We, the undersigned members of the Town Board of the Town of Southold, do hereby request the Supervisor to- call. a special meeting cEthe Southold Town Board to be held at the Supervisor's Office, 16 South Street, Green- port, New,-York, on Tuesday, April 14, 1964, at 3:00 P.M. Tuthill A Special meeting of the Southold Town Board was held at the Supervisor ' s Office, 16 South Street, Greenport, - New York, The meeting was called to order by` the' Supervisor at 3:00 P.M. with the following present: Supervisor Albertson; Councilman Demarest and Justices Tuthill and Clark; Town Attor- ney Tasker; Supt. of Highways Price •and Town. Clerk Richmond. The- regular meeting of this Town Board to be held April 7, 1964 at 3: 00 P.M. at the Supervisor' s Office was cancelled due to the fact that a quorum 'of the Board was not present. Councilman Valentine was out of town, Councilman Demarest was ill and Justice Edwards was unable to come by plane from Fishers Island due to fog. Moved by Justice Clark; seconded by Councilman Demarest; RESOLVED: That the minutes of April 3, 1964 be and they hereby are duly approved. Vote of Town Board: Ayes-Supervisor Albertson; Councilman Demarest; Justices Tuthill and Clark. Moved by Justice Clark; seconded by Councilman Demarest; RESOLVED: - That the next meeting of the Town Board will be held at the office of the Supervisor, Lester M. Moved by Justice Tuthill; seconded by Councilman Demarest; RE That the Town Board agrees to the following 'permit: PERMIT KNOW ALL MEN BY THESE PRESENTS, that whereas BERNHARDT' S SHORES, INC. , a domeStic corporation of the.- State of New York, having an office . and- place of business at Duck Pond Road, Cutchogue, Town of Southold, Suffolk County, New York, has duly applied in writing f6r permission to lay and maintaina welll"point and water pipe under the Town highway in ,front of 'its permises to be "1'6cated as hereinafter more particularly described and-.whereas the To' ' Board of the Town of- Southold has dulyyconsented to the granting of said. application, NOW, THEREFORE, :phis indenture witnesseth, that HAROLD -PRICE, the duly elected and acting Town Superintendent of Highway of the Town of Southold, Suffolk County, New York, does give and grant unto .the said Bernhardt'$ Shores, Inc. of Duck Pond Road, Cutchogue., N.Y. ,in the Town- of Southold, and its successors and assigns, the permission and right to .maintain a well point' and water pipe not exceeding two (2) inched '-in diameter under a certain� Town Highway known as Duck Pond Road, said well point to be lo- cated under said Duck Pond Road near the westerly side thereof at a point approximately• 23 feet southerly of New York Telephone utility pole #5 and said water-pipe to extend northerly under the said Duck PoncJ Road for a distance of approximately 59 feet to the premise of the said Bernhardt' s Shores, Inc. adjacent to said Highway all in accordance with the drawing attached hereto. The permission and right hereby granted is only upon the 308 conditions hereinafter set forth and the said Bernhardt.' s Shores.,, Inc. , by its .acceptance of this permit does . for itself, and its, successors .and assigns,. covenant and agree. that such .conditions shall be performed and that this permit may be revoked, and• the well point and pipe maintained ..in such highway removed by the Town Superintendent of Highways without notice upon the failure of performance of any such conditions, the condit- ions being the following, to wit:- 1. The well point and water pipe hereinbefore specified shall be laid under the ground at a depth of .not less than two and .one half, (.221). feet. The same shall be laid in a manner satisfactory to the • Town . Superintendent of Highways under his supervision. 2. The well point and ,water pipe permitted to be laid -hereunder shall be so laid as not to interfere or interrupt public travel upon the said highway, and the applicant shall replace all earth removed and .resur- face the pavement and leave the said highway in all respects .in as good condition as before the laying of said well point and water pipe, and the applicant shall keep the said well point and water pipe .in repair..and maintain the traveled portion of the highway and the highway premises free from any defects which might otherwise be occasioned by the install- ation of such well point and water pipe. 3 . The said Bernhardt' s Shores, Inc.., its successors and assigns, shall forever save the Town of Southold harmless from all damages which may accrue by reason of the installation of said well point and water pipe in said highway as aforesaid.. 