MEETING OF MAY 19, 1964
The Southold Town Board met at the office of the Supervisor, Lester
M. .Albertson, on Tuesday,: May.:.J% 1964, at ,Greenport, -New York:.-`The
meeting was called to order at 3:00 P.M. with the following present:
Supervisor Albertson; Councilmen Demarest.-and Valentine; Justices
Tuthill and Clark; - Town .Attorney Tasker- and Town Clerk Richmond..
Moved by Councilman Demarest; seconded ,by..Justice Clark;
RESOLVED: That. the' minutes of. May 5, . 1964 ,be and they hereby :are
duly approved.

Moved by Justice Tuthill; seconded -by Councilman Valentine;
RESOLVED: That the Town Clerk be and he hereby is directed to request
the Long Island Lighting Company to install five (5) 400 W-MV lights
with long brackets and remove two (2) 100 cp lights-along new road
in Mattituck as per enclosed survey of April 28, 1964, all in the
Mattituck Light District.
Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest
and Valentine; Justices Tuthill and Clark.
Moved by Councilman Valentine; seconded by Justice Tuthill;
WHEREAS, Cutchogue Fire Department requests permission to use the
parking lot which is under lease to the Town of Southold and situated
across the street from the Cutchogue Fire Department, on August 22, 1964,
RESOLVED: That the Cutchogue Fire Department be .granted the use of
said parking lot on August 22, 1964. .
Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest
and Valentine; Justices Tuthill and Clark.

WHEREAS, Goose Bay Estates Civic Association applied to the Town Board
for financial Assistance in dredging the entrance of Goose Creek, a
Town waterway in the Town of Southold,
NOW, THEREFORE, BE IT RESOLVED; That Supervisor Lester M. Albertson
be and he hereby is authorized'to contribute Town Funds in an amount
equal to one half of the total cost up to but not to exceed the sum
of $475.00 toward the cost of dredging the entrance of (Moose Creek,
Southold, L.I. , N.Y.

and Valentine; Justices Tuthill and Clark.
Moved by Councilman Valentine; seconded by Justice Tuthill:
RESOLVED: That the Supervisor, Lester M. Albertson, be and he hereby
is authorized to enter into a program advertising the Town of Southold
in the Long Island Conference Review, the sum not to exceed $500.00.

and Valentine; Justices Tuthill and Clark.
Moved by Justice Clark; seconded by Councilman Demarest;
WHEREAS, the Commissioners of the Fishers Island Ferry District wish
to enter into a bareboat charter for the use of the M/V Yankee or
the M/V Block Island fora period commencing at 7:00 A.M. on May 18,
1964 and -shall end at 7:00 A.M. on May 23, 1964 at a lump sum payment
of $500.00 to cover the first two days charter and if the charterer
shall elct to continue the charter thereafter it shall pay the owner
at the rate of $200.00 per day for each additional day or part there-
of for the M/V Yankee, and a lump sum minimum pyyment of $600.00 to
cover the first two (2) days charter and if the charterer shall elect
to continue the charter thereafter it shall :::pay the owner at the rate
of $250.00 per day for each additional day or part thereof for the M/V
Block Island.
NOW, THEREFORE, BE IT RESOLVED:. That the Southold Town Board approves
the action, of the Commissioners of the Fishers Island Ferry District
with the Interstate Navigation Company on ' the above contract.

WHEREAS, the Board desires to amend the provisions of the Building Zone
Ordinance of the Town of Southold as hereinafter set forth,
NOW, THEREFORE, BE IT RESOLVED: . That the Town Clerk of the Town of
Southold be and he hereby is authorized and directed to transmit to the
Planning Board of .the Town of Southold a certified copy of this resolution
together with a request in writing to said Planning Board instructing
said Planning Board to prepare an official report with its recommendations
on said proposed amendments pursuant to the provisions of Article IX,
Section 900 of the Building Zone Ordinance of the Town of Southold, said
proposed amendments being as follows:-to wit-
By amending Article III, Section 300 of said Ordinance by.
adding- a new subdivision 4A, to read as follows;
4A Stables and riding academies, when authorized
as a .special exception by the Board of Appeals
as herein after provided.
II. By amending Article III, Section 300, subdivision 5 of
said Ordinance to read as follows:
5. Clubs, fraternity houses and golf courses, when
authorized as a special exception by the Board
of Appeals as hereinafter provided.
III. By amending Article IV, Section 400, subdivision' 5 of said
Ordinance. to read as follows:
5. Offices, banks and fifnancial institutions.
IV By amending Article IV, Section 400, subdivision 1. 0 of said
Ordinance to read as follows;
10. Storage,houses, express ,carting or hauling offices
or stations, ice manufacturing, yards for. storage
and sale of coal and building materials.
V.'- By amending Article X of said Ordinance by adding thereto a
new section to be Section 1000B, to read as follows:
Section 1000B - No dwelling shall hereafter be erected
or altered .in any district unless provision shall be
made therein for not less than eight hundred and fifty
(850) square feet of space within the exterior' of the
foundation walls at ground level, exclusive of a garage,
carport, carpark,. open porch or terraces,. or Sher ex-
tensions outside the body of the house. Provided, how-
e"V ever, that fifty (50%) percent of the habitable area
of the second story may be. used and applied to the area
requirement of the first floor.
Notwithstanding any thing hereinabove to the contrary
the area of the second floor shall be included in com-
puting the area of the total habitable area when the finished floor of
the second story has a clear headroom 'of not less than
seven and one half (7h) feet .with knee walls of not
less than five (5) feet and when .the second floor is
serviced by' a permanently placed stairway.
The provisions of this section shall not apply to dwell-
ings located within a tourist camp as defined in the
Southold 'Town Ordinance providing for the regulation
of tourist camps,' house trailer camps, trailers. or
similar, establishments when a permit for such. tourist
camp has been issued by the Town Board pursuant to
the provisions of said ordinance.

