WAIVER: WE, the undersigned, being members_ of the Town Board of the
Town of Southold, Suffolk County, New York, do hereby severally waive
notice of the time, place and purpose of the meeting 5f the Town Board
to be held at the Town Clerk Office, Main Road, Southold, N.Y. in the
Town of Southold, on March 16, 1970, and do hereby consent that the same
be held on said date for the transaction of any business which may
properly come before said meeting. Dated: March 16, 1970. Supervisor
Martocchia; Councilmen Valentine and Rich; Justices Demarest, Suter
and Edwards.
Moved by Councilman Valentine; seconded by Justice Suter;
RESOLVED that pursuant to Article IX .of the Constitution,, the Town o.f
Southold requests the enactment .of Assembly Bill #5871 entitled
AN ACT to provide a separate board of commissioners for the Orient-
East Marion Park District in the Town of Southold, Suffolk County,
and to make the provisions of article thirteen of the town law
applicable to said district.
It' is hereby declared that a. necessity exists for the enactment of such
legislation, and that the facts establishing such necessity are as
follows : The local government does not have the power to. enact such .
legislation by local law.
Vote of Town Board: Ayes-Supervisor .Martocchia; Councilmen Valentine
and Rich; Justices Demaeest and Suter.
Moved by Justice Suter; seconded by Councilman Valentine;
WHEREAS, the Town of Southold has requested the County of Suffolk to
dredge and improve Gull Pond Beach, Town of Southold, and
WHEREAS, the County . of Suffolk proposes to do said dredging at Gull
Pond Beach in the Town of Southold at a nominal cost to the Town
of Southold, and ,
WHEREAS, in order to accomplish said dredging, plans, specifications-,
agreements and other documents must be executed on behalf of the Town
of Southold, now, therefore be it
RESOLVED: That the Supervisor be and he hereby is authorized to execute,
on behalf of the Town of Southold, all necessary plans and specifications,
spoil area agreements, assurances to County of Suffolk, license and/or
dredging permit applications to Federal and State Agencies and all other
documents that may be required to accomplish said dredging work..

and Rich; Justices Demarest and Suter.

WHEREAS, the Town of Southold has requested the County oof Suffolk to
dredge and improve Gull Pond Beach, Town of Southold, as shown on the
accompanying maps, and
WHEREAS, the County of Suffolk proposes to do said dredging, and
WHEREAS, the Supervisor of the Town of Southold by resolution duly. adopted
by the Town Board of said Town of Southold has been authorized and direct-
ed to sign for and on behalf of the Town of Southold assurances to the
County of Suffolk, that the said Town of Southold will perform all acts
required to be performed by said Town in connection with the preparation
for the dredging operation as aforesaid and obtaining of all necessary
easements and rights of way for said dredging operation and use of areas
indicated on the attached map for spoil areas together with all necess
ary rights incidental to said dredging operation;
NOW, THEREFORE, 1E cdnalddb�ftt of the benefits to the Town of Southold,
as aforesaid, the Town of Southold hereby assures the County of Sdffolk
that it will;
(a), Furnish, free of cost to the County of Suffolk all lands, easements,
rights of way and spoil disposal areas necessary for the new work and
subsequent maintenance when and if required for the dredging operations
at Gull Pond Beach, all as shown on the attached map, and
(b) Hold and save the County of Suffolk free from any claims or damages
resulting fr om said improvement or resulting in any way from the said
dredging operation or the use of equipment at the said Gull Pond Beach,
or use of any spoil area or any other area affected by said dredging
operation.
