z57 MEETING OF MARCH 10, 1970 The Southold Town Board met at the office of Supervisor Albert Martocchia on Tuesday, March 10, 1970 at 3 :00 P.M. with the following present: Super- visor Martocchia; Councilmen Valentine and Rich; Justices Demarest and Suter; Town Attorney Tasker; Supt. of Highways Dean and Town Clerk Richmond. Absent: Justice E. Perry Edwards. Moved by Justice Demarest; seconded by Justice Suter; RESOLVED: That the minutes of the meeting of February 24, 1970 be and they hereby are approved. Vote of Town Board: Ayes-supervisor Martocchia; Councilmen Valentine and Rich; Justices Demarest and Suter. Moved by Councilman Valentine; seconded by Justice Suter; RESOLVED: That the next meeting of the Town Board will be held at the office of Supervisor Albert Martocchia, 16 South Street, Greenport, New York, , on Tuesday, March 31, 1970 at 3 :00 P.M. Vote of Town Board: Ayes-Supervisor Martocchia; Councilmen Valentine and Rich; Justices Demarest and Suter. Irving Miller, Public Accountant, retained by the Town of Southold, has audited the accounts of the departments of Town Government under Section 105 of the Town Law and finds them to be correct. Moved by Justice Suter; seconded by Justice Demarest; RESOLVED: That the Town Board retain Attorney Kenneth Slocum in place of Attorny Gary Olsen to pepresent the Southold Town Assessors in all tax review proceedings presently being handled by Attorney Olsen and that he be paid a reasonable compensation for his services. Moved by Councilman 'Rich; seconded by Councilman Valentine; WHEREAS, the New York Telephone Company is the owner of lands and buildings R erected thereon situate on the north side of Route 25 at Cutchogue, Town of Southold, New York, and desires to sell said premises to the Town of Southold for the 'sum of $9, 000. 00, and WHEREAS, THE Town of Southold desires to purchase said premises at the above specified_,price subject to the adoption of a resolution authorizing such acquisition which resolution will be subject to a permissive referendum, NOW, THEREFORE, BE IT RESOLVED that the Supervisor be and he hereby is auAhorized 'rand directed to execute the contract with the N.Y. Telephone Company for the purchase of said premises at the above specified price. Said contract being conditioned upon the adoption of f resolution subject to a permissive referendum authorizing such acquisition. RECITAL WHEREAS, the Town of Southold (herein called "Town") , in the County of Suffolk, New York, has heretofore duly authorized, sold and issued its $135, 000 Bond Anticipation Note For Acquisition of Addition- al Ferry .,Boat-1969, and it is now desirable to redeem said Note to the extent of $20, 000 from a source other than the proceeds of the bonds in anticipation of which said Note has been issued, now, therefore, BE IT RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUIIHOLD, IN THE COUNTY OF SUFFOLK, NEW YORK, AS FOLLOWS : Section 1. The $135, 000 Bond Anticipation Note For Acquisition of Additional Ferry Boat-1969 of the Town, hereinabove referred to in the Recital of this resolution is hereby authorized to be redeemed on or before March 13 , 1970 to the extent of $20, 000 from funds of the Town now available to said purpose (including $10, 000 surplus funds) said funds being a source other than the proceeds of the bonds in 260 anticipation of which said Note was issued, andt'lthe said amount of $20, 000 is hereby appropriated therefor. Moved by Justice Suter; seconded by Justice Demarest; BOND ANTICIPATION NOTE RESOLUTION OF THE TOWN OF SOUTHOLD, NEW YORK, ADOPTED MARCH 10, 1970, AUTHORIZING THE RENEWAL, IN PART, OF THE $135, 000 BOND ANTICIPATION NOTE FOR ACQUISITION OF ADDITIONAL FERRY BOAT-1969, BY ISSUANCE OF A NEW NOTE IN THE PRINCIPAL AMOUNT OF $115, 000. RECITAL WHEREAS, the Town of Southold (herein called "Town") , in the County of Suffolk, New York, has heretofore duly authorized, sold and issued its $135 , 000 Bond Anticipation Note For Acquisition of Addit- ional Ferry-Boat 1970 and has duly authorized the redemption of the Note to the extent of $20, 000 and it is now necessary and desirable to provide for the renewal, in part, of said Note by the issuance of a new Note in the principal amount of $115, 000; NOW, THEREFORE, BE IT RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD: IN THE COUNTY OF SUFFOLK., NEW YORKr AS FOLLOWS : Section 1. The $135, 000 Bond Anticipation Note For Acquisition of Additional Ferry Boat-1969 of the Town, dated March 14, 1969, matur- ing March 13, 1970, subject to prior redemption, numbered 3R-1, here- tofore duly authorized, sold and issued purauant to the bond anticipat- ion note resolution duly adopted by the Town Board of said Tows on March 18, 1969, is hereby authorized to be renewed, in part, by the, issuance of a new Note in the principal amount of $115, 000, said Note dated March 14, 1969, having been heretofore duly authorized to be redeemed from a source other than the proceeds of the bonds (including $10, 000 surplus funds) in anticipation of which said Note has been issued, to the extent of $20, 000 all as hereinabove referred to in the Recital hereof, pursuant to the provisions of the Local Finance Law, constituting Chapter 33-a of the Consolidated Laws of the State of New York (herein called "Law") . The maturity of said renewal Note herein authorized shall not be later than one year from its date, and said Note may be further renewed pursuant to the provisions of the Law. Section 2. The terms, form and details of said renewal Note shall be as follows : Amount and Title: $115, 000 Bond Anticipation Note For 11 Acquisition of Additional Ferry-Boat- 1970. Dated: March 13, 1970 Matures : March 12, 1971, subject to -,prior.. redemption No. 4R-1 $115, 000 Interest rate : 4-3/4% per annum, payable at maturity Place of payment of principal and interest: Supervisor ' s Office, Greenport, N.Y. Form of Note: Substantially in accordance with form prescribed by Schedule B, 2 of the Law. Section 3. Said Note is hereby sold to the SECURITY NATIONAL BANK, Southold, New York, at the purchase price of $115, 000, tg bear interest at the rate of four and three-quarters per centum (4-3/4%) per annum, payable at maturity, and the Supervisor is hereby authorized to deliver said Note to said purchase upon receipt of the purchase price, plus, accrued interest, if any, from the date of said Note to the date of delivery. Section 4. Said Note shall contain the recital of validity pre- scribed by 5. 52. 00 of the Law and shall be a general obligation of the Town, payable as to both principal and interest by a general tax upon all the taxable real property within the Town, without limitation of rate or amount. Teh faith and credit of the Town are hereby irrevocably pledged to the punctual payment of the principal of and interest on said Note and provision shall be made in the budget of the Town by appropriation for the redemption of the Note to mature in such year and for the payment of interest to be due in such year. i ISection 5. Said Note shall be executed in. the name of the Town';y� its Supervisor and the corporate seal of said Town shall be affixed thereto and attested by its Town Clerk. Section 6. Moved by Councilman Valentine; seconded by Councilman Rich; WHEREAS,the Chief of Police has applied for a grant under the Highway Safety Project and said application has been approved and the Town of Southold is to receive a grant pursuant thereto in the amount of $1, 392. 00, - and WHEREAS, IN ORDER TO RECEIVE said grant the Town of Southold must enter into an agreement with the Interdepartmental Traffic Safety Committee acting on behalf of the State of New York, NOW, THEREFORE, BE. IT RESOLVED: That the Supervisor be and he hereby is authorized and directed to execute an agreement with said Interdepart- mental Traffic Safety Committee for Highway Safety Project No. PT 70-004- (001) entitled "TEAP-Traffic Enforcement Assistance Project". Moved by Councilman Demarest; seconded by Councilman Vale.±ine; RESOLVED.: That pursuant to Article IX of the Constitution, the. Town of Southold requests the enactment of Assembly bill No. 4711 entitled -An a-CT -,'-to rercecticPeconic County out of territory comprised of towns of East Hampton, Riverhead, Shelter Island, Southampton and Southold` in Suffolk County. " It is hereby declared that a necessity exists for the enactment of such legislation, and that the facts establishing such necessity are as follows : The local government does not have the power to enact such legislation by local law. The local legislative body of such local government, at least two-thirds of the total membership thereof having voted in favor of such request. Disposal Area : Ray Latham - from $3 . 