Manhansett Avenue adjacent to. Gull Pond Inlet, and WHEREAS, this board deems it in the best interest of the Town of Southold that such a facility be constructed, NOW, THEREFORE, BE IT RESOLVED: That the Supervisor be and he hereby is authorized and directed to execute an agreement with ,the Commissioner of the Conservation Department of the State of New York for the- construct- ion of such facility, said agreement to be in the following form, to wit:- T H I S A G R E E M E N T Made the 6th day of February, 1970, by and between the People of the State of New York acting by and through. the Conservation Commissioner of the State of .New York, hereinafter referred to as "COMMISSIONER" of the Conservation Department of the State of New York, hereinafter referred to as. "DEPARTMENT" , with offices at 50 Wolf Road, City and County of Albany, State of New, York and the Town of Southold, , Suffolk County, Long Island, New York, a political subdivision of the State of New York hereinafter referred to as"MUNICIPALITY" , with offices at Southold, New York, 11971. That the Town of Southold and the DEPARTMENT will enter into an agreement to construct a boat launching facility on that tract .or parcel of land .recorded in the Suffolk County Clerk' s Office in Book of Deeds #5894 at page 20, and more particularly described as follows : ALL, that tract or parcel of land situate, lying and being in the Town of Southold, County of Suffolk, State of New York, bounded and des- cribed as follows : BEGINNING at a point on the southerly right-of-way line of Manhanset Avenue on the center line of a culvert under the said Manhanset Avenue,. which- point-- is S 740 30 ' E 280 feet from a concrete monument at the inter- section of said Manhanset Avenue Inlet Lane and ,49 feet from another concrete monument on the southerly right-of-way line; running thence the following nine courses and distances : S 740 30 ' E 46 feet; S 670 00 ' E 88 feet; N 340 30 ' E 501 feet; N 890 10 ' E 100 feet to the existing bulkhead; N 400 00 ' W 126 feet along said bulkhead; N 590 00 ' W 59 feet.; S 670 30 ' W 178 feet; S 320 30 ' W 319 feet; S 130 30 ' W 103. feet to a point on the center line of the north end of the aforesaid culvert; thence .S. 60 30 ' W, along the center line of said culvert 62 feet to the . point .or .place of beginning, containing 2 .46 acres of land, more or less. 3..Such facility to be built on plans approved by the DEPARTMENT at a total. cost_ including all necessary engineering ,costs, . not to exceed $130, 000. 00 to be paid by the DEPARTMENT. 4. The Town of Southold and the DEPARTMENT ,agrees that.: A. Upon completion of construction, such facilities shall thereafter be maintained and operated by the Municipality without res- trictions as to place of residence of users of such facilities except that a reasonable variation in us.age. fees may be applied to those residing outside the MUNICIPALITY. B. The public shall have the right to ingress and egress from the premises at all times for the launching and/or hauling of their boats, the parking of their cars and such other purposes not inconsistent with the purpose of this agreement, as set forth herein. However,, the MUNICIP- ALITY may establish the daily- hours of .operation. and may close And prohibit entry -to the site during such hours between sunset and sunrise as may be desired, subject to approval of such operational arrangement ,by the DEPARTMENT. C. The DEPARTMENT reserves the right to enter upon said premises at all times for the purpose ascertaining that the MUNICIPALITY has complies with provisions of this agreement. In the event the MUNICIPALITY fails to perform maintenance or maintain the site in a clean and orderly manner or 252 fails to remove debris or obstructions from waters adjacent to the site, the DEPARTMENT shall forthwith perform such work as required and',the. cost of performing such work shall be borne by the MUNICIPALITY. - D. The MUNICIPALITY agrees, when the site is ready for public usem to operate and maintain it in a clean, safe and orderly manner in keeping with other comparable public facilities maintained by the Con- servation Department, and- further agrees to assign such permanent personnel and equipment as may be necessary to operate and maintain,the facilities in the aforementioned manner. . WHEREAS, the Town of Southold has received a notice (Public Notice No. 6501) of a public hearing to be held by the Corps of Engineer-s- on February 13, 1970 in a matter of the application of Levon Properties Corporation of Jamesport, New- York for Department of. the Army -approval of the construct- ion of jetties . and dolphins and dredging in Long Island Sound at Jamesport, Suffolk County, New York, and WHEREAS, the site of the -work is located within -1500 feet of the westerly boundary line of the Town of Southold and accordingly is of concern" to the Town of Southold and the inhabitants thereof, and. WHEREAS, after investigation this board has concluded that the work con- templ,ated by Levon Properties Corporation will adversely affect the inter- ests of the Town of Southold and cause injury to property within tfie