The Southold Town Board met at the office of Supervisor Albert M.
Martocchia , 16 South Street, Greenport, New York, at 3 :00 P.M. ,
Tuesday, July 11, 1972, with the following present:
Supervisor Albert M. Martocchia, Councilman James

Moved by Councilman Homan, seconded. by Justice Suter , it was
RESOLVED, that the minutes of June 20, 1972 and Special Meeting
of July 5, 1972 , be and they hereby are approved. '

RESOLVED, that the next meeting of the Town Board of the Town

RESOLVED, that the Southold Town Board approves the action of the
Fishers Island Ferry District in the hiring of the following
employees for the summer operation of the theatre and ferry:
Theatre:
Edwin Horning, Cashier, $73 .00 per week, Fishers . Island, N.Y.
Ernest Middleton, Recreation Aid, $11.25 per show, Fishers, Island, N.Y.
J.. B. Hartsfield, Recreation Aid, $11. 25 per show, Fishers Island, N.Y.

BE IT FURTHER RESOLVED, that all of the heretofore mentioned employees
be engaged by the Fishers Island Ferry District effective June 15,
1972 and at the compensation so specified.

WHEREAS the Women ' s Society of the' Southold Methodist Church has

NOW, THEREFORE, BE IT RESOLVED, that Mechanic Street, Southold, New
. York, be closed to public traffic August 12 , 1972 from 10:00 A.M.
to 4 :00 P.M.

to the Cutchogue Little League.

RESOLUTION AND DETERMINATION - ' In the Matter of the Petition of
Arthur Wolpert, 'Wilhelm V. Krumholz, Joseph DeSchrage, A. Bernstein
and Lillian S.' Pell 'for Annexation of Territory to the Village of'
Greenport.
The following resolution was offered by Councilman Rich, seconded
by Justice Demarest,'
WHEREAS, Arthur Wolpert, Wilhelm V. Krumholz, Joseph DeSchrage,
A. Bernstein and Lillian S. Pell have heretofore presented a
petition to this board requesting that the territory described _
in said petition be annexed to the Village of Greenport, and
WHEREAS, a public hearing with respect to said petition was duly
held jointly with the Board of Trustees of the Village of Greenport
on the 13th day of April, 1972 to hear any testimony and receive
evidence and information which may be presented concerning the
said petition and the question of whether the proposed annexation
is or is not in the over-all public interest,
NOW, THEREFORE, this board does hereby make the following findings
with respect to compliance of the' said petition with the provisions
of Article 17 of the General Municipal Law and with respect to the
effect of such proposed annexation on the over-all public interest,
to wit:
I. That' the said petition doe's not substantially comply in
form with the provisions of' Article 17 of the General Municipal
Law for the following reasons, t6 wit:
(a) The petition and exhibits annexed to the petition
state that the petitioners are the owners of all of the assessed
.valuation of the property in the territory sought to be annexed.
Howeuerr an examination of the assessment rolls of the Town of
Southold for the 1971-72 tax year shows that the portion of the
property sought to be annexed allegedly assessed to Arthur- Wolpert
and others is in fact assessed to Chapel Lane Associates and not
to the individual petitioners signing said petition.
(b) A portion of the real property sought to be annexed
to the Village' of Greenport is assessed on the aforesaid Southold
Town tax rolls to Lillian S. Pell. The said Lillian S. Pell has
presented a letter to this board dated July 10, 1972' where.in she
has indicated that she wishes to withdraw the property assessed
to- her from the petition for annexation. Of the total assessed
valuation of the territory sought to be annexed amounting to
$17 , 900, the real property assessed to Lillian S. Pell with an
assessed valuation of $9, 900 comprises more than one-half of. the
assessed valuation of the entire territory sought to be annexed.
' Accordingly, the petition now does not comply with the requirements
of Article 17 of the General Municipal Law since it does not -contaLLn
t,74bhnames of owners of a majority ' in -assessed valuation of the real
property in such territory assessed on the last preceding assessment
roll.
(c) For the aforesaid reasonp, this board determines that
the aforesaid petition does not substantially comply with the
provisions of Article 17 of the General Municipal Law.
II. That the proposed annexation is not in the over-all
public interest (1) of the territory proposed to be annexed or
(2) of the Village of Greenport to which the territory is proposed
to be annexed, or (3) of the remaining area of the Town of Southold
in which such territory is situated, or (4) of the' Union Free'
School District, both of which districts are situated partly in the
territory proposed to be annexed for the following reasons, to *it:

(a) That as indicated on the exhibits annexed .to the
aforesaid petition, the area of the territory sought to be annexed
contains 29. 993 acres of vacant land. The territory in question is
contiguous along a portion of its easterly boundary line with land
within the incorporated limits of the Village of Greenport. The
land within the incorporated Village of Greenport to which the
territory is sought to be annexed is contiguous is owned by the-
Village of Greenport, is uninhabited and is used by the Village of
Greenport as a water-shed area and was annexed to the Village of
Greenport several years ago. That said lands of the Village of
Greenport were permitted to be annexed to the Tillage of Greenport
, by action of this board in order- to eliminate the payment of taxes
On' said property by the Village of Greenport to the- Town of Southold
since said lands at that time were outside the incorporated limits
of the Village of Greenport and under applicable law were then
subject to Southold Town taxes.
(b) - That with the exception of that portion of the
territory sought to be annexed ajdacent to "old highway" to a
distance of 200 feet, all of the territory sought to be annexed
is within the "A" Residential and Agricultural District under the
Town of Southold Building Zone Ordinance which provides for a
minimum size .lot of 40, 000 square feet if. public sewer and public
water are not provided and 20, 000 square feet if public sewer and
public water is provided. Public water is available to the territory
in question but public sewers are not. Under the provisions of the
Village of Greenport Zoning Ordinance, all territory annexed to
the Village of Greenport shall be placed in the "R-l" One-family
Residence District which requires a minimum size lot of 10, 000 square
feet without regard to whether public .sewer or water is provided.
Therefore, if the territo.r.y .in.question were annexed to the Village
of Greenport, _ the Village of Greenport Zoning Ordinance would. pe.rmit
the territory to. .be. developed with..four . times.. the number . of`. dwellings
as -is .permitted by the .Southold .Town. Zoning. Ordinance. It was
testified to at the. hearing in this matter that the Town of Southold
including the_ Village of Greenport has . a limited . supply of fresh
water... The Master Plan of- the Town- of Southold including the water
resources- study forming a part thereof .has recommended the conserva-
tion of the limited freshwater resources- .of.- the. town by. limiting
the density of the development of . the .town. _ This . board . believes
that to permit the territory in question to be developed as .
provided by the Village of Greenport Zoning Ordinance would severely
endanger_ the fresh water resources of . the_ Town. of. Southold.
.(c) The petitioners herein have indicated.. that the .
principal reason for seeking annexation'As to. avail themselves of
the public operated. by the Village of
Greenport. The Superintendent.. of .Utilities of the. Village. of
Greenport has stated that said sewer system has a maximum capacity
of 500, 000 gallons per-day. . The system is a pimary treatment.
system. and is .presently. in . violation. of applicable rules and regula-
tions of the state. and. federal .government... Said sewer plant.- is
presently. operating at 85% of- its capacity. - The affluent- from
said system is discharged into_ the- waters. of. Long Island Sound.. . :,
adjacent to the Town of Southold. This board believes_ that .to.. .. .
permit the annexation sought. .herein.would; possibly. cause an:
additional vo-lume. of improperly.. .treated. sewage to be discharged
into the..waters. of Long Island Sound. and thereby cause , a potential
pollution problem. -
(d) . -. The-. assessed. .valuation ,of. the- territory sought_ to.
be annexed amounts fo $17 , 900. If the territory were annexed. to-
the- Village of Greenport it. would result in an increase in the,. ,,.;
Village. of- Greenport. tax .base of approximately, one.-ha.lf of,. one. - .
percent. This- board believes- that the. detriment_ to. the Town- of.
Southold by.. reason_ of_ •the_ annexation. .of . the territory s-et, forth.
in the aforesaid petition would far outweigh. .any. benefit- to .be_
derived by the Village of Greenport by reason of any increase in.
its tax base.

