Albertson, at Greenport, ,New York, on Tuesday, March 24, 1964 at 3:00 P.M.- with the following present: Supervisor Albertson; . Supt. of Highways Price; Town Clerk Richmond; Councilmen- Demarest and Valentinep Justices Tuthill and Clark and Town Attorney Tasker. Moved by Justice Tuthill;. seconded by Councilman Demarest; RESOLVED: That the minutes of March 10, 1964, . be and they are..here- by duly approved. Planning Board prepared an .official-.report and recommendation upon the petitions of James V. and Frances J. Calfa and Vail Bros. Inc. for a change of zone from- "A" Residential and Agricultural District to "B" Business District on certain property in Greenport and Peconic, N.Y. respectively., also to amend the provisions of the Building Zone Ordinance by amending-Article III Section 300 by adding thereto a new part to -be Paragraph 1 A to read as- follows: : 3-A - The conversion of any Building in existance at the effective date hereof to two family dwelling when authorized as a Special Exception by the Board of .Appeals .as hereinafter prov- ided, .. Councilman Demarest; - WHEREAS, the County.of Suffolk proposes to dredge certain areas:.of - RICHMOND .CREEK in the Town of Southold which dredging will be performed by County :,owned dredging equipment at: a -nominal cost to the. Town of Southold, and WHEREAS, in order to accomplish said dredging, plans,_ specifications, agreements and other documents must be executed on behalf of the Town of Southold, now THEREFORE, BE. IT. RESOLVED: That, the . Supervisor be and he hereby: is.-auth- orized to execute, on behalf of the Town of. Southold, all necessary plans and specifications, spoil area agreements, assurances to the County of Suffolk, license ,dnd/or. dredging permit implications to Federal and . State. Agencies and -all other documents that may be required•.to accomp- lish said dredging work. Vote of Town Board: Ayes-Supervisor. WHEREAS, the Town. of Southold has requested that the said dredge be, used in connection with--the dredging of RICHMOND. CREEK, Town of Southold,. as _shown on the accompanying maps and specifications, and . WHEREAS, the Supervisor of the Town of Southold by resolution ,.duly adopt- ed by the Town Board -of said-Town-of Southold has been- authorized and 6 directed. to sign for and--on, behalf of . the• Town iof Southold. assurances to the County of Suffolk, that..the said Town of Southold will -perform .all acts required to be performed by said Town -in connection with the prep- aration for the dredging operation as aforesaid and obtaining of all necessary easements and rights of way:.for, said-dredging ,operation and use. of areas. indicated on the 'attached map for spoil, areas together. with .all necessary rights- incidental .to said dredging . operation; NOW, THEREFORE, in.'.consideration of the benefits to the. Moved by Councilman Valentine; seconded by Councilman Demarest; WHEREAS, Irving Miller, Public Accountant, retained by the Town, . . has audited the accounts of all the departments under ' Section 105 of .the Town Law, and has found them to be _correct, NOW, THEREFORE, BE IT RESOLVED: That these reports be placed in the minutes of the Town Board. Moved by Councilman Demarest; .seconded by Councilman Valentine; WHEREAS, the Town Board bn its own motion .proposed a .change of the Building Zone Ordinance of the Town of Southold, Suffolk County, N.Y. and I _ WHEREAS, the petition was referred to the Planning Board for .its official recommendation and report, and WHEREAS, the Town Board pursuant to due notice thereof held a hearing on March 24, 1964 at which .time alliinterested persons were given an opportunity to be heard,, NOW, THEREFORE, BE IT RESOLVEDy That the Building Zone Ordinance of the Town of Southold, Suffolk ounty, New York be amended as follows: to wit; 1. By amending Article III, Section 300, Subdivision 6 of said Ordin- ande by adding a new subdivision 6A to read as follows: 6A. Public utility buildings, structures, or facilities, when authorized as a_ special exception by the Board of Appeals as hereinafter provided. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Valentine; Justices Tuthill and Clark. Mr. Nelson of Mattituck, N.Y. appeared before the Board requesting - the Town do something about the water which runs across his property. He also protested against the Town leasing the Mattituck Air Base. . .Mr. Albert Martocchia appeared on behalf of the residents of 7th St. Greenport protesting the parking of cars by teachers and students on 7th st. all day when the school maintains area for thes purpose. Mr. Robert Trubenbach, Mr. Schwarting and--Mr. Stephen Campbell were. . ` present at the meeting. A letter was received from Mather Dairy thanking the police:-.for.,help and-assistance when their trucks were disabled on the, highway.•., Adjournment. Albert W.