Town of Southold and will also adversely affect the fresh water resourses .of the Town of Southold, NOW, THEREFORE, BE IT RESOLVED: That this Board does hereby oppose the granting of the application of Levon- Properties Corporation for the con- struction and dredging set forth in said Public Notice No. 6501, the reasons for such opposition being as follows , to wit: (A) The construction of jetties and structures into the waters of Long Island Sound will cause serious erosion. of the shorline lying to the east of the site and within the boundaries of the Town -of Southold. The 'inevitability of such erosion is evident by the conditions presently existing and caused by the jetties and structures constructed by Levon Properties Corporation at the site within the past several years. The. threat of .Burther shorel-ine erosion is also based upon observed erosion. of the shoreline on Long Island. Sound caused by other jetties similar to those proposed by. 'the applicant in other .locations. (B) The present sand and gravel operations conducted by Levon Properties -Corporation at the Jamesport site has resulted in spillage of clay and other materials into the waters of Long Island Sound. Such spill- age has drefted easterly along the shoreline and caused a pollution" of FEBRUARY 6, 1970 2,53 the beaches in the Town of Southold. An extension of the jetties further into ,'Long Island Sound will cause further destruction of the" beaches in the Town of Southold by reason of such spillage. (Cl The construction and dredging operations contemplated by Levon Properties Corporation will adversely affect the fresh water re- sourses: of the Town of Southold. The largest available fresh water supplies of the Town of Southold are located "in the westerly areas 'of the Town of Southold within a few thousand feet of the applicant' s construction site. Recent engineering studies conducted by the ' Town of Southold have indic- . ated that the dredging of water*ays will cause contamination 'of the fresh water resourses of the Town of Southold by reason of salt water intrusion and will also cause the fresh water resourses to flow into the waters of Long . Island Sound thereby depleting such water resourses. IT IS FURTHER RESOLVED, that the Supervisor of the Town of Southold and/or. the. Chairman,.of the Planning Board of the Town of Southold be and they hereby are requested to attend said hearing and to present such documents and information as they shall deem appropriate to protect the interests of the Town of Southold and the inhabitants thereof. e IT IS FURTHER RESOLVED, that a certified copy of this resolution shall be presented and filed as a part of the records of said hearing. "I propose that if the shoreline of the town of Southold is being eroded by 'the construction of jettys in the Town of Riverhead by Levon Properties Incorporated, then the Town Attorney take legal. action to cause this operation to be halted as soon as possible, and further, if the water supply of the Town ' of Southold is being endangered by the operations of Levon Properties Incorporated then the Town Attorney take the necessary legal action to cause Levon Properties Incorporated to comply with the laws affecting their operations. Henry Santacroce, who assisted in, the rescue and prompt delivery of their son, Jimmy, to the hospital follow- ing an accident. A request was made by Mr. Proom for financial assistance in dredging the entrance to Wunneweta Pond. Moved by Councilman Valentine; seconded by Councilman Rich; RESOLVED: That the Town Clerk be and he hereby is directed to request the Long ' Island Lighting Company to install the following lights: One 175 MVOH street light on the corner of Route 27A and Peconic -Lane, on LILCO pole #254, One 175 MVOH street light on NYTCO pole #27 , Oaklawn Ave. , Southold, N.Y. Also, as recommended by Mr. Kincaid, that 7-7600 lumen mercury vapor street lightsfixtures be installed and 5-1000 lumen street lights be removed, thus providing a mercury vapor light on Wickham Ave. , at every intersection and on alternate pole in between, from Route 27A to Grand Avenue. Absent: Justice E. Perry Edwards and Councilman Howard Valentine. Moved by Justice Suter; seconded by Councilman Rich; RESOLVED: That the minutes of the meeting of February 6, 1970 be and they hereby are approved as corrected. Vote of Town Board: Ayes: Supervisor Martocchia; Councilman Rich; Justices Demarest and Suter. Several people appeared before the Board protesting the ramp to be in- stalled at Norman E. Klipp Marine Park, stating that it would hamper a good swimming beach and create pollution and littering of the beach area. They also felt it would not be properly policed and requested that an- other sight be chosen for the public ramp. Moved by Councilman Rich; . seconded by Justice Demarest; RESOLVED: That the Southold Town Board approves the action of the Fishers Island Ferry District in advertising for bids and the purchase of one 25-man life raft for the ferry owned and operated by the Fishers Island Ferry District. _ Vote of Town Board: Ayes-Supervisor Martocchia; Councilman Rich; Justices Demarest and Suter. s