25 to $3. 70 per hour. H. Latham - from 2. 75 to 3 . 95 per hour S. Verity - from 2. 60 to 2. 95 per hour.- J. Goodwin - from 2.85 to 3. 20 per hour. Moved by Justice Demarest; seconded by Councilman Valentine; WHEREAS, Clifford and Edwina Tyler, Cutchogue, N.Y. by petition verified the 6th day of June, 1969, petitioned the Town Board for a transient travel trailer camp, and WHEREAS, the said petition was approved by the Board of Appeals on November 7, 1968, and WHEREAS, the Town Board pursuant to due notice thereof, held a hearing thereon on the 25th day of November 1969 at which time all interested persons were given an opportunity to be heard, NOW, THEREFORE, BE IT RESOLVED: That the Southold Town Board approves of said permit with requirements for planting and screening as stated and shown on a diagram as part of the application of Clifford and Edwina Tyler and filed in the office of the Town Clerk. Moved by Councilman Rich; seconded by Councilman Valentine; WHEREAS, this Board deems it in the best interest of the Town of Southold, that an Ordinance entitled "PEDDLING AND SOLICITING ORDINANCE" be adopted, NOW, THEREFORE, BE IT RESOLVED: That a public hearing will .be held by the Town Board of the Town of Southold at the the Supervisor ' s Office, 16 South Street, Greenport, New York, on the 7th day of April, .1970, at 7 :30 P.M. on the matter of the enactment of the following Ordinance, to wit: PEDDLING AND SOLICITING ORDINANCE SECTION I. No person shall enter upon any private residential property in the Town of Southold, Suffolk County, New York, for the purpose of vending, peddling, or soliciting orders .for any merchandise, device, book, periodical or printed matter whatsoever; nor for .the purpose of soliciting alms, or a subscription or a contribution to any church, . charitable or public institution whatsoever; nor for the purpose, of distributing any handbill, pamphlet, tract, notice or advertising matter; . nor for the purpose of sellinggor distributing any tickets or chances whatsoever, without the consent of the occupant of said premises previously given. SECTION2'. Nothing herein contained shall be construed to apply to any person who has been a bona fide resident of the Town of Southold, Suffolk County, New York, for a period of at least six (6) consecutive months last part; nor to any person who has maintained a place of bus- iness in the Town of Southold for a period of at least six (6) consecutive months prior thereto, - or his duly authorized representative. SECTION 3. Any person, firm, or. corporation violating any of the provisions of this Ordinance shall upon conviction thereof; be punished by a fine not to exceed one hundred dollars ($100. 00) or by, imprison- ment not to exceed 15 days or both such fine and imprisonment. Babylon, New York, to make a parking study .on the curve of Route 25 at NYS mile point marker .#25-0704- 1621 in Southold, and at NYS mile point marker #25-0704-1635 west of Greenport, both of which are found, to be areas of serious traffic problems. AT SOUTHOLD TOWN BEACHES" be adopted, NOW, . THEREFORE, BE IT RESOLVED: That a public hearing will be held by the Town Board of the Town of Southold at the Supervisor' s Office, 16 South Street, Greenport, N.Y. on the 7th day of. April, 1970, at 7 :30 P.M. on the matter of the enactment of the following Ordinance, to wit: ORDINANCE REGULATING THE USE OF PARKING AREAS AT SOUTHOLD TOWN BEACHES SECTION I -POLICY: The Town of Southold provides bathing beaches and recreational facilities and parking areas adjacent thereto at various. locations within_ the Town for the use and enjoyment of. residents of the Town of Southold. The use of such facilities by persons other than residents has increased to such an extent that such, facilities have become overcrowded with the result that residents are denied the use thereof. . The Town Board therefor declares it. to be the -policy of the Town ,of Southold to restrict and regulate