October 17, 2005 Jerilyn B. Woodhouse, Chairperson Planning Board -Town of Southold pCT 1 P.O. Box 1179 11 ' Southold NY 11971 Subject: Final Site Plan Submission for The Whitaker House, LC Dear Madame Chairperson: We respectfully submit an "as built" site plan. We have addressed all issues raised in Mr. Semon's Site Inspection Report dated October 6, 2006. We would appreciate your endorsement of the final site plan so that there is no further delay to our application for a certificate of occupancy from the building department. In your letter dated October 111 2005, you have-indicated that you are unable to recommend a certificate of Occupancy based upon Mr. Semon's inspection, because the site work does not match the approved site plan as amended March 21, 2005. We would like to bring to your attention the discrepancies and errors in Mr. Semon's report as follows: 1. "Parking configuration as approved is different. The site plan was approved with 16 parking spaces required and the as built condition will be less." The report is incorrect. There are 16 parking spaces. We are not sure how Mr. Semon made this determination. We met with Mr. Semon in his office prior to the Planning Board Meeting and showed him that we removed one parking spot that was very close to a tree and added another spot close to the building. At the same time we created a shaded area for people to sit and relax. We invited Mr. Semon to come back and measure the space to see that iri fact there are 16 spots, 9 feet each with an additional 5 feet for handicap access. Mr. Semon, assured us that he believed us, there was no need for him to come and measure and yet proceeded to include the assertion that the space is less in his report to you. We question why your inspector would take such a position. We assume that if his job is to make accurate and truthful statements to you and the rest of the planning board, he should resolve a discrepancy when brought to his attention rather than issue an erroneous report. As to the movement of the space, we were not ti aware that such a minor change required a new site plan. We don't understand why we were not able to indicate such a minor change on the existing site plans without the added expense and delay of another iteration of the site plan. 2. "Parking spaces 9 & 10 has been eliminated and replaced with a landscape island." Again the report is incorrect. The parking spaces were not eliminated. Parking space 9 is there as per the plan and parking space 10 was moved to the other side of the parking lot to protect the tree as noted in the explanation above. 3. "Parking spaces 14, 15 and 16 have changed" This statement is partially correct and partially incorrect. Parking space 16 is unchanged. We changed the designation of the handicap parking from parking space 14 to 15. We also created a small buffer between the ADA ramp to protect it from cars parking too closely. This change is reflected in the site plan submitted. 4. "The ADA space is now in location 16 and may not meet the requirements of the standard." As noted above, the space is not 16 but 15. The inspector assumed that there was only one space where there are actually 2 spaces. 5. f° The ADA sign is less then (than) the required 60"in section 502.6 of the standard." We appreciate you're pointing this out to us, we have corrected this. However, the height of the sign is not noted on the site plan for purposes of approval. Neither is this an as built issue. Just a sign that is too low. 6. "IVo ADA ground markings was(were) observed at the site visit." Again, we will correct this as required by the ADA standards. Also not an inconsistency with the site plan. S 9. "Driveway entrance was widenedichanged and a 6" diameter tree was removed from Town property." The driveway entrance was reconfigured per the final site plan attached. The tree that was removed was diseased. Per Town code section 100.259 (attached), we have the right to remove diseased or dead trees without first having to obtain site plan approval. Nevertheless, we first checked with the head of the building department before removing the trees. We have also attached a letter from Joseph P. Shipman, noting that the trees he removed (4 of 32) were "badly diseased or grossly infected with carpenter ants." Again, knowing the Town Code, and having spoken with us regarding these trees, we question the inclusion of this issue in the inspector's report for approval purposes. Again, we question the motivation of such actions. S. "The gravel topcoat appears to (be) much less then (than) the 2" thick requirement, which was incorporated in the approval." Attached is a letter from East End Asphalt certifying that the gravel has a 2- inch top coat. 9. NOT IN THE REPORT BUT IN YOUR DISAPPROVAL LETTER OF OCTOBER 11, 2005-roof overhang on west side of building. We have attached a photo from the library's archives showing that the west- side overhang was present in older photos. We've also attached a 2002 photo showing that all overhangs had been removed when the Town put on the vinyl siding. Since the site plan reflects all the wood decks in the same manner, we can only assume that the Planning Department is suggesting that we altered the original appearance of the house, which we did not. Again, we question the assumption of wrong-doing vis-a-vis, making an effort to verify that issues raised are valid. In summary, the only valid issue that needed to be addressed in the site plan was the movement of the parking space from one side of the parking area to the other. Do you honestly believe that this