WHEREAS, the Greenport Fire Department, Greenport, L.I. , applied 'd . .
the Town Clerk for a Bingo License, and
WHEREAS, the Town' Board has- examined the- application -and after-:invest=
igation, duly-lade findings and determinations as required'by 3'aw, :..,
NOW, THEREFORE, BE IT RESOLVED: 'That the -Supervisor be and he hereby
is authorized and directed to execute on-behalf of the -Board the`
findings and determinations required by law and it is further
RESOLVED: That the Towne Clerk be and he'% hereby is directed to issue
a Bingo' License to the Greenport Fire Department, Greenport, N:Y.

WHEREAS, Southold Town Planning Board prepared an `official: report `
and recommendation upon the petition of Matthew J. Mullen,- Cutchogue
N'.Y. fora change of zone- from "A" Residential and Agricultural Dist-
rict to "B" Business District' on certain property in Cutchogue, - N.Y. ,
NOW, THEREFORE, BE IT RESOLVED:- That -appublic'hearing will`�be held
by the Southold Town Board at 'the Supervisor's Office, 16 South St. ,
Greenport, N.Y. on June 5,- 1964, at 7-:30' P'.M. on the above mentioned'
petition and that the Town Clerk be and he hereby is authorized and
directed to cause' a, notice' of said hearing to be published in the
Long Island Traveler=Mattituck Watchman pursuant to the requirements
of law.

WHEREAS, Southold Town Planning Board prepared an official report and
recommendation upon the petition of Michael Wieczorek for• a'.- change
of zone from "A" Residential and Agricultural District to -"B""'Busine-ss
District 'on -certain property in New Suffolk;°N.Y.-
NOW, THEREFORE, BE IT' RESOLVED: That a -public hearing wilL 'be held
by the Southold Town Board at the Supervisor's Office, 16 south
Greenport; N.Y, on June 5,1964, at 7:30 P.M. on the above mentioned
petition and thatthe, Town Clerk be and -he -hereby is authorized and
directed'-to-'-cause a notice of said Hearing, to be published in the
Long Island''Travler-Mattituck'-Watchman pursuant � 'the 'requirements of
law.

RESOLVED:- That Robert Tasker, Town Attorney-,- Town of Southold, be
-and he. hereby' is authorized to attend conference to be held in Albany,
N.Y on June 3, 4 and 5, 1964, :and be 'it ' further
RESOLVED: That the necessary expenses--incurred while attending said
conference be a legal -charge. against' the Town of�2Southold.

RESOLVED: That Supervisor nester M.. Albertson' be and he bereby is
appointed to represent the Town Board at the opening of Bids for the
Boat -and Radio for Bay Constables- = May 21, -1964 at 10:00 A.M.

Moved by Councilman Demarest; seconded- by Councilman Valentine;
WHEREAS, Henry R. Jacobi, Sr. has applied to the Town Board for a
single trailer permit..dated April 9, 1964,
NOW, THEREFORE, BE IT RESOLVED:That the application of Henry Jacobi, Sr.
to locate a single trailer on property under contract, Southold, N.Y.
be and the same is hereby denied.

WHEREAS, Joseph H. Mann has applied to the Town Board for a single

NOW, THEREFORE, BE IT RESOLVED: That the application of Joseph Mann
to locate-' a single trailer on his property, Lot 175, Peconic Bay Estates,
Greenport, N.Y. be and the same is hereby denied.

WHEEREAS, Joan VanCura has applied to the Town Board for a single trailer
permit dated May 11, 1964,
NOW, THEREFORE, BE IT RESOLVED: That the application of Joan VanCura
to locate a single trailer on property of Estate of Joseph LaColla,
Joan VanCura Admin. , Southold, N.Y. hereby is granted for a three (3)
month period beginning May 19, 1964.

RESOLVED: That the Town Clerk be and he hereby_- is directed to r°equest
the Long Island Lighting Company to install three (3) 100 W lights in
Gardiners Bay Estates, East Marion, N.Y. as follows: -
One (1) on Cedar Lane, Pole #19 NYT with 8' bracket
One on Bay View Drive, Pole # 7 LIL (near A.W.Johnson) , and
One at intersection of Old Orchard Lane and Bay View Drive.

RESOLVED: That the Town Clerk be and he hereby is directed to request
the Greenport Light Department to remove present street light and
install one (1) MV street light on Pole #1, corner of Moores Lane and
Route 25.

RESOLVED: That the Town Clerk be and he hereby is directed to request
the Long Island Lighting Company to transfer the charge on the MV street
light on Pole #42 LIL, corner of Route 27 and Sound Road, Greenper t,
N.Y. presently being paid by Walter Sledjeski (Porky) to the Town of
Southold.

RESOLVED: That the Town Clerk be and he hereby is directed to request
the Long Island Lighting Company to install one (1) 400 MV light on
Pole #25 LIL corner of Youngs Avenue and Route 27, - Southold, N.Y.

and Valentine; Justice Clark.
Supervisor Lester M. Albertson was directed to .negotiate for. more.
property adjacent to Town Property on Middle Road, Cutchggue:, 'M.Y...
He was also authorized to proceed with acquisition of beach property
between First and Second Street, New Suffolk, N.Y.
Supervisor Albertson is making all necessary arrangements_�:for, the
coming season by having the beaches cleaned; the floats reconditioned
•and arranging for Life Guards for the beaches.
A petition was received from property owners adjacent to- jockey
Creek for additional dredging.
A petition was received from property owners in Corey -Creek area
requesting a bridge be replaced over the present colvert.