the parking of vehicles in-fthe parking areas adhacent to the bathing beaches and recreational facilities described in this ordinance in accordance with the provisions hereof. - SECTION II. PARKING AREAS REQUIRING PERMITS : (a) , The following parking areas are hereby designated as Tower of Southold "PARKING BY PERMIT ONLY" areas,. to wit:- (1) Parking area adjacent to the bathing beach located on Long Island,,Sound between the Hamlets of East Marion and Orient, known as- and referred to herein as "Stephenson' s Beach". (2) Parking area adjacent to the bathing_ beach located on Gardin- er ' s Bay at the terminus of Manhanset Avenue, known as and. referred . to herein as "Norman E. Klipp Marine Park". (3) Parking area adjacent to the bathing beach located on Long - Island Sound at Arshamomaque (approximately 100 feet east of the inter- section bf County Route 27 and Sound .View Avenue) , known as 'and referred to herein as "Southold Town Beach". (4) Parking area adjacent to the bathing beach located on Long Island Sound at .-Southold. at the terminus _of Horton Lane, known as and referred herein as "McCabe' s Beach". (5). Parking area adjacent to the bathing beach located on Long ; Island ,-Sound at Southold at.-the terminus of- Kenny Road, $nown as and referred to herein as "Kenny ' s Beach". (6) . Parkinq, area .adjacent to the bathing beach located on Town Harbor .at Southold adjacent to North Bayview Road (east of Goose Creek Bridge) , known as .and referred to herein .as "Goose- Creek Beach"_ (7) Parking area adjacent to the .bathing..beach located on Long Island ;Sound at Peconic at the .terminus of Mill Road, known as and referred to herein as "Goldsmith ' s Inlet Beach". (8) Parking area adjacent to the bathing beach- located on Peconic Bay at New, Suf6*olk ,at -the terminus of First Street, known as and referred to herein as "New Suffolk Beach". (b) No person shall park a vehicle in any parking area designated herein as a "PARKING BY PERMIT .ONLY" area unless .such vehicle .displays a valid parking permit duly issued for such vehicle in accordance with the provisions of this ordinance. SECTION III - PARKING PERMITS. (A) Parking permits for parking vehicles in the parking areas des- -ignated in Section I of this ordinance shall be issued .as follows : 264 (1) Resident Parking Permit A resident parking permit shall be issued by the Town Clerk; or a person designated by him, without charge to all persons who are qualified residents of the Town of Southold. Persons applying for a resident parking permit shall be requested to sign an application in affidavit form and submit for inspection either of the following as proof of residence.- (a) A validated tax receipt stub for the current year for any taxable real property within the Town of Southold assee.sed in the name of the applicant, or (b) A valid New York State motor vehicle registration license in the name of the applicant and to an address located within the- Town of Southold. The Town Clerk, or a person designated by him, shall inspect such application to determine that the applicant is a qualified resident of the Town. Upon approval of the application, a resident parking permit shall be issued and inscribed with the vehicle license registration number. Such permit shall not be transferred to any other vehicle. A resident shall be entitled to a permit (without charge) for each vehicle owned by him if such vehicle is registered to an address within the Town of Southold. Resident parking permits shall be permanently affixed to the interior right hand corner of the windshield or to the interior right , hand front door window of the vehicle. (2) Lessee Parking Pertait A lessee parking permit shall be issued by the Town Clerk, or a person designated by him, to all persons who lease or rent property within the Town of Southold, but do not qualify as residents- as defined in Section III A (1) hereof. Persons applying for a lessee parking permit shall present an application in affidavit form, signed by the lessee and 'the owner of the -property setting forth the location .of the leased ©r rented property, the persons occupying the same,. and the term of such tenancy. Upon a determination by the Town Clerk, 'or a person