was sufficiently serious enough not to approve the site plan and cause us to have a further delay and expense in securing the C of O and our mortgage financing? Especially since "the Planning Board may allow or require landscaping to be installed in place of specified parking spaces." Code section 100-254 B (5) attached. Is this also sufficiently serious enough to cause us to be fined or sued by the Town? 1 It is our belief that the Planning Board was given an erroneous report upon which it based its decision. We can understand honest mistakes but we cannot understand a deliberate effort to misrepresent the facts, especially when it was within the purview of the inspector to verify the information given him. We have modified the site plan to comply with all valid issues raised. We would appreciate your appro , arie & L Beninati The Whitaker House, LLC 1 - ' 0 § 100-254 ZONING § 100-254 exception by the Zoning Board of Appeals, if such is required. The Planning Board issued conditional final approval on April 11, 2005 for an alteration of an existing two-story building of 2,177 sq. ft. to an office of 1,373 sq. ft. on the first floor and two accessory apartments on the second floor. The subject property is HB-zoned and is located on the southeast corner of NYS Road 25 &Horton's Lane in Southold. During the site plan review process, the project was classified as a Type II action and was therefore not subject to SEQRA. The proposed project is not expected to have significant environmentally damaging consequences. 2. The subject property is located within Southold's designated"Hamlet Center." The proposal for a mix of office and residential uses is consistent with the recommendations made in the Hamlet Study, including provisions to provide affordable housing. In addition, it is within the designated Hamlet Centers and HALO Zones that higher density development is most appropriate. 3. The subject property is located within a district that contains adequate resources and public facilities to support increased development. 4. The Planning Board referred the site plan to the Southold Fire District on February 9, 2005. In a letter dated March 9, 2005, the Southold Fire District indicated that fire protection for the site is adequate. 5. The transfer of sanitary flow credits is needed in order to obtain Health Department approval for the project. There are no other agencies for which approvals or permits are required at this time. Based on the above assessment, the Planning Board supports the transfer of sanitary flow credits onto the subject property for the purpose of constructing two affordable rental units on the second floor of the existing structure. *pF SO(/ryo ELIZABETH A.NEVILLE lQ Town Hall, 53095 Main Road TOWN CLERK P.O. The question of whether an action may be significant is not always easy to answer. Frequently, there are aspects of a project that are subjective or unmeasurable. It is also understood that those who determine significance may have little or no formal knowledge of the environment or may not be technically expert in environmental analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting the question of significance. The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature, yet flexible enough to allow introduction of information to fit a project or action. Full EAF Components: The full EAF is comprised of three parts: Part 1: Provides objective data and information about a given project and its site. By identifying basic project data,it assists a reviewer in the analysis that takes place in Parts 2 and 3. Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides guidance as to whether an impact is likely to be considered small'to moderate or whether it is a potentially-large impact. The form also identifies whether an impact can be mitigated or reduced. Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the impact is actually important. THIS AREA FOR LEAD AGENCY USE ONLY DETERMINATION OF SIGNIFICANCE -- Type 1 and Unlisted Actions Identify the Portions of EAF completed for this project: Part 1 Part 2 LJ Part 3 Upon review of the information recorded on this EAF(Parts 1 and 2 and 3 if appropriate),and any other supporting information, and considering both the magnitude and importance of each impact, it is reasonably determined by the lead agency that: A. The project will not result in any large and important impact(s) and, therefore, is one which will not have a significant impact on the environment, therefore a negative declaration will be prepared. B. Although the project could have a significant effect on the environment, there will not be a significant effect for this Unlisted Action because the mitigation measures described in PART 3 have been required, therefore a CONDITIONED negative declaration will be prepared.