MEETING OF MAY 5, 1964.
The week of. May 9, 1964- being. Youth Week, six students.,..Richard Reeve
and Gini Strub from Mattituck,,. Donna .Deroski from Cutchogue, Jack
Larsen. from Pe.conic., --Dave Corwin. and Tom Costello from Greenport,
and Chief Petty Officer Viscovi representing the Elk Lodge from
Riverhead were present at the Town Board meeting. The students acted
as. officers in the various_ departments. of the Town. . Their..purpose.
was to acquire knowledge of how the Town Government is conducted.
Supervisor Albertson had them conduct part of the meeting, eachc
one representing a member of the Town Board. The students thanked
the Town Board-:for their day of experience in office and said they
had learned a great deal about the government of the Town. .
The Southold Town Board met at the office of the Supervisor., Lester
M. Albertson, at Greenport,_ New York, , on Tuesday, May 5, 1964, The
meeting was called to order at 3: 00 P.M. with the following present:
Supervisor Albertson; Councilmen Demarest 'and. Valentine;- Justices .
Tuthill and Clark; Supt. of Highways Price; Town Attorney Tasker
and Town Clerk Richmond.
Moved by ,Councilman Valentine; seconded by, Justice Clark;
RESOLVED: That the minutes of April 21, 1964, be and the same are
hereby duly approved.

RESOLVED:; That the._next regular meeting of .the- Town Board ,will be ..

At 3::00 P.M. in accordance with a..notice published according -to law,
bids were opened for the operation of the concession stand and other
facilities at the Southold Town Beach, located on Long Island Sound
at Arshamomoque, in the Town .of Southold. The following.,,bids were .
submitted: Mollie. Trainer-----$100.00; Russell Tuthill--:7-.$625.00..

RESOLVED: That the bids received for the concession stand be placed
in the hands of the Beach Committee for its recommendation,

NOW. THEREFORE, BE IT RESOLVED: That a public hearing will be held by
the.. Southold _Town Board at the Supervisor' s Office, 16 South Street,
Greenpor.t, N.Y. .on May/9, 1964, at 7:30 P.M.` ,on the above mentioned
--petition,= and .that the Town Clerk be and he hereby is authorized and
directed to cause a notice of said hearing to be published in the L.I.

WHEREAS, the Board of Commissioners -of Fishers. Is]a nd Ferry District
at a meeting held April 30, 1964 adopted a resolution increasing„the.
salary of Ernest John Bowles, purser of MV Mystice Isle from $4600000
per annum to $4800.00 per annum, and
WHEREAS, pursuant to the special act of the Legislature creating . said
District such action of the Board of Ferry District commissioner is
subject to the approval of the Town Board of the Town of Southold, and
WHEREAS, a copy of said resolution has. been .submitted to th Board for
the purpose of approving the .action of the Ferry District Commissioners,
RESOLVED: That the Town Board of the Town of Southold hereby -approves
the action of Fishers Island Ferry District in increasing ,.the annual
salary of Ernest. John Bowles, Purser, from $4600.00 to $4800.00 per
annum beginning May 1, 1964.

Highway Law- the -Town Supt. of. Highways is hereby authorized to purchase
in accordance with the provisions of Article 5-a of the General Munic-
ipal Law, with the approval. of the County- Supt. of Highway;. the•,.follow-
ing: One New 1964 Oldsmobile Dynamic 88 Sedan, or EQUAL

1964, petitioned the Town Board .for a. change of zone- of certain property
described in said petition..from "A" Residential and Agricultural .District
to "B" Business District, and
WHEREAS .,.theEsaid petition was referred-.to the Planning Board for its
official recommendation and report,. and- , ,
WHEREAS, the Town Board pursuant .to due noticethereof held a hearing
thereon on the 1st day- of May, 1964 at which time all interested :
persons were given an opportunity to be heard,
NOW, THEREFORE, BE IT RESOLVED: That the Southold Town. Building -Zone
Ordinance including the Building Zone Maps, be amended from "A" Resid-
ential.-and Agricultural' District to "B" Business District on .the follow-
ing described property:
ALL that certain tract or parcel of land situated at Peconic, N.Y. ,
Town of Southold, Suffolk County, and more particularly bounded and
described as follows:
Commencing at a point on the northerly side of Main Road formed by
the intersection of the easterly line of the premises herein described,

running thence in a general northerly direction along the easterly line
of lands of. Vail Bros. 180 feet to a point; running thence in a gener-
al easterly direction along land s of -Adam Cierach and wife and on a
line parallel to the northerly line of Main Road- 170 feet to a point;

WHEREAS, the Town Board, pursuant to due notice thereof, held a hearing
on May 1, 1964 at which time all interested persons were given an
opportunity to be heard, '
NOW, THEREFORE, BE IT RESOLVED: That the Building Zone Ordinance of
the Town .of Southold, Suffolk County, New York, be amended as follows,
to wit:-
By amending the Southold Town. Building Zone Ordinance as follows:
Amending. Article. III, Section 300, by adding thereto a new part to be
paragraph 1-a to read as follows:
1-a' - The conversion of any building in existance
at the effective date hereof to two family
dwelling when authorized as a special exception
by the Board of Appeals- as hereinafter provided.
BE IT FURTHER RESOLVED: That the Town Clerk be and he hereby is author-
ized :and directed to cause a notice of said amendment to be posted
and published pursuantto ]law.

