the entrance of Wunneweta Pond,
NOW, THEREFORE, - BE IT RESOLVED, that. Supervisor Martocchia be and
he hereby is authorized to contribute half of 'the total cost up
to but not to- exceed the. sum of $475.. 00 . toward the cost of dredg-
ing the entrance of Wunneweta Pond., Nassau Point, Cutchogue, New.
York.

RESOLVED, that this Town Board approves the recommendation of
Joseph Lite, attorney for the Town of Southold, in the settlement
of assessment for the property of Mr. John Evans, Fishers Island,
New York.

Moved by Justice Demarest, 'seconded by Councilman Rich, it was
RESOLVED, that the Southold Town Board approves the action of the
Fishers Island Ferry District, Fishers Island, New York in the
lease of building #383 to William J. Faulkner, Fishers Island,
New York, for a term of three (3) years at a rental of $900.00
per year.

Sledjeski who resigned. Term to run until January 9, 1975 .

WHEREAS, a written petition dated September °11, . 1971,, wa's duly
. filed with this board requesting the permanent improvement of,
highways in this Town known as :
All those certain lands• at ,Bayview in the Town of Southold
known add designated as Longview Lane, Rambler Road, ;
Pleasant- Place. and Watersedge Way on a - certain map
entitled "Map of: Terry Waters at Bayview, Town of
Southold, Suffolk County, New York" filed in the Suffolk
County Clerk 's Office on December 29, 1958, as Map No.
2901.
WHEREAS, said petition was-duly signed by owners- of: real : estate
owning real estate to the extent of at least one-half of. the ..
entire frontage or bounds,•on_ both , sides of such highways and .
also signed- by resident owners. owning , not less than one-half:
of the frontage owned by resident owners- residing.- in or along
such highways, ' and
WHEREAS, the said petition was duly acknowledged or. proved as to
each signer in the same manner as required of a deed to be
recorded, and
WHEREAS,, at a meeting of said Town! Board- duly called and held on
April 25 , 1972 , an order was� dti-ly adopted by it and entered in
its minutes, ' reciting the:.filing of. such petition; the improvement

RESOLVED-,, that this boards does hereby, determine. that- it is in the
public interest: to make the improvements petitioned for, .- to. wit::
The permanent pavement of the:- highways set forth in:. said petition
and- the construction of such curbs, gutters-, catch basins and
drainage facilities: as may be- necessary;: and it is. further
RESOLVED that Lawrence :M-. Tuthill., as, engineer for this Town,- shall
prepare definite plans and specifications: and make• a careful
estimate of the expenses for the performance. of the work; ,and it
is . further _
RESOLVED that Otto Van Tuyl_.& ,Son, Civil Engineers., who are hereby
employed for that purpose shall survey said highways and establish
the lines and- grades- ther,.eof. and. such--. survey._ and a profile of ; the
grade shall be- filed in the. Town_ Clerk 's Office-; and ,it is further
RESOLVED that upon the completion of the aforesaid plans, specifi-
cations, estimate:_ of-, expenses, survey and profile: of the grades,
that the Superintendent of Highways perform said work by. using
regular highway employees . and; that the cost thereof to. be deemed
a part of the expense of the improvement.