* ®C. The project may result in one or more large and important impacts that may have a significant impact on the environment, therefore a positive declaration will be prepared. *A Conditioned Negative Declaration is only valid for Unlisted Actions Name of Action Name of Lead Agency Print or Type Name of Responsible Officer in Lead Agency Title of Responsible Officer Signature of Responsible Officer in Lead Agency Signature of Preparer(If different from responsible officer) 1 website Date Page 1 of 21 PART 1--PROJECT INFORMATION Prepared by Project Sponsor NOTICE: This document is designed to assist in determining whether the action proposed may have a significant effect on the environment. Please complete the entire form,Parts A through E. Answers to these questions will be considered as part of the application for approval and may be subject to further verification and public review. Provide any additional information you believe will be needed to complete Parts 2 and 3. It is expected that completion of the full EAF will be dependent on information currently available and will not involve new studies, research or investigation. Page 10 of 21 PART 2- PROJECT IMPACTS AND THEIR MAGNITUDE Responsibility of Lead Agency General Information(Read Carefully) In completing the form the reviewer should be guided by the question: Have my responses and determinations been reasonable? The reviewer is not expected to be an expert environmental analyst. The Examples provided are to assist the reviewer by showing types of impacts and wherever possible the threshold of magnitude that would trigger a response in column 2. The examples are generally applicable throughout the State and for most situations. But,for any specific project or site other examples and/or lower thresholds may be appropriate for a Potential Large Impact response, thus requiring evaluation in Part 3. The impacts of each project,on each site,in each locality, will vary. Therefore, the examples are illustrative and have been offered as guidance. They do not constitute an exhaustive list of impacts and thresholds to answer each question. The number of examples per question does not indicate the importance of each question. ! In identifying impacts, consider long term, short term and cumulative effects. Instructions(Read carefully) a. Answer each of the 20 questions in PART 2. Answer Yes if there will be any impact. b. Maybe answers should be considered as Yes answers. C. If answering Yes to a question then check the appropriate box(column 1 or 2)to indicate the potential size of the impact. If impact threshold equals or exceeds any example provided, check column 2. If impact will occur but threshold is lower than example, check column 1. d. Identifying that an Impact will be potentially large(column 2)does not mean that it is also necessarily significant. Any large impact must be evaluated in PART 3 to determine significance. Identifying an impact in column 2 simply asks that it be looked at further. e. If reviewer has doubt about size of the impact then consider the impact as potentially large and proceed to PART 3. f. If a potentially large impact checked in column 2 can be mitigated by change(s)in the project to a small to moderate impact, also check the Yes box in column 3. A No response indicates that such a reduction is not possible. This must be explained in Part 3. 1 2 3 Small to Potential Can Impact Be Moderate Large Mitigated by Impact Impact Project Change Impact on Land 1. However, the Planning Board will need additional information regarding the sanitary flow requirements of the Health Department before recommendations can be made. Specifically, we need to know how the sanitary flow credits are to be used? The Town Code is very clear that sanitary flow credits can only be used when providing.affordable housing. If the credits (or a portion thereof) are needed for the commercial part of the project or the applicant is prosing to use them for market rate apartment rentals, the sanitary flow credits cannot be used. Upon receipt and review of the aforementioned information, the Planning Board will prepare comments and recommendations for the Town Board as requested. The application that was sent to us does NOT indicate HOW MANY credits are being sought and for how many dwelling units. This information is critical to both the building department and the planning office in our review of the application. Perhaps the application form should be amended to ask this specific information? The letter that was attached indicates that there will be two apartments, but it is not clear if they need one credit for each apartment or just one credit for one of the apartments. That said, when the TB adopts a resolution I think the resolution should indicate the tax map number of the site, the number of credits and the number of apartments that the credit is applied towards. Elizabeth A. Neville Southold Town Clerk Ll F.An beninati associates reaj estate To Valerie Scopaz Information regarding our water problem: Background: Inspector from Suffolk County Water Authority inspected existing water hook up and failed to approve because new gas line and water line crossed. The water line was moved and reinspected. The location was approved. However, we have been told that it will take 2 months for water hook up because this is being treated as new construction. This is not new construction, we have been forced to move the water line because of something that is beyond our control. To be without water for two months is a major hardship for us. We have given notice in our current office (since we had no idea that this problem would crop up) and must move by August 1st or we will be without an office. This would be a major interruption in our business. Confidentially, our construction loan is expiring, another 2 months would create a financial problem for us. The customer service rep Ann (563 5658) at the Suffolk County Water Authority told me this morning that it could take 4 weeks just to get the permit from the State to make the hook up. Then probably another 4 weeks to get someone out to do the work. The street are torn up now, it's the perfect opportunity to make the hook up. RE: Attachment to Application for Transfer of Sanitary Flow Credits We are applying for Sanitary Flow Credits to allow mixed use of the property known as, "The Whitaker House" as permitted under Town Code. The mixed use consists of 2 apartments and professional office space - primarily Real Estate Sales. The Sanitary Flow Credits are needed to provide water allotment under the Health Department guidelines. It should be noted that in the past, The Whitaker House had been used as a 3 family dwelling. There were separate utility meters for each apartment. Because we will only have 2 apartments, and one dry office, we feel that the water usage will actually be less than previous occupants. Our desire to have this mixed use is twofold: 1. There is a tremendous demand for apartments. The Hamlet location and zoning, provides the opportunity to offer housing. 