HomeMy WebLinkAboutTB-10/27/1964 MEETING OF OCTOBER 27 , 1964. The Southold Town Board met at the office of Supervisor Lester M. a Albertson at Greenport, N.Y. on Tuesday, October 27 , 1964. The meet- ing was called to order at 3 :00 P.M. with the following ,present: , Supervisor Albertson; Councilmen.-Demarest and Valentine; Justices Tut':- hill and Clark; Town Attorney Tasker and Town Clerk Richmond. Moved by Justice elark; seconded by Councilman Demarest; RESOLVED: That the minutes 'of October 13, 1964 be and they hereby are duly approved. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Valentine; Justices Tuthill ,and Clark. Moved by Councilman Demarest; seconded by Justice Clark; RESOLVED: That the next regular monthly meeting of this Board will be held at the office of Supervisor tester M. Albertson, 16 South ,St. , Greenport, N.Y. on Tuesday, Nov. 5 , 1964, at 3 :00 P.M. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Valentine; Justices Tuthill and Clark. At 3 :00 P.M. in accordance with a notice published- according to law, bids were opened for proposals to furnish to the Town of Southold reefers . Only two bids were submitted which follow: Levin ' s Men ' s Shop----------$71. 5.0 each Abe Brown------------------- 69.45 each Moved by Justice Clark; seconded by Councilman Demarest; WHEREAS, the Police Committee reported that the lowest bid on the Police Reefers was submitted by Abe Brown of Greenport, N.Y. RESOLVED: That Lester M. Albertson be and he hereby is directed to en- ter into a contract with Abe Brown 'for the purchase of 12 Reefers in accordance with bids submitted. , Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Valentine; Justices Tuthill and Clark: , Moved by Councilman Demarest; seconded by Justice Clark; WHEREAS, Fishers Island Ferry District proposed leasing,a portion Qf the Airport Property to the Fishers Island Rod and Gun Club for a Skeet and Trap Ranged permission is hereby requested that the Town Board authorize``. this District to conduct a public hearing on the matter as prescribed by the terms of a quit claim deed conveying the airport- property and by the enabling act of this District, NOW, THEREFORE, BE IT RESOLVED: That the Southold Town Board approves the action of the Commissioners of the Fishers Island Ferry District. Vote of Town Board: Ayes-Supervisor A-lbertson; Councilmen Demarest and Valentine; Justices Tuthill and Clark. Moved by Councilman Demarest; seconded by Councilman Valentine; WHEREAS, the Commissioners of the Fishers island Ferry District wish to enter into a bareboat charter for the use of the M/V Yankee-; NOW, THEREFORE, BE IT RESOLVED: That the Southold Town Board approves the action of the Commissioners of the Fishers Island Ferry District with the Interstate Navigation Company on the contract. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Valentine; Justices Tuthill and Clark. Supervisor tester M. Albertson appointed Herbert Boughton of Mattituck, N.Y. for the position on the Fire Advisory of Suffolk County represent- ing the Town of Southold for the year 1965 , which he presently holds. Moved by Justice Clark; seconded by Councilman Demarest; WHEREAS, Islands End Golf and Country Club, " Inc. by petition verified the 25th day of May, 1964 petitioned the Town Board. for a change of zone of certain property described in said petition from "A" Resident- ial and Agricultural 'District to "B" Business, and WHEREAS, the said petition was referred to the Planning Board for its official report with the Town Board, and WHEREAS, the Town Board pursuant to due notice thereof, held a Hearing on said petition on the 28th day of July, 1964, at which time all inter- ested persons were ,given an opportunity toobe heard, NOW, THEREFORE, BE IT ,RESOLVED: That ,the relief demanded in said petition of the Island, End Golf and Country Club, Inc. be and the same is in all respects denied. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Valentine; Justices Tuthill and Clark. Moved .by Justice Tuthill; .seconded by Councilman Demarest; WHEREAS, Vina Baker and .George VanBueen by petition verified on the. 13th day of July, 1964, petitioned the Town Board for a change of zone of certain real property described in said petition from "A" Residential and Agricultural District to "B" Business District, and WHEREAS, the said petition was referred to the Planning Bard for its official recommendation and report, and , WHEREAS, the Town Board pursuant to due notice thereof, held a hearing on said petition on August 27 , 1964, at which time all .interested persons were given an opportunity to be heard, NOW, THEREFORE, BE IT RESOLVED: That the relief demanded in said petit- ion of Vina Baker and George VanBuren be and the same is in all respects denied. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Valentine; Justices Tuthill and Clark. Moved by Councilman Valentine; seconded by J,Istice Clark; WHEREAS., Paul S. and Lois Wilson by petition verified the 24th ,day of August, 1964, petitioned the Town Board for a change of zone of certain real property described in said petition from ."A" Residential ,and, Agric- ultural District to "B" Business--District, and WHEREAS, the said petition was referred to the Planning Board for its official recommendation and report, and WHEREAS, the Town Board pursuant to due notice thereof .held a hearing thereon on the 20th day of October, 1964, at which time all interested persons were given an opportunity to be heard, NOW, THEREFORE, BE IT RESOLVED: That the Southold 'Town B-iildinq Zone Ordinance including the Building Zone Map be amended from. "A" Resident- ial and AgricAltural District to "B" Business District- on the follow- ing described property.: ALL that certain tract or parcel of land situated at Greenport, in the Town of Southold, Suffolk County, New York, and more particularly bound- ed and described as. follows : BEGINNING at the intersection of the southerly line of Manhanset Avenue with the westerly line of Beach Road; from said point of beginning run- ning along said westerly line of Beach Road, two courses, as follows : (1) S 4 006 ' 00 " E. 481.84 feet; thence (2) southeasterly on a curve to the left having a radius of 436. 