designated by him, that the applicant is entitled to a lessee parking permit and the payment of the permit fee, such permit shall be issued and inscribed with the vehicle license registration number and shall be affixed to the vehicle in the same nabber as provided in- Section III A (1) hereof. The fee for the issuance of a lessee parking permit shall be such fee as shall be proscribed by resolution of the Southold Town Board. (3) Hotel-Motel Parking Permits Hotel-Motel parking permits shall be issued by the ow Clerk, or a person designated by him, to the owners or their designated managers, of hotels, motels, rooming or boarding houses, and trailer parks for use by the paying guests temporarily residing therein. Persons applying for a Hotel-Motel parking permit shall present an application to the Town Clerk in affidavit form, signed by the applicant, setting forth the number of rental units available at the applicant; s premises, the number of permits applied for, and the designated business name if any, of the premises applied for, Upon a determination by the Town Clerk, or a person designated by him, that the applicant is entitled to such permits, and upon payment of the required permitfee, permits shall be issued, provided, however, that the number of permits issued shall not exceed the number of rental units available at the premises applied for. Such permits shall be inscribed with the name of the applicant or the designated business name of the applicant;s premises, and shall be used only by paying - guests occupying the premises for which such permits are issued. Hotel-Motel parking permits shall be transferable and shall be issued in a clear plastic case and designed to be affixed temporarily to the interior right hand windshield ur right hand -front door window of the vehicle. The owner or manager ro whom such permits are issued shall make no charge for the use of such permits by such guests, but may require a deposit, not to exceed five dollars ($5.00) 'to insure return of a permit. The fee for the issuance of a Hotel-Motel Parking Permit shall be such fee as shall be prescribed by resolution of the Southold Town Board. 26 (4) One Day Non-Resident Permits ' One day non-resident parking permits may be issued for the parking of vehicles in the parking area at "Southold Town Beach" to, any person by the attendent on. duty at such parking area,. Such permit shall be valid only for a day on which the same is issued. The fee for the 'issuance •of a one day non-resident parking permit shall be such fee as shall be prescribed by resolution of the Southold Town Board. SECTION IV.- PARKING AT STEPHENSON'S BEACH Notwithstanding any of. the provisions of this ordinance, no person shall parka vehicle, except a vehicle displaying a valid residence park- ing permit in the parking area at "Stephenson' s Beach." SECTION V. - DURATION OF PARKING PERMITS All parking permits provided for in this ordinance, except one day non=resident permits, shall expire on December 31, of the year in which -issued. SECTION VI - OTHER PARKING REGULATIONS Persons using parking areas pursuant to the provisions _of this ordinance shall comply with all lawp, ordinances, rules, regulations, and resolutions applicable thereto. SECTION VII REMOVAL OF VEHICLES Any vehicle parked in violation of the provisions of this ordinance or any other law, ordinance, rule or regulation may be removed or caused to be removed by a police officer of the. Town of outhold, and after such removal, stored or caused to be stored in ,a guitab.le place at the expense of the owner. The owner, or person, in charge of such vehicle, may redeem the same upon paymentto Southold Town Police Department of the amount of all actual and necessary expenses incurred in the removal and storage of such vehicle. The said Police Department shall' ascertain, to the extent possible, the owner or person in charge of such vehicle and notify him of the amount which will be required to redeem the same. SECTION VIII - PENALTIES Any person convicted of a violation of any provision of this ordinance shall be punished by a fine not to exceed one hundred dollars ($100. 00) or by imprisonment not to exceed 15 days or both such fine and imprisommnet.
