MEETING OF JANUARY 14, 1964.
The Southold Town Board met at the office of Supervisor Lester M.
Albertson at Greenport, New York, on Tuesday, January 14, 1964. The
meeting was called to order at 3: 00 P.M. with the following present:
Supervisor Albertson; Councilman Valentine;, Justices Tuthill and Clark
Town Attorney Tasker; Supt. of Highways. Price and Town Clerk Richmond.
Moved by Justice Clark; seconded by Councilman Valentine;
RESOLVED: That the minutes of the Annual Meeting of January_ 2, 1964,..be
and they are hereby approved.
Vote of Town Board: Ayes-Supervisor Albertson; Councilman Valentine;.
Justices Tuthill and Clark.
Moved by Justice Clark; seconded by Justice Tuthill:
RESOLVED: That the next monthly meeting of this Town Board will be held
at the office of Supervisor Lester M. Albertson, 16 South Street, Green-
port, N.Y. on TuesdaX, January 26, 1964 at 3: 00 P.M.

RESOLVED: That Bond No. 73S-688BC, issued by the Aetna Casualty and Surety
Company in the name of Raymond Doyen, Fishers Island, N.Y. Town of South,
old, as Commissioner-Secretary of Fishers Island Garbage & Refuse District
in the sum of $1000.00 be and the same is hereby approved as to its form,
manner of execution and sufficiency of sureties therein.

WHEREAS, the -Board of Commissioners of the Fishers Island Ferry District
has by contract retained the firm of Johnson and Williams, Public Account-
ants, of 774 Broad Street, Waterford, Conn. to perform auditory and
accounting service for said District effective as of January 1, 1964 to
December 31, 1964 at the annual fee of $1100.00 to be paid quarterly,
.NOW, THEREFORE, BE IT RESOLVED: That the Southold Town Board approves
said contract.

WHEREAS, Charles Christiansen, purser for the Fishr s Island Ferry District
is physically unable to serve at this time, and
WHEREAS, Fishers Island Ferry District requests permission to hire William
A. McLeod as Relief Purser,
NOW, THEREFORE, BE IT RESOLVED: .That the Town Board approves the action
of Fishers Island Ferry District in hiring said William McLeod as Relief
Purser . Vote of Town Board: Ayes-Supervisor Albertson; Councilman Valentine;
Justices Tuthill and Clark.
Moved by Councilman Valentine; seconded by Justice Tuthill:
WHEREAS, John Tillinghast has served the children of Southold Town for
the past twenty years in his capacity at the American Legion Skating Rink,
and
WHEREAS, John Tillinghast has kept the rollerskates in so good a repair
as to have no major accidents to the youth of the community due to faulty
skates, and
WHEREAS, Mr . Tillinghast has done this for the past twenty years at a
very nominal fee and because of hi€ services the children of Southold Town
have had a good place to enjoy themselves,
BE IT RESOLVED: That this Southold Town Board, sitting in its regular
session, does hereby commend Mr. John Tillinghast for the splendid job
that he has done for the children of the Town of Southold.

Moved by Justice Clark; seconded by Councilman Valentine:
WHEREAS, the Town Board of the Town of Southold, by resolution, ..did on
April 25, 1955, appoint a Planning Board for -the Town of Southold, and
such resolution provided that said Board shall have all the powers
granted by the Town Law, and
WHEREAS, at the time of the adoption of the foregoing resolution it was
intended to give to such Board the authority to approve Plats, pursuant
to Section 276 of the Town Law, and said Planning Board has, since it' s
appointment, exercised its authority to. approve. Plats, and
WHHEAS, it now appears that there is a question of whether the afore-
mentioned resolution specifically granted authority to the Planning
Board to .approve Plats,
NOW, THEREFORE, BE IT RESOLVED: That the Planning .Board of the Town. of
Southold shall have the power to review and approve new subdivisions of
land in the Town of Southold. consistent with the requirements- of
Article 16 of the Town Law, and
BE IT FURTHER RESOLVED: That the Planning Board of the Town .of Southold
is hereby authorized and empowered to review and approve previously filed
Plats covering land in the Town of Southold which are wholly or partially
undeveloped as provided by Article 16 of the Town Law, and
BE IT FURTHER RESOLVED: That the Planning Board of the Town of Southold is
hereby authcr ized and empowered to confirm or modify the zoning regulations
of the land. shown on a subdivision Plat under its review (as more partic-
ularly specifidd in Section 281 Article 16 of the Town Law) provided
all such modification shall be limited by the following:
1. Conditions set forth in Section 281 of the Town Law.