Justice Demarest offered the following resolution and moved its

OF TOWN ROADS, IN, SAID ,TOWN,. STATING ,THE ESTIMATED MAXIMUM_;.;
COST THEREOF, $10, 500,00 PN D AUTHORIZING THE ISSUANCE OF
$10, 500. 00 SERIAL BONDS OF THE TOWN TO FINANCE SAID APPROPRIATION.
Recitals
WHEREAS, following receipt of a petition in due form, .:a, pub,lic
hearing duly.-called- and held for the improvement of •,the existing
highways known as Longview Lane, Rambler. Road,. Pleasant: Place
and Watersedge Way (herein called "Improvement" and "Streets"
respectively) , in' the: ,Town of. S.outhold.:-(herein-,. called. "Town") ,
in the County of Suffblk,_ New York, by the, permanent. pavement of
the same and the construction of such curbs, gutters, catch. basins
and drainage facilities as may be neeessary, at an estimated_
maximum cost of $10, 500. 00, ; the Town Board, of the Town determined
pursuant to- reso'lut-ion duly. adopted on June 6-, 1972, that the
notice of such hearing was published and posted as required by
law and is, otherwise sufficient and ..that it ;is in the public
interest to make the Improvement pursuant to the definite plans,
specifications and estimate of cost to ,be prepared by the Town
Engineer; _
now therefore, be it
RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD IN THE COUNTY
OF SUFFOLK, NEW YORK (by the ; favorable vote of not .less than two-
thirds of a-11. the. members _- of : said Board)., ,AS FOLLOWS : .
Section 1. The Town- hereby- appropriates the amount of
$10, 500. 00 for '-the, permanent pavement. of Longview.. Lane, . Rambler
Road, Pleasant Place and Watersedge Way and the construction of
:luch curbs, gutters,, catch - basins, and drainage _f.acilities. as
may be necessary. on and: along !the Town Highways- in the_ Town, .all
in accordance- with the. map, ;pla.n and- specifications and estimate
of cost prepared by the Town Engineer, hereinabove referred to
in the Recitals hereof, and hereby approved. The estimated
maximum cost of said specific :object or purpose, including
preliminary-. costs and costs t. incide.nal hereto and the financing
thereof, is $10, 500. 00 ,and the plan of financing incl-udes� ,the .
issuance of serial bonds of the .Town. in the principal amount
of $10, 500. 60 and the assessment, levy and collection of assess-
ments from the severa.l � lots and parcels of land which the Town_
Board shall deem especially benefited:.-.hereby to :pay the. principa:l
of .said bonds and the interest thereon- so much upon and from each
as shall be in just proporation to the. amount of_ benefit which the
Improvement shall confer upon the. same. ,
. Section 2 . To finance such appropriation, serial bonds of
the Town are hereby authorized to be issued in the principal
amount of $10, 500. 00 pursuant to the provisions of the Local
Finance. Law, constituting Chapter- 33-a . of the Consolidated Laws of
the State of New York, (herein called "Law") .
Section 3. The period of. probable usefulness of_ the specific
object or purpose for which the. bonds authorized pursuant to this
resolution are to be issued, :.within the limitations of. Section
11.00a 20. of the Law, is five .(5) years.
(A) Current .funds are. not required .to be provided prior to
the issuance of the bonds authorized pursuant to this resolution,
or any bond anticipation notes issued in anticipation thereof,
pursuant to the provisions of Section.. 107. 0'0 of the Law.
(B) The proposed maturity of. the. bonds authorized. pursuant.
to this resolution, will not exceed five '(5) years.
Section 4. Each of the bonds authorized pursuant to this
resolution, and any notes. issued. in anticipation thereof, shall. _
contain the recital of valifity prescribed by $52. 00 of the Law
and said bonds . and any notes issued in anticipation of said bonds
shall be general .obligations of the Town,.. payable as to both.
principal and interest by general tax upon all the taxable real
property within the Town without limitation of rate or amount.
The faith, and credit of the. Town, are.. hereby irrevocably pledged.
to the punctual payment of. the principal of and interest on said
bonds and provision shall be made annually in the budget of the
Town by appropriation for (a) the. amortization and redemption of
the bonds to .mature in such year and. (b) . the payment of interest
to be due and payable in such year.
Section 5 . Pursuant_ to. the provisions of this. resolution and
pursuant to the provisions of $30.00 relative. to. the authorization
of the issuance of bond anticipation. notes and of 050. and $$56.00 to
60.00 of .the. Law, the . powers and. duties of the Town Board relative
to prescribing the terms, form and- cont ents and as to. the sale
and issuance of said bonds and any notes issued in anticipation
of said bonds , or the. renewals thereof, are hereby delegated to
the Supervisor, the chief fiscal officers=of the ,Town. .
Section 6_. . The validity of the. bonds authorized pursuant
to this resolution may be contested only if:
(a) Such, obld!gations are authorized for an
objector purpose. f or which the Town is not
authorized to expend moeny, or
(b) . The provisions of law which should be
complied with at the date of publication of.
such resolution, are not substantially
complied with,
and an action, -suit or proceeding contesting such validity, is .
commenced within twenty days after the date of such publication, . or
(c) Such ,obligations are authorized in
violation of the provisions of . the constitution.
The adoption of the foregoing resolution was seconded by Justice
Suter and duly, put to a vote on roll . call., . which resulted as

Justice. Demarest offered the following_ resolution and moved for

RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD IN THE
COUNTY OF. SUFFOLK, NEW YORK,. AS FOLLOWS :
Section 1. The Town Clerk .of the Town of Southold, in the
County of' Suffolk, New York, is hereby directed to publish the
foregoing bond resolution in full, . in the "LONG ISLAND TRAVELER-
MATTITUCK WATCHMAN" a newspaper.. .published in the. Town of Southold,
New York., and having a general circulation in. the Town, which
newspaper is hereby designated as the official newspaper of the
Town. for such publication, . ,together with .the Town Clerk ' s statutory
Notice in substantially the form as. prescribed in Section 81. 00
of the Local Finance Law of the State of New. York.
Section 2 . This resolution shall take effect immediately. ,

said transportation for the Senior_ Citizens at a cost not to
exceed.

he herbby .is authorized to contribute half of the total cost up to
but not to exceed the sum of $475.00 toward the cost of dredging
the entrance of The Lagoon, Nassau Point, Cutchogue, New York.