2. The economics of restoring the Whitaker House and making it a viable business venture necessitated monthly rental income to support financing costs. A site plan is attached showing the proposed design of the interior. We thank you for your assistance in this matter. Respectfully submitted, The Whitaker House, LLC E. A Landscape Plan indicating proposed plantings 2. Indicate if a dumpster will be located on the site. We will not have a dumpster on the site. 3. Scaled detail of proposed sign. Detail of the sign is indicated on the site plan in the upper right hand corner. I have attached a site plan indicating our landscaping plan. This plan was developed with the intention of presenting the Whitaker House with as much authenticity as possible. The recommendations we have received from knowledgeable people in the field is to keep the grounds as simple as possible in keeping with the style of homes built in the late 17005s and early 18005s. As such, the rationale behindsour plan is as follows: • We have made a concerted effort to save as many trees as possible. Our plan will require the removal of only one tree near the entrance of the parking. All other healthy trees will remain in place - the parking is designed around existing trees. Please note, there are existing tree .;"a#Qrg Horton's Lane and on the Main Road. All a ``sfin trees have been indicated with a red circle. 05 53155 Main Road • P.O. Box 1346 • Southold,NY 11971 • Phone 631.765.5333 Fax 631.765.5225 • We plan to remove 3 overgrown shrubs in front of the building to give the fagade clean, simple lines, in keeping with the simplicity of housing in the period when the Whitaker House was built. • The perimeter of the parking area has a number of trees which will remain. Our plan is to supplement the trees with additional evergreen hedges and or trees whichever will be most appropriate, with a preference to trees whenever possible - indicated with a green circle. The Town of Southold plans to remove the generator, stockade fence, and the metal box which infringes on our property within one year. When that is done, we will proceed with planting in that area. • We will maintain the existing lawn which surrounds the property. • As noted in the site plan, we will plant a modest flower bed around the sign (also noted in the site plan) mostly perennials. The sign itself will also be simple in keeping with the architectural simplicity of the period. Please let me know if this adequately responds to the requests in your letter dated February 15, 2005. We thank you and the Board for your help in guiding-us through the site planning process. This site plan is for the restoration of an existing historical residence located on the corner of Horton's Lane and.Route 25. The proposed curb cut entrance to the site is preexisting and considered satisfactory. The "Proposed Gravel Parking Area" should consist of a minimum two (2") inch thick blue stone blend top-coat. Drainage Calculations have been provided for both the parking area and the renovated building. As proposed, the site appears to be graded to maintain all surface water run-off within the parking area and Inlet Grate elevations should be established to accommodate this requirement. As designed, the proposed installation of drainage pools meets the minimum requirements of Town Code. Box 1179 Southold, NY 11971 Subject:Application for Consideration of a Site Plan for The Whitaker House, LLC Dear Planning Board Members-Town of Southold: Attached please find our site plan submission for your approval. As you all know we have undertaken the restoration of The Whitaker House with the intention of saving an historic home and making it a business locale for our Real Estate office-Beninati Associates-as well as retaining two of the three apartments. We believe the mixed use will benefit the community by provided much needed housing for residents who cannot afford to buy a home-a problem we are very aware of in our real estate business. In,addition, the rentals will provide us with an income flow to help defray the monthly carrying cost of the renovation. We believe this project is a win-win for thie Town of Southold, for us and for the members of the community. When we entered into this project,we did not anticipate the delays we have been faced with. Some have been due to the condition of the house-which was far worse than anyone could have imagined and some due to the process required for the change of use. Time is such an important factor in controlling our costs. We are currently incurring double costs since we must maintain our offices in addition to the costs of the Whitaker House. We hope that you will support this project by expediting our application so that we will be able to complete the project soon. We will do whatever is necessary on our part to move the project to completion. Thank you for your consideration.