Southold be and he hereby is directed to transmit .this application to
the Planning Board, in accordance with Section 901, .Subdivision C of
Article IX-. of the 'Building Zone Ordinance of the Town- of Southold.

- WHEREAS, after study by the Beach- Committee of the bids, it .was their
recommendation that the high bid of Russell L. Tuthill of $525.00 per
annum be accepted by the Town of Southold,

NOW; THEREFORE, BE IT RESOLVED: That the .Supervisor be directed --.to. enter
into a contract .with. Russell L. Tuthill -for: the operation of: the Town
Beach Refreshment Stand and facilities for_ a .period of Five :(!5) : years,
all in accordance with the terms. set. forth in the specifications..-
per-taining the advertisement for bids_.

. WHEREAS, the- Town of Southold desires that the existing ;Federal-channel
at Mattituck Harbor, in t he Town of Southold, Suffolk County,.,.,New ::York,
be deepened, extended and a mooring area provided, and .
WtikiZFAS, the United States Corps of Engineers has prepared, a report
on said project, pursuant to Section 107 of the 1960 River, and.--Harbpr
Act which would provide for a 400 by 600 foot anchorage area to a
depth of 7 feet at, mean low water near the head of the hbrbor and.-.also
fora channel of the same depth connecting .the anchorage with-,.the; . -
existing 7•, foot deep ,channel in .the lower- portion o_ f the .harbor:,_,.,and
WHEREAS, the said United States Corps of Engineers will proc.eed,,.with
such improvements subject to the :condition, that local, interes .-ts coop-
erate in the project by (a) contributing. in cash 500/6 of the. total.
first cost of. dredging; (b) provide -without cost to the United• States.
all lands, easements and rights- of- way. required for construction and
subsequent maintenance of the project as well,• as. aids to navigation
upon the request of the Chief of -Engineers, including suitable spoil
disposal areas and necessary retuning dikes or bulkheads; (c) hold
and save the United States free from damages that may result from
construction and. maintenance of said project; (d). provide and maintain
without cost to the United States the ,necessary mooring facilities .and
utilities including public landings with .suitable supply facilities:
and public parking areas .open to all .on..:equal terms; and. (e) establish
a competent and properly constituted public body .empowered to regulate
the use, growth. and development of the bArbor- facilities with the
understanding. that said facilities will--be open to all persons on
.- equal terms, ,and
WHEREAS, the Board of Supervisors .of :the County of Suffolk.:her.etofore
adopted a resolution authorizing the County of .Suffolk to. pay 5011/ of
the cost of the necessary dredging .and. all necessary diking of•:.spoil
areas not to exceed the sum of $25,000.00, .and.
WHEREAS, the Town Board of the Town of Southold deems it in the public
interest t.bat ,such project be. :completed and this Board .desires .to
cooperate in said project by agreeing to. comply with the. aforesaid
conditions,
NOW, THEREFORE,,-. BE IT RESOLVED: That ih consideration of the._foregoing
the Town Board of the Town of Southold hereby agrees by:-and with -the.'
United ,States Corps of. Engineers` that: the Town of Southold will comply
with .the .following requirements:. s-
(a) Provide without cost to the United States, all•:.lands
easements and rights of way required for the construction and subse=
quent maintenance of the aforesaid .project •and also of aids. to •navig=
ation upon the request of the.:Chief of Engineers, including suitable'
spoil disposal areas and necessary retaining dikes or bulkheads there
for, or the cost of such retaining .works. =
(b) The Town. of Southold hereby agrees to pay 50% of the cost
of the--necessary-dredging and the necessary diking of spoil areas
less-' the sum -of _$25,000.00' which the County of Suffolk has '-her etofore
agreed to pay
(c) Hold and save the United States free from damages that-- may
result from- construction and- maintenance of the aforesaid project*-:
(d) Provide and maintain without cost to the United States,
necessary mooring facilities .:and utilities,- including public landings.
with' suitable supply facilities and public parking areas open, to all
persons on equal terms. =
(e) Establish and/or provide a competent and properly constit-
uted public'.body.empowered to regulate the use, growth and development

of .-the aforesaid harbor facilities..which will be open to all persons
on equal terms.
BE IT FURTHER RESOLVED: That the Supervisor of the Town of .-Southold
be and. he •hereby- is authorized and directed to execute on behalf o f
the Town of Southold all agreements and other documents necessary
to effect the aforesaid purposes, and
BE IT FURTHER RESOLVED: That the ,resolution of .this Board adopted
on March 7, 1963, relative to the matter of the dredging of-
Mattituck Inlet is-,hereby rescinded.

Mrs. VanCura -was present and spoke on .behalf of Ronald F. Oliver
-for a trailer permit which was denied.. The Board suggested that
Mr. Oliver apply again for the trailer for.:three (3) . months.
