Moved by Councilman Valentine; seconded by Councilman Rich; WHEREAS, the Southold Town Planning Board,' pursuant to due notice thereof, held a hearing on amending the subdivision regultions in the Town of Southold as- adopted September 26, 1967, amending Article 3, Section 4, Subsection A to increase the inspection fees f.Fom .2% to 4% of the estimated bonds for , improvements and roads in subdivisions in Southold Town, on the 24th day of March, ' 1970 at which time all interested persons were- given, an opportunity to be heard, NOW, THEREFORE, BE IT RESOLVED: That. the Town Board approves of the increase of Inspection Fees from 2% to' 4% of the estimated Bond. Moved by Justice Demarest; seconded by 'Conncilman Rich; RESOLVED: That the highways Specifications, Town of Southold; adopted in November 1968 be revised to read as follows : HIGHWAY SPECIFICATIONS TOWN OF S OUTHOLD Any person or persons desirous of dedicating land for town highway purposes shall be required to file six (6) prints of the proposed layout- with corrections of such highway with the 'Planning Board of the- Town of Southold 15 days prior to their regular meeting with full details. The Planning Board shall examine such prints and prepare a written report thereon, . containing its recommendations concerning the proposed layout, and file the same with the Southold Town Board and one copy to the Super- intendent of Highways, together with one print of the proposed . layout. . The Planning Board shall retain one 'print- for- its files and shall return one . print to the applicant. Thereafter, the Town Board shall approve or dis- approve such layout and so' advise the Planning Board and the applicant. After such proposed layout has been approved by the Southold Town Board, the following specifications shall be ' complied with: 1. Any person or persons desiring' to dedicate real estate to the Town of Southold for highway purposes must execute and submit. to .the Town Board the following: a. A duly acknowledged dedication and release, together with the required County Clerk's recording fees. b. ' Proposed consent to the Town' Board. _ c. Proposed cordert'M the Superintendent. d. A Survey map of the property which shall show the actual location of the highway area within the highway right-of-way. e. An Attorney's . certificate of title and- an abstract of title certified to the Town Board by an attorney or a $2, 000. title policy issued in the name of the Town of Southold. f. A Bargain and sale deed with covenant against grantor's acts in the proper farm for recording in the' County Clerk's office The foregoing six documents shall be fastened together in one folder and the dedication and release shall include the signatuise of all fee owners, easement owners, mortgages- and so forth, and the attorneys certificate shall certify to such. . 2. All highways accepted- by the Town as Town Highways must be at least fifty (50) feet in width; ' such width shall hereinafter be knownaas the bounds of the highway. ` 3. All proposed highways 'shall be properly surveyed, monumented with concrete monuments on all points, curves and intersections at'-point of curvature, 100 ft. along curve and point of tangency. Monument to 'be 4''x4"x4' . All roads shall be laid. out in a "station mark" system showing elevations, percentage of grade distances between station. marks, all drainage pipes, drainage structures, recharge basins, etc. 'to. be - clearly shown on both map and profile map ,of each road. All profile maps to be on a large scale, clearly and legibly printed with not more than one (1) road on one page or sheet. Name of highway, name of all adjacent owners, if any, drainage rights of way or leaching areas_,-width and length-.of, highway, scale of amap shall not be more than 1 to 2001 . An additional survey map of the property other than the one in the folder shall also be submittea. 2 Detailed construction drawings of each road must be submitted, 5 copies of each road. Highway Department, Construction Inspector, and Planning Boardtto)be=notified 2 days before each phase or step i� 4gun. 4. All highways terminating at tidewater shall have a width of nbt less than 100 feet back from the mean high water mark. All highways on water front property must have the same access to the water " as above requried. Eae;h dead-end shall have a stop sign on a 10 foot steel U type sign post. 5: All (D�ad-end highways must have a width of not less than `100 feet for a 'distance of 100 feet back from the dead end to for a turn- around, all of Which must be free of trees, bushes, a�rovide d stumps. A guard rail --sFsll be installed along the entire dead-end line. Such guard rail shall be -of galvanized steel (fled-beam type) 182 inches in width mounted on 6° x 6" k 4 ' -posts dipped` in creosote to a depth of 30" _and placed in ,the-ground to a depth of 30". A standard stop sign shall be placed in the center of the dead-end in the rear of the guard rail. 6. The name of such highway may be proposed by the owner or owners off property dedicating such-highways but the name of such highway shall be subject- to the approval of the Town Board and the Planning Board., , 7: A width. of -36 feet shall be hereinafter known as the highway area from which all trees, brush, rocks, stumps and -other obstructions shall._ be thoroughly cleared and all such material shall be removed from the bounds of the highway, the remaining distance from the curb line to the property line, shall be raked and seeded. Q kind of seed) 8: The portion known as they highway area shall be plowed, disc-harroed, rolled and graded to a -uniform surface to the longitudinal grade as shown on the final map and construction drawings. 