by Councilman Rich; BOND AND CAPITAL ' NOTE RESOLUTION OF THE TOWN OF SOUTHOLD, NEW YORK, ADOPTED SEPTEMBER 8, 1970, AUTHORIZING THE CONSTRUCTION OF POLICE HEAD- QUARTERS BUILDING ON LAND NOW OWNED BY THE TOWN, SITUATE ON THE -NORTH SIDE OF ROUTE 25, IN THE HAMLET OF PECONIC, IN. SAID TOWN, STATING THE ESTIMATED MAXIMUM COST THEREOF IS $130, 000, APPROPRIATING SAID AMOUNT THEREFOR AND AUTHORIZING THE ISSUANCE OF $6, 500 CAPITAL NOTES TO PROVIDE THE DOWN PAYMENT AND $123, 500 SERIAL BONDS OF SAID TOWN TO FINANCE THE BALANCE OF SAID APPROPRIATION. The Town Board of the Town of Southold, in the County of Suffolk, New York, hereby resolves (by the favorable vote of not less than two- thirds of all the members of said Board) ; as follows : Section 1. The Town of Southold (herein called "Town") , in the County of Suffolk, New York, is hereby authorized to construct a police headquarters building on land now owned by the Town., situate on the north side of 'Route 25, in the Hamlet of Peconic; approximately 500 feet west' of Peconic Lane, in the Town,- including grading and improving the site, all in accordance with plans, specifications and estimates of cost pre- pared by Donald Brown, a licensed architect of the State of New York, on file in the office of the Town Clerk and hereby approved. The 'estim- ated maximum cost of said specific object or purpose, including prelimin- ary costs and costs incidental thereto and the financing thereof, is $130, 000 and the said amount is hereby appropriated therefor, The plan of financing includes the issuance of $6, 500 capital 'notes to provide the down payment required by law, the issuance of $123 , 000 serial bonds to finance the balance of said appropriation "and the levy of a tax upon all the taxable real property in the Town to pay the interest on said notes and bonds and the principal thereof when due and payable. Section 2 . Capital notes in the principal amount of $6, 500 and serial bonds ' in the principal amount of $123 , 500 of th-e Town are hereby authorized to be issued pursuant to the provisions of the Local: Finance Law, constituting Chapter 33-a of. the Consolidated Laws of the State of New York (herein called "Law") , to finance said- appropriation: Section 3. The following additional matters -are hereby determined and stated: ' (a) The said police headquarters building to be constructed is of Class "B" construction, as defined by Section ll.-00 a. 11 (b-) of the Law and the period of probable usefulness of the specific object or pur- posedfor which said capital notes and serial bonds are to be issued, is twenty ('20) years and the maturity of said bonds will exceed five (5) years. (b) Current funds are required by the Law to be provided prior to the issuance of the bonds authorized by this resolution 'or any bond antic- 31 ipation notes issued in anticipation thereof and such current funds will be provided from the proceeds' of the capital notes herein authorized to be issued. The Supervisor is hereby authorized and directed to 'set aside said current funds and to apply the same solely to the said specific object or purpose described in Section . l hereof. Section 4. Each of the notes and. bonds authorized, by this 'res- olution and any notes issued in anticipation of said bonds shall contain the recital of validity prescribed by Section' 52.00 of the Law and said notes and bonds and any notes issued in anticipation of said bonds -shall be general obligations of the Town and the Town hereby irrevocably pledges its faith and credit to the punctual payment of the principal thereof and interest thereon and there shall be raised annually by tax on all the taxable real property in the Town a sum sufficient to pay the principal of and interest on said notes and bonds as the same shall become due. '. . Section 5 . Subject to the provisions of this r-esolution and of the Law, and pursuant to the provisions of Section 30.00 relative to the. . authorization of the issuance of bond anticipation notes .and of Section 50. 00 and Sections 56. 00 to 60.00 of the Law, the powers and duties of the Town Board relative to prescribing the terms, form and contents and as to the sale and issuance of said notes and bonds and any notes ,issued . in anticipation of said bonds , or the renewals thereof, are delegated to the Supervisor, the chief fiscal officer of .the Town. Section 6. The validity of said notes and bonds authorized pursuant to this resolution and of. any notes in anticipation of said bonds, may be contested only if : (a) such obligations are authorized for an object or purpose for which the Town is not authorized to expend money, or . (b) the provisions of law which should be complied with at the date: of the publication of such resolution, are not substantially complied with, and an action, suit or proceeding contesting such validity, is commenced within. twenty days after .the date of such publication, or (c) such obligations are authorized in violation of the provisions of the constitution. Section 7 . This resolution is subject to a . permis.sive referen- dum. Vote of Town Board: Ayes-Supervisor Martocchia; Councilmen Valentine. and Rich; Justices Demarest and Suter. Moved by Councilman Valentine; seconded by Councilman Rich; RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF SUFFOLK AND STATE OF NEW YORK, AS FOLLOWS : Section 1. The Town Clerk of the Town of Southold, in the County of Suffolk, New York, shall, within ten -(10) days after, the adoption of the bond and capital note resolution referred to in the form of Notice hereinafter set forth in Section 3 hereof, cause. to be .published at'-least once in "THE LONG ISLAND TRAVELER MATTITUCK WATCHMAN" , a . newspaper pub- lished in Southold, New York, having a general circulation within said Town and hereby designated as the official newspaper of said Town, and to be posted on the sign board maintained pursuant to subdivision 6 of . Section 30 of the Town Law, a Notice which shall set forth the date of a- doption of said foregoing resolution and contain an abstract thereof .con-' cisely stating its purpose and effect. Section 2 . After said bond and capital note resolution shall take effect, the Town Clerk is hereby directed to cause said bond and capital note to be published, in full, in the newspaper hereinabove re- ferred to in Section 1 hereof, and hereby designated the official news- paper for said publication, together with a notice in substantially the form as provided by Section 81. 