Moved by Justice Tuthill; seconded by Councilman Valentine:
WHEREAS, the construction of- a jetty- at -the northerly terminus of Mill
Road at Peconic, in the Town of Southold,. will afford increasing use of the
area by the public, and will require greater facilities than presently
available, and
WHEREAS, -it appears in the public interest that the..Town. acquire by
purchase or by condemnation in the manner provided by law the premises
immediately adjacent to the northerly terminus of said Mill Road and on
the westerly side thereof, more .particularly known and designated as
"ALL that tract or parcel of land, situate, lying and being at Peconic,
in the Town of Southold, County of Suffolk, and State of New York.,
known and designated as Lots numbered One (1) and Two (2) on a..certain
map entitled "Map of Peconic Shores" , located. at Peconic, Long Island,
Property .of William B. Codling" , surveyed September 1922 by J. W. .Weels,
C.E. , and filed in the Suffolk County Clerk' s Office, on August 8, 1924,
under :File No. .117.
TOGETHER with. the beach, waters and lands under water in .front of and
abutting said premises. "
WHEREAS, said premises appear to be presently owned by ,Jalal Elahi, re-
siding at 71 East Williston Avenue, East Williston, New York,
NOW, THEREFORE, BE IT RESOLVED: That the Town of Southold acquire the
aforesaid real property for public use by pnrchlase or by condemnation
in the manner by law, and be it further
RESOLVED: That Supervisor Lester M. Albertson be and he hereby is
authorized and directed to. proceed with negotiations for the purchase of
said real property, and in the -event of his inability to agree with the
owner of said premises as to the fAir market value, .or if the- owner re-
fuses .to grant the Town the use thereof, then in such event the Supervisor
is hereby authorized and directed to proceed with the acquisition of
said premises for the Town of -Southold by condemnation in the manner pro-
vided by law, and be it further
RESOLVED: That the Supervisor be and he hereby is authorized to retAin
Rensselaer G. Terry, Jr. , Main Road,. Southold, N.Y. as Special Town Attor-
ney for the purpose--:of representing the Town in the matter of the acquis-
ition of said premises by condemnation.

WHEREAS, ..Article 14 of the General Municipal Law and Article 14 , of the
Town Law, authorize a Town Board. by resolution, subject to a permissive
referendum, to establish, .construct, equip., maintain, and operate for
such town an airport or landing field for the use of aeroplanes and
other aircraft and to lease real property for such purpose, and.
WHEREAS, the owners of the airport located. at Mattituck, in the Town of
Southold, have offered to lease the landing field at said airport to
the Town of Southold for the purpose of establishing an airport or
landing field- for the Town of Southold, ..and
WHEREAS, the Town Board .deems it: in..the public interest that. an. airport
or landing field be established in the Town of Southold,
NOW, THEREFORE, BE IT RESORT ED::by. the Town Bca rd of the Town of Southold
as follows:
Section 1. The Town Board does hereby determine to establish, construct,
equip, maintain and operate for the Town of Southold an airport or
landing field for the use. of aeroplanes and other aircraft.
Section 2. The site for such airport or landing field which is hereby
approved shall be at Mattituck, in the Town of Southold, generally
bounded and described as follows:
BEGINNING at a monument at the northwesterly corner of land of Donald
Hildeshein; said point. of beginning being about 150 feet westerly .
along said land of Hildeshein from Marratooka Road; from said point .
of beginning running along said land of Hildeshein and along land
of John Tandy, South 0 degrees 10' 30" West about 455 feet to a monument
at the southwesterly corner of said. land. of Tandy and the northwesterly
corner of land of Audioun; thence through land of J. Parker Wickham and
across the highway known as "Park Avenue" , South 0 degrees 10' 30"
West about 1835 feet to a monument on the southerly line of said "Park
Avenue" at the northwesterly corner of land of McKenna; thence still
through said land of J. Parker.. Wickham, South 0 degrees. 10' 30" West.
about 650 feet to ordinary high watermark of Great Peconic Bay; . thence
southwesterly along said high water mark about 157 feet to a point .
150 feet westerly from the last described point measured at .r.ig#t
angles thereto;Theace thorough said land of J. Parker Wickham ,eight
courses as follows:
(1) North 0 degrees 10' 3011 East, about 2860 feet; thence _
(2) North 61 degrees 45' West about 587 feet; thence
(3) partly along the easterly :edge of, the concrete slab .under the gas
pumps, North 4 degrees West about 175 feet to the southerly side of
an existing building, thence
(4) Along s&id.. southerly side of said building and the direct. extension
easterly thereof, North 85 degrees East about 185 feet .to a wire _fence,
thence
(5) partly along said fence, South 13 degrees East about 133 feet;.. thence
(6) Paralle& to and 150 feet northeasterly :from course (2) .hereinabove.
described measured at right angles to said course, South 61. degrees
45 ' East about 358 feet to a point in the direct extension northerly of
course (1) hereinabove described, thence .
(7) At right angles to course (6) hereinabove described, North 28 degrees
15 ' East about 50 feet; thence .
(8) South 61 degrees 45' East about 143 feet to the point of:beginning_
Section 3 . The Supervisor of the Town of Southold is hereby .authorized
and directed to lease for such purpose, the real property hereinabove
described, provided, however, that the terms and conditions of said .
lease whall be approved by this Board.
Section 4. This resolution shall take effect immediately .and shall .be
subject to a permissive referendum.