9. Six inches of Bank Run Base Material with a gravel content of 20/ or -more will be installed below the finished grade of the road section, if the existing material is not of porous nature, and shall be free of all vegetable matter. If clay is encountered, the road bed depth shall be 18" of sandy loam or 12" of bank run, existing material--! shall not be considered satisfactory unless there is 10% or more of gravel. ) -10-. Where cuts and fills a(re necessary in order to bring the highway to the proper grade and cross sections, the cut or- fill shall meet the abutting surface with a 1 on 2 slope. Where the slope or fil-1 extends beyond the fifty feet or bonnds of highway, the necessary releases, easements or deeds must be obtained -from the property( ox�ner or owners. `11:' Concrete curbs, storm sewers, lea4iing -basins, leaching areas ab- gutters, shall be installed in accordance with the requirements and under the supervision of the Superintendent of Highways, or duly appointed Construction Inspector. When leaching basins and gutters are required, the -same shall be constructed as follows : a. Catch basins & leaching basins : Only inlet type basins shall be connected to each other with eighteen (18) -inch corrugated pipe, or 14, -inch- asbestos cement pipe-. b. Concrete curbs: Curbs shall be installed on- all streets within - the subdivision or development. All intersectiors shall have a curve with a radius of not less than twelve (12) feet. The distance between curb faces on both sides of the highway area shall be 36 feet. Curbs shall be 6 inches wide, 18 inches deep, 6 inches above road surfaces. c. Full length concrete curb on both aides of all roads are required-: Integral curb and gutter bhall be installed at all intersections 2F70 for at least ten (10)' .feet each side of -the. curve and at least ten (10) feet each side of a drainage inlet structure intake. Integral curb and gutter on both sides _of ,any road,.,having.a grade :of .5/ or, more. 12. After the highway area has been properly graded, rolled, and shaped to the approval of the Superintendent of Highways or duly appointed Construction Inspector, the thirty-six (36) foot section in the center of the highway area (hereinafter referred to as the "road section") shall be stabilized with an application of three (3) gallons of MC-250 (bituminous cut-back) per square yard mixed to a depth ,of 6" minimum in two (2) separate applications. Within two (2) months and not less than one ' (1) month after stabilization, the road section shall be rolled and properly. prepared and an application of one-half (2) gallon of RC-250 (bituminous cut back) per square yard be applied with sufficient sand to absorb the excess oil. In case of dry weather, the sub-grade shall be.wet-down before the application of oil. Before the highway is accepted by the Town of Southold, the Superintendent of Highways or Construction Inspector shall examine the same and there- after a final application of . 3 �gallons of RC-250 (bituminous cut back): per square yard, shall be applied and shall be covered with three eighths (3/8) inch blue stone at the rate of 20 lbs. per square yard, which shall be rolled with a roller having a minimum weight (8) tons.: Where curbs are installed, the road section shall_ be deemed to be the entire . area within the curbs. 13. On both sides of the oiled surface or road section of the highway area, there shall be a six (6)' foot shoulder which shall be graded and free from all trees, .brush, rocks, stumps, and other obstructions_, and raked and seeded with a suitable grass .seed .mixture. a. Corrugated pipe having a minimum diameter of 18 inches extending from drainage area to bounds of highway shall be installed with clean-out boxes at the minimum of 150 ft. intervals. All Drainage. easements shall be a minimum of 15 ft. in width. 14. Before any highway shall be accepted by the Town of Southold, as a town highway by dedication, the assessed value of the buildings and . structures on the land on both sides of such highway (as shown on the current tax roll of the Town of Southold) shall have an assessed value of not less than forty thousand ($40, 000.00) dollars per ,mile .proport- ioned at that rate if more or less than a mile. 15. Where it is necessary to have a drainage area located beyond the fifty- (50) foot bounds of the highway, fee title to_ such area sha_1,-1, be conveyed to the Town of Southold, together with the necessary land= to. connect such area to the bounds of the highway. Corrugated pipe having a minimum diameter of eighteen (18) inches extending from the drainage area to the .bounds of the highway shall be installed with clean_ out 'boxes at 150 foot intervals. 16. Sidewalks shall be standard four foot in width, four inches- thick-, except in driveways where they .must be not less than six inches thick. All curbs and gutters to be built to standard .forms as may be directed by the Super-intendent Pf �ighways. On existing Town Highways the Town will furnish the necessary engineering, grading, fill and labor; the property owner or owners shall furnish the necessary ready mixed concrete and shall deliver such concrete to the site as directed by the Superinten- dent of Highways, The amount of sidewalk construction throughout the Town shall be determined by the) Town Board.. 17. Maps and Plans a. Scale map 1" to 100 ft. with 5 ft. contours extending 200 ft. outside limits of subdivision. b. Profile map ofor each road at a scale of 1"--to 10- ft.=vertical 2 -1, and 1" to. 100 ft. horizontal, clearly and legibly printed. c. _ All highways shall be laid out , n a "station mark." system showing elevations and percentage of grade between station marks. All drainage ;draina .,e structures ,_rechar 'pipes, t, g ge ,basins., etc, , shallbe_ clearly shown on both map and profile map of each. road. d. Highways shall be a minimum of 50 feet in width and designed to the requirements of foet visability on curves depending on curve and radii as specified here*ith.. e. Drainage structures shall show such details as location, pipe sizes, number of rings, depth of excavation,- type of leaching basins, and type of entry and cover for each. Easements for drainage facilities and for side.