00 of the Local Finance Law, constituting Chapter 33-a of the Consolidated Laws of the State of New York. Section 3. The Notice referred to in Section 1 hereof shall be in substantially the following form:- TOWN OF SOUTHOLD, NEW YORK PLEASE TAKE NOTICE that on September 8, 1970, the Town Board of the Town of Southold, in the County of Suffblk(,� New York, adopted a bond and capital note resolution entitled: "Bond and Capital Note Resolution of the Town of Southold, New York, adopted September 8, 1970, authorizing the construction of police headquarters building on land now owned by the Town, situate on the north side of Route 25, in the Hamlet of Peconic, in said Town, stating the e i estimated maximum cost thereof is $130, 000, appropriating said amount c therefor and authorizing the issuance of $6, 500 capital notes to .provide. the down payment and $123, 500 serial bonds .of said Town to finance the balance of said appropriation" . an abstract of which resolution concisely stating the purpose and effect thereof, is as follows : FIRST: AUTHORIZING the Town of Southold ("Town") to construd- t a Police headquarters building on land now owned by the Town, situate on the north side of Route 25, in the Hamlet of Peconic, approximately 500. - feet west- of Peconic Lane, in the Town, including grading and improving the site, all in accordance with plans, specifications and estimates of cost prepared by Donald' Brown, a licensed architect of the State of New York, on file in the office of the , Town Clerk; APPROVING said plans, specifications and estimates of cost; STATING the estimated maximum cost thereof, including preliminary costs and costs incidental thereto and the financing thereof, is $130, 000; APPROPRIATING said amount there- for; STATING the plan of financing includes the issuance of $6, 500. cap- ital notes to provide the down payment required by law, the issuance of $123 , 500 serial bonds to finance the balance of said appropriation and the levy of a tax upon all the taxable real property in the Town to pay the interest on said notes and bonds and- the ,,principal thereof when- due and payable; . SECOND: AUTHORIZING the issuance of $6, 500 capital notes and $121, 500 serial bonds of the Village to finance said appropriation; THIRD: DETERMINING AND STATING that the period of probable use- fulness of the specific object or purpose for which said notes and bonds authorized are to be issued 'within the limitations of .said-, Local Finance Law, is twenty (20) years , and that said serial bonds will have, a matur- ity in excess of five (5) years.; DETERMINING that current funds are re- quired to be provided prior to the.; issuance of -the bonds -herein authoriz- ed or any bond anticipation notes issued in . anticipatio.n:-thereof, ,_and said current funds will be provided from. the proceeds of said. capital , notes; AUTHORIZING AND DIRECTING the Supervisor to set aside said current funds and to apply the same solely to said specific object .,or purpose; . - FOURTH: DETERMINING that said notes and bonds and any notes issued in anticipation of said bonds shall be general obligations of . the Town - and PLEDGING to their payment the faith and credit of the Town; FIFTH: ,DELEGATING to the Supervisor .the powers and duties as to issuance of said notes and bonds, and any bond anticipation:,notes, includ- ing renewals thereof; and sixth; determining that this resolution is subject to a permissive referendum. Post #803 , Southold, N.Y. applied to the Town 'Clerk for a Bingo License, and WHEREAS, the Town Board has examined the application and after investig- ation duly made findings and determinations as required by law, NOW, THEREFORE, BE IT RESOLVED: That the Supervisor be and he hereby is authorized and directed to execute on behalf of the Town Board the find- ings and determinations as required by law, and it is further RESOLVED: That the Town Clerk be and he hereby is directed to issue a Bingo License to the Southold American Legion G.T.G. Moved by Councilman Valentine; seconded by Councilman Rich; RESOLVED: That the Southold Town Board investigate the possiblity of preserving the Orient Point Lighthouse as one of the historical points of the Town. Moved by Councilman Valentine; seconded by Supervisor Martocchia; _ WHEREAS, Mildred Chapman, Greenport, New York, has been a faithful- and conscientious employee of the Town .of Southold for more than ten years, and WHEREAS, Mildred Chapman has acted as Clerk to the .Assessors of the .Town , of Southold.. and has diligently and faithfully performed all . of the duties in connection with this position, NOW, THEREFORE, BE IT RESOLVED: That it . is with deep regret that,. the Town Board of the the Town of Southold accepts the resignation of Mildred Chapman, and wishes her .a most satisfying and happy retirement of many years, and be it further , RESOLVED That a copy of this resolution be forwarded to Mildred- Chapman and a copy be recorded in the minutes of the meeting of the Town Board.