0 feet a distance of 100. 98 .feet to the land of the Town of Southold; thence along said land of the Town of Southold S. 330 10 ' 00" W. 202 .53 feet to ordinary- high water mark of Sterling. Bas.in; thence southwesterly 80 feet, more or less to the northeasterly boundary of the Incorpor- ated Village of Greenport where it intersects the ordinary high water mark of. Sterling Basin; thence along said boundary N. 540 33 '. 00" 290 feet more or less, to said high water mark; thence northwesterly along said highwater mark 300 feet more or less to land of Saint Agnes Cem- etery N. 130 37 ' `30" E. 652. 20 feet to said southerly line of Manhanset Avenue thence along said southerly line S . 67 48 ' 50" E. 479. 60 feet_ to the point of beginning. Containing 9 acres, more or less.. BE IT FURTHER RESOLVED: That the Town Clerk be and he hereby is auth- orized and directed to cause notice of said amendment to. be posted and published pursuant to. law. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Valentine; Justices Tuthill and Clark. t Moved by Councilman Valentine; seconded by Justice Clark,' WHEREAS, it is 're'quired by Section 148 of the Education -Law that a local, Historian shall be appointed by the Supervisor of .the Town,. and WHEREAS, the Supervisor has appointed Mrs. Mary iman to,-,sae-t. as Town Historian, NOW, THEREFORE, BE IT RESOLVED: That Mrs. Mary Chapman be compensated while acting in such opacity in the amount of six hundred dollars per year payable in regular monthly payments as of November 1, 1964, and BE IT RESOLVED: That the 'Town Clerk be instructed to file such certif- icate with the proper parties as is required by Section 30 , Subdiv- ision 3 of the Town Law. , Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Valentine; Justices Tuthill and Clark. Albertson. be and he hereby is authorized to request the New York Conservation Commission to appoint William Januick, Bay- Constable, Town -of Southold., N.Y, to enforce the New York State Conservation Laws. Moved by Justice .Clark;: seconded by Justice Tuthill; RESOLVED: That Supervisor Lester M. Albertson be and he hereby is authorized to enter into a contract with Florence Kramer for the rental of a room for the Town Historian up to January 1, 1965. at $75.00 per month. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest : and Valentine; Justices Tuthill and Clark. Moved by Justice Tuthill; seconded by Councilman Demarest; RESOLVED: That the Town Board accept $12 ;000 cash in escrow from Estate of Fleet, Cutchogue, . N.Y. as the security for the completion of roads in East Woods Estates, asubdivision-,in Fleets Neck, Cutchogue, New York. Vote of Town Board: Aye `s-Supervisor Albertson; Councilmen Demarest and Valentine; - Justices Tuthill and Clark. The following recommendations were made to the Town Board by the Planning Board:-' (1) RESOLVED: . That the Southold Town Planning Board recommend to the Town Board that Lawrence Tuthill, professional engineer, be paid for his services on the following basis: .-Making estimates for bonds for roads, he shall receive $25.00 for the first 10 acres in a subdivision, and $1. 00 for each additional acre over 10 acres. (2) RESOLVED: That the Southold Town Board recommends to the Planning Board that the Planning Board amend its Rules and Regulations relative to the filing of Plats to change the filing fee as follows : Fifty Dollars for the first 10 acres in the subdivis(Don, and five dollars for each additional acre over 10 acres. :: Moved by Justice Tuthill; seconded by Councilman Valentine..; WHEREAS,. Martin Filla applied to the Town Board for a single trailer renewal permit dated October 1964, NOW, THEREFORE, ,BE IT RESOLVED: That the application of Martin F11-la to locate a single trailer on his property on Oregon Rd. , Mattittick, N.Y, be and hereby is granted for occupancy for a six -month period - from October 27 , 1964. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Valentine; Justices Tuthill and Clark. Moved by Councilman Demarest; ' seconded by _Justice Clark; RESOLVED: That Bond. No. 73S-1905BC, issued by the Aetna Casualty, and Surety, Company in ,the .name of James J. Fitzpatrick in the sum of $4, 000 . be and the same is hereby approved as to its form, manner of execution and sufficiency of sureties therein. Albertson, at Greenport, New York, with the follow- ing present: Supervisor Albertson; Councilmen Demarest. and Valentine; Justices Tuthill. and Clark; Town Attorney Tasker Supt. of Highways 'Price and Town Clerk Richmond. The Hearing on the Preliminary Budget for 1965 was opened by the Supervisor at 3:00 P.M. and the minutes were taken by Barbara Carrozza. Moved' by Councilman' Valentine; seconded by Justice Clark; RESOLVED: That the minutes of the meeting of October 27, 1964 be and 'they' are hereby duly approved.