RESOLVED: That the Supt, of Highways of the .Town of Southold be author-
ized to purchase from Mutual Steel Company the following: 1500-10.00x20
Cross Chains.

RESOLVED: That the report of Howard M. Terry, Building Inspector,. for
the month of December be accepted by the Town Board and placed on file.

WHEREAS, the accounts of Howard M. Terry, Building Inspector, were
presented and the annual report of Howard M. Terry for the fiscal
year 1963 was filed,
NOW, THEREFORE, BE IT -RESOLVED: That such annual statement be entered
in detail in detail in the minutes of this meeting by the Town Clerk
as required by Section 105 of the Town Law.

WHEREAS, Samuel Glickman, Attorney for Robert H. Ohlmann, has applied
to the Town Board for a single trailer renewal permit dated Jan. 14, 1964,
NOW, THEREFORE, BE IT RESOLVED: That the application of Robert H.
Ohlmann to locate a single trailer ,on his own property, Bay Road, South-
old, N.Y. and herebyL,is granted until May 15, 1964.

WHEREAS, Burton Potter Post #185, Greenport, N.Y. applied to the Town
Clerk for a Bingo License Amendment, and
WHEREAS, the Town Board has examined the application and after invest-
igation duly made findings and determinations as required by law,
NOW, THEREFORE, BE IT RESOLVED: That the Supervisor be and he hereby is
authorized and directed to execute on behalf of the Town Board the find-
ings and determinations required by law and it is further
RESOLVED: That the Town Clerk be and he hereby is directed to issue an
amended Bingo License to the Burton Potter Post # 185 of Greenport, N.Y.

RESOLVED: That Howard M. Terry, Building Inspector, Town of Southold,
be and he hereby is authorized to attend Eastern State School for Build-
ing Inspectors at Hotel New Yorker on Feb. 20 and 21,. 1964, and be it
FHRTHER RESOLVED: That registration fees not exceeding $10.00 and all
actual and necessary expenses of travel, meals and lodging incurred
while attending said school be a legal charge agaiest the Town.

RESOLVED: That General Bills in the sum of $14, 162.06; Lighting District

sum of $8, 722.21 and Highway Bills in the sum of $3,476 .78 be and the
same are hereby ordered paid.

WHEREAS, the Town of Southold is commencing the preparation of a Master
Plan for the future development of the Town of Southold, which program is
to be paid in part by the Federal Government and the New York State,
Government, and
WHEREAS, in order to comply with the requirements of the New York State
Department of Commerce it is necessary for the Town' of Southold to. pro-
pose to the Department of Commerce a firm of planning consultants which
the Town of Southold would like to engage for the preparation of such study,
NOW, THEREFORE, BE IT RESOLVED: That the Town of Southold does hereby pr6-
pose to the New York State Department of Commerce the firm of Raymond and
May of White Plains, New York as the consulting firm to perform such services.

Rev. Burns of Southold and Miss Hall of the County Welfare Department
appeared before the Town Board stating the need for a program to assist
those in our Town who have not had the opportunity for a formal elementary
education. They are asking for volunteers to learn to teach this methold
and have tramned personnel ready to instruct volunteer teachers, The ,
Town Board is very:-much in favor of this program. .