For the reasons hereinbefore set forth, this board does
hereby DETERMINE that it is not in the over-all public interest
to approve such proposed annexation of the territory set -forth
in the- petition- of Arthur Wolpert, Wilhelm V. Krumholz, Joseph
DeSchrage, A. Bernstein and Lillian S. Pell.
The foregoing resolution was duly put to a vote which resulted
as follows: Supervisor Martocchia voting yes, ' Councilman Rich
voting yes, Councilman Homan voting yes, Justice Demarest voting
yes, Justice Suter voting- yes.
The resolution was declared unanimously- adopted.
ORDER- In the Matter- of the Petition of Arthur Wolpert, Wilhelm
V. Krumholz,, Joseph DeSchrage, A. Bernstein- and Lillian S. Pell
for Annexation of Territory to the Village of Greenport.
There having been presented to this town board a petition
of Arthur Wolpert, Wilhelm V. Krumholz, Joseph DeSchrage, A.
Bernstein and Lillian S. Pell requesting that the- territory
described in said petition be annexed to the Village of Greenport;
and a public hearing with respect to said- petition having been
duly- held jointly with the Board of Trustees of the Village of
Greenport on the 13th day of April, 1972, to hear any testimony
and receive- evidence and information which- may be presented-
concerning the said petition and the question of whethef the
proposed annexation- is or is not in the over-ail public interest;
and this town board having, by a resolution duly adopted' on- the
llth day of July, 1972 duly determined that said petition does
not comply with the provisions of Artiole 17 of the General
Municipal Law and was not in the- over-all public interest to
consent to the annexation of the territory described in said
petition; Now, on motion of Juatice Suter, seconded by Councilman
Homan, it is
ORDERED that this town board does hereby disapprove such proposed
annexation and does not consent to -the same; and it is further
ORDERED, that the town clerk shall cause a certified copy of this
order, together with copies of the petition, the notice, the
written objections; if any, and testimony and minutes of proceed-
ings taken and kept on the hearing, in the office of the clerk of
the Village of- Greenport; - and 'it is further
ORDERED, that the town clerk shall cause a certified copy of this
order to be filed in the office of the County Clerk of the County
of Suffolk.

WHEREAS, Philip Abatelli, Cutchogue, New York by application dated
January 17, 1972, petitioned the Town Board fora- change of zone
on certain property situated at Cutchogue, New York, from "A" -
Residen-tial and Agricultural District to "B-1" General Business
District, and
WHEREAS, the said petition was referred to the Southold Town
Planning Board for official recommendation and report, and
WHEREAS, the Town Board pursuant to due -notice, held a public
hearing thereon on the 20th day of June 1972 at 7 :30 P.M. , at
which time all interested persons were given an- opportunity to
be heard,
NOW, THEREFORE, BE IT RESOLVED, that Philip Abatelli, Cutchogue,
New York, be granted a -change of zone from "A" Residential and
Agricultural Distric t to "B-1" General Business District on his
property at Cutchogue, New York, more particularly bounded and

CONSENT OF TOWN BOARD, TO PROPOSE TOWN HIGHWAY
In the Matter of the Laying out of certain town highways in the
Town of Southold, County of Suffolk and State of New York, known as
LONGVIEW LANE, RAMBLER ROAD, PLEASANT PLACE AND WATERSEDGE WAY.
UPON READING AND FILING the application of Helen G. Cochran dated
and acknowledged April 20, 1972, and the dedication and release
of Helen G. Cochran dedicating and releasing the necessary lands
for proposed town highways to extend from Main Bay View Road through
the lands of the said Helen G. Cochran,
RESOLVED, that, in accordance with the provisions of Section 171 of
the Highway Law of the State of New York, consent be and the same
hereby is given that the Town Superintendent of Highways of the
Town of Southold make an order laying out the aforesaid town highways,
the said town highways to consist of the lands described in the said
dedication and release and to extend as delineated upon- the map
thereto annexed, and it is further
RESOLVED, that the Town Clerk be and he hereby is directed "to
forthwith cause such release to be recorded in the Office of the
Clerk of the County of Suffolk and, upon its return, to attach it
hereto.

RESOLVED that Chester Melot, Mattituck, New York, be and he hereby
is appointed Attendance Officer, subject to the written approval
of the District Superintendent of Schoolp, throughout the Town
of Southold, except such schools as are otherwise provided for by
Section 3113 of the Education Law, and be it further
RESOLVED, that such Attendance Officer shall be removable at the
pleasure of the District Superintendent of -Schools , and be it
further,
RESOLVED, that the Compensation of such Attendance Officer be fixed
at $1, 200.00 per year payable in regular monthly installments, he
to pay his own expenses, and be it further
RESOLVED, that the Town Clerk be and he hereby is instructed to
