Albertson, at Greenport, N.Y. on Tuesday, September 10, 1963, at 3:00 P.M. with the following present: Supervisor Albertson; . Council- men Demarest and Grathwohl; Justices Tuthill and Clark; Supt. of High- ways Price; Town Attorney Tasker and Town Clerk Richmond. Moved by Justice .Clark; seconded by.Justice Tuthill: RESOLVED: That the minutes of August 20, 1963 and the Special meeting of September 4, 1963. be and they are hereby duly approved. Vote of Town Board: Ayes-supervisor Albertson; Councilmen Demarest and Grathwohl; Justices Tuthill and Clark. Moved by Councilman Demarest; seconded by Councilman Grathwohl; RESOLVED: That the next regular monthly meeting ,of this Town Board will be held at the office of the Supervisor,_ Lester M. Albertson, 16 South Street, Greenport, N.Y. on Tuesday, September 24, 1963, at 3: 00 P.M. Vote of Town oard: Ayes-Supervisor Albertson; Councilmen Demarest and Grathwohl; Justices Tuthill and Clark. Mr. George Raynor and a delegation from the Mattituck Inlet Civic Association. appeared before the Board'protesting against the dust, noise, fumes etc from the Asphalt Plant in their area. The .Supervisor informed them that this was a temporary plant and their permit would expire the end of this month. He was sorry that the plant was so annoying and would try not to have it happen again. He informed them he had notified the Health Department and that if there was a health problem the Health Department should close the plant. At 3:30 P.M. in accordance with the notice published according to, law, bids were opened for proposals' to furnish to the Town of Southold, police shirts, trousers, caps and coats. Cox, ' Dog Warden, for the month of August be accepted by the Town Board and 'placed on file. Moved by Councilman Demarest;- seconded' by Justice Tuthill: RESOLVED: That Leander Chute, John Sherwood, Howard Terry and A. John Gada are hereby recommended -for a.Epointment to serve as,Deputy County Fire Coordinates for the Town -of -Southold, New York. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Grathwohl; Justices Tuthill and Clark. Moved by Justice Clark; seconded by Councilman Grathwohl; WHEREAS, the contingent Fund in the Annual Budget for the current year is $10; 000, and WHEREAS, of such sum appropriated, $10;000 remains unexpended, to date, NOW, THEREFORE, BE IT RESOLVED; That $2, 000.00 of said unexpended- balance be and the same is transferred to Town Offices-other expenses, and $2;500.00 to Public Dump, $1,600.00 to Drainage Areas, $3, 775.00- to Capital' Improvement, $18.30 to Damage to Truck-Insurance payment, $40.71 to Fire Fighting, and thatthe amount heretofore appropriated for said purposes be and the same hereby is increased in the amounts mentioned. Moved by Councilman Grathwohl; , seconded by Councilman' Demarest; WHEREAS, Southold American Legion G.T.G. Post #803 of Southold, N.Y. applied to. the Town' Clerk fora Bingo License Amendment, and WHEREAS, the Town Board' has examined the application and after invest- igation, duly made findings and determinations as required by law, NOW, THEREFORE, BE IT RESOLVED: That the Supervisor be and he hereby is authorized and directed-to execute on behalf of the Board the'-find- ings and determinations required by law and it is, further RESOLVED: That the Town Clerk be and he hereby is directed to issue an Amended Bingo License to the Southold American Legion G.T.G. Moved by Justice Tuthill; seconded by Councilman Demarest; WHEREAS, Chester -L. Ciaglo has applied to the Town Board for single trailer renewal permit dated August 15, 1963, NOW, THEREFORE, BE IT RESOLVED:' That the- application of Chester L. Ciaglo to locate a single trailer on family property, Laurel, N.Y. be and hereby is granted for"-year round occupancy for a one year period. Vote of--Town Board: Ayes-Supervisor- Albertson; Councilmen Demarest and Grathwohl; Justices Tuthill and Clark. Moved by Councilman Demarest; seconded by Councilman^Grathwohl; - RESOLVED: That General Bills in the amount of $4, 747.93; Lighting.. District Bills in the amount $3, 241.16 _and Fishers Island Ferry 'Di6trict Bills in the amount of $37, 354.27°be and the same are hereby ordered paid. Moved by Councilman Grathwohl; seconded by .Justice Tuthill: WHEREAS, the Police Committee .-reported that the lowest--bid for the Police Uniforms .wds submitted `by' Abe Brown, RESOLVED: That Lester M. Albertson, Supervisor, be and he hereby is directed to enter into a contract with Abe Brown for the purchase of Police Uniforms in accordance with the bid submitted. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Grathwohl; Justices Tuthill and Clark. Recess was called at 5: 30 P.M. and reconvened at 8: 00 P.M. 235 Moved by Councilman Demarest; seconded by Justice Tuthill; WHEREAS, the Town Board of the Town of Southold, pursuant to due notice thereof, held a public hearing on an application of the Long Island Railroad Company for a franchise to operate an omnibus line on or over the streets, highways and public places of the Town of Southold, Suffolk County, New York, on September 10, 1963, at which time all interested persons were given an opportunity to be heard, NOW, THEREFORE, BE IT RESOLVED: That the Town Board of the Town of - Southold grant said franchise to the Long Island Railroad Company subject to the -following terms and conditions: A. That the route over which said omnibus shall operate shall be .New York State Route #k25 . B. That no passengers shall be discharged in the Town of Southold,' said omnibus is travelling in a westerly direction through said Town, and that no passengers shall be -picked up by said omnibus in the Town of . Southold while said omnibus is traveling in an easterly direction through the Town of Southold. D. That this Franchise is granted fora term of FIVE years from September 10, 1963 . E. That the said Long Island Railroad Company pay to the Town of Southold the sum of THIRTY ($30.00) Dollars per year, payable on September loth of each year as and for a fee for the granting of this franchise. :Vote" of Town Board Ayes-Supervisor Albertson; Councilmen Demarest and Grathwohl; Justices Tuthill and Clark. Moved by Councilman Demarest; seconded by Justice Tuthill: WHEREAS, Police Chief- (Constable) Theodore Howard requests this Board to grant a one day leave of absence with pay to Sgt. Joseph Sawicki, Patrol- man Boken and Patrolman Beebe for their fine work of capturing Evangelo - Sanches Ortiz, who had in his possession illegally a �^-38 cal. revolver, 25 cal. automatic, two pen type tear gas guns with, three cartridges,. and twenty-one .38 cal. cartridges found on the premises, NOW, THEREFORE, BE IT RESOLVED: That the request be granted. . Moved by Councilman Demarest; seconded by Justice Tuthill: RESOLVED: That Supervisor Lester M. Albertson be and he hereby is author- ized to advertise for bids for a Fall-out Command Storage Shelter, to be located in Peconic, N.Y. Moved by Jusjt ce Tuthill; seconded by Councilman Demarest; WHEREAS, Long Island Cablevision Corporation of Southold heretofore applied to the Town Board of the Town of Southold for a franchise, per- mission or consent to use the streets, highways and public places in the Town of- Southold for the purpose of transmitting and distributing television impulses by coaxial cable, and WHEREAS, the Town Board held a public hearing- on the 5th day of June, 1963, at the Supervisor' s Offic,q, 16 South Street, Greenport, N.Y. upon the matter of said application at which time all interested persons were given an opportunity' to be heard, and WHEREAS, after due deliberation this Board believes that .it would be in the best interest of the Town of Southold and the inhabitants thereof that a franchise be granted -to said corporation, NOW, THEREFORE, BE IT RESOLVED: That a franchise, permission or consent be and the same hereby -i-s granted to Long Island Cablevision of. Southold for the use of the streets, highways and public places in the Town of Southold or any part thereof or the space above or under them for the purpose of erecting, maintaining and operating cables, wires, and appurt- enances for the purpose of transmission and distribution by coaxial cable of television impulses and television energy both community antenna and closed circuit, FM music systems and background music systems upon the following terms and conditions, to wit: 26 (a) That Long Island Cablevi,sion Corporation of Southold obtain all required approvals from the necessary telephone and/or electric utility companies as well as all governmental agencies having jurisdiction over such proposed operation. (b) That the installation and operation of said television transmission and distribution system conform to the provisions of all ordinances of the Town of Southold. (c) That said corporation commence construction of said system within six (6) months from the date hereof and that said corporation cause . such system to be on an operation basis within two (2) years from the date hereof. (d) That the rents and fees to be charged by said corporation to subscribers of such system be subject to prior approval of the Southold Town Board, unless such rates and fees are within the jurisdiction of any other public regulatory board, - in which case the rates and fees fixed by such public regulatory board shall apply. The rates and fees presently approved by this Board are as follows: . (1) Private Dwellings. ----Installation Charge------$30.00 (2) Monthly Service Fee---------------------------- 5 .00 (e) That the franchise hereby granted shall be non-exclusive. (f)- That the franchise hereby granted shall. be for a term of ten (10) years from September 10; 1963 . ..(g) That. in the event that .additional poles are required for: the oper- ation of . sai d system, said corporation shall have the. pr.ivilege of erecting the same: at its own cost and expense provided, however, that the erection of the additional poles shall be located in. such places and in such manner as approved .by. the Southold Town Board. (h) That the installation and operation of such system shall not inter- fere with the reasonable use by the public of the streets,, highways and public places of :the Town of Southold or any space above or under the same. . (i) That the annual fee for the granting of this franchise shall be $25.00 payable in advance on the .lOth day..of September of ,each .and every year during the term hereof. (j) That :this franchise or any rights granted hereunder- shall not be transferred or assigned by Long Island Cablevision Corporation of ,South old without prior approval of .the, Town.. of outhold.