- slope_ shall be shown. II. Final plans must be submitted upon receipt of written approval and return of one (1) copy of the preliminary' p Lan 'approved or approval as corrected, as - follows : a. Final plan shall be to the scale of 1" to 100 ft. showing actual distances along the highway. b. Monuments shall be shown. c. -Exact. location and types of drainage structures. d. Exact location of curbing and sidewalks. e. Exact location of easements. III: Construction plans A construction plan shall be submitted for approval upon return of final plan. .No work on roads shall be done until approval- of construction plan has .been received by the Subdivider. The plans shall be at a scale of 1" to 100 ft. showing stations of roads. ` Points of beginning and ending of stations shall be detailed and curve .design data given on the plans. The 'various 'type of curbs shall be shown_ on .the plans, locating the limits by road .stationing. Drainage structures -shall be exactly located' and. details of each structure given including cover elevation, invert elevations, type of grate, frames,. covers, rings, size and number," and' separate ' deta.ils' and drawings. of each recharge basin. Profiles shall show grades; stationing and elevations o'f '-intersections, length of vertical curves. Drainage structures including pipes, shall be shown with size, type and inverts 'indicated. The 'scale .shall be 1" to 10 ft. vertically, 1" to 10o ft."horizontally: ' Borings shall be taken at every station to a" depth of 4 feet to deter- mine the type of soil present and this information ,shall` be on the construction plans. IV. Where. .curbing has been waivered and not required by the Superin- tendent of Highways an gd the Planning Board a detailed drawin of the cross , section of the road shall be shown. Without such-' curbing and' detail 'of. _road, surfacing and shoulder grading must be shown. 18. Authorization to proceed with road construction work ' The drainage system may be installed at any time before the final grading of the roads is completed.' The Superinten.dent's . engineer shall be notified .of the time of in'stallation' sothat' he can .inspect the .work while in progress. . ` ` When the final grading work of roads is completed, the 'Superintendent shall be notified. The Superintendent's- engineer will then make -an analysis of the road bed material and submit a report of his findings. . After :the analysis of the road bed material is accepted as satisfactory in compliance With Section#9 of Specifications,' authorization to proceed with the road work....wi�ll be' issued by the Superintendent as follows Approval to proceed with the work of stabilizing the roadbed with MC-250. The Superintendent's engineer shall be notified when this work ' will be done, He shall be' present on the site to observe the work during the entire operation, A record of the quantity of oil used shall be made available to him. 7 Approval to proceed with the work of applying the` oil and sand to the road surface. The Superintendent's engineer shall be notified when this work will be done, He- shall be present on the site to observe the work during the entire operation: A record of� the- quantity of' boil used shall be made available to him. Approval to proceed with the work of applying the oil and bluestone chips to the road surface-.' T ie'. Whenever in the opinion of the Superintendent of Highways he feels that for the best interest of the Town, alterations or modifications should be made 'to the above, specifications, rules, and regulations, such alterations or modifications may be made on -the recommendation of the Sup- erintendgnt of Highways to and. with the approval of the Town Board. 20. Any work done on any highway without notifying the Superintendent of Highways or his Inspector and done with no Inspector present will be considered unacceptable and subject to review by the Planning Board and the Superintendent of Highways. 21. Moved by Councilman Valentine; seconded by Justice Suter; WHEREAS, Aldrich Lane Realty Inc. by petition verified the loth day of-- November, 1969, petitioned the Town Board for a change of zone of certain property described in said petition from "A" Residential District. to "B" Business District, and WHEREAS, the petition was referred to the Planning Board and the County Planning Board for official recommendations and reports, and WHEREAS t the Southold Planning Board and the County Planning Board have filed official recommendation's and reports with the Town Board, and WHEREAS, the Town Board pursuant to due notice thereof, held a hearing thereon on the 3rd day of February, .1970, at' which time all interested .persons were' given an opportunity to be heard,' NOW, THEREFORE® BE IT RESOLVED,: What the relief demanded in' said petition be and the same is in all respects denied. It is hereby declared that a necessity exists for the enactment of- such legislatiom, and that facts establishing such necessitT are as follows :, The Local Government , does not, have the power to enact such legislation by Local Law. It is hereby declared that a necessity exists for the enactment of such legislation, and that facts establishing such necessity are as follows : The Local Government does not have the power to enact such legislation by Local Law. Richard Cron, Esq. appeared before the Board on behalf of Albert_ Zanowski,: Cutchogue, -N.Y. requesting the Town to force the L.I. Railroad to replace the bridge on Bridge Lane, Cutchogue, N.Y o , William Schrifer, Orient, N.Y. ,requested the Board to zone Greenport Homes, .west of Ninth Street, Greenport, N.Y. into 50 foot lots.