4.. The said Bernhardt' s Shores, Inc., its successors and assigns, upon-notice .by the Town Superintendent of Highways of .the Town of Southold, shall forthwith make any repairs- required for the protection .or preservat- ion of .such highway and rendered necessary by reason of the installation" of said well point and water pipe as aforesaid.^ 5 . In case the said Bernhardt's Shores, Inc. or it' s successors or assigns, shall fail to make such repairs.• to .the town l ghway -as, are. - required. to be made by the conditions of this, permit, the necessary repairs may be .mad e-without notice by the Town Superintendent of Highway .of the Town of Southold, at the expense of the said Bernhardt' s Shores, . Inc. , its successors or assigns, and the cost thereof shall be a lien_ prior. ,to. any lien upon the land benefited by the use of the highway for the laying of the pipe herein profided for . 6. If .in the judgment of the Town. Superintendent of .Highways, it shall be necessary to remove,,- relocate or/and replace said well. point and water pipe by reason of the. _repair, relocation or change' in grade or otherwise of said highway, it is specifically understood and .agreed that the said Bernhardt' s Shores, Inc. or its successors and assigns at its own expense shall. remove said well point and .water pipe and appurtenances and shall eeplace. the same in conformity with the directions of the- said Town Superintendent of Highways. Moved. by councilman Demarest; seconded. by Justice Clark; WHEREAS, this Board deems it in the public interest that a Department .of Public Works be establishedn n the Town of Southold, and WHEREAS; Section 64, subdivision 21-a of the Town Law.authorizes the estab- ishment of a Department of Public Works and provides that the Town Super- _indendent of Highways shall be the administrative head thereof, NOW, THEREFORE, BE IT RESOLVED: That there is hereby established a Depart- ment of Public Works in the Town of Southold, and it is further RESOLVED: That the Town Superintendent of Highways shall be the administrat- ive- head of such department, and it is further RESOLVED, that said Department of Public Works shall..have the duty of per- forming such functions concerning Town property, public works and such other matters as the Town Board may from time to time direct. Moved. by Justice Clark; seconded by Justice Tuthill: WHEREAS, . the Surplus 'Fund on the Annual Budget for the current year is $70, 111.06, and WHEREAS, of such sum $70, 111.06 remains unexpended to date, NOW, THEREFORE, BE IT RESOLVED: That $5000.00 of said unexpended balance be and the same .is transferred to Public Works Airport and that the amount heretofore appropriated for said purpose be . and .the same hereby is increased in the amount mentioned. Moved by Justice Tuthill; seconded by Justice Clark; WHEREAS; the Town of Southold has or -is about to enter into an agreement, for the -lease and operation of an airstrip and/or airfield at Mattituck, in .the Town of Southold, for a term of ten (10) years, and WHEREAS, it is deemed' in the public interest that said airstrip be regrad- ed, altered, repaired and:cresurfaced in order that the same may be in a safe condition for the use of the public on a year round basis, NOW, THEREFORE, BE IT RESOLVED: That the Department of Public Works of the Town "of Southold be and it hereby is directed to perform such work as may be required- for the regrading, alteration,, construction, repair' and improve- ment 'of the airstrip and/or landing field leased by the Town of Southold at Mattituck, New York, provided, however, that in no event shall such work 'ekceed the appropriation made therefor in -the .curr"ent budget of the Town of Southold. , Vote of 'Town Board: Ayes Supervisor Albertson; Councilman