BOND RESOLUTION OF THE' TOWN OF SOUTHOLD, NEW YORK;
ADOPTED DECEMBER 0, 1964, AUTHORIZING THE ACQUISITION OF
CERTAIN LAND AT NEW SUFFOLK, IN SAID TOWN, AS THE SITE
OF ATTOWN BEACH ARD RECREATION AREA STATING THE
ESTIMATED MAXIMUM COST THEREOF IS $441000 APPROPRIATING
"SAID AMOUNT THEREFOR AND AUTHORIZING- THE ISSUANCE OF
' $44,000 SERIAL BONDS OF .SAID TOWN TO FINANCE SAID
APPROPRIATION.
RESOLVED BY THE TOWN BOARD OF THE TOWN OF--SOUTHOLD IN' THE COUNTY OF
SUFFOLK, NEW YORK, (by the favorable .vote of not less than two-thirds
of all the members of said Board) AS FOLLOWS: '
Section 1. The Town of Southold, in the County of 'Suffolk,
New York, hereby authorizes the acquisition by purchase of the- certain
piece o3f-parcel of land bounded on the north* by Jackson Street, on,
the east by First Street, on the west by Second- Street and on the south
by' Bay; New Suffolk;- , in the said Town of Southold, as the site -of 'a
Town--beach and recreation area, said piece- or parcel of land- being
more particularly- described by metes and bounds, as follows:
BEGINNING- at an iron pipe at-'the intersection of-
the southerly line of Jackson--Street with- the
westerly line of First Street; from said point
of beginning running along -said- westerly-line of
First Street, S.0004120" W.==274 feet, more - or
less, to ordinary high water mark- of Peconic Bay; - -
thence westerly along said high water mark 203 feet;
more or less; to the easterly line of Second Street,
thence along said easterly line of Second Street
due NORTH 284 feet; more or less,- to an 'iron pipe '
on said southerly line of Jackson Street; ,thence- - '
along said southerly line, N: 89°27' 10" E.-202:57
feet to the point of beginning.
The estimated: maximum�cost of said specific object or purpose, includ-
ing preliminary costs of-maps,' §&veys and estimated and costs incid=
ental thereto and the financing thereof, is-$44,000 and the sai& amount
is bereby' appropriated therefor. The plan of financing includes the
issuance of $44, 000-serial bonds of the Town to finance- said appropri-
ation and the levy and collection of a tax--upon- all' the taxable real
property in the Town to pay the principal of and the interest on said
bonds.
Section 2. Pursuant to the provisions- of 'the- Local Finance
Law, constituting Chapter 33-a of the- Consolidated Laws' of the State
of New York, serial bonds of the Town of Southold', in the principal-
amount of $44,000 are hereby authorized"to be -issued to finance said-
appropriation.
Section 3. The following additional matters -are hereby
determined and stated: (a) The period 9f probable .usefulness 'of .the
specific object or purpose for which the bonds authorized by this
resolution are- to be issued, within the limitation of S. -11.00 a'.
21 of- said Local 'Finance Law, - is thirty (30) years, b-gt the maturity
of the bonds herein authorized will not exceed five - (5) years.
(b) - Pursuant to the -provisions of S. 107.00 d. 4 of -said-. -
Local Finance Law, current funds are not required to be= provided as� a
down payment prior to the issuance- of the bonds herein authorized or ,
of any notes issued in anticipation of- the= sale of- such-bonds.
Section 4. Each of the serial bonds authorized by this
resolution and any bond anticipation notes. .issued in anticipation of .said
bonds, shall contain the recital of validity prescribed by. .S. 52..'00 of,. ,
said Local Finance Law. and ' said serial bonds and any notes..issue d .in
anticipaiion' of said .bonds''shall be general obligations of, the' Town of
Southold, payable as. to both .principal- and interest by a_ general tax -
upon all the taxable property within the Town 'without -limitation of -rate
or amount. The faith and credit. .of the Town are hereby irrevocably pledged
to the puncual payment of the principal of and the interest on-said bonds
and provisione.shall be made annually in the budget of the Town 1by approp-
riation for (a) the amortization and redemption of the bond_ s ,to mature
in each year and (b) the payment of interest to be due and payable in '
each year.
Section 5. Subject to- the provisions of this resolution
and pursuant to S. �0.00 relative 'to the authorization of the issuance
of bond anticipation notes and of S. 50,.,00 and S.S. 56.00 .to 60.00 of
said Local Finance Law, the powers; .and duties of the Town Board relative
to authorizing bond anticipation notes and" prescribing the."terms, form
and contents and as to the sale and issuance of the serial bonds author-
ized by this resolution and of any notes authorized to be issued in anti-
cipation. of said bonds, are hereby delegated to the Supervisor, the chief
fd�icer of the Town...
Section 6. The -validity of the bonds authorized.`by this
resolution, and- of any notes issued in anticipation ,of said bonds, may
be 'contested only if:
(a) such obligations are authorized for an object or purpose. .for'. ,4hich
the town is not authorized to expend money, or
(b) the provisions of law which should be . complied with at the date of
the publication of such. resolution are not substantially co-MP
lied 'with , ,
and an action, suit or proceeding, contesting such validity is,.commenced
within twenty days after.'the date of such publication, or
(c) such obligations are authorized. in violation of the provisions of
the constitution.
Section 7. This resolution shall take effect immediately,,:

RESOLVED: Section 1. The Town Clerk of the Town of Southold, in the County
of Suffolk, New York, is, hereby directed to, publish the foregoing bond
resolution in full, in the "LONG ISLAND TRAVELER. MATTITUCK WATCHMAN", a
newspaper published in Southold, New York, - having a general circulation
in said Town and hereby designated 'as the official newspaper of said Town
for such publication, together 'with the Town Clerk' s statutory notice in
substantially the ,form prescribed by Section 81.00 of the Local -Finance
Law of the State of New York,

WHEREAS, the County of Suffolk owns and operates a dredge and other
equipment suitable for .dredging channels and depositing fill on,
designated areas, and ` .
WHEREAS,- the. Town of Southold has requested that the said dredge be''
used in connection with the dredging of Deep. Hole Creek, Tdwn of
Southold, as shown on the accompanying maps and specifications, and'
WHEREAS, the Supervisor of the Town of- Southold by resolution duly,
adopted by the Town Board of" said Town of Southold has 'been author-
ized and directed to. sign for and on behalf. of the Town of Southold
assurances to the County of Suffolk, that the said Town of Southold
will perform all acts required to- be performed by said' Town in '
connection with the preparation- for the dredging operation .as .afore
said and obtaining of all. necessary easements and rights'-of way 'for-
said dredging operation and use of areas indicated on the attached''
map for spoil areas together with all .,necessary 'right6 incidental
to. said dredging operation;
NOW, THEREFORE, in'consider ation. of the benefits to''the Town of South-
old, as aforesaid, the Town .of Southold hereby- assures the County
of Suffolk that it will (a) -Furnish, free of cost tothe County. of
Suffolk, all lands, easements, ' rights of way and spoil disposal
areas necessary for the new.work and subsequent maintenance when and
if required for the dredging operations at Deep'Hole Creek, all as
shown on the attached map, and' (b) Hold and save the County of
Suffolk free from any claims or damages resulting from said improve=
ment or resulting in any way from. the said dredging operation or the
use of equipment at the said Deep Hole Creek, or . use of any spoil
area or any other area affected by said'diedging operatioi '.

WHEREAS, the Fishers Island Ferry District presently is under contract
with Alfred Bicknell for the operation of the motor vessel, Mystic
Isle, which said contract terminates on December, 31, 1964, and
WHEREAS, the Fishers Island Ferry District desires to advertise for
bids and enter into a contract with a successful bidder for the oper-
ation of said vessel for a term of three (3) years, commencing on
January 1, 1965, .and
WHEREAS, the Fishers Island Ferry District has prepared a proposed
form of contract for the operation of said vessel for the period .
from January 1, 1965 to December 31, 1967, and has submitted the same
to this Board, and

WHEREAS, this Board has examined said. form. of contract and. app roves
of all .of the .terms and conditions. contained ,therein,
NOW, THEREFORE, BE IT. RESOLVED: That the. Board of CommissiQner•s .of
the Fishers Island Ferry District be and ,they hereby are authorized . ,
and: directed to advertise-•for sealed bids. for the operation-of:-the
motor vessel, Mystic Isle, for a term of three (3) years,, commencing