Demarest; Justices Tuthill and Clark: Moved by, :Justice Clark; seconded by Justice .Tuthill: RESOLVED: That the Town Board approves the abandonment of the following described highway:' DESCRIPTION OF HGGHWAY ABANDONED PURSUANT TO #205 OF THE* HIGHWAY" LAW I, the undersigned Town Superintendent of Highways of the Town of Southold, County- of Suffolk, State of New York, hereby certify' the follow- ing described portion of a certain highway known as the Main Road and first laid out as a town highway in 1833, to' wit:- BEGINNING at the intersection of the westerly line of Moore' s Lane with the northerly line of the ' old highway' , -said point of beginning being the southeasterly corner `of land formerly of W. H. H. Moore Estate and now of the Village of Greanport; from said point -of beginning, running southerly on the direct extension southerly of said westerly ,line of Moore' s Lane, 11 feet, 'more or less; to the northerly line of the'Main Road as altered; 310 thence %westerly, along said northerly line, 513 'feet, more or less, to a point where said line intersects the northerly line of said 'old highway' said point being also the southwesterly corner of land of Mae T. ' Adams, and others; thence in a northeasterly direction, along the northerly line of the "old highway", about 260 feet to the northeasterly corner of said Adams land; thence 'in a more easterly direction, and still along the, north- erly line of the "old highway" and along said land formerly of the .Moore Estate, now of the Village of Greenport, 270 feet, more or less, to the point- of beginning, has not been opened or worked for more than six years last past, and that the same has been abandoned by the public, and is no longer used as 'a public highway. NOW, THEREFORE, BE IT RESOLVED: That Supervisor Lester M. Albertson be and he hereby is authorized to contribute half of the total cost up to but not to exceed the sum of $475.00 toward the cost of dredging the entrance of Wickham's Creek at Fleets Neck, Cutehogue, N.Y. Dean, President of the Southold Town Trustees, and WHEREAS, in his service. .to the people of the Town of.' Southold as' Trustee since his election in Nobember, 1937, Mr. Dean has distinguished himself as a dedicated and 'conscientious public servant, NOW, THEREFORE, BE IT RESOLVED: That the Town Board of the 'Tow.n off Southold hereby gives formal expression o.f its.- loss in the death "of. Town Trustee Emmons C. Dean, a man esteemed by .his associates and.respect- ed by all, and BE IT FURTHER. RESOLVED that when the Town, Board adjourns this day, , it do so out of .respect to the memory of Town Trustee, Emmons C. Dean, and BE IT FURTHER RESOLVED that a copy of this resolution be spread upon - the_ minutes of this meeting and a copy be transmitted to' the family. of Town Trustee Emmons C. YOZK, AT A MAXIMUM ESTIM_ ATED COST OF $.3400..00 AND AUTHORIZING THE ..ISSUANCE OF A $3400.00.-;CAPITAL NOTE TO PAY THE COST THEREOF. . BE IT. RESOLVED: By the Town Board of the Town of .Southold, .Suffolk County, New York, as fol_ lows-: Section 1. The ,purchase' of an office machine .consisting. of an ,electric Graphotype machine,. .together with 'cabinet .to be used'. in connection with the. assessment rolls for the -Town of ,Southold,. ,Suffolk. County, New York is hereby authorized at a maximum cost of $34.00.00. . . Section 2. .The plan for the financing of such maximum estimated cost is by the .issuance of a $3400.00- capital note hereby authorized. to be issued pursuant to the provisions of the Local Finance Law.. . , Section 3 It is hereby determined that the period of probable usefulness of such specific object or purpose is five years pursuant to sub-division 52 of paragraph a of Section,.11.00 of -the .Local Finance Law, and that the proposed maturity of the note herein authorized will not exceed .five years. Albertson be and he hereby is auth- orized to enter into a' lease with Elizabeth Dlsen for a tract of land including a bathing beach and parking field adjacent to Peconic Bay at New Suffolk, Town of Southold, Suffolk. Constable of the Town of Southold at the pleasure of the Town Board, and RESOLVED: That the compensation for such appointment be $5200.00 per year .
